THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to the Plant Protection and Quarantine Ordinance 2001;
Pursuant to the Government Decree No. 86/2003/NĐ-CP dated July 18, 2003 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Decision No. 88/2003/QĐ-BNN dated September 4, 2003 of the Minister of Agriculture and Rural Development stipulating the functions, tasks, powers, and organizational structure of the Plant Protection Department;
Considering the proposal of the Director of the Plant Protection Department and the Head of the Cadre and Civil Servant Affairs Department,
DECISION:
Article 1. Position and Functions
The Post-Import Plant Quarantine Center I is a public service unit under the Plant Protection Department, having legal personality, its own seal, operating funds, and bank accounts as prescribed by law.
The scope of activities of the Center includes provinces from Thua Thien-Hue Province and beyond.
The headquarters of the Center is located in Dong Nac Commune, Tu Liem District, Hanoi City.
Article 2. Tasks and Powers
1. Supervise and investigate harmful organisms subject to plant quarantine and potential harmful organisms on imported planting materials;
2. Assess the safety level of beneficial organisms imported for use in plant protection;
3. Participate in developing standards, procedures, and conducting experimental surveys on post-import plant quarantine;
4. Confirm the results of post-import plant quarantine for beneficial organisms and new planting materials;
5. Coordinate training and professional development in post-import plant quarantine;
6. Guide, compile, and report to the Department on the work of post-import plant quarantine conducted by provincial and municipal Plant Protection Departments;
7. Participate in international cooperation programs on post-import plant quarantine;
8. Manage staff, finance, assets, and other resources assigned by the Department;
9. Provide services related to plant quarantine;
10. Perform other tasks assigned by the Director of the Plant Protection Department.
Article 3. Organizational Structure
1. Leadership of the Center:
The leadership of the Center consists of the Director and Deputy Directors appointed by the Director of the Plant Protection Department according to regulations.
The Director manages the operations of the Center, is responsible before the Director of the Plant Protection Department and the law for the activities of the Center and the assigned tasks.
The Deputy Directors assist the Director, are responsible before the Director and the law for the implementation of their assigned tasks. The number of Deputy Directors shall not exceed two persons.
2. The support staff of the Center's Director:
a) Administrative General Department;
b) Investigation and Surveillance Section;
c) Experimental Survey Section.
The Director of the Plant Protection Department shall prescribe the operational rules of the unit.
Article 4. Effectiveness
This Decision takes effect fifteen days after its publication in the Official Gazette of the Government; This Decision replaces Decision No. 82 NN-TCCB/QĐ dated February 8, 1994 of the Minister of Agriculture and Food Industry (now the Ministry of Agriculture and Rural Development) regarding the establishment of the Post-Import Plant Quarantine Center I. Previous provisions contrary to this Decision are abolished.
Article 5. Responsibility for Implementation
The Heads of the Office of the Ministry, the Head of the Cadre and Civil Servant Affairs Department, the Director of the Plant Protection Department, the Heads of relevant agencies and units under the Ministry, and the Director of the Post-Import Plant Quarantine Center I are responsible for implementing this Decision.
