Decree No. 35/2010/NĐ-CP on the levels of preferential allowances for persons who have rendered meritorious service to the revolution

DECREE

REGULATING THE AMOUNTS OF SUBSIDIES AND ALLOWANCES FOR PERSONS WITH MERIT TO THE REVOLUTION

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

BASED ON THE ORDINANCE ON PRIVILEGES FOR PERSONS WITH MERIT IN THE REVOLUTION dated June 29, 2005, AND THE ORDINANCE AMENDING AND COMPLEMENTING CERTAIN PROVISIONS OF THE ORDINANCE ON PRIVILEGES FOR PERSONS WITH MERIT IN THE REVOLUTION dated June 21, 2007;

CONSIDERING THE PROPOSAL OF THE MINISTER OF LABOR, INVALIDS, AND SOCIAL AFFAIRS;

DECREE:

Article 1. Standards for determining the levels of preferential allowances and subsidies for persons with merit in the revolution and the levels of allowances and subsidies

1. The standard for determining the levels of preferential allowances and subsidies for persons with merit in the revolution as stipulated in this Decree is 770,000 VND.

2. This Decree promulgates accompanying tables of preferential allowances and subsidies for each category of persons with merit in the revolution, including:

a) Table No. 1: Levels of preferential allowances and subsidies for persons with merit in the revolution;

b) Table No. 2: Levels of disability allowances for war invalids and persons benefiting from policies similar to those for war invalids;

c) Table No. 3: Levels of disability allowances for war invalids type B.

Article 2. Implementation Funding

THE STATE BUDGET WILL ENSURE FUNDS FOR IMPLEMENTING THE SUBSIDY AND ALLOWANCE SYSTEM AS PROVIDED IN THIS DECREE.

Article 3. Effectiveness

1. This Decree takes effect from May 20, 2010.

2. This Decree replaces Decree No. 38/2009/NĐ-CP dated April 23, 2009 of the Government on the levels of preferential allowances and subsidies for persons with merit in the revolution.

3. The preferential allowances and subsidies prescribed in this Decree shall be implemented from May 1, 2010.

Article 4. Responsibilities for Implementation

1. The Minister of Labor, Invalids, and Social Affairs is responsible for guiding the implementation of this Decree.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the central government shall be responsible for enforcing this Decree./.
