DIRECTIVE
OF THE PRIME MINISTER

On Prohibiting Drunkenness

Currently, the habit of excessive drinking of alcohol or alcoholic beverages is on the rise. Some individuals become drunk due to overconsumption of alcohol or beer, losing self-control, leading to behaviors that negatively impact social order and safety, sometimes even committing crimes, harming their own family life and stability, contravening Vietnamese cultural traditions and healthy living habits, and affecting people's health and work capacity. Government agencies, mass organizations, units, enterprises, schools... need to intensify campaigns against drunkenness while promoting public voluntary reduction of extravagant eating and drinking customs during celebrations, funerals, weddings, which waste time and money, and are contrary to civilized living habits.

To contribute to this campaign, the Prime Minister issues the following directive:

1. Prohibit drunkenness at workplaces, hotels, restaurants, eateries, on transportation means, and in public places for all individuals.

2. Prohibit children under 16 years old from consuming alcohol or beer; prohibit minors (under 18 years old) from consuming alcohol or beverages with an alcohol concentration of 14 degrees or higher.

3. Prohibit hotels, restaurants, eateries... from selling alcoholic beverages with an alcohol concentration of 14 degrees or higher to minors and alcohol or beer to children under 16 years old. Strictly prohibit the sale and consumption of alcohol or beer in general education schools.

4. State officials, civil servants, military personnel, minors, children under 16 years old, and all citizens violating this Directive shall be subject to disciplinary action and administrative penalties. In cases where drunkenness leads to criminal behavior, they will also be held criminally responsible according to current laws.

The owners of hotels, restaurants, eateries... must commit to and implement measures to prevent customers from becoming drunk. If they fail to fulfill their responsibilities or seek profit by tolerating or encouraging customers to drink excessively, resulting in public disorder or violation of the law, they will be held jointly liable and punished similarly to those who are drunk.

Heads of Ministries, Sectoral Departments, Chairpersons of People's Committees of provinces and centrally-administered cities have the responsibility to coordinate with the Vietnam Fatherland Front and other mass organizations and social organizations to effectively implement the following tasks:

a. The Ministry of Culture and Information shall cooperate with relevant ministries and departments, along with provincial and centrally-administered city People's Committees, to strengthen extensive propaganda through mass media about this Directive so that state officials, civil servants, and military personnel are aware and set examples in its implementation, participating in mobilizing various strata of the population to limit alcohol consumption and the societal trend of eliminating the vice of drunkenness.

b. The Ministry of Trade shall be responsible for researching and submitting to the Government measures to better control the sale and importation of foreign-made alcoholic beverages into Vietnam.

c. The Ministry of Industry shall research and submit to the Government policies on alcohol production and measures to end illegal alcohol and beer production currently existing in some areas.

d. The Ministry of Education and Training shall take the lead in coordinating with the Communist Youth Union Central Committee and related agencies to develop plans for joint propaganda and education to raise awareness among young people about the dangers of drunkenness, organizing them to actively participate in mobilizing society to implement this Directive.

e. The Ministry of Home Affairs shall take the lead in coordinating with the Ministry of Justice and related ministries and sectors to quickly complete the supplementation and revision of Decree 141/CP on administrative penalties in the field of security and public order, including specific provisions to implement this policy, and submit it to the Government for issuance as soon as possible.

This Directive takes effect from June 30, 1996. At all levels of People's Committees, ministries, and sectors, efforts should be made to prepare necessary measures for effective implementation of the Directive from now until June 30, 1996.
