activities of calibration, verification, testing vocational training for railway security guards

Pursuant to Decree No. 55/2006/NĐ-CP dated May 31, 2006 on the organization, tasks, powers, equipment, uniforms, insignia, and auxiliary tools of railway security forces fire;

Pursuant to Decree No. 106/2014/NĐ-CP dated November 17, 2014, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director of the Traffic Police Corps;

Article 3. Purpose of Implementing Democracy in Fire Prevention, Fighting, and Rescue Workon vocational training for railway security guards.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the subjects, program contents, responsibilities for training, and the model of the Certificate of Completion of Railway Security Guard Vocational Training (hereinafter referred to as the Certificate).

Article 2. Applicability

1. Police officers and non-commissioned officers of the People's Public Security performing the task of vocational training for railway security guards.

2. Public security units and localities.

3. Railway security forces under enterprises operating rail transport on national railways (hereinafter referred to as railway security forces).

4. Enterprises operating rail transport on national railways.

Chapter II

SPECIFIC PROVISIONS

Article 3. Responsibilities for training and ensuring funding for railway security guard vocational training

1. The Traffic Police Department shall be responsible for training railway security guards in their vocational duties.

2. Enterprises operating rail transport that request training shall bear responsibility for the funding to organize such training.

Article 4. Subjects of training and content of the training program for railway security guard vocational training

1. Railway security forces shall be trained in their vocational duties according to the provisions of this Circular.

2. Content of the training program

Railway security forces shall be trained in theory for six working days and in practice for four working days with specific contents as follows:

a) In theory

- Legal knowledge on ensuring railway security, public order, and traffic safety;

- Work on ensuring railway security, public order, and traffic safety;

- Propaganda and mobilization work to encourage the public to participate in maintaining railway security, public order, and traffic safety;

- Situation awareness work on railway security, public order, and traffic safety;

- Fire prevention and firefighting work of railway security forces.

b) In practice: training basic martial arts movements, techniques for moving around on trains, and methods of communication using signs and signals.

Article 5. Responsibilities of the Traffic Police Department and related units of the Ministry of Public Security

1. Responsibilities of the Traffic Police Department

a) Guidance on vocational training for railway security guards;

b) Taking the lead and coordinating with units specified in Clause 2 of this Article to develop the content of the vocational training program for railway security guards and arrange personnel to teach and train vocational skills for railway security guards; arranging locations for training;

c) Organizing vocational training for railway security guards; issuing Certificates of Completion of Railway Security Guard Vocational Training to eligible subjects; guiding the management and use of Certificates in accordance with the law;

d) Guidance on examination formats, grading scales for passing and failing according to the training content specified in Clause 2 of Article 4 of this Circular;

e) Monitoring and retaining relevant files concerning vocational training for railway security guards.

2. Responsibilities of related units of the Ministry of Public Security

The National Security总局，公安部刑事侦查局，公安部政治部，公安部特勤局，公安部消防局和救援局以及公安部其他相关单位应与公安部交通警察局合作编写本通令第四条第二款规定的铁路保安人员职业培训内容，并根据公安部交通警察局的要求派遣其管辖范围内的人员参与讲授和培训铁路保安人员的职业技能。

Article 6. Sample of the Certificate of Completion of Security Training on Railways

The certificate shall be made of white paper with dimensions of 85.6mm in length and 53.98mm in width; specifically:

1. The front side has a light yellow background; at the top is the text "SOCIALIST REPUBLIC OF VIET NAM", font size 10, Times New Roman style, all caps, bold; below it is the text "Independence - Freedom - Happiness", font size 11, Times New Roman style, bold; in the center is the text "CERTIFICATE OF INSURANCE OR OTHER FINANCIAL SECURITY" (in red color), font size 12, Times New Roman style, all caps, bold; and below that is the text "COMPLETED SECURITY TRAINING ON RAILWAYS" (in black color), font size 10, Times New Roman style, all caps, bold.

Front Side:

2. The back side has a pink floral patterned background, black text, font size 10, Times New Roman style; specifically, from top to bottom on the left side is a color photograph of the certificate holder measuring 2cm x 3cm, in a frontal portrait wearing the autumn-winter uniform of railway security personnel, badge, cap, and serial number, validity period of the certificate. On the right side from top to bottom are the following information: full name, year of birth, position, place of work, date of issuance of the certificate, and authority issuing the certificate. The stamp on the certificate is a reduced version of the Traffic Police Inspectorate's seal.

Article 7. Printing and Managing the Sample of the Certificate

1. The Traffic Police Inspectorate shall organize the printing and management of the sample of the certificate as stipulated in Article 6 of this Circular.

2. The management of the sample of the certificate shall be carried out according to the operational file system of the Traffic Police.

3. The budget for printing the sample of the certificate shall be allocated annually in the State budget estimate of the Ministry of Public Security. Annually, the Traffic Police Inspectorate shall be responsible for preparing the quantity of samples needed for printing and the printing cost estimate, which shall be submitted to the Ministry of Public Security's Financial Inspectorate for consolidation and preparation of the budget estimate for review and decision by the leadership of the Ministry of Public Security.

Chapter III

IMPLEMENTATION

Article 8. Effective Date

This Circular takes effect from November 10, 2016, and replaces Decision No. 1669/2007/QĐ-BCA(C11) dated December 25, 2007, of the Ministry of Public Security on the sample of the Certificate of Completion of Security Training on Railways.

Article 9. Responsibility for implementation

1. The Director of the General Traffic Police Corps is responsible for guiding, inspecting, and urging the implementation of this Circular.

2. The Directors of the General Departments, Heads of units under the Ministry of Public Security, Provincial Police Chiefs, Fire and Rescue Services Directors of centrally governed cities and relevant organizations and individuals shall be responsible for implementing this Circular.

During implementation, if there are difficulties or obstacles, local police units, relevant organizations, and individuals shall report to the Ministry of Public Security (through the Traffic Police Inspectorate) for timely guidance./.
