Pursuant to the Law on Organization The Government on September 30, 1992,
Decree No. 73 - CP dated January 1- November 1995 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development,
At the proposal of the Ministry Ministry of Science and Technology of Agriculture and Rural Development, the Minister, the Head of the Civil Service Committee of the Government, the Water Resources Management and Irrigation Works Administration is an agency directly under the Ministry of Agriculture and Rural Development, assisting the Minister
DECISION:
Article 1. of the Ministry of Agriculture and Rural Development in performing state management functions over water resources, including rural domestic water (excluding mineral raw water and geothermal water), irrigation works, and the exploitation and comprehensive development of rivers nationwide. The Water Resources Management and Irrigation Works Administration has legal personality, possesses a seal, and its operational budget is provided by the State Budget; it may open accounts at the State Treasury. The headquarters of the Administration is located in Hanoi City.
The Water Resources Management and Irrigation Works Administration has the following main tasks and powers:
Article 2. 1. Developing overall master plans, regional medium-term and long-term plans, and annual plans for:
- Basic investigation of water resources, water balance, development and protection of water sources, prevention of water environmental pollution, management of exploitation, protection, and development of irrigation systems serving production and public life.
Organizing the implementation of these plans after they have been approved by competent authorities. 2. Drafting or participating in drafting laws, regulatory documents, policies, and systems regarding water resource management, irrigation works, and the exploitation and comprehensive development of rivers; submitting to competent authorities for issuance or issuing according to their authority procedures, standards, economic and technical norms within the scope of the Administration's management, guiding, and supervising the implementation of these matters after approval.
3. Reviewing or chairing reviews of irrigation planning projects, repair, upgrade, and completion projects of irrigation works assigned by the Ministry
for approval or for submission to the Government for approval.
Serving as the permanent member of the Acceptance Council for handing over and putting into operation centrally-managed irrigation works. 4. Directing the operation and regulation of large-scale irrigation works, integrated utilization, and inter-provincial irrigation works. Directing flood control, drought prevention, disaster aftermath mitigation, and ensuring the safety of agricultural and irrigation works.
5. Proposing models for managing irrigation systems, water resources, and river basins.
6. Issuing or revoking water usage permits according to the law within the authority granted.
7. Directing the application of scientific and technological advancements in practice and training technical
expertise for staff involved in water resource and irrigation works management.
8. Implementing international cooperation in water resource management and irrigation works according to the division of labor by the Ministry.
9. Organizing the implementation of inspection and supervision tasks as assigned.
10. Managing organization, staffing, and assets allocated in accordance with State regulations.
Organizational structure of the Water Resources Management and Irrigation Works Administration. 1. The Administration is led by a Director and Deputy Directors assist the Director.
The Director is responsible to the Ministry
Article 3. of Agriculture and Rural Development for all activities of the Administration. Deputy Directors are responsible to the Director for the tasks assigned to them.
The Director and Deputy Directors are appointed and relieved from duty by the Minister
of Agriculture and Rural Development. Ministry of Science and Technology The machine assisting the Director of the Water Resources Management and Irrigation Works Administration is specified by the Minister
of Agriculture and Rural Development. Ministry of Science and Technology 3. Research organizations:
2. The Water Resources Investigation and Evaluation Center. Ministry of Science and Technology - Technology Transfer Center for Water Resources Management and Irrigation Works.
The Minister of Agriculture and Rural Development shall specify the specific tasks, powers, organizational structures, and staffing of the subordinate organizations of the Water Resources Management and Irrigation Works Administration.
This Decision takes effect from the date of issuance. Previous provisions contrary to this Decision are abolished.
The Minister of Agriculture and Rural Development, Ministers, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairmen of Provincial People's Committees under central administration, and the Director of the Water Resources Management and Irrigation Works Administration are responsible for implementing this Decision./.
Minister of The Ministry of Agriculture and Rural Development shall specify in detail the tasks, powers, organizational structure, and staffing of the subordinate organizations under the Water Resources Management and Irrigation Works Administration.
Article 4. This Decision takes effect from the date of issuance. All previous regulations that conflict with this Decision are hereby abolished.
Minister of The Ministry of Agriculture and Rural Development, the Ministries ministers, heads of ministerial-level agencies, heads of government agencies, Chairpersons of People's Committees of provinces and centrally governed cities, and the Director of the Water Resources Management and Irrigation Works Administration are responsible for implementing this Decision./.
