- The funds for paying allowances shall be provided from the state budget according to the annual plan and settled after the completion of the appraisal work.
- This Circular takes effect from March 15, 1996, and abolishes provisions contrary to this Circular.

Guidelines for implementing Decision No. 160/TTG dated March 15, 1996 of the Prime Minister on the implementation of the allowance system for judicial experts
Implementing Decision No. 160/TTg dated March 15, 1996 of the Prime Minister on the implementation of the allowance system for judicial experts; the Joint Ministry of Personnel - Civil Service of the Government, Ministry of Finance, and Ministry of Justice provide guidelines as follows

I. OBJECTIVES AND SIGNIFICANCE:
The allowance system for judicial experts or specialized staff assigned to perform judicial expertise aims to compensate for part of the health expenses incurred to ensure the completion of assigned tasks.
II. ELIGIBILITY AND AMOUNT OF ALLOWANCE
1. For financial accounting, forensic psychiatry, criminal technical, scientific and technical, literary and artistic works, cultural and artistic products, and other judicial expertise, the following allowances shall be granted:
- A rate of 12,000 VND/day/expert, applicable to experts performing expertise on a daily basis.
- When experts perform expertise outside regular working hours, they shall receive night shift and overtime allowances as stipulated in Circular No. 18/LĐTBXH-TT dated June 2, 1993 of the Ministry of Labor - Invalids and Social Affairs guiding the implementation of the overtime pay and night shift allowance system.
2. For forensic expertise, the following allowances shall be granted:
a) A rate of 10,000 VND/case/expert, applicable to simple cases of forensic expertise on living persons (causing injury, rape...); a rate of 20,000 VND/case/expert in complex cases.
b) A rate of 20,000 VND/case/expert, applicable to simple cases of forensic expertise on materials and objects (organs, hair, blood...); a rate of 30,000 VND/case/expert in complex cases.
c) For post-mortem expertise, the following allowances shall be granted:
- Non-surgical post-mortem expertise:
+ A rate of 30,000 VND/case/expert, applicable to deceased persons within 48 hours.
+ A rate of 40,000 VND/case/expert, applicable to deceased persons beyond 48 hours up to 7 days, or within 48 hours but requiring exhumation.
+ A rate of 50,000 VND/case/expert, applicable to deceased persons beyond 7 days, or within 7 days but requiring exhumation.
+ A rate of 60,000 VND/case/expert, applicable to deceased persons beyond 7 days requiring exhumation.
- Surgical post-mortem expertise:
+ A rate of 80,000 VND/case/expert, applicable to deceased persons within 48 hours.
+ A rate of 100,000 VND/case/expert, applicable to deceased persons beyond 48 hours up to 7 days, or within 48 hours but requiring exhumation.
+ A rate of 120,000 VND/case/expert, applicable to deceased persons beyond 7 days, or within 7 days but requiring exhumation.
+ A rate of 150,000 VND/case/expert, applicable to deceased persons beyond 7 days requiring exhumation.
III. IMPLEMENTATION
1. The source of funds for paying the allowance system is provided from the state budget according to the annual plan.
In 1996, the funds for paying the allowance for judicial experts are included in the 1996 state budget plan approved by the Government and notified to the relevant units.
2. Payment of allowances to the subjects mentioned in Part II of this Circular shall be made by the requesting agency after the completion of the expertise work, and may be paid based on the number of working days or the case, and settled according to the current regulations.
3. This Circular takes effect from March 15, 1996.
Any provisions regarding the allowance system for judicial experts that conflict with this Circular shall be abolished.
Any difficulties encountered during implementation should be reported to the Joint Ministry for study and resolution.
