for medical practitioners engaged in diagnosis and treatment

Pursuant to the Law on Diagnosis and Treatment;

Pursuant to DecreeNo. Article 1. This Circular regulates the scope of professional activities for medical practitioners specified in Article 17 of the Law on Diagnosis and Treatment who have been issued practice certificates.of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home AffairsFor traditional medicine doctors, traditional medicine practitioners, licensed traditional medicine practitioners, and those with hereditary prescriptions or hereditary treatment methods, the scope of professional activities shall be implemented according to another Circular issued by the Minister of Health.

The scope of professional activities of medical practitioners includes specialized techniques that they are permitted to perform as stipulated in this Circular.

Chapter I
GENERAL PROVISIONS

Article 1. Scope of Regulation

2. Consistent with educational degrees, certificates, and recognized qualifications related to health care that the individual has obtained in Vietnam;

3. Consistent with the capability of performing specialized techniques within the registered specialty and consistent with the list of specialized techniques of the medical facility approved by competent authorities;

Article 2. Interpretation of Terms

4. Suitable for practical conditions, especially at district and commune levels, and in economically disadvantaged areas;

5. Not distinguishing between doctors working at higher or lower levels, or between newly certified doctors and those with long-term experience;

6. A technique may be performed across multiple specialties but should be listed under the most appropriate specialty in the list of techniques attached to this Circular.

SCOPE OF PROFESSIONAL ACTIVITIES

FOR MEDICAL PRACTITIONERS ENGAGED IN DIAGNOSIS AND TREATMENT

Article 4. Scope of professional activities for medical practitioners who are doctors

1. Doctors have a scope of professional activities including general diagnosis and treatment, which involves performing specialized techniques as detailed in Appendix I attached to this Circular, and emergency care, monitoring, and treatment until the patient can be transferred to another medical facility if their condition exceeds the doctor's capabilities.

2. Doctors specializing in specific fields have a scope of professional activities involving performing specialized techniques within their field as detailed in Appendix II attached to this Circular, and emergency care, monitoring, and treatment until the patient can be transferred to another medical facility.

Chapter II
3. The person responsible for technical and professional management at the medical facility shall, based on the scope of professional activities recorded on the practice certificate, educational degrees, certificates, or recognitions, and the capability of the doctor, assign in writing specific technical and professional activities for the doctor to perform at the medical facility they manage.
OF HEALTH CARE PRACTITIONERS

Article 4. Scope of Professional Activities of Practitioners as Physicians

1. The scope of professional activities of practitioners as physicians in general medical practice includes performing specialized techniques specified in Appendix I attached to this Circular, and providing first aid, emergency care, monitoring, care, and treatment of patients until they are transferred to another medical facility when such cases exceed their professional capacity.

2. The scope of professional activities of practitioners as physicians in specialty medical practice includes performing specialized techniques within their respective specialties as specified in Appendix II attached to this Circular, and providing first aid, emergency care, monitoring, care, and treatment of patients until they are transferred to another medical facility.

3. The person responsible for technical and professional management at the medical facility shall, based on the scope of professional activities recorded on the practitioner's license, degree, certificate, or certification, and the practitioner's capability as a physician, assign in writing specific professional techniques for the practitioner to perform at the medical facility under their supervision.

Article 5. Scope of professional activities of preventive medicine doctors

A person practicing as a preventive medicine doctor is permitted to examine, detect, and treat common diseases; provide initial treatment for some emergency cases in the community.

Article 6. Scope of professional activities of medical assistants

A person practicing as a medical assistant at the commune level is allowed to participate in initial first aid, diagnose, and treat common illnesses according to Circular Joint Circular No. 10/2015/TTLT-BYT-BNV dated May 27, 2015, of the Ministry of Health and the Ministry of Home Affairs on job code and qualification standards for doctors, preventive medicine doctors, and medical assistants.

Article 7. Scope of professional activities of nursing officers, midwives, and medical technicians

A person practicing as a nursing officer, midwife, or medical technician is permitted to carry out the corresponding scope of professional activities as stipulated in Circular No. 26/2015/TTLT-BYT-BNV dated October 7, 2015, of the Ministry of Health and the Ministry of Home Affairs on job code and qualification standards for nursing, midwifery, and medical technology.

Chapter III
IMPLEMENTING PROVISIONS

Article 8. Effective Date

1. This Circular takes effect from March 1, 2020.

2. Repeal Clause 1, Article 6 of Circular No. 50/2017/TT-BYT dated December 29, 2017, of the Minister of Health Amending and Supplementing Relevant Provisions on Payment of Medical Examination and Treatment Costs from the date this Circular takes effect.

Article 9. Cross-References

In case the referenced documents in this Circular are replaced, amended, or supplemented, they shall be implemented according to the replaced, amended, or supplemented documents.

Article 10. Responsibility for Implementation

Gentlemen, Ladies: The Director of the Department of Medical Examination and Treatment Management, the Head of the Ministry's Office, the Inspector General of the Ministry, the Directors of the Departments, the Heads of the Bureaus under the Ministry of Health, the Directors of Provincial Health Services under the Central Government are responsible for implementing this Circular. During implementation, if there are difficulties or obstacles, it is recommended that organizations and individuals promptly reflect them to the Ministry of Health (Department of Medical Examination and Treatment Management) for consideration and resolution.
