Guidelines on the Reporting System for Basic Statistics on Technology Transfer

Pursuant to Decree No. 28/2008/NĐ-CP dated March 14, 2008, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

Pursuant to the Decree No. 40/2004/NĐ-CP dated February 13, 2004 of the Government detailing and guiding the implementation of certain provisions of the Law on Statistics;

Pursuant to Decree No. 30/2006/NĐ-CP dated March 29, 2006 of the Government on science and technology statistics;

Pursuant to Decree No. 133/2008/NĐ-CP dated December 31, 2008 of the Government detailing and guiding the implementation of certain provisions of the Law on Technology Transfer,

The Minister of Science and Technology hereby issues guidelines on reporting basic statistics on technology transfer as follows:

Article 1. Scope of Regulation and Applicability

1. These Circulars provide guidance on the contents of reports on basic statistics on technology transfer, the reporting system for basic statistics on technology transfer at enterprises under various economic sectors, scientific research and technological development organizations, universities, colleges, and other equivalent training institutions (hereinafter referred to as reporting units).

2. Entities specified in Clause 1 of this Article operating in the field of national security and defense are not within the scope of regulation of these Circulars.

Article 2. Contents of Reports on Basic Statistics on Technology Transfer

1. Reports on basic statistics on technology transfer include the following contents:

a) General information about the reporting unit;

b) Information on technology;

c) Information on products of technology.

2. Reports must be filled out with all contents according to the form prescribed in the annex attached hereto. The form for reports on basic statistics on technology transfer is published on the Ministry of Science and Technology's website (www.most.gov.vn) and the website of the Agency for Technology Application and Development (www.sati.gov.vn).

Article 3. Provisions on Submission of Reports

Reporting units shall submit their reports on basic statistics on technology transfer to the Department of Science and Technology of the province or centrally-administered city where the unit's main office is located.

Article 4. Reporting Period and Deadline for Submission of Reports

1. The reporting period is one year, from January 1 to December 31 of the reporting year.

2. Deadline for submission of reports: reporting units shall submit reports to the Department of Science and Technology no later than January 15 of the following year of the reporting year.

Article 5. Form and Method of Submission of Reports

1. Reports must be prepared in writing accompanied by an electronic data file according to the Model prescribed in Clause 2 of Article 2 and the annex of this Circular and submitted directly or via postal service and email:

a) Written reports must have the signature and stamp of confirmation of the Head of the reporting unit, sent directly or via postal service;

b) Electronic data may be submitted directly on optical disc, data storage device (USB), or sent via email.

2. Reporting units are responsible for the consistency between the written report and the electronic data file.

Article 6. Rights and Responsibilities of Reporting Units

1. Reporting units have the right:

a) To be guided and provided with statistical information and forms according to the provisions of this Circular;

b) To have statistical information they provide kept confidential in accordance with the law on statistics;

c) To be given priority in reviewing tasks, topics, and projects under state-level, ministry-level, provincial-level, and equivalent science and technology programs.

2. Reporting units shall be responsible for:

a) To report fully, truthfully, objectively, and in accordance with the information content prescribed in this Circular and to bear responsibility under the law for the contents of the reports;

b) To submit and send reports within the stipulated period.

Article 7. Powers and responsibilities of the Department of Science and Technology

1. The Department of Science and Technology has the authority to urge, request units to submit reports on time and verify information when necessary.

2. Responsibilities:

a) Guide units within its jurisdiction to implement base-level statistical reports on technology transfer in accordance with the Circular issued herein;

b) Inspect, handle, and compile data from base-level statistical reports on technology transfer into comprehensive statistical reports;

c) Submit comprehensive statistical reports to the Ministry of Science and Technology (Technology Application and Development Department) in accordance with the deadlines stipulated in the Circular guiding the reporting system for comprehensive statistics on technology transfer;

d) Safeguard statistical information in compliance with laws governing statistics.

Article 8. Effective Date

1. This Circular takes effect forty-five (45) days from the date of issuance.

2. During the implementation process, if there are any difficulties, organizations and individuals are requested to report them to the Ministry of Science and Technology for consolidation and resolution./.
