CIRCULAR

Regulations on Postal Business Reports

Pursuant to the Law on Posts dated June 17, 2010;

Pursuant to Decree No. 47/2011/NĐ-CP dated June 17, 2011 of the Government detailing the implementation of certain provisions of the Law on Posts;

Based on Decree No. 132/2013/ND-CP dated October 16, 2013 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

At the proposal of the Director of the Post Department,

The Minister of Information and Communications issues this Circular on postal business reports.

Article 1. Scope of Regulation

This Circular stipulates postal business reports, including: reporting entities, receiving entities; report forms; periods and deadlines for submitting reports; methods and means of submitting reports; responsibilities of related entities and funding for reporting work.

Article 2. Applicability

1. State agencies with authority over posts.

2. Organizations and enterprises participating in postal activities in Vietnam.

3. Individuals related to the implementation of postal business reports.

Article 3. Reporting Entities, Receiving Entities

State agencies, public service units, political organizations, political-social organizations, social organizations under the state sector managed by the central government and provinces/cities.

a) Provincial Departments of Information and Communications under central cities;

b) Enterprises providing postal services within provinces, inter-provincial, and international areas, including enterprises designated by the State to provide public postal services;

c) Branches, business locations, or other forms of enterprises providing postal services as specified in point b Clause 1 of this Article.

2. Receiving entities include:

a) Ministry of Information and Communications (Postal Department);

b) Provincial Departments of Information and Communications under central cities.

Article 4. Report Forms

1. Periodic report forms include:

a) Report on issuing postal licenses and notifications of postal operations - Form No. 01/BC-STTTT attached hereto. This form applies to Provincial Departments of Information and Communications under central cities reporting to the Ministry of Information and Communications (Postal Department).

b) Report on production, business, and provision of postal services - Form No. 02/BC-DN attached hereto. This form applies to the following entities:

- Enterprises providing postal services within provinces report to the Ministry of Information and Communications (Postal Department) and Provincial Departments of Information and Communications under central cities that have issued postal licenses or notifications of provincial postal operations;

- Enterprises providing postal services across provinces and internationally report to the Ministry of Information and Communications (Postal Department) and Provincial Departments of Information and Communications under central cities where the enterprise's headquarters is located;

- Branches, business locations, or other forms of enterprises providing postal services report to Provincial Departments of Information and Communications under central cities where the branches or business locations operate.

c) Report on results of providing services on the public postal network - Form No. 03/BC-CI attached hereto. This form applies to the following entities:

- Enterprises designated by the State to provide public postal services report to the Ministry of Information and Communications (Postal Department);

- Branches of enterprises designated by the State to provide public postal services report to Provincial Departments of Information and Communications under central cities where the branches operate.

2. In cases requiring urgent reports to fulfill state management requirements for posts, competent state agencies must request reports in writing, specifying the time, deadline, specific content of the report, and other requirements (if any) for the reporting entity to comply with.

Article 5. Reporting Periods and Time Limits for Submitting Reports

1. Reporting Periods:

a) Six-month report: The data collection period runs from January 1 to June 30 of the reporting year;

b) Annual report: The data collection period runs from January 1 to December 31 of the reporting year.

2. Time limit for submitting reports:

a) Six-month report: Before July 31 of the reporting year;

a) Annual report: Before January 31 of the year following the reporting year.

Article 6. Forms of Report and Methods of Submitting Reports

1. Forms of reports:

Reports shall be made in one of the following forms:

a) Written report (a document signed by the head of the reporting unit and stamped according to regulations);

b) Electronic data file report sent via email (an electronic data file with digital signature or scanned copy of the written report as specified in point a, Clause 1 of this Article).

2. Methods of submitting reports:

Reports shall be submitted to the receiving units through one of the following methods:

a) Direct delivery;

b) By postal service;

c) Sending via fax;

d) Via email.

3. Address for receiving reports:

a) For the Ministry of Information and Communications:

Department of Posts - Ministry of Information and Communications.

b) For Provincial Departments of Information and Communications under central cities:

The name of the unit, address, email, and fax number for receiving reports are publicly disclosed on the unit's website or e-government portal.

Article 7. Responsibilities of Units Receiving Reports

1. Publicize the name of the unit, address, email, fax number for receiving reports and the report forms attached as an appendix to this Circular on the unit’s website or e-government portal.

2. Guide reporting units to provide data and related information for postal business reports.

3. Check, reconcile, process, and compile data from postal business reports.

4. Require reporting units to check, provide again, or supplement data and related information for postal business reports when necessary.

5. Compile data and prepare postal business reports.

6. Safeguard received data and information according to legal provisions.

Article 8. Responsibilities of Reporting Units

1. Report fully, accurately, truthfully, and objectively; reported figures must not be duplicated or omitted and the reporting unit is responsible before the law for the contents of the report as stipulated in this Circular.

2. Submit reports to receiving units within the prescribed time limits, forms, methods, and reporting periods as set out in this Circular.

3. Check, provide again, or supplement data and related information for postal business reports upon request of the receiving unit.

4. Maintain records, reports, documents, and vouchers related to postal business reports in accordance with regulations issued by enterprises that comply with legal provisions on record keeping.

Article 9. Funding for Postal Business Reporting Work

Funding for activities such as collecting, compiling data, and preparing postal business reports by receiving units shall be guaranteed from the state budget and included in the annual expenditure plan of the unit.

Article 10. Effective Date

1. This Circular takes effect from February 15, 2017.

2. Provisions regarding statistical reports on universal postal services in Circular No. 20/2009/TT-BTTTT dated May 28, 2009 on statistical reports and surveys of universal postal services cease to be effective from the date this Circular takes effect.

3. The Director of the Office, Heads of the Department of Posts, Heads of relevant units under the Ministry of Information and Communications, Directors of Provincial Departments of Information and Communications under central cities, General Directors, Directors of postal service supply enterprises, and individuals involved in implementing postal business reports are responsible for enforcing this Circular.

4. During the implementation process, if any issues arise or difficulties occur, agencies, organizations, and enterprises should promptly reflect them to the Ministry of Information and Communications for review, amendment, and supplementation.

GUIDELINES FOR COMPLETING FORM 01/BC-STTTT

"Report on License Issuance and Notification of Postal Activities"

1. Definition, Calculation Method:

- A postal license is a permit issued by a competent authority in charge of postal affairs to an enterprise providing letter services with a weight up to two kilograms (kg) when it meets the conditions stipulated by law on postal affairs.

- The confirmation document for postal service activities is a document issued by the competent state agency on postal services to organizations and enterprises conducting the following postal activities when they meet the conditions prescribed by the Postal Law:

+ Providing unaddressed letter services with individual weight up to 02 kilograms (kg);

+ Providing letter services with individual weight over 02 kilograms (kg);

+ Providing package and parcel services;

+ Acting as agents for foreign postal service enterprises;

+ Acquiring franchise rights in the postal sector from abroad;

+ Representing foreign postal service enterprises;

+ Establishing branches or representative offices of domestic postal service enterprises according to Vietnamese law;

+ Establishing representative offices of foreign postal service enterprises.

2. Format:

- Table I. Issuance of postal licenses and confirmation documents for postal service activities:

+ Column 1: Record the number of enterprises and organizations corresponding to each type listed in column B that have been established during the reporting year (from January 01 to December 31 of the reporting year).

+ Column 2: Record the total number of enterprises and organizations corresponding to each type listed in column B as of December 31 of the reporting year.

"Report on Production, Business and Postal Service Supply Activities"

1. Definition, Calculation Method:

- Mail includes letters, packages, and parcels accepted, transported, and delivered legally through the postal network.

- A letter is information exchanged in written form, either handwritten or printed, with or without an address, accepted, transported, and delivered domestically or internationally, excluding regular publications, books, newspapers, and magazines.

- Packages and parcels are items accepted, transported, and delivered domestically or internationally.

- The postal network is a system of mail processing facilities and postal service points connected by transportation and delivery routes to provide postal services.

- A postal service point is a location where mail is accepted and delivered, including post offices, kiosks, agents, public mailboxes, and other forms for accepting and delivering mail.

- Post office branch is a postal service point with staff serving as part of the postal network of a postal service provider enterprise.

- Postal agent is an organization or individual that enters into a contract to act as an agent for providing postal services of a postal service provider enterprise to customers to earn remuneration.

- Sorting and processing center for mail is a location where opening, sorting, handling, bagging, and packaging of mail items for transportation and delivery are carried out.

- Unclaimed mail is mail that cannot be delivered to the recipient and cannot be returned to the sender after six months from the date the mail was accepted.

2. Format:

- Table I. Infrastructure:

GUIDELINES FOR COMPLETING FORM 03/BC-CI

"Report on the Results of Providing Services on the Public Postal Network"

1. Definition, Calculation Method:

- Universal postal services are postal services provided at the request of the State, including universal postal services (basic letter services with address and weight not exceeding two kilograms (kg), including: Domestic basic letter services; Basic letter services from Vietnam to other countries; Basic letter services from other countries to Vietnam) and postal services for national defense, security, and special missions.

Basic letter services are provided at rates set by competent state authorities.

The enterprise designated by the State to provide universal postal services must statistically record the entire volume of domestic basic letter services at all postal service points and the entire volume of basic letter services from Vietnam to other countries and from other countries to Vietnam at foreign exchange post offices.

- Public interest services in the distribution of press publications include the distribution through the public postal network of the following types of newspapers and magazines: People's Newspaper, People's Army Newspaper, Communist Review, newspapers issued by the Party Committees of provinces and centrally governed cities.

The enterprise designated by the State to provide public postal services shall conduct a comprehensive statistical record of the volume of public interest services in the distribution of press publications at all postal service points.

- The group of postal services includes domestic and international postal services, agency postal services, domestic and international EMS express delivery services, international VNQuickpost express delivery service, Datapost service, administrative public service, and other postal services.

- The group of financial services includes banking agency services, payment services via post offices, insurance agency services, and other postal financial services.

- The group of other press distribution services includes organizing subscription sales, retail, and delivery of printed newspapers (excluding those types of newspapers and magazines within the scope of public interest services in the distribution of press publications) published domestically and imported foreign press publications from enterprises designated by the State to provide public postal services to customers.

- The group of communication distribution services includes telecommunication and information technology services, distribution and retail of goods, infrastructure business operations, and distribution of other products and services.

- Ordinary stamps are postal stamps without a supply period and are allowed to be reprinted.

- Special stamps are postal stamps with a supply period and are not allowed to be reprinted.

- Commemorative stamps are postal stamps with content related to historical, economic, political, cultural, scientific, social events or figures, issued on the occasion of anniversaries or relevant events.

- Thematic stamps are postal stamps issued according to a topic or theme.

- Stamp sheet is one or more stamps printed on the same sheet of paper, with decorative text, illustrations, or blank spaces around the stamps.

2. Format:

- Table I.1. Volume, Revenue - Public Postal Services and Public Interest Services in Press Distribution Activities:

+ Column 2: Record the volume of services divided by type corresponding to column B.

+ Column 3: Record the revenue of services divided by type corresponding to column B.

+ Column 4: Provide additional details for columns B, 2, and 3.

- Table I.2. Volume, Revenue - Other Services Provided on the Public Postal Network:

+ Column 1: Record the revenue of service groups divided by type corresponding to column B.

+ Column 2: Provide additional details for columns B and 1.

- Table I.3. Volume, Revenue - List of Services Provided on the Public Postal Network

+ Column 1: Mark column 1 if the corresponding services in column A are provided.

- Table II. Postal Stamps:

+ Column 1 = Column 2 + Column 3: Record the total number of Vietnamese postal stamps printed during the reporting period, divided by type corresponding to column B.

+ Column 2: Record the number of Vietnamese postal stamps printed during the reporting period for philatelic business purposes, divided by type corresponding to column B.

+ Column 3: Record the number of Vietnamese postal stamps printed during the reporting period for postal service fee payments, divided by type corresponding to column B.

+ Column 4: Record the number of Vietnamese postal stamps sold during the reporting period, divided by type corresponding to column B.

+ Column 5: Record the total number of Vietnamese postal stamps remaining as of December 31 of the reporting year, divided by type corresponding to column B.

+ Column 6: Record the quantity of Vietnamese postal stamps canceled due to expiration of circulation during the reporting period.

+ Column 7: Provide additional details for columns B, 1, 2, 3, 4, 5, and 6.

3. Scope and Reporting Period:

Scope: Includes data from enterprises designated by the State to provide public postal services and their branches regarding the volume and revenue of public postal services, public interest services in press distribution activities, postal stamps, and other services provided on the public postal network.

- Reporting Date:

+ Semi-annual report: Before July 31 of the reporting year.

+ Annual report: Before January 31 of the following year immediately after the reporting year.

4. Data source:
