Circular No. 37/2020/TT-BTC stipulates that from May 7, 2020 to the end of 2020, the level of fees and charges in the securities sector shall be reduced by 50% compared to the previous level. From January 1, 2021 onwards, the original levels will be applied.

CIRCULAR

Regulations on the amount of fees and charges to be collected and paid in the securities sector

   Pursuant to the Law on Fees and Charges dated November 25, 2015;

   Pursuant to Decree No. 87/2017/ND-CP dated July 26, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

   In accordance with the proposal of the Director of the Tax Policy Department;

   The Minister of Finance hereby issues this Circular stipulating the amount of fees and charges to be collected and paid in the securities sector.

Article 1. Amount of fees and charges to be collected and paid in the securities sector

Organizations and individuals who are required to pay fees and charges as prescribed in Article 2 of Circular No. 272/2016/TT-BTC dated November 14, 2016 of the Minister of Finance stipulating the amount of fees and charges, the collection system, payment, management, and use of fees and charges in the securities sector (hereinafter referred to as Circular No. 272/2016/TT-BTC) shall implement the payment of fees and charges as follows:

1. From May 7, 2020 to December 31, 2020, pay fees and charges at 50% of the amounts of various fees and charges (excluding the two items of fees and charges specified in Clause 2 of this Article) as prescribed in the Table of Fee and Charge Collection Rates in the Securities Sector attached to Circular No. 272/2016/TT-BTC.

During the period of applying the fee and charge collection rates as prescribed in Clause 1 of this Article, the full rate (100%) of fees and charges prescribed in the Table of Fee and Charge Collection Rates attached to Circular No. 272/2016/TT-BTC shall not be applied.

2. The amount of fees for issuing, renewing, and reissuing securities business practice certificates for individual securities practitioners at securities companies, investment fund management companies, and investment securities companies, and the supervision fee for securities activities shall be implemented according to the provisions in the Table of Fee and Charge Collection Rates attached to Circular No. 272/2016/TT-BTC.

3. From January 1, 2021 onwards, pay fees and charges in the securities sector according to the provisions in the Table of Fee and Charge Collection Rates attached to Circular No. 272/2016/TT-BTC.

Article 2. Implementation

1. This Circular takes effect from May 7, 2020 to December 31, 2020.

2. Matters concerning the scope of regulation, applicable subjects, organization of collection, declaration, payment, management, use, collection receipts, publicizing the fee and charge collection system, and other related matters not stipulated in this Circular shall be implemented according to the provisions of Circular No. 272/2016/TT-BTC.

3. During the implementation process, if there are any difficulties, organizations and individuals are requested to promptly report to the Ministry of Finance for research and supplementary guidance.
