REGULATIONS ON HEALTH STANDARDS, MEDICAL EXAMINATIONS FOR DRIVERS AND OPERATORS OF SPECIALIZED MOTORCYCLES; PERIODIC MEDICAL EXAMINATIONS FOR PROFESSIONAL TRUCK DRIVERS; HEALTH DATABASE FOR DRIVERS AND OPERATORS OF SPECIALIZED MOTORCYCLES
BASED ON THE ROAD TRAFFIC ORDER AND SAFETY LAW dated June 27, 2024;
Pursuant to Decree No. 95/2022/NĐ-CP dated November 15, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
At the proposal of the Director of the Department of Medical Examination and Treatment;
The Minister of Health issues this Circular to regulate health standards, medical examinations for drivers and operators of specialized motorcycles; periodic medical examinations for professional truck drivers; and the health database for drivers and operators of specialized motorcycles.
Article 1. Scope of Regulation
Article 1. This Circular regulates health standards, medical examinations for drivers and operators of specialized motorcycles; periodic medical examinations for professional truck drivers; and the health database for drivers and operators of specialized motorcycles.
Article 2. This Circular does not apply to motorcycle riders.
Article 2. Health Standards for Drivers and Operators of Specialized Motorcycles
Clause 1. Health standards for drivers and operators of specialized motorcycles are specified in Appendix I attached hereto.
Clause 2. Health standards for drivers and operators of specialized motorcycles are divided into three groups as follows:
a) Group 1: Applies to cases where medical examinations are conducted to issue driving licenses for category A1, B1, and operators of specialized motorcycles.
b) Group 2: Applies to cases where medical examinations are conducted to issue driving licenses for categories A and B.
c) Group 3: Applies to cases where medical examinations are conducted to issue driving licenses for categories C1, C, D1, D2, D, BE, C1E, CE, D1E, D2E AND DE.
Clause 3. Individuals holding driving licenses issued before January 1, 2025 who wish to exchange or reissue their driving license from category A1 to category A according to point a, Clause 3, Article 89 of the Road Traffic Safety Law shall undergo medical examination based on Group 1 health standards.
Clause 4. Medical examinations for individuals with disabilities applying for driving licenses for category A1 or category B according to Clause 2, Article 57 of the Road Traffic Safety Law shall be conducted based on the health standards specified in Appendix I attached hereto, but without requiring a specialist orthopedic examination.
Article 3. Medical Examinations for Drivers and Operators of Specialized Motorcycles; Periodic Medical Examinations for Professional Truck Drivers
Clause 1. The process of medical examinations for drivers and operators of specialized motorcycles and periodic medical examinations for professional truck drivers shall be carried out in accordance with the provisions of Article 35 of Circular No. 32/2023/TT-BYT dated December 31, 2023, issued by the Minister of Health detailing certain provisions of the Law on Medical Examination and Treatment (hereinafter referred to as Circular No. 32/2023/TT-BYT).
Clause 2. The content of medical examinations for drivers and operators of specialized motorcycles is stipulated in Appendix II attached hereto.
Clause 3. The content of periodic medical examinations for professional truck drivers:
a) As stipulated in Clause 3, Article 36 of Circular No. 32/2023/TT-BYT; for mental health examinations, follow the provisions at Section 1, Part II of Appendix II attached hereto;
b) For female professional truck drivers undergoing periodic medical examinations, conduct gynecological examinations as stipulated in Clause 4, Article 36 of Circular No. 32/2023/TT-BYT;
c) Drug testing and alcohol concentration testing.
Clause 4. Issuance and retention of medical examination certificates for drivers and operators of specialized motorcycles; periodic medical examination books for professional truck drivers shall be carried out in accordance with the provisions of Article 38 of Circular No. 32/2023/TT-BYT.
Article 4. Health examination files
1. The health examination file for drivers and operators of specialized motorcycles shall be carried out according to the model prescribed in Appendix II attached to this Circular.
2. Periodic health examination files for drivers of motor vehicles:
a) Shall be implemented according to the model prescribed at point a, Clause 4, Article 34 of Circular No. 32/2023/TT-BYT.
b) Shall supplement the category of driving license into item 7 (occupation).
Article 5. Database on the health status of drivers and operators of specialized motorcycles
The structure of the health examination result data for drivers and operators of specialized motorcycles includes the following information:
1. Administrative Section: Information as prescribed in Decision No. 06/QĐ-TTg dated January 6, 2022.
2. Name of the medical facility conducting the health examination for drivers and operators of specialized motorcycles; periodic health examination for drivers; date of health examination.
3. Drug test results.
4. Conclusion on health status.
Article 6. Costs for health examinations for drivers
The costs for health examinations for drivers and operators of specialized motorcycles shall be implemented according to the provisions of Article 33 of Circular No. 32/2023/TT-BYT.
Article 7. Effective Date
1. This Circular takes effect from January 1, 2025.
2. Circular Joint Circular No. 24/2015/TTLT-BYT-BGTVT dated August 28, 2015 of the Minister of Health and the Minister of Transport regarding the health standards for drivers, the regular health examination for drivers of passenger cars, and the regulations on medical facilities conducting health examinations for drivers shall cease to be effective from the date this Circular takes effect.
Article 8. Reference Provisions
Where referenced documents in this Circular are replaced or amended, implementation shall be in accordance with the replacing or amending documents.
Article 9. Transitional Provisions
1. Health examination certificates and periodic health examination books issued to drivers before the date this Circular takes effect shall continue to be used within the validity period stated on the health examination certificate and periodic health examination book of the driver as prescribed in Joint Circular No. 24/2015/TTLT-BYT-BGTVT dated August 28, 2015 of the Minister of Health and the Minister of Transport regarding the health standards for drivers, the regular health examination for drivers of passenger cars, and the regulations on medical facilities conducting health examinations for drivers.
2. The health examination certificate model for drivers issued in Joint Circular No. 24/2015/TTLT-BYT-BGTVT dated August 28, 2015 of the Minister of Health and the Minister of Transport regarding the health standards for drivers, the regular health examination for drivers of passenger cars, and the regulations on medical facilities conducting health examinations for drivers, the printed version, shall continue to be used and must comply with the instructions prescribed in Appendix II attached to this Circular. In cases where new health examination certificates are printed, they must comply with the model prescribed in Appendix II attached to this Circular.
3. The periodic health examination book model for drivers issued in Joint Circular No. 24/2015/TTLT-BYT-BGTVT dated August 28, 2015 of the Minister of Health and the Minister of Transport regarding the health standards for drivers, the regular health examination for drivers of passenger cars, and the regulations on medical facilities conducting health examinations for drivers, the printed version, shall continue to be used until June 30, 2025, and must include additional information as prescribed in Clause 3, Article 36 of Circular No. 32/2023/TT-BYT.
4. Medical facilities conducting health examinations for drivers prior to the date this Circular takes effect shall continue to conduct such examinations without having to reannounce their qualifications, except in cases as prescribed at point c, Clause 2, Article 69 of Decree No. 96/2023/NĐ-CP dated December 30, 2023 of the Government detailing certain provisions of the Law on Medical Examination and Treatment.
5. Medical facilities conducting periodic health examinations for drivers prior to the date this Circular takes effect:
a) In cases where they have announced their qualification to conduct periodic health examinations for drivers prior to the date this Circular takes effect: they may continue to conduct periodic health examinations for drivers of passenger cars as prescribed in this Circular.
b) In cases where they lack the conditions to conduct oral and maxillofacial surgery, dermatology, and general surgery specialties, they may enter into contracts with other medical facilities to conduct these specialties. From January 1, 2026, the facility must meet the conditions prescribed in this Circular.
Article 10. Implementation Organization
1. The Department of Medical Examination and Treatment shall take the lead and coordinate with relevant agencies and organizations to direct, inspect, review, and summarize the implementation of this Circular nationwide.
2. Provincial Departments of Health under the central government; Health Ministries and sectors:
a) Shall direct, guide, inspect, audit, review, and summarize the implementation of this Circular within their jurisdictional authority.
b) Shall compile health examination data for drivers of passenger cars within their jurisdiction and submit it to the Ministry of Health (Department of Medical Examination and Treatment) annually.
3. Medical facilities shall be responsible for:
a) Reporting health examination activities for drivers and operators of specialized motorcycles; periodic health examinations for drivers of passenger cars to the competent management agency.
b) Implementing the connection and sharing of health examination data with the database on road traffic order and safety and other databases as prescribed by law. During the implementation process, if there are difficulties or obstacles, agencies, organizations, and individuals shall promptly report to the Ministry of Health (Department of Medical Examination and Treatment) for consideration and resolution./.
