Joint Circular No. 37-TT-LB stipulates the temporary regulations on granting scholarships to students and pupils in the northern region at university, vocational high school, and vocational primary school classes.

Regulations on Temporary Scholarship Granting System for Students in Northern Universities, Vocational Secondary Schools, and Primary Vocational and Specialized Schools

Implementing Circular No. 12-TTg dated January 31, 1964 of the Prime Minister regarding the amendment of scholarship granting systems for university and vocational education levels, and the resolution of the Standing Committee of the Council of Ministers at its meeting on July 16, 1964.

After exchanging opinions with some Ministries having universities and vocational secondary schools, and some localities, the Ministry of Education and Finance re-regulates the temporary system for granting scholarships to students in universities, vocational secondary schools, and primary vocational and specialized schools as follows:

I. ELIGIBILITY FOR SCHOLARSHIP GRANTING.

Chapter I. ELIGIBILITY FOR SCHOLARSHIP GRANTING.

Based on the spirit of the resolution of the Standing Committee of the Council of Ministers, from the academic year 1964-1965 onwards, the State will only grant scholarships to certain eligible groups to assist excellent students with good moral character and extremely poor families, take care of families with meritorious service to the revolution and ethnic minorities. Specifically:

1. Excellent students with good moral character but extremely poor families.

- In terms of study: must have two-thirds or more subjects with excellent grades, the rest with good grades.

- In terms of moral character: must have good moral character, be exemplary in study, work, and all tasks assigned by the school and youth organizations, have good conduct, and be classified as type A.

- In terms of family economic conditions: based on the economic conditions specified in Section II, depending on specific circumstances, may be granted a higher standard than the general standard or full scholarship.

If the student achieves excellent grades in only fifty percent or more of the subjects tested and inspected, with the rest being good grades and no average grades, they will also be considered for this category and may be granted a higher standard than the general standard.

2. Students who are currently studying and have good grades and moral character, but whose families have encountered unexpected accidents leading to special difficulties, making it impossible to continue their studies.

The criteria for this category are as follows:

- In terms of study: must be classified as above average.

- In terms of moral character: as with the categories above.

- In terms of family economic conditions: the family's income has significantly decreased due to unexpected accidents (natural disasters, fires, death or loss of labor capacity of the main breadwinner...) causing the average income level in the family to decrease by thirty percent or more over a period of time compared to the average income level in the province.

This category does not include newly admitted students; it only applies to students currently enrolled who have completed at least one semester and can only be granted scholarships for that academic year.

All students in these categories are eligible for scholarships based on the general economic standards specified in Section II.

3. Students from families with meritorious service to the revolution.

This category includes:

- Children of martyrs: based on the definition provided in Decree No. 980-TTg dated July 27, 1956 of the Prime Minister (Official Gazette No. 29, 1956).

- Children of deceased soldiers: children of military personnel who died or went missing while serving, as defined in Circular No. 38-TT-LB dated August 1, 1962 of the Ministry of Interior and Finance (Official Gazette No. 30, 1962).

- Children of workers and officials who died in accidents while on duty.

- Children of disabled veterans: as defined in Decree No. 18-NĐ dated November 17, 1954 of the Ministry of Veterans Affairs, National Defense, and Finance.

- Children of long-serving officials: officials who have been engaged in revolutionary activities since before the August Revolution in 1945, those covered by Circular No. 03-NV dated February 1, 1963 of the Ministry of Interior and Circular No. 32-TT-TC dated October 14, 1960 of the Central Organization Department of the Vietnam Labor Party.

- Children of military personnel, civil servants, and party members who have been awarded medals or war merit awards, or children of families awarded certificates of Merit to the Country or War Merit Medals.

These categories are eligible for scholarship grants but must meet the following conditions:

In terms of study: must be classified as average or above;

In terms of moral character: as with the categories above;

In terms of family economic conditions: based on the general standards specified in Section II, they may be granted a higher standard; however, if they are excellent students with comprehensive excellence, they may be granted an additional higher standard.

4. Ethnic minority students:

- In terms of study: must achieve at least average grades.

- In terms of moral character: as with the categories above.

- In terms of economic conditions: ethnic minority students studying in southern schools are eligible for full scholarships without distinction between ethnic minority groups or large ethnic groups, and regardless of family economic conditions. If ethnic minority students are excellent and achieve two-thirds or more excellent grades in subjects tested and inspected, with the rest being good grades and no average grades, and have good moral character, they may be eligible for special scholarships.

For students of ethnic minorities studying in mountainous schools, the Administrative Committee of the autonomous region will specify standards suitable for the specific conditions of the locality.

Chapter II. ECONOMIC CONDITIONS OF FAMILY LIFE

In addition to the academic performance and moral character conditions mentioned above, the following specific criteria regarding economic living standards are set forth as the basis for guiding the examination and granting of scholarships to various categories:

1. For agricultural households whose main income comes from rice and crops, the average annual income per capita (only counting the income from the collective economic sector, while sideline income is only for reference when examining scholarship grants):

- If the average per capita income of the family in one year is 250 kilograms of rice or less, no grant will be provided.

- If the average per capita income of the family in one year is 100 kilograms of rice or less, full scholarship will be considered.

2. For households whose main income is in cash, based on the average monthly income per capita of the household:

a) In areas with normal living conditions: - From 14 dong per month, no grant will be provided. - From 5 dong or less per month, full scholarship will be considered.

b) In areas with regional allowances of 10% or more: - From 16 dong per month, no grant will be provided. - From 7 dong or less per month, full scholarship will be considered. For families of state workers and officials, when calculating the average income, 40% of their salary and allowances (excluding child allowances) will be retained for themselves. The remaining portion and child allowances, along with other sources of income of the family, will be divided among the other members whom the worker or official is responsible for supporting. To ensure a minimum standard of living for those with low salaries, if 40% of the salary and allowances are insufficient to reach 25 dong, it will still be calculated as retaining enough to reach 25 dong.

Chapter III. AMOUNTS OF SCHOLARSHIPS.

Based on distinguishing between different levels of education and economic living conditions in different regions, the following types of scholarships are now established for all fields of study:

Chapter IV. PRINCIPLES FOR GRANTING SCHOLARSHIPS

1. All universities, secondary vocational schools, primary vocational and technical training classes must conduct the examination and granting of scholarships according to the prescribed system, and no class can automatically provide scholarships to all students.

2. The examination and granting of scholarships must be based on the specified categories and specific criteria for each category (academic performance, morality, family economic conditions), but also based on the state's financial capacity. The Ministry and relevant departments will negotiate with related ministries to determine the scholarship ratio for each academic year, distinguishing between students entering from 1963-1964 and later, and those entering from 1964-1965 and later.

3. Scholarships are granted annually, and only once per year, except in special cases approved by the competent ministry or local administrative committee. Scholarships are also provided during summer vacation.

4. Schools and classes shall not continue to distribute scholarships to the following cases: - Students who have graduated and are waiting for job placement; - Students disciplined with warnings or higher penalties, retained due to poor academic performance, or who have falsified application documents for scholarship consideration. - Students with long-term illness certified by medical personnel as unable to study, or who have been treated for three months or more without recovery.

5. For families with multiple children studying at university and vocational schools, only the eldest child will be considered for a scholarship if two children are studying at university and vocational schools simultaneously, and only the two eldest children will be considered if three or more children are studying at university and vocational schools simultaneously; however, if the second and third children are children of martyrs, fallen soldiers, disabled veterans, ethnic minorities, or excellent all-around students, they will still be eligible for scholarships according to the criteria stipulated above.

Chapter V. REGARDING STUDENTS AND PUPILS WHO HAVE BEEN STUDYING FROM THE 1963-1964 ACADEMIC YEAR OR PRIOR

For students and pupils who entered school from the 1963-1964 academic year or earlier, appropriate consideration and accommodation must be provided to ensure their peace of mind and continued studies. Specifically, all students and pupils who have been granted scholarships since the 1963-1964 academic year will continue to be eligible for scholarship assessment under the new regulations until graduation, but when assessing, attention should be paid to: - Moral character: Must be classified as good (no criticism or warning received). - Academic performance: Must meet the minimum requirement of at least average. - Economic conditions of the family: Generally, they should refer to the new standards specified in Section II, but if any student or pupil is classified as a comprehensive excellent student, they will be assessed for scholarships according to the new provisions stated in Section I.

Chapter VI.

PROCEDURES FOR SCHOLARSHIP ASSESSMENT

1. Submitting and transferring scholarship application forms:

Any student or pupil who considers it necessary to apply for a scholarship shall submit the application form (according to the template that has been disseminated) and necessary supporting documents (certified copies of certificates of meritorious service to the country, certificates of meritorious service to the nation, certificates of disability status...) to the People's Committee of the commune or ward or state-owned enterprise no later than the beginning of August, so that the local authority or state-owned enterprise can certify and then directly transfer the applications to the schools by mid-August to allow the schools sufficient time and conditions to assess scholarships at the start of each academic year. Newly admitted pupils wishing to apply for a scholarship must submit their application form and supporting documents to the People's Committee of the commune or ward or state-owned enterprise at the beginning of September. Scholarship application files must be retained throughout the period during which the student or pupil remains enrolled at the school.

2. Certification by state-owned enterprises and local authorities:

- The number of dependents and income of the student or pupil applying for a scholarship must be certified specifically by the People's Committee of the commune or ward, including the number of dependents, main income, and supplementary income. For families engaged in agricultural production, scholarship application requests must be reviewed through the Management Board of the cooperative to compare with work point records, profit distribution records, and the People's Committee of the commune must confirm the income from cooperatives and supplementary economic activities of the family. For children of state employees and workers, scholarship application requests are certified by state-owned enterprises regarding income and number of dependents. - Those who certify incorrectly the number of dependents and income will bear responsibility for their certification. - The People's Committees of districts, cities, and provinces need to issue specific directives to relevant departments and levels within their jurisdiction to ensure accurate and detailed certification, avoiding general, subjective, favoritism, or prejudice.

3. Scholarship Council:

a) Each school shall have a Scholarship Council consisting of the following members: - The Rector or Vice Rector as Chairperson - An officer responsible for organizational affairs, academic affairs, finance, and management as a member - A representative of students and pupils as a member The organizational officer serves as the permanent secretary of the Council and is assisted by some officers from organizational affairs, academic affairs, finance, and management.

b) Responsibilities of the Council: - Reviewing scholarship application files. - Conducting further verification for cases where declarations and certifications are unclear, incomplete, or inaccurate. - Compiling a list of students and pupils applying for scholarships and submitting it to the Ministry or People's Committee of the district, city, or province for decision. - Monitoring and recommending adjustments for unreasonable cases, handling emergency situations such as sudden accidents affecting the families of students and pupils. - Studying and resolving complaints related to scholarships within the scope of the school.

4. New students admitted to study, if granted a scholarship, will begin receiving it from the date of the academic year opening ceremony. While waiting for the scholarship assessment, generally students and pupils must be self-sufficient, except for special cases requiring particular care: children of martyrs, deceased soldiers, disabled war veterans without support, ethnic minority pupils, who will receive temporary food allowances.

Chapter VII. IMPLEMENTATION PROVISIONS

This scholarship regime applies to all levels of professional and vocational university classes managed by the Ministry of Education as well as those managed by other ministries and sectors, centrally managed as well as locally managed.

This regime does not apply to training classes for workers and apprentices, training classes for cadres for communes and cooperatives, and living expenses subsidized by communes and cooperatives for students.

This Circular takes effect from the start of the 1964-1965 academic year; provisions for implementation in Decree No. 776-NĐ-LB dated September 15, 1956 issued jointly by the Ministry of Finance and the Ministry of Education, and all regulations on general scholarship regimes and special scholarship regimes, including Circular No. 34-TT-ĐH dated June 21, 1961 issued by the Ministry of Education, shall no longer be applied.

Autonomous regions will base their specific regulations on the provisions set out in this joint Circular, adapting them appropriately to the circumstances and conditions of schools in their respective localities.

Detailed implementation of this joint Circular shall be guided specifically by the Ministry of Education. Financial authorities have the responsibility to work together with educational authorities to guide and monitor the scholarship awarding process strictly and ensure compliance with the policies and regimes already established.

The current revision of the scholarship regime is necessary and appropriate to the situation and tasks in the northern part of our country during the period of socialist industrialization.

The Joint Ministries request that ministries, sectors, and localities develop plans to lead ideological work to thoroughly organize dissemination, while also developing strict plans to guide implementation so that everyone can correctly understand and comply well with this temporary scholarship awarding regime.

The Joint Ministries will collaborate with ministries, local administrative committees to draw lessons and establish policies subsequently.
