Circular No. 37/2011/TT-BGDĐT amending and supplementing certain provisions related to administrative procedures in Decision No. 31/2008/QD-BGDĐT dated June 23, 2008, issued by the Ministry of Education and Training on the regulations for teacher training and Decision No. 62/2007/QD-BGDĐT dated October 26, 2007, issued by the Ministry of Education and Training on the content and form of teacher recruitment in public preschool education institutions, primary and secondary schools, and continuing education centers.

Article 1. Amending and supplementing certain provisions of Decision No. 31/2008/QĐ-BGDĐT dated June 23, 2008 of the Ministry of Education and Training promulgating regulations on teacher training and Decision No. 62/2007/QĐ-BGDĐT dated October 26, 2007 of the Ministry of Education and Training promulgating regulations on the content and form of teacher recruitment in preschool education institutions, public primary and secondary schools, and continuing education centers as follows:

Article 2. Amending and supplementing Article 5 and Article 10 of Decision No. 31/2008/QĐ-BGDĐT dated June 23, 2008 of the Ministry of Education and Training promulgating regulations on teacher training (hereinafter referred to as Decision No. 31/2008/QĐ-BGDĐT) as follows:

1. Article 5 of Decision No. 31/2008/QĐ-BGDĐT shall be amended and supplemented as follows:

"Article 5. Procedure for assigning tasks for teacher training
1. Regulations on the format of the application and project for teacher training The Minister of Education and Training shall decide to assign tasks for teacher training to each training target when the training institution meets the conditions specified in Article 4 of this regulation. A training institution that wishes to undertake the task of teacher training must prepare an application for undertaking the task of teacher training for each training target and submit it to the Ministry of Education and Training. The application includes:
a) An application for undertaking the task of teacher training for each training target (in the format prescribed in Appendix I attached hereto);
b) A project for teacher training for each training target (in the format prescribed in Appendix II attached hereto).
2. Assignment process: Within thirty days from the date of receipt of complete and valid applications, the Ministry of Education and Training will organize the examination of the applications for teacher training tasks according to Article 4 of this regulation. In cases where higher education institutions meet all the required conditions, the Ministry of Education and Training will issue a decision to assign the task of teacher training. In cases where the educational institution does not meet the required conditions, the Ministry of Education and Training will notify the results of the examination and specify the reasons in writing.
3. The number of sets of application materials is one set.

2. Article 10 of Decision No. 31/2008/QĐ-BGDĐT shall be amended and supplemented as follows:

"Article 10. Procedure for registering for teacher training
1. Application materials for registering for teacher training for each training target are stipulated by the training institution assigned the task.
2. Applicants must submit their application materials for registering for teacher training to the training institution at least thirty days before the selection process.

1. Clause 1, Article 5 of Decision No. 62/2007/QĐ-BGDĐT shall be amended and supplemented as follows:

"1. Application for registration as a civil servant (in the format prescribed in Appendix III attached hereto). The applicant must commit in the application for registration about the current conditions and standards as publicly announced and bear legal responsibility for the copies of diplomas, certificates, and other related documents submitted in the application for registration; commit to voluntarily serving in remote, border, and island areas (if applicable)".

2. Clause 4, Article 5 of Decision No. 62/2007/QĐ-BGDĐT shall be amended and supplemented as follows:

"4. Unofficial copies (without notarization or certification by authorized agencies) of diplomas, certificates, and transcripts consistent with the requirements of the position applied for, and certificates of priority in recruitment (if applicable). When selected, the applicant must bring the originals to the recruiting agency for verification."

3. Clause 6, Article 5 of Decision No. 62/2007/QĐ-BGDĐT shall be abolished.

4. Sub-clause c, Clause 5, Article 13, Chapter IV of Decision No. 62/2007/QĐ-BGDĐT shall be amended as follows:

"c) After receiving the decision recognizing the recruitment results from the competent authority, the head of the unit signs the employment contract in accordance with the regulations and reports the list of recruited personnel to the competent authority managing teachers for monitoring."

Article 4. This Circular takes effect from October 1, 2011.

Article 5. The Director of the Office, Heads of units under the Ministry of Education and Training, Chairpersons of People's Committees of provinces and centrally governed cities, Directors of Departments of Education and Training, Principals of secondary schools, high schools, and comprehensive schools with multiple levels are responsible for implementing this Circular./.
