DECREE

Regulations on functions, tasks, powers, and organizational structure

of the Ho Chi Minh Mausoleum Management Board

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Considering the proposal of the Chairman of the Ho Chi Minh Mausoleum Management Board and the Minister of Interior Affairs.

DECREE:

Article 1. Position and Functions

The Ho Chi Minh Mausoleum Management Board is an agency under the Government, with the function of directing and coordinating relevant agencies and organizations in preserving the integrity and longevity, and absolutely ensuring the safety of President Ho Chi Minh's remains; managing and ensuring security, order, and organizing certain activities at the Ho Chi Minh Mausoleum, Ba Dinh Square, Heroes and Martyrs Memorial, Reception Area for the People, and related facilities in accordance with the provisions of the law.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

The Ho Chi Minh Mausoleum Management Board (hereinafter referred to as the Board) shall perform the following tasks and powers:

1. Submit to the Government draft decrees amending, supplementing, or replacing decrees stipulating the functions, tasks, powers, and organizational structure of the Ho Chi Minh Mausoleum Management Board; draft resolutions and decrees within the jurisdiction of the Government according to the laws on the management fields of the Board and organize their implementation after they are promulgated.

2. Submit to the Prime Minister strategic plans, master plans, long-term plans, five-year plans, annual plans, important projects and programs within the management scope of the Board; draft decisions, directives, and other documents within the directive and administrative control authority of the Prime Minister according to the law and organize their implementation after approval or promulgation.

3. Issue, guide, and inspect the organization and implementation of standards, procedures, and professional regulations applied in subordinate organizations and related units according to the provisions of the law.

4. Manage and maintain the Ho Chi Minh Mausoleum, Heroes and Martyrs Memorial, Ba Dinh Square, and related structures; care for flower gardens, ornamental trees, grass lawns, and environmental sanitation; plan the overall and detailed systems of technical infrastructure in the Ho Chi Minh Mausoleum area, Ba Dinh Square, Heroes and Martyrs Memorial, and Reception Area for the People in accordance with the overall and detailed planning of the Ba Dinh Central Political Zone.

5. Take the lead and coordinate with relevant Ministries, sectors, agencies, organizations, and localities in ensuring the preservation of the integrity and longevity, and absolute safety of President Ho Chi Minh's remains, and in managing the Ho Chi Minh Mausoleum, Ba Dinh Square, Heroes and Martyrs Memorial, and related facilities.

6. Take the lead and coordinate with the Ho Chi Minh Museum and the Ho Chi Minh Presidential Palace Relic Site to organize welcoming and serving the people and international guests visiting for cultural and political activities at the Ba Dinh Historical and Cultural Relic Complex.

7. Take the lead and coordinate with the Hanoi City People's Committee to organize welcoming the people and international guests visiting to pay respects to President Ho Chi Minh and commemorate Heroes and Martyrs.

8. Decide and organize the implementation of the administrative reform program of the Board according to the objectives and contents of the state administrative reform program after approval by the Prime Minister.

9. Manage the organizational structure, staffing; implement salary systems and incentive policies; recruit, appoint, dismiss, retire, terminate employment; reward and discipline cadres, civil servants, public officials, and employees under its management according to the law; train, develop, and build a cadre of cadres, civil servants, public officials, and employees under its authority.

10. Manage and implement investment projects within its jurisdiction according to the law.

11. Implement international cooperation in the assigned fields according to the law.

12. Organize scientific research and apply scientific and technological progress in specialized fields to serve assigned tasks.

13. Organize the implementation of certain public service activities according to the law.

14. Inspect compliance with policies, laws, and assigned tasks by organizations, individuals, cadres, civil servants, public officials, and employees under its authority; coordinate with relevant agencies to resolve complaints and denunciations related to cadres, civil servants, public officials, and employees under its authority according to the law; organize anti-corruption, thrift, bureaucracy, and arrogance against individuals and units under the Board.

15. Implement reporting systems to the Government, Prime Minister, and competent agencies according to the law.

16. Manage and utilize the budget, assets allocated, and other financial sources according to the law.

17. Perform other tasks assigned by the Government, Prime Minister, or according to the law.

Article 3. Organizational Structure

1. Subordinate organizations:

a) Board Office (the Board Office is organized into departments to perform advisory, support, and other tasks according to its assigned functions, tasks, and powers);

b) Ba Dinh Square Management Board;

c) Center for Scientific Research, Application of Science and Technology, and Environment.

2. Specialized affiliated organizations:

a) The Ho Chi Minh Mausoleum Protection Command, Ministry of National Defense;

b) Regiment 375 of the General Guard Command, Ministry of Public Security.

The Chairman issues the operational regulations of the Board and the coordination regulations of the specialized affiliated organizations after reaching consensus with the Minister of National Defense and the Minister of Public Security; directs and inspects the specialized affiliated organizations and subordinate organizations in implementing the regulations and assigned tasks.

The Chairman stipulates the functions, tasks, powers, organizational structure, and appoints, dismisses heads and deputies (not exceeding three persons) of the organizations specified in Clause 1 of this Article.

Article 4. Leadership of the Board

1. The Ho Chi Minh Mausoleum Management Board has a Chairman and not more than three Deputy Chairmen.

2. The Chairman is appointed, dismissed, or removed from office by the Prime Minister upon the recommendation of the Minister of National Defense and in accordance with the law; Deputy Chairmen are appointed, dismissed, or removed from office by the Prime Minister upon the recommendation of the Chairman, the Minister of National Defense, or the Minister of Public Security.

3. The Chairman is a general-level cadre of the Vietnam People's Army, responsible before the Government, Prime Minister, and the law for all activities of the Ho Chi Minh Mausoleum Management Board.

4. The Deputy Directors are the Heads of the specialized subordinate organizations, working on a concurrent basis, assisting the Director in directing certain areas of work according to the Director's assignment and being responsible before the Director and the law for the assigned tasks.

Article 5. Effectiveness and Responsibility for Implementation

1. This Decree takes effect fifteen days from the date of publication in the Official Gazette and replaces Government Decree No. 128/2003/NĐ-CP dated October 31, 2003, stipulating the functions, tasks, powers, and organizational structure of the Ho Chi Minh Mausoleum Management Board.

Article 2. Abolish previous provisions that conflict with this Decree.

3. The Director of the Ho Chi Minh Mausoleum Management Board, the Ministers, the Heads of ministerial-level agencies, the Heads of government-affiliated agencies, and the Chairpersons of provincial and centrally governed city People's Committees are responsible for implementing this Decree./.
