PROVISIONS ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE CINEMA CIRCUS

At the proposal of the Director of the Cinema Department.

Pursuant to the Cinema Law No. 62/2006/QH11 dated June 29, 2006;
Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government on the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 185/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;
Considering the proposal of the Director of the Cinema Circus and the Head of the Cadre and Civil Servant Organization Department,

DECISION:

Article 1. Position and Functions

The Cinema Circus is an agency under the Ministry of Culture, Sports and Tourism with the function of advising the Minister to implement state management over cinema; it is entrusted by the Minister with the responsibility to direct and guide the development of the cinema industry nationwide in accordance with the Party's guidelines and state laws.

The Cinema Circus has its own seal and a bank account at the State Treasury.

Article 2. Tasks and Powers

1. Draft strategic, planning, long-term and annual plans for cinema for submission to the Minister.

2. Organize the implementation, guidance, and inspection of the enforcement of legal regulations, strategies, plans, and programs on cinema after approval; promote legal education and disseminate information on state management activities related to cinema.

3. Organize the implementation, guidance, and inspection of the enforcement of plans for state-owned units in the cinema sector after approval by the Prime Minister.

4. Regarding film production activities:

a) Develop and manage the plan for film production from the state budget;

b) Submit to the Minister for approval and revocation of decisions on the production of feature films ordered and funded by the state; permit domestic organizations and individuals to engage in joint ventures, collaborations, and services for film production with foreign entities;

c) Approve and revoke decisions on the production of video feature films, documentary films, scientific films, and animated films ordered and funded by the state;

d) Approve and revoke decisions permitting domestic organizations and individuals to engage in joint ventures, collaborations, and services for documentary, scientific, and animated film production with foreign entities;

đ) Approve and revoke certificates of eligibility for business operations in film production.

5. Regarding film distribution and storage activities:

a) Guide and inspect the importation, distribution, screening, and storage of films in accordance with regulations;

b) Approve and revoke permits for film distribution;

c) Approve and revoke decisions allowing domestic and foreign organizations and individuals to screen Vietnamese films abroad and foreign films in Vietnam without using the state budget and not for commercial purposes;

d) Issue labels for the management of audiovisual discs for film works.

6. Regarding international cooperation activities:

a) Implement international cooperation plans, integration, and international commitments on cinema;

b) Submit to the Minister for approval and revocation of decisions allowing the establishment of representative offices of foreign film institutions in Vietnam; documents approving the establishment of representative offices of Vietnamese film institutions abroad; permit organizations and individuals to organize Vietnamese film festivals, Vietnamese film days abroad, international film festivals in Vietnam, and foreign film days in Vietnam;

c) Implement the dispatch of Vietnamese films to participate in international film festivals, Vietnamese film days, and Vietnamese film weeks abroad; organize foreign film days and foreign film weeks in Vietnam according to the Minister's decision;

d) Guide the cooperation in investment and joint ventures with foreign organizations and individuals in the field of cinema in accordance with the law.

7. Organize national film festivals and screenplay competitions according to the Minister's decision.

8. Implement training and professional development plans in cinema, participate in building occupational standards and technical ranks for cadres, civil servants, and workers in the cinema sector.

9. Review and submit to the Minister programs and projects on cinema investment targets and guide inspections of their implementation in accordance with the law.

10. Coordinate in establishing operational mechanisms and fees for state-owned units and service organizations in the cinema sector and implement them after approval.

11. Develop sponsorship, procurement, bidding, and subsidized plans using the state budget and other sources for cinema activities.

12. Develop research and application plans for scientific and technological progress in the cinema sector; take the lead and coordinate with relevant agencies to submit economic and technical norms, procedures, and regulations in the cinema sector to the Minister.

13. Assist the Minister in implementing state management functions over the activities of associations and non-governmental organizations in the cinema sector in accordance with the law.

14. Guide and inspect the distribution of films through cinema chains, mobile screenings, and television broadcasts; direct and guide the implementation of television film programs.

15. Implement preventive measures against illegal activities in the cinema sector; inspect and cooperate in auditing the implementation of laws on cinema activities; inspect and cooperate in auditing the implementation of laws on cinema activities; recommend legal actions against violations according to the law.

16. Implement administrative reforms according to the program and plan of the Ministry.

17. Propose rewards and disciplinary actions for organizations and individuals involved in cinema activities according to the law.

18. Manage the organizational structure, staffing, and implement policies and systems for cadres, civil servants, employees, and workers under the jurisdiction of the Circus; manage and utilize assets, finances, and other resources assigned according to the law and the Minister's delegation.

19. Perform other tasks assigned by the Minister.

Article 3. Organizational Structure

1. Director and Deputy Directors.

2. Specialized Departments:

a) Office of the Department;

b) Art Department;

c) Economic and Technical Department;

d) Film Distribution Department;

đ) Representative Office of the Cinema Circus in Ho Chi Minh City.

3. Affiliated Organizations:

a) Saturday Cinema Center (operating under a self-financing public institution mechanism);

b) Stage Cinema Magazine.

The Director of the Cinema Department shall be responsible for specifying the specific functions and tasks of the departments and the Saturday Film Center; arranging and assigning civil servants, officials, and employees according to the appropriate job titles and professional standards; establishing and promulgating the Rules on the organizational structure and operations of the Department; submitting to the Minister for the determination of the functions and organizational structure of the Cinema Stage Magazine.

Article 4. Effectiveness

This Decision shall take effect fifteen days after its publication in the Official Gazette, replacing Decision No. 49/2004/QĐ-BVHTT dated July 5, 2004, issued by the Minister of Culture and Information regarding the functions, tasks, authorities, and organizational structure of the Cinema Department.

 Article 5. Responsibility for Implementation

The Director of the Cinema Department, the Head of the Office, the Heads of the Cadre and Civil Servant Organization Department, the Planning and Finance Department, the Heads of the Ministries' agencies and units, and related organizations and individuals are responsible for implementing this Decision./.
