JOINT CIRCULAR

Guidelines on the functions, tasks, powers, and organizational structure of the Animal Health Service under the Department of Agriculture and Rural Development

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; and Decree No. 75/2009/NĐ-CP dated September 10, 2009 of the Government amending and supplementing Article 3 of Decree No. 01/2008/NĐ-CP dated January 3, 2008;

Pursuant to Decree No. 48/2008/NĐ-CP dated April 17, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to Decree No. 33/2005/NĐ-CP dated March 15, 2005 of the Government detailing the implementation of certain provisions of the Animal Health Ordinance;

The Ministry of Agriculture and Rural Development and the Ministry of Home Affairs hereby issue guidelines on the functions, tasks, powers, and organizational structure of the Animal Health Service under the Department of Agriculture and Rural Development of provinces and centrally governed cities (hereinafter referred to collectively as provincial level) as follows:

Article 1. Position and Functions

1. The Animal Health Service is an organization under the Department of Agriculture and Rural Development, assisting the Director of the Department of Agriculture and Rural Development in advising the People's Committee at the provincial level to perform state management functions in animal health (including aquatic animal health) within the province.

2. The Animal Health Service has legal personality, a headquarters, a seal, operational funds, and a separate bank account in accordance with the law.

3. The Animal Health Service is subject to the direction and management of the Department of Agriculture and Rural Development regarding organization, staffing, and operations; it is also subject to guidance and inspection by the Animal Health General Department under the Ministry of Agriculture and Rural Development concerning its professional and technical matters.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Advising and assisting the Director of the Department of Agriculture and Rural Development in submitting to competent authorities for issuance of normative legal documents, strategies, plans, programs, projects, standards, technical regulations, procedures, norms, and economic-technical quotas in the specialized field and area under its jurisdiction.

2. Implementing normative legal documents, strategies, plans, programs, projects, standards, technical regulations, procedures, norms, and economic-technical quotas in the field of animal health that have been approved; disseminating and popularizing laws related to the specialized field and area under its jurisdiction.

3. Submitting to the Director of the Department of Agriculture and Rural Development for issuance or issuing within their authority individual normative legal documents in the specialized field and area under their jurisdiction.

4. Prevention and control of animal diseases:

a) Organizing inspections and supervision of the implementation of projects and programs to control and eradicate animal diseases, compiling and reporting on the results of such implementation;

b) Regularly or urgently inspecting and supervising animal diseases listed in the Catalogue of Diseases Subject to Inspection as prescribed by the Ministry of Agriculture and Rural Development at breeding facilities and production bases within the province (excluding those managed by the central government and national breeding centers);

c) Organizing inspections and supervision of the implementation of vaccination plans for compulsory diseases as prescribed by the Ministry of Agriculture and Rural Development;

d) Conducting diagnosis, testing, and treatment of animal diseases; inspecting and supervising compliance with regulations on disease prevention and control; investigating, monitoring, and detecting outbreaks of animal diseases; guiding quarantine, handling of disease foci, disinfection, and restoration of livestock farming environments after disease outbreaks;

đ) Guiding preventive and control measures against animal diseases; guiding the network of veterinary services at communes, wards, and towns (hereinafter referred to as commune-level veterinary services) in monitoring, detecting, preventing, and handling new disease foci and controlling old ones;

e) Reporting to the Department of Agriculture and Rural Development to request the Chairman of the Provincial People's Committee to declare and announce the end of animal disease outbreaks;

g) Cooperating with the Forest Protection Service in assessing hygiene conditions and monitoring disease situations at wildlife breeding facilities within the province;

h) Mobilizing individuals and organizations engaged in veterinary practice within the province to participate in vaccinating animals against diseases and in combating animal disease outbreaks;

i) Requiring individuals and organizations engaged in veterinary practice to provide information on animal disease situations and report on their veterinary practice activities as prescribed.

5. Establishing disease-free zones and safe premises:

a) Advising and assisting the Director of the Department of Agriculture and Rural Development in submitting to the Provincial People's Committee for approval projects, programs, and plans to establish disease-free zones and safe premises within the province;

b) Fulfilling the responsibilities of the state management agency for animal health regarding disease-free zones and safe premises in accordance with the regulations of the Ministry of Agriculture and Rural Development;

6. Animal quarantine, product quarantine; slaughterhouse control; hygiene inspection:

a) Carrying out quarantine of animals and animal products circulating domestically; managing and supervising imported animals and animal products after quarantine isolation periods;

b) Quarantining animals and animal products for export, import, temporary import for re-export, temporary export for re-import, transshipment, and transit through Vietnam's territory at authorized border gates in accordance with the law;

c) Organizing the implementation of slaughterhouse controls; processing, preserving, and trading in animal products for domestic consumption;

d) Inspecting hygiene of live and processed animal products circulating in the market; feed ingredients and raw materials for feed production derived from animals; animal waste at concentrated livestock farms, slaughterhouses, and processing facilities within the jurisdiction.

đ) Inspect veterinary hygiene conditions and issue veterinary hygiene certificates for centralized livestock breeding facilities; production and business facilities for animal breeds (excluding centralized livestock breeding facilities managed by the central government and national breeding facilities); animal slaughter facilities, initial processing, manufacturing, packaging, and preservation facilities for animal products for domestic consumption; business establishments selling live animals and initially processed animal products; quarantine zones, isolation areas, disease-free zones, and safe animal disease control facilities according to the delegation from the Department of Animal Health;

e) Inspect veterinary hygiene conditions; guide and supervise the implementation or directly carry out cleaning, disinfection, and decontamination at locations where animals and animal products participate in fairs, exhibitions, sports, and artistic performances;

g) Guide and supervise the implementation or directly carry out cleaning, disinfection, and decontamination for facilities related to veterinary activities, transportation vehicles, containers holding animals and animal products, and animal waste; handle animals and animal products that do not meet veterinary hygiene standards; handle waste, transportation vehicles, and items related to animals and animal products that do not meet veterinary hygiene standards;

h) Issue and revoke quarantine uniforms; revoke animal quarantine officer cards and animal quarantine signs according to regulations;

i) Coordinate with units under the Department of Animal Health to appraise locations and veterinary hygiene conditions during the construction of animal slaughter facilities, initial processing, and preservation facilities for animal products for export, and quarantine zones for imported and exported animals;

7. Manage veterinary drugs, biological preparations, microorganisms, and chemicals (hereinafter referred to as veterinary drugs) used in veterinary practices, except for products used to treat and improve aquatic environments:

a) Manage the sale and use of veterinary drugs within the province according to the provisions of the law;

b) Guide the use of various types of veterinary drugs for disease prevention, treatment, and epidemic control in animals;

c) Appraise veterinary hygiene conditions for drug testing and trial facilities and supervise the drug testing and trial process according to regulations;

d) Inspect and issue certificates of eligibility for retail stores and agents selling veterinary drugs within the province;

8. Issue and revoke the following types of veterinary practice licenses:

a) Vaccination, laboratory testing (including non-clinical testing), disease diagnosis, prescription writing, disease treatment, and animal health care;

b) Animal surgery;

c) Veterinary drug sales;

d) Consulting and other services related to veterinary practices;

9. Issue and revoke veterinary certificates according to the provisions of the law;

10. Organize the management of the collection, payment, and use of fees and charges according to the provisions of the law;

11. Train, enhance, and improve the professional skills of civil servants and employees of the District Office;

12. Conduct training and enhance knowledge on professional skills, policies, and laws related to veterinary practices for village-level veterinary staff and individuals and organizations involved in veterinary activities within the province;

13. Organize the implementation of veterinary technical services according to general legal provisions;

14. Organize the implementation of international cooperation activities in veterinary practices according to regulations; research and apply scientific and technological advancements in veterinary practices;

15. Carry out specialized inspection functions in veterinary practices according to the provisions of the law. Resolve disputes, complaints, and accusations in the field of veterinary practices;

16. Report periodically and urgently on the situation of animal diseases, animal quarantine, animal products, slaughter control, veterinary hygiene inspections, veterinary drug management, and other activities related to veterinary practices according to the guidelines of the Department of Animal Health;

18. Perform other tasks assigned by the Director of the Department of Agriculture and Rural Development;

Article 3. Organizational Structure

1. Leadership of the Sub-Department:

a) The District Office has a Director and no more than three Deputy Directors;

b) The Director is responsible before the Director of the Department of Agriculture and Rural Development and the law for all activities of the District Office. The Deputy Director is responsible before the Director and the law for the assigned work area;

c) The appointment, dismissal, and removal of the Director and Deputy Directors shall be carried out according to the law and the delegation of the provincial People's Committee;

2. Organizational Structure:

Based on the workload, nature, and characteristics of state management in veterinary practices in the locality, the Director of the Department of Agriculture and Rural Development, in coordination with the Director of the Department of Personnel Affairs, shall submit to the Chairman of the provincial People's Committee for decision on the specific number and names of the District Office's organizations as follows:

a) The number of professional departments of the District Office shall not exceed four, ensuring comprehensive coverage of the following basic areas: administrative and general affairs; veterinary epidemiology; animal quarantine; community veterinary services;

For provinces without a Livestock Breeding Department under the Department of Agriculture and Rural Development and where the District Office is tasked with specialized livestock breeding management, the District Office may establish an additional Livestock Breeding Department, and the Department of Agriculture and Rural Development shall not establish additional specialized departments in this field;

b) Subordinate units:

- County, district, town, and city animal health stations (hereinafter referred to as county-level animal health stations);

- Animal Disease Diagnosis and Treatment Station;

- Animal Quarantine Stations at major transportation hubs (established according to the planning of the Ministry of Agriculture and Rural Development);

- Animal Quarantine Stations at border gates authorized by law;

These subordinate stations of the District Office have their own offices, seals, and operational funds according to the provisions of the law;

c) The appointment and dismissal of department heads, deputy department heads, station chiefs, and deputy station chiefs shall be carried out according to the law and the delegation of the Department of Agriculture and Rural Development;

d) The Director of the District Office shall define the functions, responsibilities, and operating procedures of subordinate units according to the delegation of the Department of Agriculture and Rural Development.

3. Staffing:

a) The establishment quota of civil servants of the Agency, including the head of the agency, deputy head of the agency, and personnel working in specialized departments of the Agency;

b) The establishment quota of public service staff of the Agency shall be allocated by the Director of the Department of Agriculture and Rural Development based on the total establishment quota for public service staff of the Department assigned by the People's Committee of the province.

Article 4. Effective date

This Circular takes effect 45 days from the date of issuance.

Article 5. Responsibilities for Implementation

1. The People's Committee of the province is responsible for organizing the implementation of this Joint Circular.

2. In the course of implementation, if there are difficulties or obstacles, the People's Committee of the province is requested to report to the Ministry of Agriculture and Rural Development for coordination with the Ministry of Home Affairs to consider and resolve them.
