Circular 35/2024/TT-BYT stipulates basic quality standards for hospitals issued by the Minister of Health

CIRCULAR

Regulations on basic quality standards for hospitals

Pursuant to the Law on Medical Examination and Treatment dated January 9, 2023;

Pursuant to Decree No. 96/2023/NĐ-CP dated December 30, 2023 of the Government detailing certain provisions of the Law on Medical Examination and Treatment;

Pursuant to Decree No. 95/2022/NĐ-CP dated November 15, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

At the proposal of the Director of the Department of Medical Examination and Treatment;

The Minister of Health issues this Circular to stipulate basic quality standards for hospitals.

Article 1. Basic quality standards for hospitals

1. Basic quality standards for hospitals include:

a) Standards regarding infrastructure as specified in Section I of the Appendix attached hereto;

b) Standards regarding scale and organizational structure as specified in Section II of the Appendix attached hereto;

c) Standards regarding personnel as specified in Section III of the Appendix attached hereto;

d) Standards regarding medical equipment as specified in Section IV of the Appendix attached hereto;

e) Standards regarding expertise as specified in Section V of the Appendix attached hereto.

2. Scope of application: These basic quality standards apply only to healthcare facilities that have been granted a license to operate in the form of a hospital.

3. The process of evaluating basic quality for hospitals shall be carried out as follows:

a) Conducting an evaluation of basic quality standards once a year;

b) The evaluation period shall take place in the first quarter of the following year;

c) Evaluation classification. Meeting basic quality standards: all standards must be marked "Yes" in the "Evaluation Result" column; Not meeting basic quality standards: if there is any standard marked "No" in the "Evaluation Result" column.

Article 2. Implementation

1. The Department of Medical Examination and Treatment shall be responsible for:

a) Serve as the directing body, organizing and implementing this Circular and guiding the assessment and professional content within their assigned functions and responsibilities;

b) Supervising and urging healthcare facilities under their management to implement the assessment of basic quality standards for hospitals as prescribed in this Circular.

2. The Department of Traditional Medicine Management shall be responsible for directing, guiding, inspecting, and urging the implementation of this Circular according to their assigned functions and responsibilities.

3. Provincial Departments of Health shall be responsible for:

a) Directing, guiding, inspecting, and urging the implementation of this Circular for healthcare facilities under their management;

b) Supervising and urging healthcare facilities under their management to implement the assessment of basic quality standards for hospitals as prescribed in this Circular.

4. Healthcare facilities shall be responsible for:

a) Implementing this Circular;

b) Reviewing, supplementing, and rectifying to ensure the maintenance of basic levels of healthcare quality;

c) Conducting evaluations and reporting the results of such evaluations as prescribed.

Article 3. Effectiveness

This Circular shall take effect from January 1, 2025.

During the implementation process, if there are difficulties or obstacles, agencies, organizations, and individuals are requested to report to the Ministry of Health (through the Department of Medical Examination and Treatment) for consideration and resolution./.
