Regulations on the functions, tasks, powers, and organizational structure of the Press Department

MINISTER OF INFORMATION AND COMMUNICATIONS

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

BASED ON THE GOVERNMENT DECREE NO. 187/2007/NĐ-CP OF DECEMBER 25, 2007 ON THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF INFORMATION AND COMMUNICATIONS;

At the proposal of the Director of the Cadre and Civil Servant Organization Department and the Director of the Press Department.

DECISION:

Article 1. Position and Functions

The Press Department is a subordinate agency under the Ministry of Information and Communications, performing the function of state management over press activities (including newspapers, magazines, bulletins, special issues, news agencies); directing and guiding the development of the newspaper industry nationwide in accordance with the Party's guidelines and State laws.

The Press Department has legal personality, possesses a seal and bank account for transactions in accordance with the law, and its main office is located in Hanoi City.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. To take the lead or participate in researching, proposing, and implementing the drafting, revision, and supplementation of draft regulatory legal documents within the authority to promulish of the National Assembly, the Standing Committee of the National Assembly, and the Government;

2. To submit to the Minister for approval or participate in developing strategies, plans, and programs for long-term, five-year, and annual development of the newspaper industry; national target programs, action programs, and projects in the field of the newspaper industry;

3. To submit to the Minister for issuance according to his/her authority regulatory legal documents concerning newspaper activities;

4. To organize the implementation, guide, and inspect the enforcement of regulatory legal documents, strategies, plans, and other documents within the scope of management of the Department after they have been approved; to publicize and educate the law on newspapers and disseminate information on state management of the newspaper industry;

5. To assist the Minister in guiding, directing, and organizing the implementation of the network planning of newspapers throughout the country, representative offices of domestic press agencies and news agencies in foreign countries that have been established;

6. To submit to the Minister for decision-making on issuing and revoking licenses for newspaper activities; bulletins of foreign news agencies in Vietnam; establishment of newspaper agencies, printing of newspapers, and representative offices and permanent correspondents of Vietnamese newspaper agencies in foreign countries; other types of licenses related to newspaper activities as prescribed by law;

7. To submit to the Minister for decision-making on suspending publication, temporarily suspending publication, confiscating, destroying printed materials, and other forms of content storage, images, and sounds related to newspaper activities;

8. To take the lead and coordinate in inspecting, checking, handling violations, resolving complaints and denunciations, and preventing corruption and negative practices in newspaper activities; to prevent and stop violations of the law in the newspaper industry;

9. To submit to the Minister for approval agreements on appointing, dismissing heads and deputy heads of newspaper agencies, and equivalent positions;

10. To submit to the Minister for decision-making on issuing and revoking press cards for individuals working in newspaper agencies and the Vietnam News Agency;

11. To submit to the Minister for approval research plans, application of scientific and technological progress, economic and technical norms, procedures, and regulations in the field of the newspaper industry;

12. To participate in implementing training and professional development plans, organizing examinations for promotion of civil servants, reporters, editors, and other positions in the newspaper industry; to participate in establishing professional standards for newspaper positions to be issued by the Ministry;

13. To organize the review and submit to the Minister for approval investment and development programs at the national level in the newspaper industry and manage them according to the division of labor by the Minister;

14. To submit to the Minister for approval the forms of journalism exams and organize their implementation according to the division of labor by the Minister;

15. To coordinate in organizing press conferences; to provide information to newspaper agencies and manage information from the newspaper industry in accordance with the Law on Press and the delegation of the Minister;

16. To organize the inspection of stored newspapers and manage the national newspaper storage facility;

17. To issue, amend, supplement, and revoke licenses for special issues, supplements, and bulletins; publishing bulletins of Vietnamese organizations and legal entities; publishing bulletins, documents, leaflets, and press releases of foreign organizations and legal entities with foreign elements; other types of licenses related to newspaper activities according to the delegation of the Minister;

18. To issue, amend, supplement, and revoke licenses for advertising supplements in newspapers; to guide the implementation of advertising in newspapers;

19. To take the lead and coordinate in inspecting, checking, and handling violations of organizations, entities, and individuals engaged in advertising in newspapers;

20. To implement tasks assigned by the Minister regarding directing and organizing the implementation of copyright laws for newspaper products;

21. To issue export and import licenses for newspaper products in accordance with the law;

22. To collect, manage, and use fees and charges from activities within the scope of management of the Department in accordance with the law;

23. To agree to allow press conferences; to publish speeches in Vietnamese newspapers by foreign organizations and individuals in Vietnam;

24. To organize the implementation and inspect the enforcement of financial support policies, orders, subsidies, and price supports for newspapers;

25. To implement international cooperation in the field of the newspaper industry;

26. To coordinate in providing information about the operation of the newspaper industry to report to the Minister and relevant agencies of the Party and State;

27. To propose rewards and disciplinary actions against units and individuals involved in newspaper activities in accordance with the law;

28. To manage the organizational structure, staffing; to implement policies and systems for civil servants, officials, employees, and workers under the Department's jurisdiction;

29. To manage finances, assets, and other resources allocated; to organize their implementation in accordance with the law;

30. To perform other tasks assigned by the Minister.

Article 3. Organizational Structure:

1. Leadership of the Bureau:

The Press Bureau has a Director and Deputy Directors.

The Director of the Press Bureau is responsible to the Minister and to the law for organizing and implementing the functions, tasks, and authorities assigned. 期限被分配。

Deputy Directors assist the Director in directing and managing all aspects of the Bureau's work and are responsible to the Director for the tasks assigned to them.

The Full View Event - Public Opinion Magazine has its own seal and separate account for transactions as prescribed by law.

The functions, tasks, and authorities of the departments and the Representative Office in Ho Chi Minh City are defined by the Director; the working relationships among units under the Bureau are also defined by the Director.

The staffing of officials, civil servants, and employees of the Bureau is established by the Director and submitted to the Minister for decision.

Article 4. Effective date

This Decision takes effect fifteen (15) days from the date of publication in the Official Gazette. Decree No. 44/2004/QĐ-BVHTT dated June 28, 2004 of the Minister of Culture, Sports and Tourism on the functions, tasks, authorities, and organizational structure of the Press Bureau is hereby abolished.

Article 5. Responsibilities for Implementation

The Chief of the General Office, Heads of the Cadre and Civil Servant Organization Department, Director of the Press Bureau, and Heads of agencies and units under the Ministry are responsible for implementing this Decision./.
