OF THE MINISTRY OF LABOR AND SOCIAL AFFAIRS NUMBER 37-TBXH ON NOVEMBER 6, 1984
GUIDELINES FOR IMPLEMENTING RESOLUTION NUMBER 128-HĐBT ON OCTOBER 8, 1984
OF THE COUNCIL OF MINISTERS.
Implementing Resolution No. 128-HĐBT dated October 8, 1984 of the Council of Ministers to supplement and amend certain benefits for cadres who were engaged in revolutionary activities before August 1945; after consultation with the Ministry of Finance, the Central Organization Bureau, and the Government's Organization Bureau, the Ministry of Labor and Social Affairs guides implementation as follows:
I. SUBJECTS ELIGIBLE FOR BENEFITS UNDER RESOLUTION
NUMBER 128-HĐBT
The cadres eligible for the benefits stipulated in Resolution No. 128-HĐBT dated October 8, 1984 of the Council of Ministers are:
a) Retired cadres (including workers and civil servants, armed forces personnel) or those who have long resided in communes, wards, towns and have been recognized by the Party, Youth League, cadre management boards, or councils of ministries, general departments (if working at central agencies) or provincial committees, municipal committees, special zone committees under the central authority (if working at local agencies) as cadres engaged in revolutionary activities before August 1945, as guided in Circular No. 7-TT/TC dated March 21, 1979 and Circular No. 26-TC/TW dated October 22, 1984 of the Central Organization Bureau.
b) Retired cadres or those who have long resided in communes, wards, towns and now request recognition as cadres engaged in revolutionary activities before August 1945 must refer not only to Circular No. 7-TT/TC but also to Circular No. 26-TC/TW dated October 22, 1984 of the Central Organization Bureau.
The Department of Veterans and Social Affairs shall base on the confirmation of competent Party levels, compile a list, and transfer it to relevant state agencies to implement the provisions of Resolution No. 128-HĐBT.
II. IMPLEMENTATION OF BENEFITS UNDER RESOLUTION NUMBER 128-HĐBT
A. For retired cadres:
In addition to retirement allowances according to general regulations, retired cadres shall enjoy the following benefits:
1. Preferential Allowance: For each year of revolutionary activity before August 1945, a monthly allowance of 20 dong is granted. This provision takes effect from October 1, 1984, replacing Article 1 of Decision No. 296-CP dated November 20, 1978 of the Council of Ministers.
For cadres who were engaged in revolutionary activities before August 1945 and retired prior to the issuance of social insurance regulations, and who have been receiving retirement benefits according to Circular No. 11-NV dated September 20, 1966 of the Ministry of Interior (now the Ministry of Labor and Social Affairs), in addition to their current retirement benefits, they will also receive additional allowances calculated based on years of revolutionary activity before August 1945, similar to currently retired cadres.
2. Food Coupons:
a) Cadres who were engaged in revolutionary activities since 1935 and currently receive food coupons of type C or C1 shall be issued food coupons of type B (according to current standards); the remainder shall be issued food coupons of type C1.
b) Cadres who were engaged in revolutionary activities from 1936 to before the August Revolution of 1945 and currently receive food coupons of type C1 shall be issued food coupons of type B (according to current standards), those currently receiving food coupons of type C shall be issued food coupons of type C1, and those currently receiving food coupons of type D, Đ, E shall be issued food coupons of type C as stipulated in Resolution No. 128-HĐBT.
To ensure timely implementation of food coupon distribution for cadres who were engaged in revolutionary activities before August 1945 in accordance with new regulations, the labor and social affairs agency, together with the organizational department of the Party, shall base on the files under management to compile a list and transfer it to the financial agency for the issuance of food coupons.
The period during which food coupons can be enjoyed according to the new regulations begins from when the financial agency receives the list from the labor and social affairs sector, no later than 1984.
B. For cadres who have long resided in communes, wards, towns (engaged in activities at the commune, ward, town level):
1. Preferential Allowance: For each year of revolutionary activity before August 1945, a monthly allowance of 20 dong is granted. This provision replaces Article 1 of Decision No. 296-CP dated November 20, 1978 of the Council of Ministers.
2. Previously, there was no system for issuing cloth, grain, and food coupons; now, the State has established the following systems:
- Cloth coupons are issued according to the regime for cadres, workers, and civil servants (including price differences for cloth) starting from 1985.
- Grain is issued through grain coupons (or books) according to standards and prices for retired cadres, to be implemented when conditions permit (no retroactive payments), no later than December 1984.
- Food purchase money:
a) Cadres who were engaged in revolutionary activities since 1935 shall receive 300 dong per month.
b) Cadres who were engaged in revolutionary activities from 1936 to before August 1945 shall receive 200 dong per month.
The implementation of food purchase money starts from October 1, 1984. - Funeral expenses: When cadres who have long resided in communes, wards, towns pass away, funeral expenses are provided according to the regime for retired cadres.
C. Regarding Certain General Regimes:
All retired cadres or those who have long resided in communes, wards, towns (engaged in activities at the commune, ward, town level) shall enjoy the following benefits:
1. Daily newspaper subscription. They are entitled to a regular daily newspaper subscription (except for cadres already entitled to the People's Newspaper). The labor and social affairs agency shall compile a list of cadres eligible for local newspapers and transfer it to the cultural and information agency responsible for distributing these newspapers according to place of residence.
The cost of purchasing this newspaper is budgeted by the labor and social affairs agency and covered by the local government budget.
2. Medical examination and treatment:
Those who already have medical examination and treatment standards set by organizations shall continue to follow the current regulations. For those without such standards, the Department of Veterans and Social Affairs shall consult with the Health Department and the Organizational Bureau to establish specific standards according to general policies and local capabilities.
3. Benefits for families when cadres pass away:
Families of cadres who were engaged in revolutionary activities before August 1945, upon their passing, in addition to the general benefits, if they still have dependents to support, shall receive additional benefits for six months (excluding grain).
Afterward, if the family faces difficulties, the locality shall take responsibility to assist in resolving urgent or ongoing difficulties.
III. REGARDING PROCEDURES AND FILES.
1. For retired cadres who have been receiving preferential allowances under Article 1 of Decision No. 296-CP dated November 20, 1978 of the Council of Ministers, the social welfare agency where they reside shall base on the files currently managed or the retirement allowance book to calculate preferential subsidies according to the number of years of revolutionary activities before August 1945 (as mentioned in Point 1, Part A, Section II above) and adjust them into the retirement allowance book and payment vouchers.
Some cases that retired earlier and were recognized by the Party Committee of the Ministry, General Department, or the Organization Department of the Provincial or Municipal Party Committee as cadres engaged in revolutionary activities before August 1945 will still be resolved. Cases from December 1984 onwards must be recognized by the Party, Youth League, or the Organization Department of the Provincial or Municipal Party Committee as stipulated in Circular No. 26-TC/TW of the Central Organization Department to be resolved.
2. After reaching an agreement with the Central Organization Department, the Government's Organization Department, and the Ministry of Finance, from now on, the social welfare sector will directly manage and implement the systems for cadres engaged in revolutionary activities before August 1945 who have been residing in communes, wards, or towns. The Provincial or Municipal Party Committee's Organization Department or the Organization Department of the Provincial People's Committee will transfer the files of these comrades to the Social Welfare Department so that the Social Welfare Department can replace the allowance books and payment vouchers (using the retirement allowance books and payment vouchers of retired cadres marked with the CM symbol on the first page).
The expenses for preferential subsidies, price differential compensation for cloth, food purchase money, and funeral expenses all fall under the central social insurance fund, except for newspaper purchase money which is covered by the local budget.
The decision of the Party and State to supplement and amend certain systems for cadres engaged in revolutionary activities before August 1945 reflects the concern of the Party and State, the responsibility of various sectors and levels in caring for these comrades, and the gratitude of the people for their contributions in the struggle for the country and the people. Therefore, responsible levels and agencies need to actively implement this policy thoroughly, promptly, and effectively.
