CIRCULAR
On child care allowances
____________
Circular No. 02-LB/CB dated May 16, 1954 on the issue of child care has resolved many difficulties for a large number of female cadres, workers, and employees living collectively. However, currently, there are still some female cadres who must work in mobile positions, living separately without the conditions to organize kindergartens or send their children to kindergartens organized by their agencies, thus encountering many difficulties in their work.
To resolve the difficulties of the aforementioned female cadres, the Joint Board stipulates:
1) A monthly allowance in cash shall be provided to female cadres, workers, and employees (in general) within the state's establishment (including people's organizations), enjoying the semi-provisioning system (regardless of rank or type of work), with children aged from one to three years old who do not have the conditions to send them to kindergartens organized by their agencies.
This allowance shall only apply temporarily while the current salary system is in effect.
2) The amount of the allowance:
- For children under two years old (24 months), this allowance is seven thousand (7,000 dong) per month.
- For children over two years old, under three years old (from 25 to 36 months), the allowance is 3,500 dong per month.
3) Principles of the allowance:
All female cadres, workers, and employees with children aged from one to three years old who do not send their children to agency kindergartens shall all receive the allowance.
Female cadres who must work in mobile positions, live separately, or work in agencies that do not have the conditions to organize kindergartens also receive the allowance.
Newborns only receive the allowance from when their mothers return to work after the maternity leave period (those working before the 15th of the month receive the full month's allowance, those working after the 15th receive half a month's allowance).
Note: For agencies that have organized kindergartens, they will be handled as follows:
For existing kindergartens, when setting up the child care allowance (must be guaranteed by the parents of the child), the kindergarten staff should be reasonably arranged (people have jobs, avoiding the situation where people sit idle and receive salaries). Therefore, for children already sent to kindergartens, when resolving the allowance, the agency must carefully consider; it should not disband existing kindergartens due to the above regulations, causing difficulties and confusion for cadres, workers, and employees. Children whose parents have requested to enjoy the child care allowance but now want to send back to the kindergarten must be decided by the agency based on the kindergarten's capacity. Newborns of female cadres, workers, and employees living collectively who do not receive the allowance can be sent to existing kindergartens of the agency.
In Circular No. 02-LB/CB dated May 10, 1954, it was stated that "agencies or enterprises with only one child under two years old who do not meet the conditions to have a caregiver, but if the child is the offspring of a female cadre in charge at the level of Deputy Director of Provincial Committee or higher, Member of the Anti-French Resistance Administrative Committee of the county or higher, will also be entitled to a caregiver." This was a regulation during the resistance war, now with the allowance system stipulated in this circular, the above provision is no longer applicable.
Any provisions in Circular No. 2-LB/CB that contradict the principles above shall no longer be implemented.
This allowance is intended to resolve part of the difficulties for female cadres, workers, and employees who meet the criteria to send their children to kindergartens, so that they can ensure the necessary conditions for their professional work, and it is only a temporary solution while we maintain the current salary system.
The allowance must be carefully considered and resolved in accordance with the spirit of the Joint Board Circular, absolutely not allowing both a caregiver and an allowance. When receiving the allowance, female cadres must also solve their own difficulties to ensure the necessary conditions for their professional work as well as study and life at the agency.
This circular takes effect from November 1, 1957, and does not apply to industrial enterprises.
While implementing, administrative and service agencies from central to local levels, if encountering any difficulties or obstacles, should promptly inform the Joint Board for timely research and supplementation (report to the Ministry of Home Affairs).
