certain provisions of the Law on Fire Prevention and Combating and the Law amending and supplementing
certain provisions of the Law on Fire Prevention and Combating
Pursuant to the Law on Fire Prevention and Combating and the Law amending and supplementing certain provisions of the Law on Fire Prevention and Combating;
Pursuant to Decree No. 79/2014/NĐ-CP dated July 31, 2014 detailing the implementation of certain provisions of the Law on Fire Prevention and Combating and the Law amending and supplementing certain provisions of the Law on Fire Prevention and Combating;
On the basis of Decree No. 01/2018/ND-CP dated August 6, 2018 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;
Pursuant to the proposal of the Director of the Fire Prevention, Firefighting, and Rescue Police Department;
The Minister of Public Security issues this Circular amending and supplementing certain Articles of Circular No. 66/2014/TT-BCA dated December 16, 2014 of the Minister of Public Security detailing the implementation of certain provisions of Decree No. 79/2014/NĐ-CP dated July 31, 2014 detailing the implementation of certain provisions of the Law on Fire Prevention and Combating and the Law amending and supplementing certain provisions of the Law on Fire Prevention and Combating.
Article 1. Amending and supplementing certain Articles of Circular No. 66/2014/TT-BCA dated December 16, 2014 of the Minister of Public Security detailing the implementation of certain provisions of Decree No. 79/2014/NĐ-CP dated July 31, 2014 detailing the implementation of certain provisions of the Law on Fire Prevention and Combating and the Law amending and supplementing certain provisions of the Law on Fire Prevention and Combating (hereinafter referred to as Circular No. 66/2014/TT-BCA)
1. Deleting the following phrases: "Director of Provincial Fire Prevention and Combating Police (hereinafter referred to as Provincial Fire Prevention and Combating Police)" at Clause 4, Article 6; "Provincial Fire Prevention and Combating Police" at Point a and Point b, Clause 5, Article 7; "Director of Provincial Fire Prevention and Combating Police" at Clause 6, Article 16 and Point b, Clause 2, Article 19.
2. Amending Clause 3, Article 12 as follows:
"a) Chairman of the People's Committee of Commune, person in charge of the agency or organization approves the fire fighting plan of the facility for facilities not included in Appendix II issued together with Decree No. 79/2014/NĐ-CP within their scope of management responsibility;
b) Head of the Fire Prevention, Fire Fighting and Rescue Department of the Public Security Office of the province approves the fire fighting plan of the facility for facilities specified in Appendix II issued together with Decree No. 79/2014/NĐ-CP; the fire fighting plan of the Fire Prevention and Combating Police for facilities, residential areas within their administrative area; in special cases approved by the Director of the Public Security Office of the province;
c) Chairman of the People's Committee of the province, centrally governed city approves the fire fighting plan of the Fire Prevention and Combating Police for facilities in communes bordering two provinces, centrally governed cities and fire fighting plans mobilizing forces and equipment of the military stationed in the locality;
d) Director of the Fire Prevention, Fire Fighting and Rescue Bureau approves the fire fighting plan of the Fire Prevention and Combating Police mobilizing forces and equipment from multiple provinces, centrally governed cities."
3. Replacing the phrase "Points b, c, d, đ and e Clause 3 of this Article" at Point b, Clause 4, Article 12 with the phrase "Points b, c and d Clause 3 of this Article"; the phrase "Director of Provincial Fire Prevention and Combating Police" at Point b, Clause 5, Article 18 with the phrase "Head of the Fire Prevention, Fire Fighting and Rescue Department of the Public Security Office of the province assigned by the Ministry of Public Security to inspect fire prevention and firefighting equipment"; the phrase "Director of Provincial Fire Prevention and Combating Police" at Point c, Clause 5, Article 18 with the phrase "Head of the Fire Prevention, Fire Fighting and Rescue Department of the Public Security Office of the province".
4. Replacing the fire prevention and firefighting equipment inspection label model (Model No. PC20) issued together with Circular No. 66/2014/TT-BCA with Model No. PC20 issued together with this Circular.
Article 2. Effectiveness and responsibility for implementation
1. This Circular takes effect from the date of signature.
2. Responsibilities for implementation:
a) The Director of the Fire Prevention, Fire Fighting and Rescue Bureau is responsible for directing, inspecting, and urging the implementation of this Circular.
b) Heads of units under the Ministry of Public Security, Directors of Public Security Offices of provinces, centrally governed cities, and related organizations and individuals are responsible for implementing this Circular. In the process of implementing this Circular, if there are difficulties or obstacles, local public security agencies shall report to the Ministry of Public Security (through the Fire Prevention, Fire Fighting and Rescue Bureau) for timely guidance./.
