Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Maritime Code of Vietnam dated June 14, 2005;
Pursuant to the Law on Trade dated June 14, 2005;
Pursuant to the Customs Law dated June 29, 2001, and the Law Amending and Supplementing the Customs Law dated June 14, 2005;
Considering the proposal of the Minister of Transport (memorandum No. 5130/TTr-BGTVT dated August 22, 2005, and letter No. 7483/BGTVT-PC dated November 28, 2005), and the review opinion of the Ministry of Justice (letter No. 3172 TP/PLQT dated October 26, 2005),
DECISION:
Article 1. The Pilot Regulation for the Cát Lái Open Port Area under Tân Cảng Sài Gòn Company is hereby issued together with this Decision.
Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
Article 3. The Ministry of Transport shall take the lead and coordinate with the Ministries of National Defense, Trade, Finance, and relevant agencies to monitor and report to the Prime Minister any issues arising during the implementation of this Regulation. After one year of pilot implementation, the Ministry of Transport shall take the lead and coordinate with relevant agencies to conduct a summary and evaluation, reporting the results of the pilot to the Prime Minister, and at the same time perfect the Regulation on "Open Port Areas" applicable to other seaports in Vietnam for submission to the Government for consideration and decision.
Article 4. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally governed cities; General Director of Tân Cảng Sài Gòn Company and related organizations and individuals are responsible for implementing this Decision./.
