CIRCULAR

Regarding the issuance of the List of Plant Protection Chemicals Permitted for Use, Restricted for Use, and Prohibited from Use in Vietnam

Pursuant to Decree No. 01/2008/ND-CP dated January 3, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development, and Decree No. 75/2009/ND-CP dated September 10, 2009, of the Government amending Article 3 of Decree No. 01/2008/ND-CP dated January 3, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 33/2005/NĐ-CP of the Government dated March 15, 2005 detailing and guiding the implementation of certain provisions of the Veterinary Law, and Decree No. 119/2008/NĐ-CP dated November 28, 2008 amending and supplementing certain provisions of Decree No. 33/2005/NĐ-CP;

Pursuant to Circular No. 38/2010/TT-BNNPTNT dated June 28, 2010, of the Ministry of Agriculture and Rural Development on the Management of Plant Protection Chemicals.

The Ministry of Agriculture and Rural Development hereby issues the List of Plant Protection Chemicals Permitted for Use, Restricted for Use, and Prohibited from Use in Vietnam as follows:

Article 1. 1. National Technical Regulation on Railway Traffic Signals, number QCVN 21:2025/BXD.

1. The List of Plant Protection Chemicals Permitted for Use in Vietnam, Appendix 1 attached includes:

a) Agricultural Products:

- Insecticides: 542 active ingredients with 1,361 trade names

- Fungicides: 374 active ingredients with 937 trade names.

- Herbicides: 169 active ingredients with 517 trade names.

- Rodenticides: 10 active ingredients with 17 trade names.

- Growth Regulators: 48 active ingredients with 126 trade names.

- Insect Attractants: 8 active ingredients with 9 brand names.

- Snailcides: 20 active ingredients with 105 trade names.

- Adjuvants (spreaders): 5 active substances with 6 trade names.

Termite Control Agents: 10 active ingredients with 12 trade names

Wood Preservatives: 5 active ingredients with 7 trade names

Warehouse Disinfectants: 5 active ingredients with 5 trade names

Chemicals for Golf Courses:

- Insecticides: 1 active substance with 1 trade name.

- Fungicides: 3 active ingredients with 3 brand names.

- Herbicides: 1 active substance with 1 trade name.

- Growth Regulators: 1 active substance with 1 trade name.

2. The List of Plant Protection Chemicals Restricted for Use in Vietnam, Appendix 2 attached includes:

Agricultural Chemicals

- Insecticides: 5 active ingredients with 10 trade names

- Rodenticides: 1 active ingredient with 3 trade names

Termite Control Agents: 2 active ingredients with 2 trade names

Wood Preservatives: 5 active ingredients with 5 trade names

Warehouse Disinfectants: 3 active ingredients with 9 trade names

3. The List of Plant Protection Chemicals Prohibited from Use in Vietnam, Appendix 3 attached includes:

a) Insecticides, Wood Preservatives: 21 active substances.

b) Fungicides: 6 active substances.

c) Rodenticides: 1 active substance.

d) Herbicides: 1 active substance.

Article 2. The export and import of plant protection chemicals under this Circular shall be carried out in accordance with Decree No. 12/2006/ND-CP dated January 23, 2006, of the Government detailing the implementation of the Law on Trade regarding international trade activities and agency buying, selling, processing, and transiting goods with foreign countries.

Article 3. The Plant Protection Department shall be responsible for guiding the use of plant protection chemicals restricted for use in Vietnam.

Article 4. This Circular shall take effect 45 days from the date of signature. It replaces Circulars No. 10/2011/TT-BNNPTNT dated March 11, 2011, No. 46/2010/TT-BNNPTNT dated July 22, 2010, and No. 24/2010/TT-BNNPTNT dated April 8, 2010, of the Ministry of Agriculture and Rural Development.

Article 5. The Director of the Plant Protection Department, the Head of the Ministry's Office, Heads of units under the Ministry, and relevant organizations and individuals are responsible for implementing this Circular./.
