DECISION

Issuing the Regulation on the Organization and Operation of

The Office of the Ministry of Science and Technology

THE MINISTER OF SCIENCE AND TECHNOLOGY

Pursuant to Decree No. 54/2003/NĐ-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology, and Decree No. 28/2004/NĐ-CP dated January 16, 2004 of the Government amending and supplementing certain provisions of Decree No. 54/2003/NĐ-CP;

Considering the proposals of the Heads of the Office and the Heads of the Department of Personnel Organization; 

DECISION: 

Article 1. This Decision promulgates the Regulation on the Organization and Operation of the Office of the Ministry of Science and Technology.

Article 2. This Decision shall take effect fifteen days from the date of publication in the Official Gazette and shall replace Decision No. 550/QĐ-TCCBKH dated May 12, 1997 of the Minister of Science, Technology and Environment (now the Ministry of Science and Technology) promulgating the Charter on the Organization and Operation of the Office of the Ministry.

Article 3. The Heads of the Office, the Heads of the Department of Personnel Organization and the Heads of units concerned shall be responsible for implementing this Decision.

REGULATION ON THE ORGANIZATION AND OPERATION OF

THE OFFICE OF THE MINISTRY OF SCIENCE AND TECHNOLOGY

PART I

FUNCTIONS, TASKS, AND POWERS

 

Article 1. The Office of the Ministry of Science and Technology (hereinafter referred to as the Office) is a unit under the Ministry of Science and Technology with the function of advising the Minister in directing and managing the general activities of the Ministry; assisting the Minister in organizing the coordination and cooperation of the activities of subordinate units; building, managing, and implementing the operational regulations, programs, and work plans of the Ministry; managing the financial resources and assets of the third-level financial unit of the Office; and assisting the Minister in directly managing other aspects of work.

 

Article 2. The Office has the following main tasks and powers:

 

1. To lead or coordinate with functional units in drafting and submitting to the Minister for issuance the operational regulations and other internal regulations; monitoring, urging, and inspecting subordinate units to implement the regulations, internal rules, and decisions of the Minister.

 

2. To advise the Minister on selecting key issues concerning policies, laws, and management mechanisms for assignment to relevant subordinate units for research and submission to the Minister. Receiving, reviewing (in terms of format, administrative procedures, compliance with Party and State policies, and directives of the Minister), and submitting to the Minister for consideration and decision on regular matters submitted by subordinate units.

 

3. To coordinate and urge subordinate units in preparing assigned projects and draft normative legal documents; receiving, reviewing (in terms of format, administrative procedures, compliance with Party and State policies, and directives of the Minister) to submit to the Minister for decision; scheduling the Minister's and Deputy Ministers' work programs; performing secretarial duties for the leadership of the Ministry.

 

4. To carry out the task of coordinating and cooperating in the implementation of the work programs and plans of subordinate units during the execution of the Ministry's overall work program and plan.

 

5. To guide subordinate units in formulating their annual work plans, consolidate them into the Ministry's overall annual plan, submit to the Minister for review; organize monitoring, inspection, and reporting to the Minister on the implementation of work plans by subordinate units; directly implement the Office's work plan.

 

6. To guide subordinate units in formulating and implementing long-term and annual scientific research and technology application plans; manage the strengthening of equipment, minor repair and construction works of the Ministry.

 

7. To guide subordinate units in formulating long-term and annual investment development plans, submit them for approval by competent authorities; manage and organize the implementation of investment projects under the Ministry according to the laws on investment and construction.  and construction.

 

8. To manage the annual operating budget of the third-level financial unit of the Office; implement financial systems and social policies for staff of the Office and subordinate units not managed at the financial level.

 

9. To manage and guide the implementation of administrative, archival, and record-keeping work of the Ministry in accordance with current state regulations.

 

10. To perform administrative management and service functions within the agency; manage material infrastructure, ensure working conditions and means for the Ministry's office; protect the office premises of the Ministry.

 

11. To be in charge of the Ministry's permanent work on commendation and propaganda; lead and monitor security, flood prevention, fire protection, and public welfare labor.

 

12. To organize and implement health and family planning work, and health protection for officials, civil servants, and employees in the Ministry.

 

13. To ensure information communication, printing, and photocopying services; manage and coordinate the use of vehicles serving the work requirements of the Ministry's leadership, the Office, and subordinate units without separate administrative and management organizations.

 

14. To lead and coordinate with functional units under the Ministry in organizing and implementing reception work of the Ministry.

 

15. To manage the personnel organization of the Office according to the Minister's delegated authority.

 

16. To perform the role of liaison for the Ministry in transactions with higher levels, lower levels, and external agencies and organizations as assigned by the Ministry's leadership.

 

17. To organize and manage the operations of the Office's permanent presence in Male Ho Chi Minh City.

 

Article 3. The Office may use its own seal bearing the name of the Office; open domestic and foreign currency accounts at the State Treasury and the State Bank.

 

PART II

ORGANIZATIONAL STRUCTURE

 

Article 4. The Office operates and works under the head system combined with collective discussion.

 

The Director of the Office is responsible to the Minister for all activities of the Office.

 

Deputy Directors assist the Director in directing certain aspects of work as assigned by the Director and are responsible to the Director for the tasks assigned to them.  regarding the tasks assigned.

 

In the absence of the Director of the Office, the operation of the Office shall be managed by a Deputy Director authorized to do so. The Director shall be responsible for the decisions made by the Deputy Director when authorized.

The specific functions, tasks, and authorities of the above units shall be defined by the Director of the Office. Additionally, based on the functions and tasks of the Office, the Director may seek the Minister's opinion to establish independent Units or Groups to carry out certain parts of the work according to the assigned functions and tasks.

 

CHAPTER III

WORK RELATIONSHIPS

 

Article 6. The Director of the Office shall manage all activities of the Office based on the Working Regulations of the Ministry, the Charter of Organization and Operation of the Office, laws and regulations concerning civil servants, public officials, and employees, and regulations regarding the organization and operation of subordinate units of the Office.

 

, Clause 1, Clause 2 Article 7a of this Regulation.. The leadership of the Office shall implement working systems and work relations with the Heads of subordinate units of the Ministry according to the Working Regulations of the Ministry and other regulations issued by the Minister.

 

Article 8. In some specialized fields, the Office, through its subordinate units, shall be subject to the direction and guidance of relevant Ministries, agencies at the level of Ministries, government agencies, and functional units of the Ministry.

 

CHAPTER IV

IMPLEMENTATION PROVISIONS  ADMINISTRATIVE

 

Article 10. The Director of the Office and the Head of the Civil Service Department shall be responsible for organizing the implementation of this Charter. During the implementation process, if there is a need for supplementation or amendment, the Director shall coordinate with the Head of the Civil Service Department to request the Minister of Science and Technology to consider and decide./.
