Pursuant to the Price Law on June 19, 2023;

Pursuant to Decree No. 85/2024/NĐ-CP dated July 10, 2024 of the Government detailing certain provisions of the Price Law;

Pursuant to Decree No. 44/2016/NĐ-CP dated May 15, 2016 of the Government detailing certain provisions of the Labor Safety and Health Law regarding technical safety and health inspection activities, safety and health training, and labor environment monitoring;

At the proposal of the Director of the Science, Technology, Environment, and Building Materials Department;

At the proposal of the Director of the Department of Planning and Finance and the Director of the Vietnam Inspection Agency;

The Minister of Construction hereby issues this Circular regulating mechanisms and policies for managing prices of inspection services for handling equipment and pressure equipment used in transportation.

Article 1. Scope of Regulation and Applicability

Article 1. This Circular regulates mechanisms and policies for managing prices of inspection services for handling equipment and pressure equipment used in transportation (excluding equipment for defense and security purposes), including:

a) Handling equipment installed and used on road and rail transport vehicles; specialized handling equipment used at airports, ports, shipbuilding and repair facilities, and railway vehicle maintenance facilities;

b) Pressure equipment installed and used on road and rail transport vehicles.

Article 2. This Circular applies to state agencies, organizations engaged in technical safety and health inspections (hereinafter referred to as inspection organizations), organizations and individuals related to the provision and use of inspection services for handling equipment and pressure equipment as specified in Clause 1 of this Article.

Article 2. Principles for Determining Prices

1. The specific price level of inspection services for handling equipment and pressure equipment used in transportation (hereinafter referred to as inspection equipment services) shall be set by inspection organizations not exceeding the maximum price of inspection equipment services as decided by the Minister of Construction.

2. The maximum price and specific price of inspection equipment services do not include: value-added tax, fees for issuing certificates; accommodation, travel, communication costs, overtime pay, and holiday pay for inspectors as stipulated for performing inspection equipment services.

3. Inspection organizations may collect accommodation, travel, communication costs, overtime pay, and holiday pay for inspectors based on actual incurred expenses, in accordance with current regulations.

4. Value-added tax and fees for issuing certificates shall be collected in accordance with current laws.

5. In cases where equipment does not meet relevant technical standards after inspection as prescribed, inspection organizations shall collect the announced specific price and additional costs as stipulated in Clause 3 of this Article.

6. In cases where inspectors have arrived at the inspection site upon request of the service user (hereinafter referred to as the customer) but the customer cancels the inspection request or it must be canceled due to non-compliance with safety conditions required for inspection, the customer must pay the costs as stipulated in Clause 3 of this Article.

7. In cases where customers request inspection services on days off as prescribed by law, inspection organizations may collect additional wages for inspectors corresponding to the actual working time confirmed by the customer's representative.

Article 3. Responsibility for Implementation

1. The Vietnam Inspection Agency is responsible for:

a) Implementing this Circular.

b) Organizations responsible for receiving price declaration documents as stipulated in Clause 5, Article 28 of the Price Law.

2. Inspection organizations are responsible for declaring, posting, and publicly disclosing information about prices of inspection services for handling equipment and pressure equipment used in transportation in accordance with current pricing laws.

Article 4. Effective date

This Circular takes effect from January 8, 2026./.
