CIRCULAR

Amending and supplementing certain contents regarding administrative procedures in Circular No. 19/2005/TT-BTM dated November 8, 2005 guiding certain provisions stipulated in Government Decree No. 110/2005/NĐ-CP dated August 24, 2005 on the management of multi-level marketing activities.

Pursuant to Resolution No. 59/NQ-CP dated December 17, 2010 of the Government on simplifying administrative procedures within the scope of functions of the Ministry of Industry and Trade;

Pursuant to Circular No. 19/2005/TT-BTM dated November 8, 2005 guiding certain provisions stipulated in Government Decree No. 110/2005/NĐ-CP dated August 24, 2005 of the Government on the management of multi-level marketing activities;

Pursuant to the Competition Law dated December 3, 2004;

Pursuant to Decree No. 189/2007/ND-CP dated December 27, 2007, issued by the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

At the proposal of the Director of the Competition Administration Department, the Minister of Industry and Trade amends and supplements certain contents regarding administrative procedures in Circular No. 19/2005/TT-BTM dated November 8, 2005 guiding certain provisions stipulated in Government Decree No. 110/2005/NĐ-CP dated August 24, 2005 of the Government on the management of multi-level marketing activities as follows:

Amending and supplementing certain contents regarding administrative procedures in Circular No. 19/2005/TT-BTM dated November 8, 2005 guiding certain provisions stipulated in Government Decree No. 110/2005/NĐ-CP dated August 24, 2005 of the Government on the management of multi-level marketing activities:

1. Amend Point a Clause 4 of Circular No. 19/2005/TT-BTM as follows:

Article 1. "a) The application dossier for registration of a multi-level marketing organization includes the documents prescribed in Article 15 of Government Decree No. 110/2005/NĐ-CP dated August 24, 2005 on multi-level marketing, including copies of the Business Registration Certificate and the Certificate of Eligibility for Business Operations that are certified true copies (in case of submission through postal service); photocopies attached with original documents (in case of direct submission); or scanned copies from original documents (in case of submission via electronic network);

2. Repeal the requirement "Confirmation by the Public Security Office at the commune level regarding the enterprise's declaration of loss of the Multi-Level Marketing Organization Registration Certificate" in Point a Clause 8 of Circular No. 19/2005/TT-BTM.

3. Supplement the provision "Number of dossiers to be submitted: 01 set" in Clauses 4, 7, and 8 of Circular No. 19/2005/TT-BTM.

4. Repeal the content "attached with the application" in Model MD-1, MD-2, MD-3 in Appendix II issued together with Circular No. 19/2005/TT-BTM.

1. This Circular takes effect from November 8, 2011.

2. In the course of implementing this Circular, if any difficulties arise, organizations and individuals concerned shall promptly report to the Ministry of Industry and Trade for appropriate amendments and supplements./.
