Article 3. AMENDMENT 01:2026 QCVN 04A:2020/MICTE TECHNICAL REGULATION ON NATIONAL TECHNICAL STANDARDS FOR QUALITY OF EXPLOSIVE PRECURSOR MATERIALS USED TO PRODUCE INDUSTRIAL EXPLOSIVES MATERIALS

Issuing AMENDMENT 01:2026 QCVN 04A:2020/MICTE TECHNICAL REGULATION ON NATIONAL TECHNICAL STANDARDS FOR QUALITY OF EXPLOSIVE PRECURSOR MATERIALS USED TO PRODUCE INDUSTRIAL EXPLOSIVES MATERIALS issued together with Circular No. 47/2020/TT-MICTE dated December 21, 2020 by the Minister of Industry and Trade at Appendix III attached to this Circular.

Article 4. Effective date

This Circular shall take effect from July 1, 2026.

Article 5. Implementation

1. The Director of the Chemicals Administration shall be responsible for organizing guidance and implementation of this Circular.

2. The Director of the Chemicals Administration, People's Committees of provinces and cities, Heads of relevant agencies, organizations, and individuals shall be responsible for implementing this Circular.

3. In the course of implementation, if any difficulties arise, agencies, organizations, and individuals shall promptly report in writing to the Ministry of Industry and Trade (through the Chemicals Administration) for guidance or research on amendments and supplements to ensure compliance../.

AMENDMENT 01:2026 QCVN 03:2012/MICTE amends and supplements the following contents of QCVN 03:2012/MICTE

1. Amend Point 1.1 as follows:

1.1. Scope of Application

This technical regulation specifies technical criteria and testing methods applicable to expanded granular ammonium nitrate used to produce ANFO explosive (hereinafter referred to as expanded granular ammonium nitrate), other forms of ammonium nitrate not within the scope of this regulation.

Expanded granular ammonium nitrate subject to this regulation is specified in Circular No. 33/2026/TT-MICTE dated June 30, 2026, issued by the Minister of Industry and Trade on the List of Products and Commodities with Medium and High Risk Levels under the Management Responsibility of the Ministry of Industry and Trade.

2. Amend Point 1.4 as follows:

QCVN 01:2019/MICTE National Technical Regulation on Safety in Production, Testing, Acceptance, Storage, Transportation, Use, Disposal of Industrial Explosives and Storage of Explosive Precursor Materials.

3. Add Clause 4, Clause 5 after Clause 3 as follows:

4. Provisions on management

4.1. Provisions on conformity declaration

4.1.1. Expanded granular ammonium nitrate within the scope of this regulation must comply with the conformity declaration requirements set forth in QCVN 03:2012/MICTE and AMENDMENT 01:2026 QCVN 03:2012/MICTE, affix the conformity mark (CR), and label according to regulations before entering the market.

4.1.2. The conformity declaration process is carried out in accordance with Article 13 of Circular No. 14/2026/TT-BKHCN dated April 9, 2026, issued by the Minister of Science and Technology on Conformity Declaration and Conformity Assessment Methods for Standards and Technical Regulations.

4.2. Provisions on conformity assessment and use of conformity marks

4.2.1. The conformity assessment for the publication of compliance with expanded granular ammonium nitrate as specified in this Standard shall be carried out according to Method 5 or Method 7 as stipulated in Appendix II attached to Circular No. 14/2026/TT-BKHCN.

4.2.2. Organizations conducting conformity assessments under laws on standards, technical regulations, and product quality shall comply with such laws.

4.2.3. The compliance mark must conform to Clause 2, Article 4 of Circular No. 14/2026/TT-BKHCN.

5. Responsibilities of organizations and individuals

5.1. Organizations and individuals engaged in the production, import, and sale of expanded granular ammonium nitrate must ensure compliance with product quality laws and the provisions of this Standard.

5.2. Organizations and individuals must register their compliance declarations through the National Database on Standards, Metrology, and Quality. In cases where the National Database on Standards, Metrology, and Quality cannot meet technical infrastructure requirements or cannot operate due to technical failures, registration of compliance declarations shall be conducted via direct submission or postal service as prescribed in Article 13 of Circular No. 14/2026/TT-BKHCN.

4. Amend Clause 4 as follows:

6. Implementation organization

6.1. The Chemicals Administration has the responsibility to coordinate with relevant agencies and units to guide and inspect the implementation of this Standard.

6.2. The Domestic Market Management and Development Administration has the responsibility to lead and coordinate with relevant agencies and organizations to inspect, control, and handle violations concerning the quality of expanded granular ammonium nitrate in accordance with this QCVN and current laws.

6.3. In cases where legal regulatory documents, materials, or standards cited in this Standard are amended, supplemented, or replaced, they shall be implemented according to the new document.

AMENDMENT 1:2026 QCVN 05:2015/BCT amends and supplements the following contents of QCVN 05:2015/BCT.

1. Amend Point 1.1 as follows:

1.1. Scope of Application

This standard specifies technical requirements, testing methods, and management regulations for crystal ammonium nitrate used in domestic emulsion explosive production, import, export, circulation in the market, and during use.

Crystal ammonium nitrate subject to this standard is defined in Circular No. 33/2026/TT-BCT dated June 30, 2026, issued by the Minister of Industry and Trade to establish the list of products and goods with medium and high risk levels under the Ministry of Industry and Trade's state management responsibility.

2. Amend Point 1.4 as follows:

QCVN 03:2012/BCT National Technical Regulation on Ammonium Nitrate for ANFO Explosive Production.

4. Amend Point 2.2.2 as follows:

2.2.2. Labeling

Labeling on packaging containing the product shall be carried out in accordance with the provisions of Decree No. 37/2026/NĐ-CP dated January 23, 2026, issued by the Government to specify some provisions and measures to organize and guide the implementation of the Law on Product and Goods Quality.

5. Amend Point 2.2.3 as follows:

2.2.3. Transportation and storage

2.2.3.1. Transportation: Shall be carried out in accordance with the provisions of Circular No. 16/2018/TT-BCA dated May 15, 2018, issued by the Minister of Public Security detailing some provisions of the Law on the Management and Use of Weapons, Explosives, and Auxiliary Tools.

2.2.3.2. Storage: Shall be carried out in accordance with the provisions of Section 5.1 of Appendix 10 attached to QCVN 01:2019/BCT.

6. Amend Point 2.3 as follows:

2.3. Regulations on equipment used in analysis

Measuring instruments used in the testing process must be calibrated, verified, or tested in accordance with legal metrology regulations and corresponding technical requirements of the test method.

7. Amend Point 4.2 as follows:

4.2. The conformity assessment for the publication of compliance with crystal ammonium nitrate as specified in this Standard shall be carried out according to Method 5 or Method 7 as stipulated in Circular No. 14/2026/TT-BKHCN dated April 9, 2026, issued by the Ministry of Science and Technology regarding the declaration of compliance with standards and technical regulations and conformity assessment methods.

8. Amend Point 4.3 as follows:

4.3. Compliance declaration shall be carried out in accordance with Article 13 of Circular No. 14/2026/TT-BKHCN.

9. Amend Point 4.4 as follows:

4.4. Crystal ammonium nitrate within the scope of this Standard before entering the market must bear the compliance mark (CR) and labeling in accordance with the provisions. The compliance mark must comply with Clause 2, Article 4 of Circular No. 14/2026/TT-BKHCN.

10. Repeal Points 4.5, 4.6, and 4.7

5.1. The Chemicals Administration has the responsibility to lead and coordinate with relevant agencies and units to guide and inspect the implementation of this Standard.

5.2. The Domestic Market Management and Development Administration has the responsibility to lead and coordinate with relevant agencies and organizations to inspect, control, and handle violations concerning the quality of crystal ammonium nitrate in accordance with this QCVN and current laws.

In cases where the National Standardization, Measurement, and Quality Database does not meet technical infrastructure requirements or cannot be implemented due to technical failures, the registration of the announcement of conformity shall be carried out in person or through postal services as prescribed in Article 13 of Circular No. 14/2026/TT-BKHCN.

Foreword

This technical regulation specifies technical requirements, testing methods, and management for sodium nitrate, sodium chlorate, potassium nitrate, potassium chlorate, and potassium perchlorate explosives precursors used for the production of industrial explosive materials (hereinafter referred to as explosives precursors), which are produced, imported, traded, and stored within the territory of Vietnam.

The explosives precursors sodium nitrate, sodium chlorate, potassium nitrate, potassium chlorate, and potassium perchlorate subject to this regulation are specified in Circular No. 33/2026/TT-BCT dated June 30, 2026, issued by the Minister of Industry and Trade regarding the List of Products and Goods with Medium Risk and High Risk under the Management Responsibility of the Ministry of Industry and Trade.

Amendment 1:2026 QCVN 04A:2020/BCT amends and abolishes certain provisions of QCVN 04A:2020/BCT.

 

Amendment 1:2026 QCVN 04A:2020/BCT amends and abolishes the following contents of QCVN 04A:2020/BCT.

 

II. TECHNICAL PROVISIONS

I. General Provisions

1. Amend Clause 1 as follows:

III. MANAGEMENT PROVISIONS

1. Amend Point 1.2 as follows:

The announcement of conformity shall be conducted in accordance with the provisions of Article 13 of Circular No. 14/2026/TT-BKHCN dated April 9, 2026, issued by the Minister of Science and Technology regarding the announcement of compliance with standards and regulations and conformity assessment methods with standards and technical regulations.

2. Amend Point 2.1 as follows:

2.1. Conformity Assessment

The conformity assessment for announcing conformity of explosives precursors regulated by this standard shall be carried out according to Method 5 or Method 7 as stipulated in Appendix II accompanying Circular No. 14/2026/TT-BKHCN dated April 9, 2026, issued by the Minister of Science and Technology regarding the announcement of compliance with standards and regulations and conformity assessment methods with standards and technical regulations.

2. Amend Point 2.2 as follows:

2.2. Conformity assessment organizations shall comply with the provisions of Clause 2, Article 4 of Circular No. 14/2026/TT-BKHCN dated April 9, 2026, issued by the Minister of Science and Technology regarding the announcement of compliance with standards and regulations and conformity assessment methods with standards and technical regulations.

4. Amend Point 2.3 as follows:

2. Organizations and individuals shall register the announcement of conformity through the National Standardization, Measurement, and Quality Database. In cases where the National Standardization, Measurement, and Quality Database does not meet technical infrastructure requirements or cannot be implemented due to technical failures, the registration of the announcement of conformity shall be carried out in person or through postal services as prescribed in Article 13 of Circular No. 14/2026/TT-BKHCN dated April 9, 2026, issued by the Minister of Science and Technology regarding the announcement of compliance with standards and regulations and conformity assessment methods with standards and technical regulations.

2. The Domestic Market Management and Development Agency shall be responsible for leading and coordinating with relevant agencies and organizations to inspect, control, and handle violations related to the quality of explosive precursors in the market according to this QCVN and current laws.

3. In cases where legal normative documents, materials, or standards cited in this Regulation are amended, supplemented, or replaced, implementation shall follow the provisions of the new document.
