Circular No. 36/2016/TT-BTTTT detailing the issuance of permits for broadcasting activities and reporting requirements for radio and television services

CIRCULAR

REGULATIONS ON THE ISSUANCE OF PERMITS FOR OPERATIONS AND REPORTING REQUIREMENTS FOR SPEECH AND TELEVISION NEWS MEDIA 

Pursuant to the Press Law dated April 5, 2016;

Based on Decree No. 132/2013/ND-CP dated October 16, 2013 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

Article 1. Amending and supplementing some articles of Circular No. 19/2016/TT-BTTTT dated June 30, 2016 of the Minister of Information and Communications on forms for registration declaration, application for license, certificate, license, and business report as prescribed in Decree No. 06/2016/NĐ-CP dated January 18, 2016 of the Government on management, provision, and use of radio and television services.

The Minister of Information and Communications issues this Circular to provide detailed regulations on the issuance of permits for operations and reporting requirements for speech and television news media. 

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular provides detailed regulations on the issuance of permits for operations for speech and television news media as stipulated in Articles 18, 19, 20, and 29 of the Press Law, and the reporting requirements for organizations and entities that have been granted permits for speech and television news media operations.

Article 2. Applicability

This Circular applies to press management agencies as defined in Clause 1, Article 14 of the Press Law (hereinafter referred to as management agencies); organizations and entities granted permits for speech and television news media operations; radio stations, television stations, and radio and television stations (hereinafter referred to as broadcasting operation organizations).

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Broadcasting Operation Permit: is the Press Operation Permit issued to broadcasting operation organizations for speech news media. This permit specifies the first radio channel of the organization granted the permit.

2. Television Operation Permit: is the Press Operation Permit issued to broadcasting operation organizations for television news media. This permit specifies the first television channel of the organization granted the permit.

Article 4. Authority to Issue Permits and Validity of Permits

1. Authority to Issue Permits

The Minister of Information and Communications issues the broadcasting operation permit and the television operation permit.

2. Validity of Permits

The broadcasting operation permit and the television operation permit become effective from the date of issuance according to Article 18 of the Press Law.

Chapter II

ISSUANCE OF PERMITS FOR SPEECH AND TELEVISION NEWS MEDIA OPERATIONS

Article 5. Documents and Procedures for Issuance of Broadcasting Operation Permit and Television Operation Permit

a) A request letter from the management agency;

b) An application form of the management agency requesting the issuance of broadcasting operation permits and television operation permits (Form No. 01 attached hereto);

c) A proposal for establishing broadcasting operation organizations approved by the management agency (Form No. 2 attached hereto);

d) A list of proposed personnel (Form No. 3 attached hereto);

đ) Legal documents of the proposed heads of broadcasting operation organizations, including: Curriculum vitae (Form No. 4 attached hereto); Certified copies of university diplomas or higher; Certified copies of valid Journalist Cards.

2. Within a maximum period of ninety days from the date of receipt of complete and valid documents, the Ministry of Information and Communications will consider issuing permits to organizations and entities (Form No. 5 attached hereto). In case of refusal, the Ministry of Information and Communications will issue a written response stating the reasons for refusal.

3. During the permit issuance processing period specified in Clause 2 of this Article, for incomplete documents, the Ministry of Information and Communications (Radio, Television, and Electronic Information Administration) will notify organizations and entities to supplement, explain, and perfect their documents.

4. Organizations and entities are responsible for submitting supplementary documents, explanations to the Ministry of Information and Communications (Radio, Television, and Electronic Information Administration) within thirty days from the date recorded on the notification letter as specified in Clause 3 of this Article.

5. Upon completion of the supplementary document submission period specified in Clause 4 of this Article, if organizations and entities fail to submit supplementary documents, the Ministry of Information and Communications (Radio, Television, and Electronic Information Administration) will terminate the processing of the documents. Submission of documents after the supplementary submission deadline will be treated as new submissions.

6. In cases where an organization requests permits for both speech and television news media operations, the management agency must prepare separate documents for each specific type of news media. Print and online news media organizations wishing to implement speech and television news media operations shall submit application documents according to the provisions of this Circular based on the Press Law.

7. Within the validity period of the broadcasting operation permit and the television operation permit issued to broadcasting operation organizations according to Circular No. 07/2011/TT-BTTTT dated March 1, 2011 of the Minister of Information and Communications, from the date this Circular takes effect, broadcasting operation organizations must complete the procedures to apply for replacement of the broadcasting operation permit and the television operation permit.

The Ministry of Information and Communications will issue replacement broadcasting operation permits and television operation permits upon receipt of complete and valid documents, including: a request letter from the organization or entity for replacement of the broadcasting operation permit and the television operation permit; an application form of the organization or entity (Form No. 01 attached hereto); approval letters from the management agency for broadcasting operation organizations of provinces, centrally-administered cities, and ministries; certified copies of the previously issued broadcasting operation permit and the television operation permit.

Article 6. Documents and procedures for changing the objectives and purposes of press activities, the objectives and purposes of radio channels and television channels as stipulated in the broadcasting operation license and the television operation license.

1. The agency or organization proposing to change the objectives and purposes of press activities, the objectives and purposes of radio channels and television channels as stipulated in the broadcasting operation license and the television operation license shall submit directly or send through the postal system one set of documents to the Ministry of Information and Communications (Radio, Television and Electronic Information Administration). The documents include:

a) A request document from the managing agency organizing provincial or centrally-administered city broadcasting and television operations or ministries and sectors. For Voice of Vietnam Radio and Vietnam Television, the request document must be signed by the head of the agency.

b) An application form of the organization operating broadcasting and television requesting to amend and supplement the contents of the broadcasting operation license and the television operation license (Form No. 6 issued together with this Circular).

c) A report on the implementation of the broadcasting operation license and the television operation license since the date of issuance (Form No. 7 issued together with this Circular).

d) A project of the organization operating broadcasting and television implementing the changed contents approved by the managing agency (Form No. 2 issued together with this Circular).

2. Within a maximum period of forty-five days from the date of receiving complete valid documents, the Ministry of Information and Communications will consider issuing the permit to the agency or organization. In case of refusal, the Ministry of Information and Communications will issue a reply document stating the reasons for refusal.

3. During the permit issuance processing period specified in Clause 2 of this Article, for incomplete documents, the Ministry of Information and Communications (Radio, Television, and Electronic Information Administration) will notify organizations and entities to supplement, explain, and perfect their documents.

4. Organizations and entities are responsible for submitting supplementary documents, explanations to the Ministry of Information and Communications (Radio, Television, and Electronic Information Administration) within thirty days from the date recorded on the notification letter as specified in Clause 3 of this Article.

5. Upon completion of the supplementary document submission period specified in Clause 4 of this Article, if organizations and entities fail to submit supplementary documents, the Ministry of Information and Communications (Radio, Television, and Electronic Information Administration) will terminate the processing of the documents. Article 7. Documents and procedures for changing the broadcasting time, the self-produced program time of radio channels and television channels as stipulated in the broadcasting operation license and the television operation license.

1. The agency or organization proposing to change the broadcasting time, the self-produced program time of radio channels and television channels as stipulated in the broadcasting operation license and the television operation license shall submit directly or send through the postal system one set of documents to the Ministry of Information and Communications (Radio, Television and Electronic Information Administration). The documents include:

a) A request document from the managing agency organizing provincial or centrally-administered city broadcasting and television operations or ministries and sectors. For Voice of Vietnam Radio and Vietnam Television, the request document must be signed by the head of the agency.

b) A report on the content of the proposed changes (Form No. 8 issued together with this Circular).

2. Within a maximum period of thirty days from the date of receiving complete valid documents, the Ministry of Information and Communications will consider issuing the permit to the agency or organization. In case of refusal, the Ministry of Information and Communications will issue a reply document stating the reasons for refusal.

3. During the permit issuance processing period specified in Clause 2 of this Article, for incomplete documents, the Ministry of Information and Communications (Radio, Television, and Electronic Information Administration) will notify organizations and entities to supplement, explain, and perfect their documents.

4. Organizations and entities are responsible for submitting supplementary documents, explanations to the Ministry of Information and Communications (Radio, Television, and Electronic Information Administration) within thirty days from the date recorded on the notification letter as specified in Clause 3 of this Article.

Documents and procedures for changing the name of the managing agency of the press; the name of the press agency; the name of the radio channel and television channel; the broadcasting location; the headquarters location linked to the central control center; the transmission and broadcasting method as stipulated in the broadcasting operation license and the television operation license.

1. The agency or organization proposing to change the name of the managing agency of the press; the name of the press agency; the name of the radio channel and television channel; the broadcasting location; the headquarters location linked to the central control center; the transmission and broadcasting method as stipulated in the broadcasting operation license and the television operation license shall submit directly or send through the postal system one set of documents to the Ministry of Information and Communications (Radio, Television and Electronic Information Administration). The documents include:

a) A request document from the managing agency organizing provincial or centrally-administered city broadcasting and television operations or ministries and sectors. For Voice of Vietnam Radio and Vietnam Television, the request document must be signed by the head of the agency.

b) Legal documents related to the cases of changing the name of the managing agency, the name of the press agency; the broadcasting location; the headquarters location linked to the central control center; the transmission and broadcasting method.

2. Within a maximum period of thirty days from the date of receiving complete valid documents according to the regulations, the Ministry of Information and Communications will consider issuing the permit to the agency or organization. In case of refusal, the Ministry of Information and Communications will issue a reply document stating the reasons for refusal.

3. During the permit issuance processing period specified in Clause 2 of this Article, for incomplete documents, the Ministry of Information and Communications (Radio, Television, and Electronic Information Administration) will notify organizations and entities to supplement, explain, and perfect their documents.

4. Organizations and entities are responsible for submitting supplementary documents, explanations to the Ministry of Information and Communications (Radio, Television, and Electronic Information Administration) within thirty days from the date recorded on the notification letter as specified in Clause 3 of this Article.

5. Upon completion of the supplementary document submission period specified in Clause 4 of this Article, if organizations and entities fail to submit supplementary documents, the Ministry of Information and Communications (Radio, Television, and Electronic Information Administration) will terminate the processing of the documents. Submission of documents after the supplementary submission deadline will be treated as new submissions.

Article 9. Documents and procedures for changing the logo of radio channels, television channels, and other contents specified in the broadcasting operation license and the television operation license.

1. The agency or organization proposing to change the logo of radio channels, television channels, and other contents specified in the broadcasting operation license and the television operation license shall submit directly or send through the postal system one set of documents to the Ministry of Information and Communications (Radio, Television and Electronic Information Department). The documents include:

a) A request document from the managing agency organizing provincial or centrally-administered city broadcasting and television operations or ministries and sectors. For Voice of Vietnam Radio and Vietnam Television, the request document must be signed by the head of the agency.

b) In case of changing the logo of radio channels, television channels, there must be a color printout of the channel logo with confirmation from the managing authority. For Voice of Vietnam Radio and Vietnam Television, the color printout of the channel logo must be signed and confirmed by the head of the agency.

2. Within a maximum period of thirty days from the date of receiving complete valid documents, the Ministry of Information and Communications will issue a written approval. In case of disapproval, the Ministry of Information and Communications will issue a written response stating the reasons.

3. During the processing time stipulated in Clause 2 of this Article, for incomplete documents, the Ministry of Information and Communications (Radio, Television and Electronic Information Department) will issue a written notice to the agency or organization regarding the need to supplement, explain, and complete the documents.

4. Organizations and entities are responsible for submitting supplementary documents, explanations to the Ministry of Information and Communications (Radio, Television, and Electronic Information Administration) within thirty days from the date recorded on the notification letter as specified in Clause 3 of this Article.

5. Upon completion of the supplementary document submission period specified in Clause 4 of this Article, if organizations and entities fail to submit supplementary documents, the Ministry of Information and Communications (Radio, Television, and Electronic Information Administration) will terminate the processing of the documents. Submission of documents after the supplementary submission deadline will be treated as new submissions.

Chapter III

REPORTING REGIME AND IMPLEMENTATION PROVISIONS

Article 10. Reporting System

1. Annually and quarterly, agencies and organizations granted the broadcasting operation license and the television operation license have the obligation to report their operational status to the Ministry of Information and Communications (Radio, Television and Electronic Information Department) (Model number 9 issued together with this Circular). The deadline for submitting reports is within ten days at the beginning of the month immediately following the quarter (for quarterly reports); ten days at the beginning of December (for annual reports).

2. In addition to regular reports, in cases of emergency, agencies and organizations granted the broadcasting operation license and the television operation license have the obligation to submit reports according to the requirements of the Ministry of Information and Communications (Radio, Television and Electronic Information Department) and the competent state management authorities at the local level where the main office or branch is located.

3. Agencies and organizations shall submit the reports stipulated in Clauses 1 and 2 of this Article in writing to the Ministry of Information and Communications (Radio, Television and Electronic Information Department) along with an electronic copy sent to the email address [email protected].

Article 11. Issuance of Forms

This Circular hereby promulgates the following forms:

1. Form Number 1. Application form for requesting issuance of broadcasting operation license/television operation license.

2. Form Number 2. Proposal for establishing an organization engaged in broadcasting/television operations.

3. Form Number 3. Comprehensive list of personnel expected to be employed by the organization engaged in broadcasting/television operations.

4. Form Number 4. Curriculum vitae of the person expected to be the head of the organization engaged in broadcasting/television operations.

5. Form Number 5. Broadcasting operation license/television operation license.

6. Form Number 6. Application form for amending and supplementing the contents of the broadcasting operation license/television operation license.

7. Form Number 7. Report on the implementation status of the broadcasting operation license/television operation license.

8. Form Number 8. Report on changes in broadcast duration and self-produced program duration of radio channels, television channels.

9. Form Number 9. Report on the operational status of broadcasting/television activities.

Article 12. Effective Date

1. This Circular takes effect from February 15, 2017, and replaces Circular No. 07/2011/TT-BTTTT dated March 1, 2011, issued by the Minister of Information and Communications detailing and guiding the issuance of licenses for press activities in the field of broadcasting and television.

2. The Director of the Office; Heads of the Legal Department; Heads of the Planning and Finance Department; Director of the Radio, Television and Electronic Information Department; Heads of agencies and units under the Ministry of Information and Communications; Managing authorities of organizations engaged in broadcasting/television operations; General Directors and Directors of organizations granted broadcasting/television operation licenses; service providers of broadcasting/television services; related organizations and individuals are responsible for implementing this Circular./.
