PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to Decree No. 73/CP dated November 1, 1995 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

At the proposal of the Minister of Agriculture and Rural Development, the Minister, Head of the Civil Service Committee of the Government,

DECISION:

Article 1. The Forestry Development Department is an agency under the Ministry of Agriculture and Rural Development, assisting the Minister of Agriculture and Rural Development in performing state management functions concerning the construction, restoration, use, and development of protective forests, special-purpose forests, production forests, and social forestry development.

The Forestry Development Department has legal personality, possesses a seal, and its operational budget is provided by the state treasury, allowing it to open accounts at the State Treasury.

The headquarters of the Department is located in Hanoi city.

Article 2. The Forestry Development Department has the following main tasks and powers:

1. Developing long-term, medium-term, and short-term plans, programs, and projects on the construction, restoration, use, and development of protective forest systems, special-purpose forests, production forests, and social forestry development, and organizing their implementation after approval by competent authorities.

2. Drafting and submitting policies, management systems for protective forest systems, special-purpose forests, production forests, and social forestry development, encouraging all organizations and individuals, including foreign organizations and individuals, to invest capital and technology in these areas, and organizing their implementation after approval by competent authorities. Submitting to the Ministry for issuance or issuing within its authority standards, procedures, regulations, and economic and technical norms regarding the use, construction, restoration, and development of forests, and organizing the implementation of these issues.

3. Assisting the Ministry in conducting professional reviews of projects and technical designs related to the use, construction, restoration, nurturing, afforestation, and exploitation of forest resources.

4. Organizing the implementation of measures to ensure the quantity and quality of forest tree seeds from seedling production, nurseries, circulation to usage for afforestation, establishing a reasonable forest structure, restoring and regenerating forests, nurturing, and thinning forests.

Managing the import and export of forest tree seeds according to government regulations.

5. Implementing forest management operations, timber harvesting, and forest products. Submitting to the Ministry or issuing within its authority permits for timber and forest product harvesting and opening/closing forest gates.

6. Organizing the application of advanced technologies and international cooperation in the use, construction, restoration, and development of forests. 7. Assisting the Ministry in managing annual production volume, types, distribution of harvested timber and forest products, and the import and export of wood, rattan, bamboo, and palm according to the division of responsibilities between the Ministry of Agriculture and Rural Development and the Ministry of Industry and Trade.

8. Organizing training and professional capacity building for staff in the fields managed by the Department according to the classification of the Ministry.

9. Managing organizational structure, staffing, and assets allocated according to state regulations.

Article 3. Organization of the Forestry Development Department:

1. The Department is led by a Director and assisted by Deputy Directors.

The Director is responsible to the Minister of Agriculture and Rural Development for all activities of the Department. Deputy Directors are responsible to the Director for the areas of work assigned to them. The Director and Deputy Directors are appointed and relieved of duty by the Minister of Agriculture and Rural Development.

2. The support staff of the Director of the Forestry Development Department is determined by the Minister of Agriculture and Rural Development.

Article 4. This Decision takes effect from the date of issuance. Any previous regulations that conflict with this Decision are hereby abolished.

The Minister of Agriculture and Rural Development, other Ministers, heads of ministerial-level agencies, heads of governmental agencies, Chairpersons of provincial and municipal People's Committees directly under the central government, and the Director of the Forestry Development Department are responsible for implementing this Decision.
