Regulations on the functions, tasks, powers, and organizational structure of the Fine Arts, Photography, and Exhibition Department

At the proposal of the Director of the Cinema Department.

Pursuant to Decree No. 178/2007/ND-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 185/2007/ND-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

Considering the proposal of the Director of the Fine Arts, Photography, and Exhibition Department and the Head of the Cadre and Civil Servant Organization Department,

DECISION:

Article 1. Position and Functions

The Fine Arts, Photography, and Exhibition Department is an agency under the Ministry of Culture, Sports and Tourism with the function of advising the Minister to implement state management over fine arts, photography, and exhibitions; it is entrusted by the Minister with the responsibility to direct and guide the development of the fine arts, photography, and exhibition sector nationwide in accordance with the Party's guidelines and state laws.

The Fine Arts, Photography, and Exhibition Department has its own seal and bank account at the State Treasury.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Draft regulations, strategies, planning for the development of fine arts, photography, and exhibitions for submission to the Minister.

2. Propose the Minister to issue operational regulations for fine arts, photography, exhibitions, installation art, video-art performances, and international sculpture creation camps in Vietnam.

3. Implement, guide, and inspect the enforcement of regulatory documents, strategies, plans, and programs on fine arts, photography, and exhibitions after approval; promote and disseminate laws and information on state management activities related to fine arts, photography, and exhibitions.

4. Implement, guide, and inspect the enforcement of national monument and grand painting planning after approval by the Prime Minister.

5. Review applications and propose the Minister to grant permission for the artistic components of national monuments and grand paintings.

6. Grant permission for fine arts and photography exhibitions within the scope of the Ministry of Culture, Sports and Tourism’s jurisdiction; guide and inspect the granting of permissions by provincial Departments of Culture, Sports and Tourism in the fields of fine arts and photography.

7. Revoke or propose revocation of exhibition permits for fine arts and photography, construction permits for national monuments and grand paintings, and other exhibition permits when they are not implemented according to the approved content, causing negative social impacts, and violating the law.

8. Directly organize national and international exhibitions of fine arts and photography works as assigned by the Minister.

9. Coordinate in building international cooperation plans in fine arts, photography, and exhibitions; implement after approval.

10. Develop research plans and apply science and technology in the field of fine arts, photography, and exhibitions; take the lead and coordinate with relevant agencies to submit economic and technical standards, procedures, and norms in the field of fine arts, photography, and exhibitions to the Minister.

11. Coordinate in establishing mechanisms for public service organizations, fees, and charges in the field of fine arts, photography, and exhibitions for approval by competent authorities and implementation according to regulations.

12. Serve as the permanent member of the specialized review board for art; organize the budget review for fine arts projects as prescribed.

13. Assist the Minister in state management over the content of activities of professional associations and non-governmental organizations in the fields of fine arts, photography, and exhibitions as provided by law.

14. Collect works to supplement the collections of fine arts and photography of the Ministry of Culture, Sports and Tourism.

15. Recommend rewards for units and individuals involved in fine arts, photography, and exhibition activities according to legal provisions.

16. Propose the Minister to issue and implement preventive measures against violations of laws concerning fine arts, photography, and exhibitions; inspect and cooperate with inspections on the implementation of laws in these fields; recommend handling of violations; resolve complaints and denunciations according to legal provisions.

17. Implement administrative reforms according to the program and plan of the Ministry.

18. Manage the organizational structure, staffing, and implement policies and systems for civil servants, officials, employees, and workers under the Department's jurisdiction; manage and utilize financial resources, assets, and other resources allocated according to legal provisions.

19. Perform other tasks assigned by the Minister.

Article 3. Organizational Structure

1. The Director and Deputy Directors.

2. Specialized and professional departments:

a) Office;

b) Accounting and Finance Department;

c) Fine Arts Department;

d) Photography Department;

đ) Exhibition Department.

3. Affiliated organizations:

a) Fine Arts, Photography, and Exhibition Magazine;

b) Fine Arts and Photography Exhibition Center.

The Director of the Fine Arts, Photography, and Exhibition Department is responsible for specifying the specific functions and tasks of each department and affiliated organization, arranging personnel according to the job titles and professional standards; developing and issuing the Organizational Regulation and Operation Rules of the Department.

Article 4. Effectiveness

This Decision takes effect fifteen days from the date of publication in the Official Gazette, replacing Decision No. 38/2004/QĐ-BVHTT dated June 28, 2004 of the Minister of Culture and Information stipulating the functions, tasks, powers, and organizational structure of the Fine Arts and Photography Department.

Article 5. Responsibility for Implementation

The Director of the Fine Arts, Photography, and Exhibition Department, the Chief of the Office, the Heads of the Cadre and Civil Servant Organization Department and the Planning and Finance Department, the Heads of the agencies and units under the Ministry, and related organizations and individuals are responsible for implementing this Decision./.
