REGULATIONS ON ADVISORY UNITS AND INSPECTION ACTIVITIES OF AGENCIES ASSIGNED TO PERFORM INDUSTRY-SPECIFIC INSPECTION FUNCTIONS UNDER THE MINISTRY OF INFORMATION AND COMMUNICATIONS

Based on the Inspection Law dated November 15, 2010;

Pursuant to Decree No. 07/2012/ND-CP dated February 9, 2012 of the Government stipulating the agencies entrusted with the function of specialized inspection and specialized inspection activities;

Pursuant to Decree No. 140/2013/NĐ-CP dated October 22, 2013 of the Government on the organization and operation of inspection activities in information and communications;

Pursuant to Decree No. 17/2017/NĐ-CP dated February 17, 2017, issued by the Government, on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

At the proposal of the Inspector General of the Ministry of Information and Communications;

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates advisory units for industry-specific inspection work of agencies assigned to perform industry-specific inspection functions under the Ministry of Information and Communications; tasks, powers of the agency, and related agencies; trinspection functions of agencies assigned to perform industry-specific inspection functions under the Ministry of Information and Communications; inspection activities; standards, uniforms, inspection officer identification cards, and related units under the Ministry.Deputy ministers of ministerial-level agencies, in the forestry sector, this Circular takes effect from February 1, 2024.inThis Circular applies to the Inspector General of the Ministry, the Director of the Ministry's Office, the Department of Organization and Cadres, the Departments assigned to perform industry-specific inspection functions, the Directors of Regional Radio Frequency Centers (Regional Center Directors), heads of industry-specific inspection teams, members of industry-specific inspection teams, individuals assigned to perform industry-specific inspection tasks, and other agencies, organizations, and individuals related in the field of information and communications.

Article 2. Applicability

Article 3. Principles for conducting industry-specific inspection activitiesinIndustry-specific inspection activities shall be carried out in accordance with the provisions of Article 3 of Decree No. 07/2012/NĐ-CP dated February 9, 2012 of the Government on agencies assigned to perform industry-specific inspection functions and industry-specific inspection activities (hereinafter referred to as Decree No. 07/2012/NĐ-CP).inTASKS, POWERS, AND ACTIVITIES OF AGENCIES ASSIGNED TO PERFORM INDUSTRY-SPECIFIC INSPECTION FUNCTIONS IN INFORMATION AND COMMUNICATIONSinArticle 4. Advisory Units for Industry-Specific Inspection Work

1. Advisory units for industry-specific inspection work at Departments assigned industry-specific inspection functions under the Ministry of Information and Communications shall perform industry-specific inspection functions for the Department head.

2. Advisory units for industry-specific inspection work at Regional Radio Frequency Centers under the Department of Radio Frequencies shall perform industry-specific inspection functions for the Center Director.

Chapter II

3. The tasks and powers of advisory units specified in Clause 1 and Clause 2 of this Article shall be prescribed by the Department head.

Article 5. Tasks and Powers of Agencies Assigned to Perform Industry-Specific Inspection Functions

1. The tasks and powers of Departments assigned to perform industry-specific inspection functions shall be implemented in accordance with Clause 1 of Article 10 of Decree No. 07/2012/NĐ-CP.inc) Participating in assessing the conditions of food production and business establishments in the area according to the分级回复

d) Monitor, urge, and inspect the implementation of conclusions, recommendations, and decisions on inspection issued by themselves;inđ) Report to the Department of Radio Frequencies on industry-specific inspection work quarterly, semi-annually, and annually;

e) Report promptly on inspection work when requested by a superior authority;

g) Take the lead or coordinate with Provincial Departments of Information and Communications within their jurisdiction in inspection activities.

2. Tasks and authorities of the Regional Inspection Centern sNo. ||policies||

d) Monitor, urge, and inspect the implementation of conclusions, recommendations, and decisions on inspections issued by itself;

e) Report to the Frequency Management Department on specialized inspection work quarterly, every six months, and annually;

f) Submit ad hoc reports on inspection work when requested by competent authorities;shall ||

g) Lead or coordinate with the Department of Information and Communications in the area under its jurisdiction in inspection activities.

Article 6. Duties and Authorities of Heads of Agencies Assigned to Perform Specialized Inspection Functions

1. The duties and authorities of the Directors of Departments assigned to perform specialized inspection functions shall be implemented in accordance with Article 11 of Decree 07/2012/NĐ-CP.in2. The duties and authorities of the Directors of Frequency Radio Waves Regional Centers in performing specialized inspection functions

a) Leading, directing, and inspecting specialized inspection work assigned by the Department Director;

b) Assigning civil servants to carry out specialized inspection tasks;

c) Reporting to the Department Director when signs of law violations are discovered and deciding to conduct inspections upon assignment by the Department Director;

d) Proposing the Department Director to handle overlapping issues regarding scope, subjects, contents, and timeframes for inspections within their management jurisdiction;inđ) Reporting to the Inspector General of the Ministry when disagreeing with instructions or handling by the Department Director during inspection activities;ine) Proposing competent state agencies to amend, supplement, or issue regulations in line with management requirements; proposing to suspend or revoke regulations found to be contrary to the law through inspection work;

g) Administering administrative penalties in accordance with the provisions of the law.inArticle 7. Specialized Inspection Activities of Agencies Assigned to Perform Specialized Inspection Functions

1. Specialized inspection activities of Departments assigned to perform specialized inspection functions shall be carried out in accordance with the provisions of Chapter III of Decree 07/2012/NĐ-CP.in2. Specialized inspection activities of Frequency Radio Waves Regional Centers shall be conducted either in inspection teams or independently.

a) In cases where inspections are conducted in teams, they shall be carried out in accordance with the provisions from Article 16 to Article 28 of Decree 07/2012/NĐ-CP;无效 b) In cases where inspections are conducted independently, they shall be carried out in accordance with the provisions from Article 29 to Article 32 of Decree 07/2012/NĐ-CP. STANDARDS, UNIFORMS, AND BADGES OF SPECIALIZED INSPECTION CIVIL SERVANTS IN INFORMATION AND COMMUNICATIONS

Article 8. Standards for Specialized Inspection Civil Servants

A person assigned to perform specialized inspection tasks is referred to as a specialized inspection civil servant. Specialized inspection civil servants must meet the conditions stipulated in Clause 1 of Article 12 of Decree 07/2012/NĐ-CP.

Article 9. Standards for Team Leaders of Specialized Inspections

Team leaders of specialized inspections must meet the standards prescribed in this Circular and the following specific standards:No. 1. Having at least five years of professional experience in the field assigned to perform specialized inspection tasks (excluding probationary periods).

2. Holding the position of Deputy Director, Senior Specialist, or equivalent or higher.

3. Understanding laws and having relevant expertise in the field assigned to perform specialized inspection tasks.

Chapter III

4. Possessing the ability to organize, manage, and guide team members and inspection collaborators in carrying out assigned inspection tasks.

5. Having the capability to analyze and evaluate issues within the scope of management according to the assigned field.

Article 10. Uniforms for Specialized Inspection Civil ServantsDeputy ministers of ministerial-level agencies, 1. The uniforms for specialized inspection civil servants of Departments specified in this Circular include: winter coat, overcoat, spring and summer trousers, short-sleeved spring and summer shirt, long-sleeved spring and summer shirt, long-sleeved shirt, helmet, tie, leather belt, leather shoes, sandals, socks, raincoat, file case, pine branch, rank button, shoulder board, insignia.

2. When provided with uniforms for official use, specialized inspection civil servants have the responsibility to maintain and preserve them in accordance with national regulations, strictly prohibiting misuse for personal gain.

- Regarding compensation.in3. Information and Communications specialized inspection civil servants are issued identification badges once; if lost, damaged, or need replacement due to promotion, new badges will be issued.

4. If a specialized inspection civil servant in Information and Communications transfers jobs, retires, or is disciplined with dismissal, uniforms not yet expired will not be recalled; if expired and not replaced, no new ones will be issued.5. Female specialized inspection civil servants in Information and Communications can choose between spring and summer trousers, winter trousers, or spring and summer skirts, winter skirts during the year they are issued; allowed to wear civilian clothes from the third month of pregnancy until childbirth.6. Specialized inspection civil servants in Information and Communications can select either a short-sleeved or long-sleeved spring and summer shirt, and can substitute a long-sleeved shirt with a long-sleeved spring and summer shirt during the year they are issued.

7. Based on specific circumstances, the Directors of Departments assigned to perform specialized inspection functions may consider decisions to tailor uniforms for specialized inspection civil servants or provide allowances for individuals to purchase uniforms in accordance with the prescribed standards, forms, colors, and styles.

3. Understanding of laws and having expertise appropriate to the specialized inspection tasks assigned.

4. Ability to organize, manage, guide members of the inspection team and cooperating inspectors in performing assigned inspection tasks.

5. Capability to analyze and evaluate issues within the scope of management according to the assigned field.

Article 10. Uniforms for specialized inspection officials

1. The uniforms for specialized inspection officials of the Departments specified in this Circular include: winter coat, overcoat, spring-summer coat, short-sleeved spring-summer shirt, long-sleeved spring-summer shirt, long-sleeved shirt, helmet, tie, leather belt, leather shoes, backstrap sandals, socks, raincoat, file case, pine branch, rank button, shoulder board, insignia.||||

2. Article 12. Specifications and colors of male uniforms

Overcoat, winter jacket, winter pants, spring and summer pants, long-sleeved shirt, short-sleeved spring and summer shirt, long-sleeved spring and summer shirt, leather shoes, backstrap sandals are specified in Article 4 of Circular 02/2015/TT-TTCP dated March 16, 2015, issued by the Government Inspectorate regarding the uniforms of state inspectors, inspection officers, civil servants, and officials of state inspection agencies (hereinafter referred to as Circular 02/2015/TT-TTCP).

Article 13. Specifications and colors of female uniforms

Overcoat, winter jacket, winter pants, skirt, long-sleeved shirt, short-sleeved spring and summer shirt, long-sleeved spring and summer shirt, leather shoes, backstrap sandals are specified in Article 5 of Circular 02/2015/TT-TTCP.The fabric color is dark blue; the base badge is made of white plastic; the star badge is made of gold-plated metal with a shiny surface; it has a green ribbon 3mm wide; the badge shape is round with a star.

Article 14. Other uniforms provided for both males and females

1. Raincoat, tie, socks, name badge, file case, button, rank insignia button, pine branch, hat badge, helmet according to the provisions of Article 6 of Circular 02/2015/TT-TTCP (excluding peaked cap).

2. Shoulder boards, rank badges:

Shoulder boards have a length of 13 cm, the pointed end width is 4 cm, the widest part is 5 cm, the background of the rank badge is made of white fabric; the core of the rank badge is made of pure white plastic; the star of the rank badge is made of gold-plated brass with a shiny surface; there is a blue stripe 3 mm wide; the rank badge button is round with a star in the middle of two (two) pine branches. Article 15. Inspection Officer Card

1. Specialized inspection officers shall be issued an inspection officer card by the Minister of Information and Communications for use when performing inspection tasks.development Used when performing inspection tasks.

2. Specialized inspection officers are responsible for managing and using the inspection officer card in accordance with the provisions of the law.n l||Depending on the scale of housing, surveying for construction shall be conducted in accordance with the following regulations: 3. In case of loss or damage to the inspection officer card, specialized inspection officers must report to the Inspectorate Bureau to process the issuance or replacement of the card in accordance with regulations. Article 16. Model of Inspection Officer Card

1. The inspection officer card is rectangular, measuring 50mm wide and 90mm long. The content on the inspection officer card is presented in the Vietnamese Unicode font according to the Vietnamese standard TCVN 6909:2001.

Article 18. Budget for making uniforms and identification cards for specialized inspection officials

1. The budget for making uniforms for specialized inspection officials under which Directorate shall be guaranteed by the State budget allocated to that Directorate.Each year, the Directorates shall base on the number of officials entitled to receive specialized inspection uniforms, the types of inspection uniforms reaching their replacement period as prescribed, prepare the budget for making uniforms to be included in the overall budget estimate of the Directorates submitted to the Department of Planning and Finance for consolidation into the overall budget estimate of the Ministry to be approved by the competent authority and provided for the making of specialized inspection uniforms for officials.

2. The budget for making identification cards for inspection officials shall be managed and implemented by the Ministry's Office.No. 3.
