RESOLUTION OF THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY

On the establishment of the Citizen Petition Board

STANDING COMMITTEE OF THE NATIONAL ASSEMBLY

SOCIALIST REPUBLIC OF VIETNAM YEAR

To serve the Standing Committee of the National Assembly in performing its tasks and powers regarding citizen petition work as prescribed by law;

Based on the Law on the Organization of the National Assembly;

Considering the proposal of the Chairman of the National Assembly Office at Document No. 1453a/VPQH dated October 1, 2002 on the establishment of the Citizen Petition Board;

RESOLUTION:

Article 1.

Establish the Citizen Petition Board.

The Citizen Petition Board is a specialized agency under the Standing Committee of the National Assembly, responsible for assisting the Standing Committee of the National Assembly in citizen petition work.

Article 2.

The Citizen Petition Board has the following tasks and powers:

1. Receiving citizens and organizing the reception of citizens visiting the National Assembly and the Standing Committee of the National Assembly; coordinating with relevant agencies and Delegations of National Assembly representatives to receive citizens who petition, appeal, or report to the National Assembly and its agencies during National Assembly sessions;

2. Receiving, processing, monitoring, and urging the resolution of petitions, appeals, and reports from citizens sent to the National Assembly and the Standing Committee of the National Assembly; assisting the Standing Committee of the National Assembly in supervising the implementation of laws on appeals and reports;

3. Assisting the Standing Committee of the National Assembly in coordinating with the Central Committee of the Vietnam Fatherland Front to compile opinions and petitions from voters through the activities of voter meetings conducted by National Assembly representatives. Compiling and reporting to the Standing Committee of the National Assembly on the results of resolving voter opinions and petitions sent to the National Assembly, and the results of implementing issues that those questioned have promised to consider and resolve; 

4. Summarizing the situation of letters and the results of supervision in resolving petitions, appeals, and reports, regularly reporting to the Standing Committee of the National Assembly according to the Standing Committee's Operation Regulations and the Rules of Procedure of the National Assembly session;

5. Assisting the Standing Committee of the National Assembly in guiding National Assembly representatives and Delegations of National Assembly representatives in performing citizen petition work; researching and proposing to the Standing Committee of the National Assembly issues related to policies and laws of the Party and State through citizen petition work;

6. Performing other tasks assigned by the Standing Committee of the National Assembly.

Article 3.

The Citizen Petition Board has a Director, Deputy Directors, and a Supporting Department which is the Citizen Petition Department.

The organization and tasks of the Citizen Petition Department shall be stipulated by the Director of the Citizen Petition Board in coordination with the Chairman of the National Assembly Office.

Article 4.

The Director and Deputy Directors of the Citizen Petition Board are appointed, relieved, or dismissed by the Standing Committee of the National Assembly. The Director is responsible to the Standing Committee of the National Assembly for the work of the Board.

The Director of the Citizen Petition Board has the following tasks and powers:

1. Organizing and directing the activities of the Board according to its functions and assigned tasks;

2. Being subject to the direction of the Standing Committee of the National Assembly and the President of the National Assembly; maintaining contact with the Permanent Council of Ethnic Minorities, Permanent Committees of the National Assembly, the National Assembly Office, Delegations of National Assembly representatives, and other agencies in citizen petition work;

3. Representing the Board in relations with relevant agencies and organizations;

4. Performing other tasks assigned by the Standing Committee of the National Assembly.

Deputy Directors assist the Director in performing tasks as assigned by the Director. When the Director is absent, a Deputy Director authorized by the Director shall perform the Director's duties and powers.

Article 5.

The Citizen Petition Board shall have a seal as prescribed by the State.

The budget of the Board is part of the operational budget of the National Assembly; the material basis and operating conditions of the Board shall be guaranteed by the National Assembly Office.

Article 6.

The Director of the Citizen Petition Board and the Chairman of the National Assembly Office are responsible for implementing this Resolution.
