Circular No. 36/2020/TT-BTC stipulates the levels of collection and payment for the examination fee for granting permits for exploration, exploitation, and utilization of water resources; discharging wastewater into water sources, and groundwater drilling activities carried out by central agencies; and the fee for exploiting and using meteorological and hydrological information and data.

CIRCULAR

REGULATIONS ON THE LEVEL OF COLLECTION AND PAYMENT OF FEES FOR THE REVIEW AND ISSUE OF PERMITS FOR EXPLORATION, EXPLOITATION, USE OF WATER RESOURCES; DISCHARGING WASTEWATER INTO WATER SOURCES AND DRILLING GROUNDWATER ACTIVITIES CONDUCTED BY CENTRAL AUTHORITIES AND FEES FOR THE EXPLOITATION AND USE OF METEOROLOGICAL HYDROLOGICAL INFORMATION AND DATA

Pursuant to the Law on Fees and Charges dated November 25, 2015;

Pursuant to Decree No. 87/2017/NĐ-CP dated July 26, 2017, issued by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

At the request of the Director of the Tax Policy Department;

The Minister of Finance issues this Circular to regulate the level of collection and payment of fees for the review and issue of permits for exploration, exploitation, use of water resources; discharging wastewater into water sources and drilling groundwater activities conducted by central authorities and fees for the exploitation and use of meteorological hydrological information and data.

Article 1. Level of Collection and Payment of Fees for the Review and Issue of Permits for Exploration, Exploitation, Use of Water Resources; Discharging Wastewater into Water Sources and Drilling Groundwater Activities Conducted by Central Authorities

Organizations, individuals (including households) when submitting applications for the review and issue of permits for underground water exploration; surface water exploitation and use permits; underground water exploitation and use permits; sea water exploitation and use permits; wastewater discharge permits into water sources and drilling groundwater activities for competent state agencies shall pay the fee as follows:

1. From May 5, 2020 to December 31, 2020, pay the fee at 80% of the level specified in the Fee Collection Schedule issued together with Circular No. 270/2016/TT-BTC dated November 14, 2016, of the Minister of Finance on the level of collection and payment, management, and use of fees for the review and issue of permits for exploration, exploitation, use of water resources; discharging wastewater into water sources and drilling groundwater activities conducted by central authorities (hereinafter referred to as Circular No. 270/2016/TT-BTC).

During the effective period of this Circular, no fees for the review and issue of permits for exploration, exploitation, use of water resources; discharging wastewater into water sources and drilling groundwater activities shall be paid according to the levels specified in the Fee Collection Schedule issued together with Circular No. 270/2016/TT-BTC.

2. From January 1, 2021 onwards, pay the fee for the review and issue of permits for exploration, exploitation, use of water resources; discharging wastewater into water sources and drilling groundwater activities according to the levels specified in the Fee Collection Schedule issued together with Circular No. 270/2016/TT-BTC.

Article 2. Level of Collection and Payment of Fees for the Exploitation and Use of Meteorological Hydrological Information and Data

Organizations, individuals when requesting the National Hydro-Meteorological Center under the Ministry of Natural Resources and Environment to provide meteorological hydrological information and data must pay the fee for the exploitation and use of meteorological hydrological information and data as follows:

1. From May 5, 2020 to December 31, 2020, pay the fee at 70% of the level specified in the Fee Collection Schedule issued together with Circular No. 197/2016/TT-BTC dated November 8, 2016, of the Minister of Finance on the level of collection and payment, management, and use of fees for the exploitation and use of meteorological hydrological information and data (hereinafter referred to as Circular No. 197/2016/TT-BTC).

During the effective period of this Circular, no fees for the exploitation and use of meteorological hydrological information and data shall be paid according to the levels specified in the Fee Collection Schedule issued together with Circular No. 197/2016/TT-BTC.

The provisions on the payment of fees for the exploitation and use of meteorological hydrological information and data in this Clause shall not apply to state agencies exploiting such information and data for purposes specified in Clause 2, Article 1 of Circular No. 197/2016/TT-BTC.

2. From January 1, 2021 onwards, pay the fee for the exploitation and use of meteorological hydrological information and data according to the levels specified in the Fee Collection Schedule issued together with Circular No. 197/2016/TT-BTC.

Article 3. Effectiveness

1. This Circular takes effect from May 5, 2020 to December 31, 2020.

2. Provisions regarding the scope of regulation, applicable subjects, organization of collection, declaration, collection, payment, management, and use of fees, revenue receipt forms, publicizing the fee collection system, and other related contents not stipulated in this Circular shall be implemented in accordance with Circular No. 270/2016/TT-BTC and Circular No. 197/2016/TT-BTC.

3. During the implementation process, if there are any difficulties, organizations and individuals are requested to promptly report to the Ministry of Finance for research and supplementary guidance.
