Decision No. 3522/2002/QĐ-BGTVT On the waters of sea ports within the jurisdiction of Thua Thien-Hue Province and the area of responsibility of the Thua Thien-Hue Port Office

Regarding the waters of the seaports within the jurisdiction

of Thua Thien-Hue province and the area of responsibility of the Thua Thien-Hue Port Authority.

THE MINISTER OF TRANSPORTATION

Pursuant to Article 58 of the Maritime Law of Vietnam dated June 30, 1990;

Pursuant to Decree No. 22/ dated October 20, 2015 of dated March 22, 1994 of the Government on tasks, powers, responsibilities for state management and organizational structure of the Ministry of Transport;

Pursuant to the opinions of Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the People's Committee of Thua Thien-Hue province at Official Letter No. 777/UB-GT dated April 12, 2002;

Considering the proposal of the Director of the Legal Affairs and Transport Department and the Director of the Vietnam Maritime Administration,

DECISION:

Article 1.Now hereby promulgating the waters of the seaports within the jurisdiction of Thua Thien-Hue province including:

VThe waters before the Thu An wharf, Thu An fuel port, and Cham May wharf.

The waters of the channels leading to the ports, anchorage areas, transshipment areas, and typhoon shelters within the port areas of Thu An, Thu An fuel port, and Cham May port.

Article 2The scope of the waters of the seaports within the jurisdiction of Thua Thien-Hue province shall be calculated based on the highest tidal level and shall be within the following limits:

1. The Thu An port and Thu An fuel port area:

a) Towards the mainland: it is the water area bounded by straight lines connecting the points with the following coordinates:

A1.16⁰33^'24^"N; 107⁰38^'38^"E.

A2.16⁰33^'06^"N; 107⁰38^'25^"E.

A3.16⁰33^'00^"N; 107⁰37^'48^"E.

A4.16⁰33^'35^"N; 107⁰37^'09^"E.

A5.16⁰33^'54^"N; 107⁰37^'12^"E.

ATTo the east: from point A1 running along the shoreline to point A7 with the coordinates:

A7.16⁰34^'00^"N;107⁰38^'30^"E.

ATTo the west: from point A5 running along the shoreline northward to point A6 with the coordinates: A6. 16⁰35^'00^"N;107⁰35^'58^"E.

b) Towards the sea: it is the water area bounded by straight lines connecting points A6, F1, F2, and A7. Points F1, F2 have the coordinates:

F1.16⁰37^'30^"N; 107⁰36^'07^"E.

F2.16⁰35^'43^"N; 107⁰40^'20^"E.

2. The Cham May port area:

a) Towards Cham May Bay: it is the entire water area within Cham May Bay bounded from point C1, running along the bay shore, to point C2. Points C1, C2 have the coordinates:

C1.16⁰20^'42^"N; 107⁰01^'06^"E (Cham May East Cape)

C2.16⁰20^'40^"N; 107⁰57^'00^"E (Cham May West Cape).

b) Towards the sea: it is the water area bounded by straight lines connecting points C1, B1, B2, and C2.

Points B1, B2 have the coordinates:

B1.16⁰22^'38^"N; 107⁰01^'54^"E

B2.16⁰22^'38^"N; 107⁰57^'51^"E

Article 3The pilot reception and delivery, quarantine, anchorage, transshipment, and typhoon shelter areas for ships entering the Thu An, Thu An fuel port, and Cham May ports are defined as follows:

1. Pilot reception and delivery and quarantine areas:

a) For the Thu An port and Thu An fuel port: bounded by a semicircle towards the north with a radius of 1.5 nautical miles centered at the position with the coordinates:

16⁰35^'48^"N;107⁰37^'36^"E.

b) For the Cham May port: bounded by a circle with a radius of 1 nautical mile centered at the position with the coordinates: 16⁰35^'48^"N; 107⁰37^'36^"E.

2. Anchorage, transshipment, and typhoon shelter areas:

a) For the Thu An port and Thu An fuel port: at positions with the coordinates:

16⁰33^'30^"N;107⁰38^'03^"E and 16⁰33^'54^"N;107⁰37^'42^"E.

b) For the Cham May port:

For vessels with a deadweight tonnage under 3,000 DWT at the position with the coordinates:

16⁰19^'35^"N;108⁰00^'23^"E.

For vessels with a deadweight tonnage of 3,000 DWT or more at the position with the coordinates:

16⁰19^'55^"N;107⁰50^'54^"E.

Article 4The Thua Thien-Hue Port Authority shall be responsible for performing its tasks and powers as prescribed in the Vietnam Maritime Code and related legal documents regarding all maritime activities within the waters of the seaports within the jurisdiction of Thua Thien-Hue province.

Article 5Outside the scope of the waters defined in this Decision, the Thua Thien-Hue Port Authority also has the responsibility for specialized state management over maritime order and safety in the sea areas within the jurisdiction of Thua Thien-Hue province.

Article 6.

1. This Decision shall take effect fifteen days from the date of signature and revoke any previous regulations that conflict with this Decision.

2. The Heads of the Office, Directors of Departments under the Ministry, the Director of the Vietnam Maritime Administration, the Director of the Thua Thien-Hue Department of Transport, the Director of the Thua Thien-Hue Port Authority, and the Heads of relevant agencies, organizations, and individuals shall be responsible for implementing this Decision./. The Provincial Department of Transportation of Thua Thien - Hue, the Director of the Thua Thien - Hue Port Office, and the Heads of relevant agencies, organizations, and individuals shall be responsible for implementing this Decision./.
