Decree No. 17/2024/NĐ-CP stipulates the Ho Chi Minh Award and the State Award for literature and art. This Decree replaces previous Decrees and takes effect from May 20, 2024.
Scope of application
The Ministry of Culture, Sports and Tourism is responsible for organizing the implementation of this Decree. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally-run city People's Committees, and relevant agencies, organizations, and individuals must enforce this Decree.

DECREE
DETAIL REGULATIONS ON THE CONSIDERATION AND BESTOWAL OF THE "HO CHI MINH PRIZE" AND "STATE PRIZE" IN LITERATURE AND ART
Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;
Pursuant to the Law on Encouragement and Reward dated June 15, 2022;
At the proposal of the Minister of Culture, Sports and Tourism;
The Government promulgates this Decree detailing the consideration and bestowal of the "Ho Chi Minh Prize" and "State Prize" in literature and art.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree stipulates the subjects, conditions, criteria, procedures, and formalities for considering and bestowing or posthumously bestowing (hereinafter referred to as considering and bestowing) the "Ho Chi Minh Prize" and "State Prize" in literature and art.
Article 2. Applicability
This Decree applies to:
1. The author or co-authors (hereinafter referred to as the author) is a Vietnamese citizen or foreigner with works, clusters of works, projects, or clusters of projects in literature and art that meet the conditions and criteria specified in Articles 7, 8, and 9 of this Decree, in the following specialties may be proposed for consideration and bestowal of the "Ho Chi Minh Prize" or "State Prize" in literature and art:
a) Music: Works belonging to various music genres; research projects on music theory and criticism;
b) Cinema: Films belonging to film types as prescribed by the Cinema Law; research projects on cinema theory and criticism; scripts adapted into films and publicly screened;
c) Architecture: Constructed architectural works; research projects on architecture theory and criticism; urban planning schemes approved and implemented;
d) Dance: Dance productions belonging to various dance genres; research projects on dance theory and criticism; dance scripts staged and publicly performed;
đ) Fine Arts: Works belonging to various fine arts genres; research projects on fine arts theory and criticism;
e) Photography: Works belonging to various photography genres; research projects on photography theory and criticism;
g) Theater: Productions belonging to various theater genres; research projects on theater theory and criticism; scripts adapted into theatrical productions and publicly performed;
h) Literature: Works belonging to various literary genres; research projects on literary theory and criticism;
i) Folk Art: Works belonging to various folk art genres; research projects on folk art theory and criticism.
2. Organizations and individuals related to the activity of considering and bestowing the "Ho Chi Minh Prize" and "State Prize" in literature and art.
Article 3. Explanation of Terms
In this Decree, the following terms are understood as follows:
1. Literary and artistic works are products of creative activities in the field of literature and art expressed through any means or form by the author.
2. Literary and artistic projects are products of creative activities in the field of research, theory, and criticism in literature and art by the author.
3. Clusters of literary and artistic works are collections of at least two works within one specialty in literature and art by the author.
4. Clusters of literary and artistic projects are collections of at least two projects within one specialty in literature and art by the author.
5. The author is the person directly creating literary and artistic works, clusters of works, projects, or clusters of projects in literature and art.
6. Co-authors are two or more persons directly creating literary and artistic works, clusters of works, projects, or clusters of projects in literature and art.
7. Prizes include:
a) Gold Award or First Prize or A Award or Excellent Award (hereinafter referred to as the Gold Award) at national professional competitions, festivals, and exhibitions in literature and art organized by the Ministry of Culture, Sports and Tourism or professional competitions, festivals, and exhibitions in literature and art organized by central specialized literature and art associations;
b) Silver Award or Second Prize or B Award (hereinafter referred to as the Silver Award) at national professional competitions, festivals, and exhibitions in literature and art organized by the Ministry of Culture, Sports and Tourism or professional competitions, festivals, and exhibitions in literature and art organized by central specialized literature and art associations;
c) Awards at international professional competitions, festivals, and exhibitions in literature and art.
International awards are reviewed by the competent authority for artistic activities under the Ministry of Culture, Sports and Tourism, which will issue a document confirming the equivalent value of the award specified in point a and point b of this clause.
Article 4. Principles for awarding the "Ho Chi Minh Award" and the "State Award" in literature and art
1. Implement according to the provisions at points a, b, and c, Clause 2, Article 5 of the Law on Competition and Reward.
2. Works, clusters of works, projects, clusters of projects (hereinafter referred to as works or projects) in literature and art by authors can only be proposed for consideration for one specialty in literature and art.
3. Works or projects in literature and art by authors who have been awarded the "State Award" in literature and art shall not be combined with other works or projects in literature and art to propose for consideration for the "Ho Chi Minh Award" in literature and art.
4. The Councils at all levels may only submit cases that meet the conditions, criteria, procedures, formalities, and files as prescribed in this Decree for higher authorities to consider.
Article 5. Time for awarding, announcing, and organizing the presentation of the "Ho Chi Minh Award" and the "State Award" in literature and art
1. The "Ho Chi Minh Award" and the "State Award" in literature and art are awarded and announced according to the provisions at Clause 2, Article 69 and Clause 2, Article 70 of the Law on Competition and Reward.
2. The Ministry of Culture, Sports and Tourism organizes the Presentation Ceremony for the "Ho Chi Minh Award" and the "State Award" in literature and art.
Article 6. Rights and Obligations of Authors with Works or Projects in Literature and Art Awarded the "Ho Chi Minh Award" and the "State Award" in Literature and Art
1. Authors are entitled to receive the Certificate of Recognition from the President, prize money, and other benefits as stipulated by law.
2. Authors have the obligation to preserve the awarded objects; continue creative labor in literature and art to produce more valuable works or projects serving the people.
Chapter II
CONDITIONS AND CRITERIA FOR AWARDING THE "HO CHI MINH AWARD" AND THE "STATE AWARD" IN LITERATURE AND ART
Article 7. Conditions for awarding the "Ho Chi Minh Award" and the "State Award" in literature and art
1. Authors with works or projects in literature and art proposed for the "Ho Chi Minh Award" and the "State Award" in literature and art must be loyal to the country, comply well with the Party's guidelines, state policies, and laws.
2. Foreign authors with works or projects in literature and art, research on Vietnam, proposed for the "Ho Chi Minh Award" and the "State Award" in literature and art must respect Vietnam's independence, sovereignty, unity, territorial integrity, laws, and good customs and traditions.
3. Works or projects in literature and art proposed for the "Ho Chi Minh Award" and the "State Award" in literature and art must meet the following conditions:
a) Have been published, used in forms such as publishing, architecture, exhibitions, stage performances, cinema, radio, television, teaching, music discs since September 2, 1945. The time that works or projects in literature and art are published or used must be at least five years for the "Ho Chi Minh Award" and three years for the "State Award" counted from the date of submission of the application for the "Ho Chi Minh Award" or the "State Award" in literature and art to the Department of Culture, Sports and Tourism or the Department of Culture and Sports or the Central Professional Association of Literature and Art.
b) There must be no disputes over copyright from the date of publication or use, or there are disputes but they have been resolved by competent authorities at the time of submitting the application for award consideration.
Article 8. Criteria for awarding the "Ho Chi Minh Prize" in literature and art
1. Works and projects in literature and art published and used before 1993 must meet the following criteria:
a) Particularly outstanding; having very high value in literature and art, in terms of ideological content;
b) Having significant impact in serving the revolutionary cause of the Party and the nation, with wide and long-lasting influence on people's lives, making important contributions to the development of the economy and society and the development of the Vietnamese literature and art.
2. Works and projects in literature and art published and used after 1993 must meet the following criteria:
a) Particularly outstanding; having very high value in literature and art, in terms of ideological content;
b) Having significant impact in serving the revolutionary cause of the Party and the nation, with wide and long-lasting influence on people's lives, making important contributions to the development of the economy and society and the development of the Vietnamese literature and art;
c) Receiving at least one Gold Award at national-level professional competitions, festivals, and exhibitions on literature and art organized by the Ministry of Culture, Sports and Tourism, or at professional competitions, festivals, and exhibitions on literature and art organized by central specialized literature and art associations, or awards at international professional competitions, festivals, and exhibitions on literature and art;
d) Each work in a series of works or each project in a series of projects in literature and art must meet the criteria stipulated in point c of this clause;
Screenplays adapted into films and publicly screened, or screenplays staged and publicly performed, or dance scripts choreographed and publicly performed must meet the criteria stipulated in point c of this clause.
Article 9. Criteria for awarding the "State Prize" in literature and art
1. Works and projects in literature and art published and used before 1993 must meet the following criteria:
a) Having high value in ideological content and artistic form;
b) Having positive impact in education, building new individuals, enhancing the aesthetic level of the people, making significant contributions to the development of the Vietnamese literature and art;
2. Works and projects in literature and art published and used after 1993 must meet the following criteria:
a) Having high value in ideological content and artistic form;
b) Having positive impact in education, building new individuals, enhancing the aesthetic level of the people, making significant contributions to the development of the Vietnamese literature and art;
c) Receiving at least one Gold Award or one Silver Award at national-level professional competitions, festivals, and exhibitions on literature and art organized by the Ministry of Culture, Sports and Tourism, or at professional competitions, festivals, and exhibitions on literature and art organized by central specialized literature and art associations, or awards at international professional competitions, festivals, and exhibitions on literature and art;
d) Each work in a series of works or each project in a series of projects in literature and art must meet the criteria stipulated in point c of this clause;
Screenplays adapted into films and publicly screened, or screenplays staged and publicly performed, or dance scripts choreographed and publicly performed must meet the criteria stipulated in point c of this clause.
Chapter III
NATIONAL COUNCIL FOR AWARDS OF THE "HO CHI MINH PRIZE" AND "STATE PRIZE" IN LITERATURE AND ART
Article 10. Operation of the Council for Awards of the "Ho Chi Minh Prize" and "State Prize" in Literature and Art
1. The Council for Awards of the "Ho Chi Minh Prize" and "State Prize" in Literature and Art is established for each award cycle. The Council dissolves itself upon completion of its mission.
2. Levels of the Council
a) Basic-level Council;
b) National-level specialized council;
c) National-level Council.
Article 11. Local Council
1. The local council at the provincial level or centrally governed city shall be established by the Chairman of the Provincial People's Committee.
a) Number of Council members: From 07 to 09 members.
b) Composition of the Council:
Chairman of the Council: Deputy Chairman of the Provincial People's Committee;
Vice Chairmen of the Council: Representatives from the leadership of the Propaganda Department; Director or Deputy Director in charge of cultural and artistic activities of the Department of Culture, Sports and Tourism or the Department of Culture and Sports;
Council members include representatives from the Department of Home Affairs, representatives from the Association of Literature and Art or local Literature and Art Association; experts in literature and art specialties; authors who have been awarded the "Ho Chi Minh Prize" or "State Prize" for literature and art in the specialty field under consideration by the locality.
c) The Council uses the seal of the Provincial People's Committee.
d) The Department of Culture, Sports and Tourism or the Department of Culture and Sports serves as the permanent body of the Council. The permanent body of the Council may use its unit's seal for certain Council activities authorized by the Council Chairman.
đ) The Council has a Secretariat established by the Chairman of the Council.
2. The local council at the central specialized Literature and Art Association shall be established by the Chairman of the Central Specialized Literature and Art Association.
a) Number of Council members: From 07 to 09 members.
b) Composition of the Council:
The Council Chairman: Chairman of the Central Specialized Literature and Art Association. In case the Chairman of the Central Specialized Literature and Art Association has works or projects being considered for the "Ho Chi Minh Prize" or "State Prize" for literature and art, then one Vice-Chairman of the Central Specialized Literature and Art Association shall serve as the Council Chairman.
The Council Vice-Chairman: One Vice-Chairman of the Central Specialized Literature and Art Association. In case the Vice-Chairman of the Central Specialized Literature and Art Association has works or projects being considered for the "Ho Chi Minh Prize" or "State Prize" for literature and art, the Central Specialized Literature and Art Association shall report to the Ministry of Culture, Sports and Tourism to appoint a replacement.
Council members include experts in literature and art specialties; authors who have been awarded the "Ho Chi Minh Prize" or "State Prize" for literature and art in the specialty field under consideration.
c) The Council uses the seal of the Central Specialized Literature and Art Association.
d) The Council has a Secretariat established by the Chairman of the Council.
3. Principles of operation of the Council
a) Individuals with applications for consideration for the "Ho Chi Minh Prize" or "State Prize" for literature and art shall not participate in the Council.
b) The Council operates based on democratic, transparent principles and secret ballot;
c) The Council convenes a meeting when at least 90% of the Council members are present, including the Chairman of the Council or the Vice-Chairman of the Council authorized by the Chairman of the Council;
d) The Council reviews the time of publication of works or projects; the legality of works or projects; evaluates the ideological content and artistic value of each work or project proposed for the "Ho Chi Minh Prize" or "State Prize" for literature and art according to Articles 7, 8, and 9 of this Decree.
đ) The local Council only considers applications submitted in accordance with Article 14 of this Decree.
Article 12. National Specialized Council
The National Specialized Council shall be established by the Minister of Culture, Sports and Tourism for each literature and art specialty.
1. Number of Council members: From 11 to 15 members.
2. Composition of the Council:
a) Council Chairman: Representative of the leadership of the Ministry of Culture, Sports and Tourism;
b) Council Vice-Chairmen include: Heads of departments responsible for commendation and reward work within the Ministry of Culture, Sports and Tourism; Heads of departments responsible for cultural and artistic activities within the Ministry of Culture, Sports and Tourism; Chairman of the Central Specialized Literature and Art Association;
c) Council members include representatives from the Department of Cultural Arts under the Central Propaganda Commission; experts in the literature and art specialty under consideration; authors who have been awarded the "Ho Chi Minh Prize" or "State Prize" for literature and art in the specialty field under consideration.
3. Principles of operation of the Council
a) Individuals with applications for consideration for the "Ho Chi Minh Prize" or "State Prize" for literature and art shall not participate in the Council.
b) The Council operates based on democratic, transparent principles and secret ballot;
c) The Council convenes a meeting when at least 90% of the Council members are present, including the Chairman of the Council or the Vice-Chairman of the Council authorized by the Chairman of the Council;
d) The Council reviews the application files, procedures, and processes of the local Council; evaluates the ideological content and artistic value of each work or project proposed for the "Ho Chi Minh Prize" or "State Prize" for literature and art according to Articles 7, 8, and 9 of this Decree.
đ) The National Specialized Council only considers applications submitted by the local Council in accordance with the procedures, processes, and files stipulated in Articles 14 and 15 of this Decree.
4. The National Specialized Council uses the seal of the Ministry of Culture, Sports and Tourism.
5. The department responsible for commendation and reward work within the Ministry of Culture, Sports and Tourism serves as the permanent body of the Council.
6. The Council has a Secretariat established by the Council Chairman.
Article 13. National Council
The National Council shall be established by the Prime Minister upon the proposal of the Minister of Culture, Sports and Tourism.
1. Number of members of the Council: From 17 to 19 members.
2. Composition of the Council:
a) Chairman of the Council: The Minister of Culture, Sports and Tourism;
b) Vice Chairmen of the Council: The Chairman of the specialized national council; representative of the Central Propaganda Department; representative of the Ministry of Home Affairs (Head of the Central Commendation and Reward Board);
c) Members of the Council: Representative of the leadership of the Vietnam Association of Literature and Art; representative of the leadership of central specialized literature and art associations; head of the specialized department under the Ministry of Culture, Sports and Tourism responsible for commendation and reward work; representative of agencies related to the awarding process of "Ho Chi Minh Award" and "State Award" in literature and art; experts in literature and art fields; authors who have been awarded "Ho Chi Minh Award" or "State Award" in literature and art.
3. Principles of operation of the Council
a) Individuals with applications for consideration for the "Ho Chi Minh Prize" or "State Prize" for literature and art shall not participate in the Council.
b) The Council operates based on democratic, transparent principles and secret ballot;
c) The Council convenes a meeting when at least 90% of the Council members are present, including the Chairman of the Council or the Vice-Chairman of the Council authorized by the Chairman of the Council;
d) The Council examines the files, procedures, and processes of the specialized national council for awarding; evaluates the ideological content and artistic value of each literary and artistic work or project proposed for "Ho Chi Minh Award" or "State Award" in literature and art according to Articles 7, 8, and 9 of this Decree;
đ) The National Council only considers files submitted by the specialized national council in accordance with the procedures and files stipulated in Articles 14 and 16 of this Decree.
4. The Ministry of Culture, Sports and Tourism is the permanent body of the Council.
5. The National Council uses the seal of the Ministry of Culture, Sports and Tourism.
6. The Council has a Secretariat established by the Council Chairman.
Chapter IV
FILES, PROCEDURES, AND PROCESSES FOR AWARDS OF "HO CHI MINH AWARD", "STATE AWARD" IN LITERATURE AND ART
Article 14. Files, methods of submitting files, and receiving bodies for applications to award "Ho Chi Minh Award" and "State Award" in literature and art
1. The file for applying for "Ho Chi Minh Award" or "State Award" in literature and art includes:
a) Application form for literary and artistic works or projects proposed for "Ho Chi Minh Award" or "State Award" in literature and art according to Model 1a or Model 1b attached to this Decree;
b) Copies or photographs of the literary and artistic works or projects proposed for "Ho Chi Minh Award" or "State Award" in literature and art, along with basic information about the year and month of publication or use; summary of the content of the literary and artistic works or projects;
c) Copies from the original book or certified copies or copies and presentation of the original for verification (in case of direct submission); copies from the original book or certified copies (in case of submission through postal service or online) of decisions on awarding prizes or prize certificates for literary and artistic works or projects as specified in point c, Clause 2, Article 8 or point c, Clause 2, Article 9 of this Decree;
d) Literary and artistic works or projects of foreign authors using foreign languages must include a Vietnamese translation (original);
đ) For joint-authored literary and artistic works or projects, there must be a power of attorney for the representative to submit the application for "Ho Chi Minh Award" or "State Award" in literature and art and an agreement on ownership and copyright in accordance with the law;
e) For deceased authors' literary and artistic works or projects, there must be an agreement and authorization letter from those with legitimate rights to represent the author in submitting the application for "Ho Chi Minh Award" or "State Award" in literature and art;
g) Other relevant documents concerning the literary and artistic works or projects (if any).
2. Authors of literary and artistic works or projects or their legal representatives submit one set of files directly or through postal service or online to the Department of Culture, Sports and Tourism or the Department of Culture and Sports where the author resides.
3. Authors or their legal representatives (in case the author is a member of an association) submit one set of files directly or through postal service to the Central Specialized Literature and Art Association.
4. Foreign authors with literary and artistic works or projects proposed for "Ho Chi Minh Award" or "State Award" in literature and art submit one set of files directly or through postal service or online to the Central Specialized Literature and Art Association.
5. In cases where the application files for "Ho Chi Minh Award" or "State Award" in literature and art are not valid and require supplementation or correction: The receiving body guides the author or legal representative to complete the files. Within seven days from the date of receiving the files back, the author submits the completed files to the receiving body.
Article 15. Procedure and formalities for awarding the "Ho Chi Minh Award" and the "State Award" for literature and art at the grassroots Council
1. Publicize the list of authors with works and projects in literature and art proposed for the "Ho Chi Minh Award" and the "State Award" for literature and art on communication means under its management authority: the official website or industry/local newspapers for a period of 10 days from the end date of the deadline for authors to submit their applications as prescribed to solicit public opinions.
2. Receive and process public recommendations within 15 days from the end date of the publicizing period of the list of authors with works and projects in literature and art proposed for the "Ho Chi Minh Award" and the "State Award" for literature and art on communication means under its management authority: the official website or industry/local newspapers.
3. Examine, discuss, and evaluate each work and project in literature and art proposed for the "Ho Chi Minh Award" or the "State Award" for literature and art according to Articles 7, 8, and 9 of this Decree within 15 days from the date the Council's permanent office reports to seek opinions from Council members regarding the application files.
4. Within 10 days from the end of the meeting, the Council is responsible for notifying in writing the results of the awarding process to the authors with works and projects in literature and art proposed for the "Ho Chi Minh Award" or the "State Award" for literature and art.
5. Receive and process public comments within twenty days from the date of the Council's notification of the results of the consideration.
6. Within 10 days from the end date of the recommendation processing period, upon completion of the application file for the "Ho Chi Minh Award" or the "State Award" for literature and art that receives at least 80% approval votes from the total number of Council members present at the meeting, send it to the permanent office of the national specialized Council. The file (one set), including:
a) A proposal for awarding the "Ho Chi Minh Award" or the "State Award" for literature and art according to Model No. 2a or Model No. 2b attached to this Decree;
b) An abstract of the work or project in literature and art proposed for the "Ho Chi Minh Award" or the "State Award" for literature and art according to Model No. 3a or Model No. 3b attached to this Decree;
c) Minutes of the Council meeting for awarding the "Ho Chi Minh Award" or the "State Award" for literature and art according to Model No. 4a or Model No. 4b attached to this Decree;
d) Minutes of the ballot counting for selecting works and projects proposed for the "Ho Chi Minh Award" or the "State Award" for literature and art according to Model No. 5a or Model No. 5b attached to this Decree;
đ) Report on the awarding process of the "Ho Chi Minh Award" or the "State Award" for literature and art according to Model No. 6a or Model No. 6b attached to this Decree;
e) Decision on establishing the grassroots Council;
g) File as stipulated in Clause 1 of Article 14 of this Decree.
7. The duration of organizing the awarding activities for the "Ho Chi Minh Award" and the "State Award" for literature and art at the grassroots Council shall not exceed 80 days.
Article 16. Procedure and formalities for awarding the "Ho Chi Minh Award" and the "State Award" in literature and art at the specialized State Council
1. Publicize the list of authors with works and projects in literature and art proposed for consideration for the "Ho Chi Minh Award" and the "State Award" in literature and art on the Ministry of Culture, Sports and Tourism's electronic portal for 15 days from the end date of the submission period set by the basic-level Council.
2. Receive and process public comments within 15 days from the end date of the publicizing of the list of authors with works and projects in literature and art proposed for consideration for the "Ho Chi Minh Award" and the "State Award" in literature and art on the Ministry of Culture, Sports and Tourism's electronic portal.
3. Examine, discuss, and evaluate each work and project in literature and art proposed for consideration for the "Ho Chi Minh Award" or the "State Award" in literature and art according to Articles 7, 8, and 9 of this Decree within 20 days from the date the Council's permanent office reports to the Council members for their opinions on the files.
4. Within 15 days from the end date of the meetings of the Councils, the permanent office shall be responsible for notifying in writing the results of the awarding of the "Ho Chi Minh Award" and the "State Award" in literature and art of the specialized State Councils to the basic-level Councils.
Within 05 days from the date the basic-level Council receives the notification of the results of the State Council, the permanent office of the basic-level Council shall be responsible for notifying in writing the authors who have submitted applications for consideration for the "Ho Chi Minh Award" or the "State Award" in literature and art.
5. Receive and process public comments within 20 days from the date of the notification of the results of the awarding by the Councils.
6. Within 20 days from the end date of the public comment receipt and processing period, complete the file for consideration for the "Ho Chi Minh Award" or the "State Award" in literature and art that has received at least 80% approval votes from the total number of Council members present at the meeting, and submit it to the permanent office of the State Council. The file (one copy) includes:
a) Documents stipulated in points a, b, c, d, đ, and g of Clause 6 of Article 15 of this Decree;
b) Decision establishing the specialized State Council.
7. The time for organizing the awarding of the "Ho Chi Minh Award" and the "State Award" in literature and art at the specialized State Council shall not exceed 115 days.
Article 17. Procedure and formalities for awarding the "Ho Chi Minh Award" and the "State Award" in literature and art at the State Council
1. Publicize the list of authors with works and projects in literature and art proposed for consideration for the "Ho Chi Minh Award" and the "State Award" in literature and art on the Government's electronic portal and the Ministry of Culture, Sports and Tourism's electronic portal for 15 days to solicit public opinion, from the end date of the submission period set by the specialized State Council.
2. Receive and process public comments within 15 days from the end date of the publicizing of the list of authors with works and projects in literature and art proposed for consideration for the "Ho Chi Minh Award" and the "State Award" in literature and art on the Government's and the Ministry of Culture, Sports and Tourism's electronic portals.
3. Examine, discuss, and evaluate each work and project in literature and art proposed for the "Ho Chi Minh Award" or the "State Award" for literature and art according to Articles 7, 8, and 9 of this Decree within 15 days from the date the Council's permanent office reports to seek opinions from Council members regarding the application files.
4. Within 15 days from the end date of the Council meeting, the permanent office shall be responsible for notifying in writing the results of the awarding of the "Ho Chi Minh Award" and the "State Award" in literature and art of the State Council to the basic-level Council.
Within 05 days from the date the basic-level Council receives the notification of the results of the State Council, the permanent office of the basic-level Council shall be responsible for notifying in writing the authors who have submitted applications for consideration for the "Ho Chi Minh Award" or the "State Award" in literature and art.
5. Receive and process public comments within twenty days from the date of the Council's notification of the results of the consideration.
6. Within 20 days from the end date of the public comment receipt and processing period, complete the file for consideration for the "Ho Chi Minh Award" or the "State Award" in literature and art that has received at least 80% approval votes from the total number of Council members present at the meeting, and submit it to the Ministry of Home Affairs (Central Steering Committee for Commendation and Reward) for consolidation and submission to the Prime Minister. The file (one copy) includes:
a) Documents stipulated in points a, b, c, d, and đ of Clause 6 of Article 15 of this Decree;
b) Decision establishing the State Council.
7. The time for organizing the awarding of the "Ho Chi Minh Award" and the "State Award" in literature and art at the State Council shall not exceed 110 days.
Chapter V
IMPLEMENTING PROVISIONS
Article 18. Effective Date
1. This Decree takes effect from May 20, 2024.
2. Decree No. 90/2014/NĐ-CP dated September 29, 2014 of the Government on the "Ho Chi Minh Award" and the "State Award" in literature and art, and Decree No. 133/2018/NĐ-CP dated October 1, 2018 amending and supplementing certain articles of Decree No. 90/2014/NĐ-CP dated September 29, 2014 of the Government on the "Ho Chi Minh Award" and the "State Award" in literature and art shall cease to be effective from the date this Decree takes effect.
Article 19. Responsibility for Implementation
1. The Ministry of Culture, Sports and Tourism shall be responsible for organizing the implementation of this Decree.
2. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial and centrally-run city People's Committees, relevant agencies, organizations, and individuals shall be responsible for implementing this Decree./.
