Pursuant to the Inspection Law No. 22/2004/QH11 dated June 15, 2004;

Pursuant to Decree No. 36/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

Pursuant to the Government Decree No. 46/2005/ND-CP dated April 6, 2005 on the organization and operation of construction inspection agencies;

Upon the proposal of the Inspector General of the Ministry and the Director of the Department of Organization and Cadres,

 

DECISION:

 

Article 1. Attached hereto is the "Regulation on the standards for Inspectors, officials, and civil servants working in construction inspection agencies; uniforms, insignia, badges, signs; technical means and equipment of construction inspectors."

Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 3. Ministries, ministerial-level agencies, central agencies under the Government, central agencies of mass organizations, People's Committees of provinces and centrally-administered cities shall be responsible for implementing this decision./.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability.

Article 1. These regulations stipulate the standards for specialized construction inspectors, officials, and civil servants working in specialized construction inspection agencies; uniforms, insignia, badges, signs; technical means and equipment of specialized construction inspectors.

Article 2. These regulations apply to organizations and individuals within the system of specialized construction inspection agencies (referred to collectively as construction inspection agencies) and other related organizations and individuals.

Article 2. General principles.

Clause 1. Officials and civil servants who meet the standards prescribed by the Inspection Law and these regulations shall be appointed to the position of construction inspector; The appointment to the position of construction inspector shall comply with the provisions of the Inspection Law and other relevant legal documents.

Clause 2. When performing official duties, construction inspectors, officials, and civil servants working in construction inspection agencies must wear uniforms and carry insignia, badges, signs of construction inspection agencies according to the provisions of this decision and are responsible for maintaining and preserving uniforms, insignia, badges, signs, and technical means and equipment for their tasks; if lost or damaged, they must immediately report to the direct management authority and bear full responsibility for the consequences.

Clause 3. In cases where construction inspectors, officials, and civil servants working in construction inspection agencies are transferred, retire, or are disciplined with the penalty of dismissal, they must return all insignia, badges, signs, and technical means and equipment that have been provided to the construction inspection agency or the direct management authority.

Chapter II

STANDARDS FOR CONSTRUCTION INSPECTORS, OFFICIALS, AND CIVIL SERVANTS WORKING IN CONSTRUCTION INSPECTION AGENCIES

Article 3. Standards for construction inspector officials and civil servants.

Clause 1. Officials and civil servants working in construction inspection agencies, local construction inspection teams, who have not been appointed as specialized construction inspectors, must have a degree of at least a secondary vocational education in construction or another field and have completed a course on construction laws.

Clause 2. In remote areas where there is a shortage of officials, officials and civil servants in local construction inspection teams must have a high school diploma or higher and have completed a course on construction laws.

2. In remote areas where there is a shortage of staff, members of the Construction Inspection Team must have at least a high school diploma and must have completed a course on construction law.

Article 4. Standards for Construction Inspection Officers.

Officials and civil servants, when appointed as specialized Construction Inspection Officers, must meet not only the general standards stipulated in Article 31 of the Inspection Law and other relevant legal documents but also the following requirements:

Professional qualifications and expertise:

- Must be an Architect or Engineer with a specialization in construction, having knowledge of construction laws; in cases where they have graduated from a different major at university, they must have completed a course on construction laws;

- Must have been trained in inspection procedures.

Specialized Construction Inspection Officers shall hold ranks as prescribed generally under the law on officials and civil servants.

Chapter III

||| Uniforms, Insignia, Badges, Emblems, EQUIPMENT AND TECHNICAL DEVICES OF CONSTRUCTION INSPECTION

MEANS OF TRANSPORTATION, TECHNICAL EQUIPMENT OF THE CONSTRUCTION INSPECTORATE

Article 5. Uniforms for Construction Inspection.

1. The uniforms for Construction Inspection are intended for Construction Inspection Officers, officials, and civil servants working in Construction Inspection agencies (collectively referred to as Construction Inspection Officials); these uniforms include male and female uniforms. The uniform for Construction Inspection Officials consists of trousers, shirts, kepi hats, insignias, badges, leather shoes, and other accessories.

For Construction Inspection Officials working in Inspection Teams, in addition to the aforementioned uniforms, there will be badges specific to Construction Inspection.

2. Regulations on uniforms for Construction Inspection (with attached samples):

a) Kepi hat: the top part is light beige, the brim is dark yellow, the visor and straps are made of black plastic, the edges around the top part and the brim are lined with yellow velvet, above the visor, two yellow ribbons are sewn onto the brim connecting to two buttons covered in yellow velvet.

b) Spring-Autumn shirt: made of light beige cotton fabric.

- For men: short-sleeved shirt with cuffs, stiff collar, two chest pockets with flaps, shoulder straps for badge attachment.

- For women: short-sleeved shirt with cuffs, stiff collar, two side pockets with flaps, shoulder straps for badge attachment.

c) Winter-Spring coat: made of light beige kaki fabric.

- For men: vest with four box pockets with flaps on the front, shoulder straps for badge attachment, four buttons, matching color buttons.

- For women: vest with two box pockets with flaps on the front, fitted waist, shoulder straps for badge attachment, four buttons, matching color buttons.

d) Long-sleeved shirt: made of light beige cotton fabric.

- For men: long-sleeved shirt with stiff collar.

- For women: long-sleeved shirt with stiff collar, feminine style.

e) Trousers: made of light beige kaki fabric.

- For men: long-legged trousers with moderate width, two diagonal pockets on the sides and one back pocket; suitable for all seasons.

- For women: long-legged trousers with moderate width, two straight pockets on the sides and one back pocket; suitable for all seasons. (in office settings, skirts can be worn according to office style, designed uniformly and compatible with the coats and trousers specified in points c and e of Clause 2 of this Article).

Trousers, coats, and shirts are tailored to fit each individual.

g) Tie in the same color as the trousers and shirt; brown-black leather belt; black leather shoes with low heels and laces; dark-colored socks.

3. When working in offices, Construction Inspection Officials are permitted to wear regular civilian attire.

Article 6. Emblem of Construction Inspection (with attached sample).

The emblem of Construction Inspection is the symbol of Construction Inspection. The emblem consists of two pine branches embracing a red shield, with a raised circular design in the middle including a semicircle border, below which is the inscription "Construction Inspection" in the center, flanked by two ears of rice, a scale of justice within the semicircle, and above it is a large shining star. The emblem of Construction Inspection, made of metal, is affixed on: kepi hat; shoulder straps; lapel; embroidered emblem in red felt sewn onto the shoulder sleeve.

1. Emblem affixed on the kepi hat: A metal shield-shaped emblem in red with a diameter of 45 mm inscribed within a circle.

2. Emblem affixed on the lapel: The lapel is black velvet parallelogram-shaped, long side 55 mm, short side 35 mm, with a central emblem having a diameter of 22 mm.

3. Emblem affixed on the shoulder strap: The shoulder strap is black velvet measuring 95 mm in length and 40 mm in width, bordered by yellow velvet, with two stripes of velvet in the center, and above it is a red metal emblem with a diameter of 22 mm and a silver star.

4. Emblem sewn directly onto the shoulder sleeve: An embroidered emblem in red felt, circumscribed by a circle with a diameter of 60 mm, is sewn directly onto the shoulder sleeve.

Article 7. Rank insignia of Construction Inspection (with attached sample).

The rank insignia of Construction Inspection is worn on both shoulder straps to distinguish various positions when performing duties, and is issued to Construction Inspection officers working at Construction Inspection Teams, as follows:

1. Team Leader of Construction Inspection Team: Two vertical stripes and two stars.

2. Deputy Team Leader of Construction Inspection Team; Construction Inspector: Two vertical stripes and one star.

3. Officer of Construction Inspection Team: Two vertical stripes without any stars.

Article 8. Badge of Construction Inspection (with attached sample).

The badge of Construction Inspection officers is worn on the left chest during work. The badge is made of acrylic, measuring 55mm x 85mm, with two colors: the upper part is blackish blue, 17 mm wide, and the lower part is dark blue, 38 mm wide.

1. Upper part of the badge: On the left is the emblem of Construction Inspection, in the center is the inscription "Construction Inspection" in square characters, each character being 5 mm high.

2. Lower part of the badge: The background is dark blue, 38 mm wide, with two red parallel stripes and the image of a Construction Inspection officer on the left corner. To the right are the name and position, fully stamped, in black characters, each character being 4 mm high. The badge number of Construction Inspection officers consists of six digits, each digit being 3.5 mm high, printed in black and standing upright.

The badge number consists of two groups of numbers: the province number group and the Construction Inspection officer number group.

The Director of the Department of Construction is responsible for issuing and managing badges for Construction Inspection officers under their management.

The badge of Construction Inspection officers of the Ministry of Construction is issued by the Minister of Construction.

3. Format for recording the badge number of Construction Inspection officers: The province number group consists of two digits (based on the vehicle registration code in the locality); the Construction Inspection officer number group consists of four digits separated by a hyphen.

Example:

- A Construction Inspection officer ranked 18th in the management list of the Hanoi Department of Construction would be recorded as 29-0018.

- A Construction Inspection officer ranked 26th in the management list of the Ha Tay Department of Construction would be recorded as 33-0026.

Article 9. Duration of Use of Uniforms and Equipment for Construction Inspectors.

The duration of use of uniforms, insignia, rank badges, and other equipment for Construction Inspectors shall be implemented uniformly as follows:

 

 

Article 10. Means and Technical Equipment of Construction Inspectors.

1. Depending on specific conditions of each locality, the Chairman of the People's Committee of the province or centrally governed city shall decide specifically on the provision of equipment and working means such as:

a) Office premises: All Construction Inspector units must have office premises. The scale of the office premises depends on the organization and conditions of each locality; sedan cars, cargo trucks, medium-sized trucks with cranes; two-wheeled or three-wheeled motorcycles;

b) Two-way radios, cameras, tape recorders, cameras, and supporting tools;

c) Computers, landline telephones, fax machines, cabinets, briefcases for documents, desks and chairs, pens, writing paper, photocopiers, and other office equipment;

d) Other equipment such as: specialized raincoats in trench coat style; rubber boots; flashlights; motorcycle helmets in male and female styles, yellow-orange color, with the letters TTXD painted on both sides of the helmet; safety helmets; leather briefcases; leather shoes; leather sandals; leather belts; down jackets; wool sweaters; socks; and other technical equipment as required;

e) Other technical means and equipment as required.

2. The means and technical equipment of Construction Inspectors must be equipped with insignia of Construction Inspectors.

3. The Minister of Construction decides on the provision of working means and equipment for Construction Inspectors of the Ministry of Construction.

Chapter IV

IMPLEMENTATION

Article 11. Implementation Organization.

1. Office premises, technical means, and equipment that have been provided to Construction Inspector organizations shall continue to be used and shall be supplemented by the competent authority to meet the requirements stipulated herein.

2. Construction Inspectors who have been provided uniforms, insignia, rank badges, and nameplates not in accordance with the provisions of this Decision shall continue to use them until the end of their usage period as specified in Article 9. When new equipment is provided, they must comply with the provisions of this Decision.

3. Annually, the Director of the Department of Construction must direct Construction Inspectors to develop a budget plan for purchasing uniforms, rank badges, nameplates, technical means, and equipment to serve inspection work, and submit it for approval by the competent authority./.
