CIRCULAR
GUIDELINES ON SALARY GRADING FOR TEACHERS IN GENERAL EDUCATION AND NEWLY HIRED WORKERS AND OFFICIALS WHO HAVE BEEN FREED FROM OCCUPATION, PURSUANT TO DECREE NO. 36-GD/TT OF DECEMBER 29, 1976
Implementing Decision No. 87-TTg-B dated August 20, 1976 and Decision No. 435-TTg dated October 30, 1976 of the Prime Minister, based on Circular No. 10/TT-LB dated September 9, 1976 of the Ministry of Education and Interior Affairs and Circular No. 20/TT-LB dated November 8, 1976 of the Ministry of Labor regarding the recruitment and payment of salaries to workers and officials newly freed who are working in administrative and service institutions in the South.
The Ministry of Education provides guidelines for salary grading for teachers in general education and workers and officials newly freed who have been officially recruited and are working in the educational sector in southern provinces and cities and educational facilities directly under the Ministry of Education as follows
A- PRINCIPLES OF SALARY GRADING
1. Utilize the existing salary tables and apply current regulations on salary grading for teachers and workers and officials newly freed who have been officially recruited.
2. Salary grading must be based on the profession and level of specialized training and vocational skills, demonstrated through the results of work achieved in completing assigned tasks.
3. Ensure consistent guidance from the Ministry, consolidate and uniformly implement the established salary grading system; properly fulfill responsibilities and authority delegated at various levels.
B- OBJECTS AND STANDARDS FOR SALARY GRADING
I- OBJECTS OF SALARY GRADING
Teachers at all levels in general education and workers and officials newly freed who have been officially recruited according to Decision No. 87-TTg-B dated August 20, 1976 and Decision No. 435/TTg dated October 30, 1976 of the Prime Minister. Circular No. 10-TT-LB dated September 9, 1976 of the Joint Ministry of Education and Interior Affairs and Circular No. 20/TT-LB dated November 8, 1976 of the Ministry of Labor.
II- STANDARDS FOR SALARY GRADING
The salary grading for teachers and workers and officials newly freed who have been recruited must follow common standards:
- Work spirit, attitude, sense of responsibility, organizational discipline awareness.
- Profession trained, ability to work, teaching ability, and assigned tasks.
- Teaching and work results since being employed.
Specific standards for each level of teacher and worker and official are as follows:
1. Teachers at Level III:
a) Recognized as Level III teachers, those who meet the following conditions:
- Regarding duties: Officially assigned to teach classes at Level III (grades 10, 11, 12) and have the qualifications to teach at Level III. In cases where they are assigned to teach both Levels II and III, the number of hours teaching at Level III must be predominant.
- Regarding qualifications and diplomas: Possess one of the following university degrees:
- Graduated from the "Secondary Teacher Training" program at universities of education.
- Hold a bachelor's degree in educational science (natural sciences or humanities) or another applied science bachelor's degree. (Example: A bachelor's degree in applied science in biochemistry can be hired to teach biology).
- Those with a bachelor's degree in liberal arts, having taught for many years in Level III classes in public or private schools, or recognized as having the qualifications to teach at Level III.
b) Criteria for grade placement:
Teachers recruited and officially recognized as Level III teachers (meeting the conditions specified in point 1a above) will be considered for placement in the Level III teacher salary table (starting grade: 55-60, grade 1: 65, grade 2: 75, grade 3: 85, grade 4: 100, grade 5: 115).
Grade 55: Those with a bachelor's degree in liberal arts, qualified to teach at Level III.
Grade 60: Those who graduated from the "Secondary Teacher Training" program at universities of education and those with a bachelor's degree in educational science or applied science.
Grade 65: Level III teachers meeting the qualifications and diploma requirements specified in point 1a above, with high organizational discipline awareness and actively engaged in work.
Higher grades (75, 85, 100, 115).
Teachers at Level III placed in higher grades must be enthusiastic about their work, have a strong sense of responsibility, high organizational discipline awareness, and teaching experience.
c) Teachers who do not meet the required qualifications and diplomas to teach at Level III, temporarily assigned to teach at Level III, will be graded as Level II teachers (as stated in point 2a below) and temporarily receive the additional allowance for teaching stipulated in Decision No. 708/QĐ dated September 10, 1962 of the Ministry of Education.
2. Teachers at Level II:
a) Recognized as Level II teachers, those who meet the following conditions:
- Regarding duties: Officially assigned to teach classes at Level II (grades 6, 7, 8, 9).
- Regarding qualifications and diplomas: Possess one of the following secondary teacher training diplomas:
1. Graduated from the "Primary Secondary Teacher Training" program at public universities of education, or the "Primary Secondary Teacher Training" program at private universities of education with the condition that the student has passed the baccalaureate exam and two years of study.
2. Hold a baccalaureate diploma and two years of secondary technical school.
3. Hold a baccalaureate diploma and a secondary teaching qualification certificate.
4. Hold a baccalaureate diploma and two or more university certificates, including one university certificate that meets the subject teaching requirement, including foreign languages such as English and French.
5. Hold a baccalaureate diploma but previously did not attend teacher training due to certain circumstances, but have teaching experience in Level II classes in public or private schools, now qualified to teach at Level II.
b) Criteria for grade placement.
Teachers recruited and officially recognized as Level II teachers (meeting the conditions specified in point 2a above) will be considered for placement in the Level II teacher salary table. (Starting grade: 45, grade 1: 50, grade 2: 58, grade 3: 68, grade 4: 78, grade 5: 88).
Grade 45: Teachers with a baccalaureate diploma without teacher training (point 5-2a diploma above), qualified to teach at Level II.
Grade 50: Teachers meeting the qualification and diploma conditions specified (points 1, 2, 3, 4-2a diploma above) with high organizational discipline awareness and actively engaged in work.
Higher grades (58, 68, 78, 88).
Teachers at Level II placed in higher grades (58, 68, 78, 88) must be enthusiastic about their work, have a strong sense of responsibility, high organizational discipline awareness, and teaching experience.
c) Teachers who have not yet met the qualification requirements for teaching secondary school but are temporarily assigned to teach at this level shall be paid according to the salary scale for primary school teachers (as stipulated in point 3 below) and shall temporarily receive the additional allowance for teaching as prescribed in Decision No. 708/QĐ dated September 10, 1962, of the Ministry of Education.
However, teachers with a Baccalaureate 2 (or Baccalaureate 1) degree from the two-year system of the National Teacher Training College, if assigned to teach at the secondary level, shall be placed on the salary grade of 50 without the additional allowance for teaching.
3. Primary School Teachers:
Those recognized as primary school teachers include those in the following categories who are recruited to teach at the primary level:
- Supplementary education teachers,
- Elementary school teachers,
- Junior teachers, part-time teachers outside the Ministry of Education's system, B2 teachers, village teachers, private teachers converted to public service with a "First Cycle Secondary School" degree or higher,
- And teachers without a "First Cycle Secondary School" degree currently teaching grades 1, 2, 3...
b) Criteria for grade placement:
Teachers recruited and recognized as primary school teachers shall be classified as follows:
- Primary school teachers with a junior level degree shall be classified as grades: 40đ, 47đ, 54đ, 62đ, 72đ.
- Primary school teachers with a senior level degree shall be classified as grades: 45đ, 50đ, 58đ, 68đ, 78đ, 88đ.
- Primary school teachers without a "First Cycle Secondary School" degree shall be classified as grades: 36đ, 41đ, 47đ, 53đ, 60đ.
Specifically:
1. Classification of primary school teachers with a junior level degree:
Grade 40đ: Primary school teachers with a "First Cycle Secondary School" degree and a Baccalaureate 1.
Grade 47đ: Primary school teachers with a "First Cycle Secondary School" degree and a Baccalaureate 1, who demonstrate discipline and actively engage in their work, ensuring they can deliver the full primary curriculum.
The subsequent grades (54đ, 62đ, 72đ).
Primary school teachers with a "First Cycle Secondary School" degree and a Baccalaureate 1 must be enthusiastic about their work, responsible, disciplined, and experienced in teaching to be classified in these grades.
2. Classification of primary school teachers with a senior level degree.
Grade 45đ: Primary school teachers with the following qualifications:
- Baccalaureate 2, or Baccalaureate 1 with accelerated teacher training,
- Baccalaureate 1 and one year of teacher training (nine months),
- Teachers who failed the supplementary education teacher training program with Baccalaureate 2 as the admission requirement and attended for two years.
Grade 50đ: Primary school teachers with a Baccalaureate 2 (or Baccalaureate 1) degree from the two-year system of the National Teacher Training College (supplementary education).
- Primary school teachers with a Baccalaureate 2 degree and at least two university certificates.
The subsequent grades (58đ, 68đ, 78đ, 88đ).
Primary school teachers in the supplementary education or elementary school category with a Baccalaureate 2 degree or higher must be enthusiastic about their work, responsible, disciplined, and experienced in teaching to be classified in these grades.
3. Classification of primary school teachers without a "First Cycle Secondary School" degree (36đ, 41đ, 47đ, 53đ, 60đ).
Grade 36đ: Teachers who can only teach grades 1 and 2, still weak in teaching but making efforts.
Grade 41đ: Teachers who can teach grades 1, 2, and 3, capable of managing a class that meets the requirements, with some experience in pedagogical practice.
The subsequent grades (47đ, 53đ, 60đ).
Must be experienced in their profession, enthusiastic about their work and teaching, responsible, and highly disciplined.
4. For workers and staff newly liberated and recruited to work in the education sector.
In addition to the above-mentioned general education teachers, the Ministry guides the recruitment and classification of salaries for workers and staff working in the education sector of provinces, cities, and schools, as well as institutions directly under the Ministry as follows:
a) Only recruit individuals meeting the conditions stipulated in Article 1-1 of Decision No. 435/TTg dated October 30, 1976, of the Prime Minister, and based on the staffing of educational agencies at all levels and schools.
b) Salary grading:
- Workers and staff newly liberated and recruited with professional qualifications will be assigned to the following positions:
+ Research, guidance, and inspection work in educational agencies at all levels shall be classified in the civil servant, officer, and specialist salary scales.
+ Administrative and management work shall be classified in the administrative and management salary scale.
+ Typing work shall be classified in the typist salary scale.
+ Driving work shall be classified in the car driver or truck driver salary scale depending on whether they drive cars or trucks.
+ Maintenance work (flooring, carpentry, electricity, water) shall be classified in the maintenance worker salary scale.
+ Auto repair work shall be classified in the mechanical repairer salary scale.
+ Medical personnel (doctors, nurses, midwives...) shall be classified in the medical salary scale according to the training system of the Ministry of Health.
+ Canteen and nursery staff shall be classified in the canteen worker and nursery worker salary scales.
+ Workers in various trades working at the Publishing Bureau, Branch Company of School Equipment under the Ministry of Education will have separate guidelines.
- The criteria for classification into each salary grade must be based on professional qualifications and demonstrated responsibility reflected in the results of their work through the completion of assigned tasks.
- The classification into the officer (grade 5, grade 6) and specialist salary grades must be for those who are enthusiastic about their work, experienced in their professional duties, and have a high sense of responsibility.
5. After formal salary classification, workers, staff, and teachers shall immediately enjoy current allowances.
a) Temporary Allowance:
- 6 đồng (in the South)/month from Quang Nam - Da Nang southward.
- 10 đồng - 15 đồng (National Bank of Vietnam currency) in Binh Tri Thien until the end of December 1976.
b) Regional Allowance (if applicable).
c) Travel Allowance.
d) Additionally, teachers shall also enjoy the following allowances within the education sector:
- Position Allowance for Principals and Vice Principals, if appointed by the competent authority as stipulated in point 3c of item 1 of Directive No. 252/TCCB dated July 27, 1976, of the Ministry of Education.
- Additional Hourly Teaching Allowance.
- Supervision Allowance for Teacher Training.
The above allowances will be detailed by the Ministry of Education.
d) Workers shall also enjoy current allowances according to their professional sectors (will be guided by relevant sectors).
6. The amounts mentioned above are calculated in the current currency of the National Bank of Vietnam.
C. REGARDING TEMPORARY RECRUITS UNDER FIXED-TERM CONTRACTS AND THOSE WHO ARE DISCHARGED
I. TEMPORARY RECRUITS UNDER FIXED-TERM CONTRACTS
Pursuant to Article 4 of Decision No. 87/TTg-B dated August 20, 1967 and Article 21 of Decision No. 345/TTg dated October 30, 1976 of the Prime Minister, the Ministry of Education guides as follows:
1. Objectives of temporary recruitment under fixed-term contracts
Are those teachers and staff members whom the Department of Education needs more time to consider, or who are close to retirement age, then apply according to Circular No. 16/LĐ-TT dated August 26, 1976 of the Ministry of Labor.
2. Salary system when temporarily recruited under fixed-term contracts.
a) Salary classification:
- Primary school teachers are temporarily classified at 40 dong if they have a basic level, or 45 dong - 50 dong if they have a secondary level as stated in Point 3b, Section II, Part B.
- Secondary school teachers are temporarily classified at 45 dong - 50 dong as stated in Point 2b, Section II, Part B.
- High school teachers are temporarily classified at 55 dong - 60 dong as stated in Point 1b, Section II, Part B.
- Workers and officials are temporarily classified at Level 1 of the salary scale for the assigned position.
After the term of the temporary contract, if officially recruited, they will be classified at the salary level as guided in Section II, Part B above.
Specifically, for teachers nearing retirement age, if recruited under a contract, they will be classified at the salary levels as officially recruited teachers as guided in Section II, Part B.
b) Allowances:
Teachers and workers temporarily recruited under contracts shall enjoy allowances as stated in Point 6, Section 2, Part B above and the benefits within the scope of enjoyment as stated in Circular No. 16/LĐ-MN dated August 26, 1976 of the Ministry of Labor.
II. THOSE WHO ARE DISCHARGED
For teachers and workers who do not meet the conditions for recruitment and are discharged, depending on each individual's circumstances, a lump sum allowance equal to three months' salary, or current allowance, will be provided. If the total amount is less than 80 dong, it will be supplemented to 80 dong (southern currency); if over 200 dong, it will only be supplemented to 200 dong (southern currency).
This allowance applies only to those discharged from November 1, 1976 onwards; it does not apply to those who were discharged before November 1, 1976.
D- IMPLEMENTING PROVISIONS
1. To ensure the implementation of the salary policy for newly liberated teachers and staff members, the Departments of Education must effectively carry out teacher recruitment and staff member recruitment as stipulated in Decision No. 87/TTg-B dated August 20, 1967 and Decision No. 435/TTg dated October 30, 1976 of the Prime Minister.
2. The Departments and District Education Offices must supplement and complete the files of each teacher thoroughly, closely coordinating with relevant agencies (Organizational Committee of the Government, Departments of Labor) to develop salary plans and implement them step-by-step.
(Prepare lists of teachers and staff members, supplement educational certificates and academic records, statistics according to forms, predict salary classifications...).
3. School Principals need to assess the spirit, attitude, and work results of each person since liberation, based on the guiding criteria to predict salary classifications for each person in their unit and propose to the District Education Office and the Department of Education for review.
For primary and secondary schools where leadership is still lacking and unstable, the District Education Office must directly grasp the situation, predict salary classifications, and report to the Department for review.
4. The Ministry of Education issues decisions on salary classifications for teachers and staff members working in units and schools under the Ministry.
- The Departments of Education issue decisions on salary classifications for staff members with a salary grade of 64 dong or less and primary and secondary school teachers.
- The People's Committees of provinces and centrally-administered cities issue decisions on salary classifications for high school teachers and staff members with a salary grade above 64 dong. Those teachers classified at grade 85 and staff members classified at grade 83 or higher must report to the Ministry before making a decision.
It is advisable to establish salary review boards at all levels with the participation of local organizational authorities, labor departments, and representatives of mass organizations to assist leaders in making decisions easily.
5. Teachers and staff members who are classified in salaries shall enjoy new salaries from November 1, 1976.
Recruitment and salary classification for newly liberated teachers and staff members should be completed in the first quarter of 1977.
6. Close cooperation with school associations is necessary to organize training sessions on the new salary system for teachers and staff members, ensuring good ideological work before and after the new salary implementation, promoting unity and enthusiasm in the "two excellences" movement.
7. The Departments and District Education Offices should assign 1-2 specialized cadres to assist the leadership in researching and classifying salaries.
8. Individual cases not covered in this guidance circular should be reported promptly for the Ministry to provide additional opinions.
The recruitment and salary classification policy for newly liberated teachers and staff members is an important part of the overall policy of the Party and State towards intellectuals and newly liberated staff members.
Implementing this policy well will contribute positively to stabilizing the lives of these individuals and unifying the salary system across the country.
The Departments, District Education Offices, and schools must thoroughly understand this policy, urgently organize its implementation, create a spirit of enthusiasm and unity among teachers and staff members, encourage everyone to contribute their abilities to the country in the new phase.
