At the proposal of the Director of the Vietnam Road Administration Bureau, the Head of the Cadre and Civil Servant Department, and the Head of the Legal Department,

THE MINISTER OF TRANSPORTATION

BASED ON THE LABOR CODE ON JUNE 23, 1994 AND THE LAW AMENDING AND COMPLEMENTING CERTAIN PROVISIONS OF THE LABOR CODE ON APRIL 12, 2002;

WHEREAS, the Road Traffic Law dated June 29, 2001;

This Decision issues "Regulations on Responsibilities and Forms of Handling for Organizations and Individuals when Violating in Management, Operation, and Business Activities of Passenger Transport by Motor Vehicles".

Pursuant to Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

The Heads of the Ministry's Office, the Inspectorate, Heads of Departments under the Ministry, the Director of the Vietnam Road Administration Bureau, Chairmen of Provincial People's Committees, Directors of Transportation Departments, Public Works and Heads of agencies, units, and individuals related shall be responsible for implementing this Decision.

DECISION:

Article 1. Responsibilities and forms of handling for organizations and individuals when violating in management,

Article 2. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

REGULATIONS

(Issued together with Decision No. 3633/2003/QĐ-BGTVT dated December 2, 2003)

These regulations determine responsibilities, violations, and forms of handling when violating in management, operation, and business activities of passenger transport by motor vehicles throughout the country.

These regulations apply to organizations and individuals carrying out management, operation, and business activities of passenger transport by motor vehicles including:

Chapter 1:

GENERAL PROVISIONS

Article 1. Scope of regulation.

1. Organizations:

Article 2. Scope of Application.

a) Vietnam Road Administration Bureau, Transportation Departments, Public Works, Highway Management Zones, Bus Station Management Boards;

b) Transport enterprises, bus station operators: state-owned enterprises, other economic sector enterprises, cooperatives.

2. Individuals:

a) Director of the Vietnam Road Administration Bureau; Directors of Transportation Departments, Public Works; General Managers of Highway Management Zones; Heads of Bus Station Management Boards;

b) Directors of transport enterprises, directors of bus station operating enterprises, cooperative managers (or managers);

c) Drivers, attendants, service staff (if any).

In addition to these regulations, organizations and individuals mentioned in Article 2 of these regulations must comply with other relevant regulatory legal documents.

REGULATIONS ON RESPONSIBILITIES

Article 3. Section A. RESPONSIBILITIES OF AUTHORITIES AND LEADERS OF AUTHORITIES IN MANAGING TRANSPORTATION.

Chapter 2:

Vietnam Road Administration Bureau.

1. Organize and guide the implementation within its authority of legal regulatory documents on management, operation, and business activities of passenger transport by motor vehicles throughout the country.

Article 4. 2. Review and announce international passenger transport routes and inter-provincial passenger transport routes passing through adjacent provinces.

3. Receive registration papers for international transport route exploitation and mediate for enterprises to put vehicles into operation.

4. Delegate to Transportation Departments, Public Works to announce fixed inter-provincial passenger transport routes and receive registration papers for some inter-provincial passenger transport route exploitation.

5. Assign tasks and direct Highway Management Zones to manage inter-provincial passenger transport routes by motor vehicle over 300 km to 1000 km within their jurisdictional areas. Direct and supervise traffic inspection forces of Highway Management Zones.

6. Coordinate with the Traffic Police Corps and the Administrative Management Corps for Social Order in organizing inspections and supervising passenger transport activities on routes, bus stations, and handling violations within their authority.

7. Direct advisory and operational agencies to fully perform state management functions in passenger transport by motor vehicle throughout the country.

8. Organize regular or spot inspections of passenger transport activities by motor vehicle at transport enterprises, bus stations, Highway Management Zones, Transportation Departments, Public Works; handle violations within their authority.

9. The Director of the Vietnam Road Administration Bureau assists the Minister of Transportation in uniformly managing inter-provincial passenger transport by motor vehicle throughout the country.

10. Implement these regulations to all relevant officers and employees.

Transportation Departments, Public Works.

1. Organize the implementation of legal regulatory documents and guidance documents from the Vietnam Road Administration Bureau on specialized state management of passenger transport by motor vehicle under their jurisdiction.

Article 5. 2. Announce intra-provincial, inter-provincial passenger transport routes with adjacent provinces and other inter-provincial passenger transport routes according to the delegation of the Vietnam Road Administration Bureau.

3. Receive registration papers for passenger transport route exploitation of transport enterprises headquartered in the area announced by the Transportation Departments, Public Works and delegated by the Vietnam Road Administration Bureau; organize mediation among enterprises on the route and announce for enterprises to put vehicles into operation.

4. Issue and manage "Contract Vehicle" stickers, "Vehicle Logbook," and other documents related to transport management as prescribed.

5. Organize the development of bus station system planning to submit to competent authorities for approval and manage the implementation of the plan.

6. Direct advisory and operational agencies to complete responsibilities regarding management and operation of passenger transport by motor vehicle, operation of bus stations within the local area.

7. Organize regular and spot inspections of passenger transport activities by motor vehicle of transport enterprises, bus station operating enterprises, bus station management boards, and individuals involved in transport management and handle violations within their authority.

8. The Director of the Department is directly responsible before the Chairman of the Provincial People's Committee, Central City People's Committee, and the Minister of Transportation for management, operation, and the status of passenger transport by motor vehicle within the local area.

9. Implement these regulations to all relevant officers and employees.

Highway Management Zone.

1. Directly manage passenger transport routes by motor vehicle according to the division of the Vietnam Road Administration Bureau.

Article 6. 2. Receive registration papers for route exploitation of transport enterprises located in the management zone and organize mediation for enterprises to put vehicles into operation on the route.

1. Directly manage bus transport routes according to the allocation by the Vietnam Highway Administration.

2. Receive the registration papers for operating routes from transportation enterprises located within the management area and organize negotiations so that the enterprises can operate vehicles on the routes.

3. Regularly inspect, audit, and handle violations in the exploitation of routes within the management scope of the Zone in accordance with the provisions of the law.

4. Direct the advisory and operational agencies to complete the tasks of managing passenger transport activities by motor vehicles within the management scope of the Zone.

5. The General Director shall be responsible before the Director of the Vietnam Highway Administration for the management, operation, and passenger transport activities by motor vehicles within the management scope of the Zone.

6. Implement this Regulation to each relevant staff member.

Article 7. Bus station management board.

1. Check the implementation of the route and schedule of the vehicle, confirm the number of passengers and the departure and arrival times at the bus station, record them in the vehicle operation logbook.

2. Inspect the vehicle and driver's documents before the vehicle enters the passenger boarding position.

3. Inspect the compliance with transportation regulations at the bus station.

4. Require the vehicle owner to arrange substitute vehicles to ensure the transportation schedule when there are urgent requests.

5. Take the lead in coordinating inspections with local authorities and related agencies to ensure order, safety, and environmental hygiene in the bus station area.

6. Draft violation reports, handle them according to the law, or transfer them to competent authorities for handling in case of violations by drivers, attendants, and bus station enterprise employees.

7. The Head of the Bus Station Management Board shall directly be responsible before the Department Director for the operations of the bus station as assigned.

8. Implement this Regulation to each relevant staff member.

Article 8. Transport enterprises.

1. Organize passenger transport business on fixed routes in accordance with the regulations:

a) Arrange sufficient vehicles for transport operations that meet the traffic conditions of motor vehicles as prescribed by the State;

b) Operate strictly along the registered route and schedule;

c) Require drivers to pick up and drop off passengers at bus stations and designated stops along the route;

d) Prepare sufficient tickets for sale to passengers;

đ) Contract with bus stations and rest stops according to approved operating plans.

2. Contract with passengers when transporting them under contractual arrangements.

3. Ensure that passenger-carrying vehicles meet safety standards and environmental protection requirements, have Safety Technical Inspection Certificates and Environmental Protection Stickers, valid Motor Vehicle Liability Insurance Certificates, and comply with current technical maintenance and repair regulations.

4. Regularly disseminate and educate drivers, attendants, and service personnel about road traffic laws to ensure passenger safety and the operation of vehicles on the road.

5. Enter into labor contracts with drivers, attendants, or service personnel in accordance with the Labor Law.

6. The Director shall directly or jointly bear responsibility under the law for the management, operation, and business activities of the enterprise and any violations by drivers, attendants, or service personnel as concluded by competent management authorities.

7. Inspect and handle violations by drivers, attendants, and service personnel, and resolve complaints from passengers regarding service quality not meeting commitments, and compensate for losses (if any).

8. Implement this Regulation to each relevant staff member.

Article 9. Bus station exploitation enterprises.

1. Sign contracts with transport units for vehicles to enter the station for picking up and dropping off passengers on passenger transport routes as directed by the route management agency and service contracts for drivers and transport vehicles.

2. Fulfill signed contracts, only refusing service when the vehicle owner breaches the contract or violates transportation regulations, with a report or request from the route management agency.

3. Ensure order, safety, and hygiene in the bus station.

4. Comply with bus station management regulations and accept inspection and supervision by the bus station management agency.

5. Protect, prevent, and request local authorities to stop and handle actions disrupting order and safety at the bus station, and demand compensation for damages caused by organizations or individuals.

6. The enterprise director shall directly or jointly bear responsibility under the law for violations in bus station exploitation as concluded by competent management authorities.

7. Implement this Regulation to each relevant staff member.

Mục B. RESPONSIBILITIES OF THE DRIVER, CONDUCTOR, AND ONBOARD STAFF

Article 10. The Driver.

1. As the representative of the vehicle owner, the business owner, the driver shall perform assigned tasks and bear all responsibilities during the operation of the vehicle.

2. Operate passenger-carrying vehicles along registered routes according to the assigned schedules.

3. Drive according to the prescribed route and schedule, and pick up and drop off passengers at bus stations and designated stops along the route.

4. Carry valid documents as required by law for the vehicle and the driver, such as: Driver's license, Certificate of Civil Liability Insurance for Motor Vehicles, Safety Technical Inspection and Environmental Protection Certificate, Vehicle Logbook (if operating on a fixed route), Passenger Transport Contract (if operating under contractual mode).

5. Comply with commitments made in the passenger transport contract when operating under contractual mode.

Article 11. The Conductor and Onboard Staff.

1. Perform duties assigned by the driver and jointly bear responsibility with the driver for all activities of the vehicle.

2. Check tickets or sell tickets to passengers; ensure that all passengers have tickets and seats as indicated on their tickets.

3. Ensure cleanliness and hygiene of the vehicle.

4. Inform passengers of the rules for riding the vehicle.

5. Maintain order, safety, and secure luggage and goods for passengers.

Chapter 3:

VIOLATIONS AND FORMS OF SANCTION

Mục A. VIOLATIONS AND FORMS OF SANCTION FOR LEADERS AND STAFF IN AUTHORITIES IMPLEMENTING TRANSPORT MANAGEMENT TASKS OR JOINTLY RESPONSIBLE

Article 12. General Provisions.

1. Violations

a) Misuse of duties and powers to act contrary to regulations in management and route announcements within the authority granted;

b) Issuing approval for registration to operate on routes contrary to regulations;

c) Lack of responsibility or covering up in inspection and supervision of assigned tasks resulting in disputes or complaints with conclusions from competent management authorities;

d) Shifting, evading, or obstructing responsibilities when handling matters, leading to disputes or complaints beyond jurisdiction as concluded by competent management authorities;

đ) When there is a report accusing corrupt behavior with conclusions from competent management authorities.

2. Forms of Sanction

a) For staff:

- Reprimand for the first violation of points a, d Clause 1 Article 12 of this Regulation;

- Warning for the first violation of points b, c, đ Clause 1 Article 12 of this Regulation;

- Reduction in pay grade for the first violation of both points or the second violation of one point Clause 1 Article 12 of this Regulation;

- Suspension from work for a period or transfer to another position for the third violation of one point a, d Clause 1 Article 12 of this Regulation; or the second violation of both points Clause 1 Article 12 of this Regulation;

b) For leaders, reprimand, warning, reduction in pay grade, demotion, or dismissal depending on the nature and severity of the violation.

Article 13. For Vietnam Highway Administration.

In addition to applying sanctions for violations stipulated in Article 12, failure to fulfill responsibilities stipulated in Article 4 of this Regulation, then:

1. The Director and Deputy Directors of Vietnam Highway Administration will be reprimanded, warned, reduced in pay grade, demoted, or dismissed depending on the nature and severity of the violation.

2. Leaders of advisory units of Vietnam Highway Administration directly responsible for assigned tasks will be reprimanded, warned, reduced in pay grade, demoted, or dismissed depending on the nature and severity of the violation.

Article 14. For Departments of Transportation and Public Works.

In addition to applying sanctions for violations stipulated in Article 12, failure to fulfill responsibilities stipulated in Article 5 of this Regulation, then:

1. The Director and Deputy Directors of Departments of Transportation and Public Works will be disciplined from reprimand to warning, demotion, reduction in pay grade, or dismissal depending on the nature and severity of the violation.

2. Leaders of advisory units of Departments of Transportation and Public Works directly responsible for overseeing and directing will be reprimanded, warned, demoted, reduced in pay grade, or dismissed depending on the nature and severity of the violation.

Article 15. For Road Management Zones.

In addition to applying sanctions for violations stipulated in Article 12, failure to fulfill responsibilities stipulated in Article 6 of this Regulation, then:

1. The General Director and Deputy General Directors will be disciplined from reprimand to warning, demotion, reduction in pay grade, or dismissal depending on the nature and severity of the violation.

2. Leaders of related departments and units responsible for managing and operating passenger transport activities will be reprimanded, warned, reduced in pay grade, demoted, or dismissed depending on the nature and severity of the violation.

Section B. VIOLATIONS AND FORMS OF DISCIPLINARY ACTION AGAINST THE BUS STATION MANAGEMENT BOARD

Article 16. Violations.

In addition to the violations prescribed in points c, d, đ, Clause 1, Article 12 of this Regulation, the Bus Station Management Board shall be subject to disciplinary action for the following violations:

1. Failing to check the journey and schedule of vehicles in the Vehicle Operation Logbook (departure time from the station, arrival time at the station, and stops for passenger pick-up at designated points according to the registered operation plan); failing to confirm in the Vehicle Operation Logbook as required.

2. Failing to inspect the driver's documents and vehicle before the vehicle enters the passenger boarding position.

3. Failing to organize joint inspections with local authorities, police, tax authorities, and health services to ensure order, safety within the station, traffic safety, and environmental hygiene.

4. Failing to implement this Regulation to relevant staff members.

Article 17. Forms of Disciplinary Action.

In addition to applying the forms of disciplinary action for violations stipulated in Clause 2, Article 12 of this Regulation, there are also:

1. Being reprimanded for the first violation of Clauses 3 and 4 of Article 16 of this Regulation.

2. Being warned for the first violation of Clause 1 or 2 of Article 16 of this Regulation, or for the second violation of Clauses 3 and 4 of Article 16 of this Regulation.

3. Having salary grade reduced when:

a) Committing the third violation of Clause 3 of Article 16 of this Regulation;

b) Committing the second violation of Clause 1 or 2 of Article 16 of this Regulation.

4. Dismissal when:

a) Committing the fourth violation of Clause 3 or the third violation of Clause 2 of Article 16 of this Regulation;

b) Committing the third violation of Clause 1 or 2 of Article 16 of this Regulation.

Section C. VIOLATIONS AND FORMS OF DISCIPLINARY ACTION AGAINST TRANSPORT ENTERPRISES

Article 18. Violations

1. Failing to provide sufficient drivers on long routes, causing drivers to work beyond the prescribed time limit.

2. Assigning vehicles to transport passengers without having a labor contract with the enterprise.

3. Failing to sign contracts with bus stations and rest stops along the route according to the approved operation plan.

4. Failing to register for operating passenger transport on fixed routes without a written transportation contract when operating under contractual terms.

5. Skipping trips or not adhering to the prescribed route and schedule.

6. Failing to provide necessary documents to drivers such as the Vehicle Operation Logbook, compulsory motor vehicle liability insurance, transportation contract...

7. Failing to comply with current technical maintenance and automobile repair regulations.

8. Failing to implement this Decision to relevant staff members.

Article 19. Forms of Disciplinary Action.

1. For transport enterprises:

a) Not being allowed to participate in passenger transport activities when violating Clause 4 of Article 18 of this Regulation;

b) Being warned for the first time when violating any of Clauses 1, 2, 3, 5, 6, 7, 8 of Article 18 of this Regulation;

c) Being suspended from operations on the route for 30 days for the second violation of any of Clauses 1, 2, 3, 5, 6, 7, 8 of Article 18 of this Regulation;

d) Having the approval registration certificate for operations on the route, business registration certificate revoked for the third violation of any of Clauses 1, 2, 3, 5, 6, 7, 8 of Article 18 of this Regulation, or for the second violation of two Clauses of Article 18 of this Regulation.

2. For the General Director of the enterprise:

a) Being directly or jointly responsible when violating any of Clauses 1, 2, 3, 6, 7, 8 of Article 18 of this Regulation regarding the violations of drivers, conductors, and service personnel involved in passenger transport, as concluded by the competent management authority;

b) Being reprimanded, warned, or dismissed from office based on the conclusions of the competent management authority for violating the provisions of Article 18 of this Regulation.

Section D. VIOLATIONS AND FORMS OF DISCIPLINARY ACTION AGAINST THE MANAGER OF A BUSINESS OPERATING A BUS STATION

Article 20. Violations.

1. Failure to enter into contracts with transportation businesses for ticket sales counters or failure to enter into agency agreements for ticket sales with transportation businesses and vehicle owners as prescribed.

2. Failure to conclude contracts with transportation businesses as prescribed by the management authority of the route; service contracts for drivers and vehicles.

3. Failure to organize buses to pick up and drop off passengers at the station according to contracts, causing disorder and safety issues at the station.

4. Failure to organize overnight parking if conditions permit.

5. Failure to provide services for loading, unloading, and storing luggage for passengers, ensuring environmental hygiene.

6. Failure to maintain infrastructure and organize fire prevention inspections within the bus station.

7. Collecting fees, charges, and prices higher than those prescribed by the State.

8. Unilaterally setting rules for collecting various types of fees, charges, and prices.

9. Failure to implement this Regulation to relevant staff members.

Article 21. Forms of Disciplinary Action.

1. Reprimand for the first violation of any of Clauses 2, 4, 6, 7, or 9 of Article 20 of this Regulation.

2. Warning for the first violation of any of Clauses 1, 3, or 5, or the second violation of any of Clauses 2, 4, 6, 7, or 9 of Article 20 of this Regulation.

3. Having salary grade reduced when:

a) The third violation of any of Clauses 2, 4, 6, or 7 of Article 20 of this Regulation;

b) The first violation of Clause 8 or the second violation of any of Clauses 1, 3, or 5 of Article 20 of this Regulation.

4. Removal from position when:

a) The fourth violation of any of Clauses 2, 4, 6, or 7, or the third violation of any of Clauses 1, 3, or 5 of Article 20 of this Regulation;

b) The second violation of Clause 8 of Article 20 of this Regulation.

Section E. VIOLATIONS AND FORMS OF DISCIPLINARY ACTION AGAINST DRIVERS

Article 22. Violations

In addition to violations stipulated in Articles 60 and 61 of the Road Traffic Law, the following additional violations are provided for:

1. Transporting passengers to eating and resting places where they are forced to eat or pay high prices, or are beaten or threatened.

2. Engaging in actions that threaten or compete for passengers.

3. Handing over the vehicle to persons who do not meet the qualifications for driving passenger transport vehicles.

4. Failing to take passengers to rest stops along the route as contracted.

5. Failing to enter the designated station for picking up and dropping off passengers; leaving the station and circling around to pick up more passengers.

Article 23. Forms of Disciplinary Action.

1. Warning for the first violation of any of Clauses 4 or 5 of Article 22 of this Regulation.

2. Suspension of driving license for a period of three months for the first violation of any of Clauses 1, 2, or 3, or the second violation of any of Clauses 4 or 5 of Article 22 of this Regulation;

3. Suspension of driving license for a period of six months for the second violation of any of Clauses 1, 2, or 3, or the third violation of Clause 4 or 5 of Article 22 of this Regulation;

4. Suspension of driving license for a period of one year for the third violation of any of Clauses 1, 2, or 3, or the fourth violation of Clause 4 or 5 of Article 22 of this Regulation.

Section F. VIOLATIONS AND FORMS OF DISCIPLINARY ACTION AGAINST ATTENDANTS AND SERVICE PERSONNEL ON VEHICLES

Article 24. Violations.

1. Taking passengers without selling tickets or selling tickets at prices higher than prescribed; having an attitude that does not respect passengers.

2. Allowing passengers to board or disembark while the vehicle is moving.

3. Storing goods in the passenger compartment.

4. Loading cargo on the roof of the passenger vehicle causing imbalance.

5. Accepting more passengers than the prescribed number of seats.

Article 25. Forms of Disciplinary Action.

1. Warning for the first violation of any of the clauses in Article 24 of this Regulation.

2. Reduction in salary grade for the second violation of any of the clauses in Article 24 of this Regulation.

3. Must be reassigned to other work for the third violation of any of the clauses in Article 24 of this Regulation.

Section G. AUTHORITY TO HANDLE VIOLATIONS

Article 26. Minister of Transport.

1. Disciplinary action against the Director and Deputy Director of the Vietnam Highway Administration Bureau, General Director of the Road Management Zone.

2. Propose the Chairman of the People's Committee of provinces and centrally governed cities to consider and decide on disciplinary action against the Director of the Department of Transport and Public Works that fail to fulfill their responsibilities.

Article 27. Chairman of the People's Committee of provinces and centrally governed cities.

1. Disciplinary action against the Director and Deputy Director of the Department of Transport and Public Works.

2. Direct the Department of Planning and Investment, the Chairman of the People's Committee of districts and counties to carry out the revocation of business registration certificates of state-owned enterprises, enterprises belonging to other economic sectors, cooperatives according to the management hierarchy.

Article 28. Director of the Vietnam Highway Administration Bureau.

1. Discipline:

a) Staff of the advisory agencies of the Bureau;

b) Deputy General Director of the Road Management Zone;

c) Director and Deputy Director of transport units under the Bureau's management.

2. Revoke the approval for operating on the route as prescribed.

3. Propose the Chairman of the People's Committees of provinces and centrally governed cities to handle disciplinary actions against individuals, state-owned enterprises, enterprises belonging to other economic sectors, cooperatives according to the management hierarchy.

Article 29. General Director of the Road Management Zone.

1. Disciplinary action against staff of the advisory agencies of the Zone.

2. Revoke the approval for operating on the route as prescribed.

Article 30. Director of the Department of Transport and Public Works.

1. Discipline:

a) Staff of the advisory agencies of the Department of Transport and Public Works;

b) Director and Deputy Director of transport management units; Head and Deputy Head of the bus station management board and positions within authority.

2. Revoke the approval for operating on the route as prescribed.

3. Notify enterprises and cooperatives for the Board of Directors and managers to consider and decide when violations occur under Articles 19, 23, and 25 of this Regulation.

4. Propose the Chairman of the People's Committees of provinces and centrally governed cities, the Chairman of the People's Committees of districts and counties, and the Director of the Department of Planning and Investment to handle disciplinary actions against individuals, state-owned enterprises, enterprises belonging to other economic sectors, cooperatives.

Article 31. Director of transport enterprises and bus station exploitation, Management Board of cooperatives, Head of the bus station management board.

1. The Director of transport enterprises and bus station exploitation shall take disciplinary action against staff under their authority as prescribed by law.

2. The Board of Directors of enterprises and Management Board of cooperatives shall take disciplinary action against staff and cooperative members under their authority as prescribed by law.

3. Head of the bus station management board:

a) Take disciplinary action against staff under their authority as prescribed;

b) Prepare a record of handling violations under Clause 1 of Article 19 of this Regulation, handle or transfer to the competent authority for handling in accordance with the law.

Chapter 4:

IMPLEMENTATION

Article 32. The Director of the Vietnam Highway Administration Bureau, Director of the Department of Transport and Public Works, General Director of the Road Management Zone, Director of enterprises, Head of the bus station management board are responsible for disseminating this Regulation to relevant units and individuals for implementation.

Article 33. The Director of the Vietnam Highway Administration Bureau, Director of the Transport Department, Director of the Legal Affairs Department, Director of the Organization and Cadre Department, Director of the Department of Transport and Public Works, General Director of the Road Management Zone are responsible for organizing and supervising the implementation of this Regulation.

During the implementation process, if there are difficulties, organizations and individuals should promptly report in writing to the Ministry of Transport for research and appropriate amendments and supplements to fit the new mechanism./.
