DECREE

Regulations on functions, tasks, powers and organizational structure of the Government Office

Pursuant to the Law on the Organization of the Government dated18 the 02 Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, procurement or tendering for the supply of products and services using state budget from regular operating expenses;25;

At the proposal of the Minister, Head of the Government Office;

The Government promulgates this Decree stipulating the functions, tasks, powers and organizational structure of the Government Office.

Article 1. Position and Functions

The Government Office is a ministry-level agency under the Government, serving as the machinery assisting the Government and the Prime Minister (including Deputy Prime Ministers).

The Government Office has the function of providing comprehensive advice and coordinating to assist the Government and the Prime Minister in organizing the common activities of the Government, leading, directing, and managing the operations of the Government and the state administrative system from central to grassroots levels, ensuring unity, smoothness, and continuity in the national administrative system; supervising administrative procedures; ensuring information for the leadership, direction, and management work of the Government and the Prime Minister according to the provisions of the law; and providing information to the public as prescribed by law; ensuring material, technical, and logistical conditions for the operations of the Government and the Prime Minister.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

The Government Office performs the tasks and powers stipulated in the Law on the Organization of the Government, the regulations of the Government on the functions, tasks, powers, and organizational structure of ministries and equivalent agencies, and the following specific tasks and powers:

1. Providing comprehensive advice and coordinating to assist the Government

a) Taking the lead in drafting and managing the Government's work program in accordance with the law; monitoring, urging ministries, equivalent agencies, and government-affiliated agencies (hereinafter referred to as ministries and sectors), provincial People's Committees, and related organizations to implement the Government's work program and the Government's Rules of Procedure; summarizing, urging, inspecting, evaluating the situation and results of implementation, and reporting to the Government;

b) Cooperating with ministries and sectors, provincial People's Committees, and related organizations during the preparation and completion of projects, draft regulatory documents, and other items to be submitted to the Government for consideration and decision-making as prescribed by law;

c) Taking the lead in reviewing the procedural steps, authority, responsibility for handling, and providing comprehensive advice on the content; independently commenting on projects, draft regulatory documents, reports, and other matters included in the Government's work program and other items submitted by ministries and sectors, provincial People's Committees, and related organizations to the Government;

d) Taking the lead and cooperating with ministries and sectors, provincial People's Committees, and related organizations in preparing content and serving sessions of the Government and Government conferences;

đ) Advising the Government in its working relations with Party agencies, the National Assembly, the Standing Committee of the National Assembly, the President, the Central Committee of the Vietnam Fatherland Front, and central agencies of political-social organizations, the Supreme People's Court, and the Supreme People's Procuracy;

e) Taking the lead in drafting projects, plans, draft regulatory documents, and reports when assigned by the Government.

2. Providing comprehensive advice and coordinating to assist the Prime Minister

a) Taking the lead in drafting and managing the Prime Minister's work program in accordance with the law; monitoring, urging, inspecting, summarizing, evaluating, and reporting on the situation and results of implementing the Prime Minister's work program; advising the Prime Minister on key tasks that need focused leadership, direction, and management at certain times, especially urgent and unexpected issues arising in all fields;

b) Taking the lead in reviewing the procedural steps, authority, responsibility for handling, and providing comprehensive advice on the content; independently commenting on projects, draft regulatory documents, reports, and other matters included in the Prime Minister's work program and other items submitted by ministries and sectors, provincial People's Committees, and related organizations to the Prime Minister;

c) Taking the lead and cooperating with ministries and sectors, provincial People's Committees, and related organizations in completing content, procedures, files, and draft documents to be submitted to the Prime Minister for consideration and decision-making regarding regular matters submitted by ministries and sectors, provincial People's Committees, and related organizations;

d) Assisting the Prime Minister in coordinating the activities of ministries and sectors, provincial People's Committees in formulating and enforcing policies and laws; and the activities of inter-ministerial coordination organizations headed by the Prime Minister as prescribed by law;

đ) Advising the Government and the Prime Minister to assign ministries and sectors, provincial People's Committees, and related organizations to develop mechanisms, policies, projects, plans, and draft regulatory documents to be submitted to competent authorities for decision-making; or proactively researching and proposing mechanisms and policies to be submitted to the Government and the Prime Minister for consideration and decision-making;

e) In cases where there are differing opinions on issues submitted to the Government and the Prime Minister, the Government Office promptly proposes effective solutions and convenes meetings immediately with the heads of ministries and sectors, provincial People's Committees, and related organizations under the chairmanship of the Deputy Prime Minister responsible for resolving differences and clarifying issues before submitting them to the Government and the Prime Minister;

g) Taking the lead and cooperating with ministries and sectors, provincial People's Committees, and related organizations in drafting reports on the Government's and Prime Minister's work, responses to inquiries, and explanations to be presented to the National Assembly, the Standing Committee of the National Assembly, the President, competent agencies, and the people as directed by the Prime Minister;

h) Chair the drafting and editing of articles, speeches, press interviews, materials (including both paper and video materials) serving the Prime Minister and other reports, documents, directives according to the Prime Minister's instructions; edit, supplement, and complete after the Prime Minister has made a statement or given comments; simultaneously implement long-term storage in accordance with the Party and State regulations;

i) Assist the Prime Minister in monitoring, urging, and inspecting the implementation of tasks assigned by the Government and the Prime Minister to ministries, sectors, provincial People's Committees, related agencies and organizations; propose necessary measures to urge implementation, address existing issues and limitations, ensure administrative discipline and effectiveness of state management to the Prime Minister;

k) Chair and coordinate with ministries, sectors, provincial People's Committees, related agencies and organizations to prepare detailed, practical, concise contents with clear focus, but also clearly defined individuals, tasks, timeframes, products, and responsibilities to serve meetings, working sessions, and local visits of the Prime Minister;

l) Attend meetings and conferences of ministries, sectors, People's Councils, provincial People's Committees, and related agencies; request ministries, sectors, provincial People's Committees, and related agencies to provide relevant documents, data, and reports on the implementation of tasks assigned by the Government and the Prime Minister; participate in inter-ministerial coordination organizations led by the Prime Minister as prescribed; proactively work with ministries, sectors, provincial People's Committees, and related agencies to understand the situation for leadership, guidance, and management by the Government and the Prime Minister;

m) Return immediately to the sender and specify the reasons, or transfer the dossier to the competent authority for resolution if the dossier is incomplete, not in accordance with procedures, regulations, or beyond the jurisdiction of the Government and the Prime Minister, or if the agency submitting the dossier does not clearly propose solutions or tasks for resolution; report this to the Prime Minister at the same time;

n) Chair the development of projects, draft regulatory legal documents, and other documents when instructed by the Prime Minister;

3. On administrative procedure control;

a) Guide, monitor, urge, and inspect the implementation of administrative procedure control by ministries, sectors, provincial People's Committees; compile the situation and results, report to the Government and the Prime Minister;

b) Chair the implementation of tasks to reform administrative procedures and the single window mechanism in handling administrative procedures at state administrative agencies; communication activities on administrative procedure reform;

c) Propose the Government and the Prime Minister to assign ministries, sectors, provincial People's Committees to study and propose or take the initiative to study and propose policies, solutions, and innovations for administrative procedure reform and related regulations; evaluate and handle the results of administrative procedure reviews according to the law;

d) Chair and actively cooperate with ministries, sectors, provincial People's Committees, and related agencies to promptly build, manage, and operate the National Database on Administrative Procedures and the National Public Service Portal; organize the implementation of tasks assigned by the Government and the Prime Minister;

đ) Receive and promptly process reflections and proposals from organizations and individuals regarding administrative regulations within the management scope of the Government, the Prime Minister, and state administrative agencies according to the law;

e) Fully and effectively perform the permanent advisory council's tasks on administrative procedure reform;

4. On ensuring information to serve the Government and Prime Minister's leadership, guidance, and management;

a) Implement daily, periodic, special topic, and urgent reporting systems as prescribed and other reports as required by the Government and the Prime Minister;

b) Receive information from ministries, sectors, provincial People's Committees, agencies, organizations, and individuals about the Government and Prime Minister's leadership, guidance, and management; proactively follow up, coordinate, and grasp real situations to timely advise and propose the Government and the Prime Minister to consider and direct prompt handling of urgent, prominent, and pressing issues of public concern;

c) Provide information to members of the Government, heads of government agencies, chairpersons of provincial People's Councils, provincial People's Committees, Party and State agencies, and related organizations about the country's economic and social situation and the Government and Prime Minister's leadership, guidance, and management according to regulations; promptly grasp and reflect public opinion and media reports related to leadership, guidance, and management by the Government and its members accurately to relevant Government members;

d) Chair and coordinate with ministries, sectors, provincial People's Committees, and related agencies to develop, manage, and operate information systems and databases assigned by the Government and the Prime Minister; connect, integrate, and share information between the Government Office and ministries, sectors, provincial People's Committees to serve the Government and Prime Minister's leadership, guidance, and management according to the law;

đ) Chair guiding and urging ministries, sectors, and provincial People's Committees in sending and receiving electronic documents; handling administrative procedures in the electronic environment; implementing reporting systems to support the Government and Prime Minister's guidance and management according to regulations;

5. On providing information to the public;

a) Provide information to the public about major activities, important decisions in the Government and Prime Minister's leadership, guidance, and management, significant political, economic, and social events, and other information as prescribed by law and directed by the Prime Minister;

b) Perform the Government and Prime Minister's spokesperson duties.

c) Chair and coordinate with ministries, sectors, provincial People's Committees, related agencies, and organizations to organize press conferences of the Government, provide regular and ad hoc information to the media; advise on interviews with the Prime Minister; implement press releases in accordance with the law.

d) Chair and proactively request relevant agencies to correct, and news agencies to amend inaccurate or unsuitable content with leadership, guidance, and management requirements of the Government and the Prime Minister as stipulated by law.

đ) Implement state management over the Official Gazette; organize management, publication, and distribution of the Official Gazette of the Socialist Republic of Vietnam in accordance with the law.

e) Manage the organization and activities of the Government Electronic Information Portal to reflect and provide timely, comprehensive, accurate, and effective information.

6. Ensure material, technical, and logistical conditions for the operations of the Government and the Prime Minister as prescribed by the Party and the State.

7. Draft and promulgate legal regulatory documents and other documents within the authority of the Government Office as prescribed by law.

8. Carry out the task of inspecting documents and handling documents that violate the law according to the authority and provisions of the law.

9. Organize the timely receipt and processing of documents submitted to the Government and the Prime Minister by ministries, sectors, provincial People's Committees, related agencies, organizations, and individuals in accordance with regulations and directives from the Prime Minister; issue and manage documents of the Government and the Prime Minister; build, manage, and operate the electronic document storage system at the Government Office as prescribed by law.

10. Strictly and effectively perform inspection, supervision, urging, receiving citizens, resolving complaints and denunciations; prevent and combat corruption, thrift, and waste in accordance with the law.

11. Summarize and guide professional and vocational work of office operations for the offices of ministries, sectors, and provincial People's Committees.

12. Regarding civil servants

a) Civil servants of the Government Office must be individuals with good political qualities and morals, high professional expertise, understanding of the assigned fields and areas, and special incentives, policies, and rewards as prescribed.

b) The Government Office may proactively propose priority transfer, rotation, and assignment of civil servants from ministries, sectors, agencies, and localities to work at the Government Office and vice versa according to its authority and the Prime Minister's regulations and laws. Ministries, sectors, agencies, and localities have the responsibility to prioritize transfers, rotations, and assignments of civil servants according to the Government Office's proposals.

13. Manage organizational structure, civil servant quota, number of employees, job positions; decide on recruitment, utilization, management, and implementation of other policies and systems for cadres, civil servants, and officials under its management as prescribed.

14. Decide and organize the implementation of programs and plans for administrative reform, information technology application, digital transformation, and building of an electronic and digital government of the Government Office according to overall national administrative reform goals, contents, and programs and legal provisions.

15. Manage finance, assets, and other resources allocated; manage scientific research activities; implement international cooperation as prescribed by law.

16. Perform other tasks and powers delegated by the Government and the Prime Minister or as prescribed by law.

Article 3. Organizational Structure

The organizational structure of the Government Office includes the following units:

1. General Department.

2. Legal Affairs Department.

3. Comprehensive Economic Department.

4. Industry Department.

5. Agriculture Department.

6. Education, Science, Culture, and Society Department.

7. Business Reform Department.

8. International Relations Department.

9. Internal Affairs Department.

10. Public Service Organization Department.

11. Inspection Supervision Department (Department I).

12. National Assembly, Local, and Mass Organizations Work Department.

13. Secretariat and Editing Department.

14. Administrative Department.

15. Cadre and Civil Servant Management Department.

16. Administrative Procedure Control Bureau.

17. Administration and Finance Bureau.

18. Government Electronic Information Portal.

Units within the organizational structure of the Government Office are administrative organizations defined by the Minister and Head of the Government Office regarding their functions, tasks, powers, and organizational structures. The Government Electronic Information Portal uses the National Emblem seal. Department I has three rooms; the Administrative Department has four rooms.

The Minister and Head of the Government Office shall submit to the Prime Minister for issuance of the list of public service establishments directly under the Government Office.

Article 4. Transitional Provisions

1. The State Administrative Organization and Public Service Department, the Inspection Supervision Department, the Complaints and Petitions Resolution Department, the Anti-Corruption, Smuggling, Trade Fraud, and Counterfeit Goods Prevention Department, the Administration and Finance Bureau, the Administrative and Financial Management Bureau II, and the Planning and Finance Department will continue to operate as currently prescribed until the Minister and Head of the Government Office issues a Decision defining the functions, tasks, powers, and organizational structures of these units as stipulated in Clause 10, 11, and 17 of Article 3 of this Decree.

2. The Government Electronic Information Portal will continue to perform its assigned functions, tasks, and powers as currently prescribed until the Decision defining the functions, tasks, powers, and organizational structures of the unit issued by the Minister and Head of the Government Office becomes effective.

Article 5. Effectiveness and Responsibility for Implementation

1. This Decree takes effect from March 1, 2025.

2. This Decree replaces Decree No. 79/2022/NĐ-CP dated October 6, 2022 of the Government on the functions, tasks, powers, and organizational structure of the Government Office.

3. The Minister and Head of the Government Office, Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, and Chairpersons of provincial and centrally-administered city People's Committees are responsible for implementing this Decree./.
