Article 2. This Decision takes effect from the date of signature and replaces Decision No. 15/2001/QĐ-BKHCNMT dated June 11, 2001 of the Minister of Science, Technology, and Environment regarding the issuance of the "Provisional Regulations on the Selection of Organizations and Individuals to Lead State-Level Scientific and Technological Projects for the Period 2001-2005".
Article 3. The Heads of the Planning Department, the Department of Industrial Science and Technology Management, the Department of Agricultural Science and Technology Management, the Department of Social and Natural Science Management, the Director of the Ministry's Office, the Heads of units under the Ministry, and the Heads of related agencies and organizations are responsible for implementing this Decision./.

TEMPORARY PROVISIONS
REGARDING THE SELECTION OF ORGANIZATIONS AND INDIVIDUALS TO LEAD STATE-LEVEL SCIENTIFIC AND TECHNOLOGICAL PROJECTS FOR THE PERIOD 2001-2005

PART I. GENERAL PROVISIONS
Article 1.
The selection of organizations and individuals to lead scientific and technological projects (hereinafter referred to as the selection of organizations and individuals to lead projects) is a process of reviewing and evaluating applications to select organizations and individuals to lead projects according to the requirements set forth in these regulations.
Article 2.
These regulations apply to the selection of organizations and individuals to lead projects. Scientific and technological projects include research projects, research and development projects within national science and technology programs (referred to collectively as Science and Technology Programs), independent national projects, and other national science and technology tasks.
Article 3.
The Ministry of Science, Technology, and Environment (Ministry of KHCNMT) will announce summaries of the selection of organizations and individuals to lead projects on the VTV1 program of Vietnam Television, Voice of Vietnam Radio, and the People's Newspaper. Detailed announcements will be published fully in the Science and Development Newspaper, the Vietnam Science and Technology Information Network, the National Science and Technology Information Center (http://www.vista.gov.vn/), and the MOSTE Information Network (http://www.moste.gov.vn/) of the Ministry of KHCNMT.
Article 4.
Each individual may not simultaneously lead more than two state-level projects.
Each organization (hereinafter referred to as the organization) may simultaneously lead multiple scientific and technological projects (Science and Technology Projects).
CHAPTER II. CONDITIONS FOR PARTICIPATING IN SELECTION
Article 5.
1\. Organizations with legal personality and functions appropriate to the field of science and technology of the research topic have the right to participate in selecting the leading organization for the topic.
2\. Individuals registering to participate in selecting the leading organization for the topic (to be the head of the topic) must have expertise in the same field of science and technology as the selected research topic.
3\. Organizations and individuals shall not participate in the selection if they have not completed the settlement of accounts on time, or have not returned the recovered funds from experimental production projects or implementation trial topics.
CHAPTER III. REGISTRATION FOR PARTICIPATION IN SELECTION
Article 6.
The registration dossier for selection (hereinafter referred to as the Dossier) includes the following documents:
1\. The application form for the main implementation of state-level scientific and technological topics according to the prescribed format (form B1-1-ĐONTC-SĐ).form B1-1-ĐONTC-SĐ;
2\. Detailed description of the scientific research and technological development topic according to the prescribed model (form B1-2-TMĐT);
3\. Summary of scientific and technological activities of the organization applying to lead the topic (form B1-3-LLTC);
4\. Scientific curriculum vitae of the individual applying to be the head of the topic (form B1-4-LLCN);
5\. Legal document confirming the agreement of organizations and individuals applying to cooperate in research (form B1-5-PHNC) - if applicable.
Organizations and individuals participating in the selection need to send the dossier (each set includes: 01 original copy and 15 copies) to the Ministry of Science and Technology at 39 Tran Hung Dao Street, Hanoi (through the Post Office or directly) within the specified deadline. The dossier must be sealed and clearly marked on the outside:
Article 7.
1\. Name and address of the organization applying to lead the topic;
2\. Full name of the individual applying to be the head of the topic and list of participants in implementing the topic;
3\. Name of the topic being selected for the organization and individual to lead;
4\. Name and code of the Science and Technology Program (if it belongs to a program).
Dossiers must be submitted on time. The date of receipt of the dossier is considered the date stamped by the Hanoi Post Office (in case of submission through the Post Office) or the "received" stamp of the Ministry of Science and Technology's General Office (in case of direct submission).
The Ministry of Science and Technology will take the lead in opening the Dossier. Representatives of the Advisory Council for Selection, relevant agencies, and representatives of organizations and individuals applying for selection will be invited to attend.
During the period before the dossier submission deadline, organizations and individuals applying to participate in the selection have the right to withdraw their dossier to replace it with a new one, supplement or amend the submitted dossier. All supplements and amendments must be submitted within the specified deadline and become part of the dossier.
Article 8.
CHAPTER IV. ORGANIZATION OF DOSSIER EVALUATION
The Ministry of Science and Technology will take the lead in opening the dossiers. Representatives of the Advisory Council for Selection, relevant agencies, and representatives of organizations and individuals applying to participate in the selection will be invited to attend.
Article 9.
The process of opening the dossiers will be recorded in a protocol signed and stamped by the Ministry of Science and Technology, the signature of the representative of the Advisory Council for Selection, and the signature of the representative of the organization and individual applying to participate in the selection (if present).
Dossiers that meet the conditions stipulated in Articles 5, 6, 7, and 8 of this Regulation will be considered for evaluation.
1\. The evaluation of dossiers participating in the selection will be carried out through a Scientific and Technological Council.
Article 10.
3\. Individuals applying to be the head of the topic and those participating in implementing the topic shall not participate in the council selecting the organization and individual to lead the topic.
2. The selection evaluation will be based on the registered Dossier.
4\. The evaluation of dossiers must follow the unified criteria stipulated in Article 11 of this Regulation.
Evaluation of dossiers will be conducted using a scoring method based on the following three groups of criteria:
Article 11.
I\. Scientific value and practical value of the research content, implementation plan, and expected results
(maximum score of 70 points) 1\. Overview of domestic and international research situation and development trends)
demonstrating the necessary understanding of the organization and individual applying to lead the topic about the research field (having information about related research works, the latest research results in the research field, clearly stating the author's view on the urgency of the topic,...): Clearly explaining the approach and design of the research for the problem to be solved (scientifically, detailed; unique)
2. Determining the research content and methods:
Research content to solve the raised problem (reasonable; new, creative)
Research methods and techniques to be used - compared with similar solution methods (appropriate; new, creative)
Potential for applying research results
Demonstrating the involvement of the receiving agency in the implementation process of the topic (the topic has specific application addresses,...)
Feasibility of the transfer plan for research results
Having a feasible plan to link research with training and developing scientific and technological personnel
Clear and specific output products
For scientific and technological topics:
Detailing the type of product of the topic compared to the order.
Creating a quantity of products and specifying advanced quality indicators.
For social and humanistic scientific topics:
Creating specific and practical products to serve economic and social development (scientific basis reports for research issues, analysis reports of practical survey results, proposals and reasonable policy recommendations...).
II\. Competence of the individual and organization applying to lead the topic
maximum score of 25 points (1\. Research experience of the individual applying to be the head of the topic: number of years of experience, number of topics implemented in the research field.)
2\. Notable achievements in the research field of the individual applying to be the head of the topic:
Number of works published in specialized journals; number of works granted industrial property rights certificates; other related scientific and technological awards
Number of works applied or transferred, scale of application,...
1\. Organizational management capability of the individual applying to be the head of the topic (scientific and rational planning, progress implementation capability, ability to complete, etc...)
2\. Potential (related to the topic of selecting the organization and individual to lead) of the scientific and technological organization applying to implement the topic
Existing material facilities (equipment, workshops, etc.) ensuring the implementation of the topic
The existing material infrastructure (equipment, workshops, etc.) ensures the implementation of the research topic
Conditions ensuring human resources, workforce, and the structure of staff, professional qualifications, experience, and research achievements of those participating in implementing the project, ...
Existing capacity for international cooperation.
III. Reasonableness of the proposed budget (to be evaluated up to five points)
The reasonableness, practicality, and sufficient basis of the proposed budget, the level of detail of the budget estimate.
Ability to mobilize other sources of funding for the implementation of the project.
Article 12.
The Ministry of Science, Technology, and Environment establishes a State-level Scientific and Technological Council (hereinafter referred to as the Council) in accordance with the specialized field to provide advisory evaluation and selection of organizations and individuals primarily responsible for the project.
The Council consists of nine to fifteen members, including representatives of scientists, reputable technology experts familiar with the research field of the project, representatives of institutions registering to apply research results, and economists and managers.
The Council is responsible for its advisory work.
Article 13.
The Council assigns two experts deeply knowledgeable about the research field of the project to provide critical reviews and evaluations of all application forms for selecting the primary implementer of one (01) project. In necessary cases, the Council recommends the Ministry of Science, Technology, and Environment to invite experts outside the Council who are deeply knowledgeable about the research field of the project to provide critical reviews and evaluations of the application forms.
The reviewing expert is responsible for researching, analyzing, and comparing the application forms for selecting the primary implementer of one (01) project, conducting reviews and evaluations of each application form according to the criteria specified in Article 11 of this Regulation, writing a review and evaluation report for each application form.
The Council organizes meetings to discuss and evaluate by voting scores.
In case only one (01) application form participates in the selection process for primarily implementing one (01) project, the Council still organizes evaluations according to the standards and procedures stipulated in this Regulation.
The organization or individual recommended as the winner is the organization or individual whose application form ranks highest, but the average score must reach at least 70/100 points, of which the minimum score for scientific and practical value must reach 50/70 points.
The Council prioritizes the application forms that have an average score of 70/100 points or higher, of which the minimum score for scientific and practical value must reach 50/70 points, based on the following principles:
Average scores in descending order;
Prioritizing the score for scientific and practical value for application forms with the same average score;
Prioritizing the Chairman's score for application forms with the same average score and the same score for scientific and practical value;
For application forms with the same average score, the same score for scientific and practical value, and the same Chairman's score, the Council recommends the Ministry of Science, Technology, and Environment to consider and decide.
In case no application form achieves an average score of 70/100 points or higher for a project, the project will not be implemented in the planning year.
The Council discusses and recommends additional and necessary amendments to the contents mentioned in the project description and recommendations regarding the budget for implementing the project, or highlights points to note during the completion of the application forms of selected organizations and individuals.
The Council records the evaluation of the applications registered for selection and recommends the winning organizations and individuals.
The working method of the Scientific and Technological Council for selecting organizations and individuals primarily responsible for the national-level project phase 2001-2005 is separately defined in another document.
CHAPTER V. APPROVAL OF SELECTION RESULTS
Article 14.
Based on the working results of the Council, the Ministry of Science and Technology decides on the organizations and individuals who have been selected.
An individual participating in the selection process with two projects recommended for selection has the right to request choosing one (01) project to lead. The request must be submitted in writing to the Ministry of Science and Technology for consideration and decision.
In the event that a selected individual refuses the project they were chosen for, the organization or individual with the next highest total score will replace them. However, they still must ensure achieving at least 70 out of 100 points, including a minimum of 50 out of 70 points for scientific value and practical application..
Article 15.
The Ministry of Science and Technology announces the selection results to the selected organizations and individuals, to the management ministries of the selected organizations, to the direct management agencies of the selected individuals, and publishes the results in the Science and Development Newspaper, the Vietnam National Science and Technology Information Network (http://www.vista.gov.vn/), and the MOST Science and Technology Information Network (http://www.moste.gov.vn/).
Article 16.
After receiving the announcement of the selection results, the selected organizations and individuals are responsible for completing the project proposal file according to the Council's recommendations and submitting it to the Ministry of Science and Technology.
The Ministry of Science and Technology reviews and organizes the assessment of the project content and budget, and decides to approve the leading organization, the project leader, and the total budget for the entire implementation period of the project.
The approval decision of the Ministry of Science and Technology serves as the legal basis for signing contracts with the selected organizations and individuals and providing funding for the implementation of the project.
Article 17.
Relevant organizations and Council members must adhere to the selection discipline, maintain confidentiality regarding information related to the evaluation process for selecting organizations and individuals to lead projects.
The retention of Application Forms and related documents during the evaluation process is carried out in accordance with current regulations.
Article 18. This regulation takes effect from the date of signature.
Article 19. Ministries/sectors, provinces/cities directly under the central government may apply this regulation to study, develop, and issue regulations on the selection of organizations and individuals to lead projects within their jurisdiction.
