Pursuant to the Law on the State Bank of Vietnam No. 01/1997/QH10 dated December 12, 1997;
Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities for state management of ministries and ministerial-level agencies;
Pursuant to Decree No. 91/CP dated November 25, 1993 of the Government on the organization of non-cash payments;
Pursuant to the proposal of the Director of the Monetary Policy Department,
DECISION:
Article 1. The accompanying Decision promulgates the regulations on the issuance, use, and settlement of bank cards.
Article 2. This Decision takes effect from November 1, 1999 and replaces the provisions on cards in the following documents issued by the Governor of the State Bank of Vietnam:
1. Clause 1.2 of Article 2 of Decision No. 162/QĐ-NH2 dated August 19, 1993 on service fees for payment transactions through banks; Article 24 of the Rules on Non-Cash Payments attached to Decision No. 22/QĐ-NH1 dated February 21, 1994; Part II, Section G of Circular No. 08/TT-NH2 dated June 2, 1994 guiding the implementation of the Rules on Non-Cash Payments.
2. Other documents issued by the Governor of the State Bank of Vietnam before this Decision takes effect that conflict with the provisions of this Decision shall cease to be effective.
Article 3. The Director of the Office; Heads of Monetary Policy Department; Heads of units under the State Bank of Vietnam; Directors of State Bank of Vietnam Branches in provinces and cities; Chairmen of Boards of Directors and General Managers (Directors) of commercial banks, development banks, investment banks, policy banks, cooperative banks, and other types of banks; organizations and individuals related to this Decision are responsible for its implementation./.

REGULATIONS ON THE ISSUANCE, USE, AND SETTLEMENT OF BANK CARDS

Chapter I
GENERAL PROVISIONS
Article 1.Scope of regulation and applicable subjects
1. These Regulations govern the activities of issuing, using, and settling bank cards within the Socialist Republic of Vietnam.
2. The subjects to which these Regulations apply are entities and individuals involved in the issuance, use, and settlement of bank cards within the Socialist Republic of Vietnam.
Article 2.Definitions
In this Regulation, the following terms are understood as follows:
1. "Bank card" (hereinafter referred to as "card"): Is a payment tool issued by a bank to customers for use pursuant to a contract signed between the issuing bank and the cardholder.
2. "Domestic card": Is a card issued by a bank in Vietnam, used and settled within the Socialist Republic of Vietnam.
3. "International card": Is a card issued by a bank in Vietnam, used and settled both within and outside the territory of Vietnam, or a card issued abroad but used and settled within the Socialist Republic of Vietnam.
4. "Cardholder": Is the person to whom the issuing bank issues a card for use, including the primary cardholder and the secondary cardholder.
5. "Primary cardholder": Is the person whose name appears on the application for a card and who is issued a card by the issuing bank for use.
6. "Secondary cardholder": Is the person issued a card at the request of the primary cardholder.
7. "Entities involved in the issuance, use, and settlement of bank cards": Are commercial banks, development banks, investment banks, policy banks, cooperative banks, other types of banks, and card acceptance units.
8. "Issuing bank" (abbreviated as IB): Is a bank authorized by the State Bank of Vietnam to conduct card issuance operations, issue cards to individual cardholders for use, and be responsible for settlement and provision of services related to those cards.
9. "Settlement bank" (abbreviated as SB): Is a bank authorized by the issuing bank to perform card settlement services according to a contract; or it is a formal member or affiliated member of an international card organization, performing settlement services according to agreements signed with that international card organization. The settlement bank directly enters into contracts with card acceptance units to receive and process card transactions at those units, providing support and guidance services to card acceptance units.
10. "Card acceptance unit" (abbreviated as CAU): Is an organization or individual accepting payment for goods or services by card according to a contract signed with the issuing bank or with the settlement bank.
11. "Automatic Teller Machine" (ATM): Is a device that the cardholder can use to withdraw cash or receive certain services provided by the issuing bank or the settlement bank.
12. "Card transaction": Is the act of the cardholder using the card to pay for goods or services at a card acceptance unit or to withdraw cash.
13. "Personal Identification Number" (PIN): Is a personal secret code assigned by the issuing bank for each card and used in certain types of card transactions.
14. "Card account": Is the account of the primary cardholder opened and managed by the issuing bank, which the secondary cardholder also uses.
Article 3.General provisions on types of cards, cardholders, and elements on the card
1. Cards applicable under these Regulations include the following types:
a. Payment card: Is a type of card used by the cardholder to pay for goods or services, withdraw cash within the balance of their deposit account at the issuing bank.
b. Credit card: Is a type of card allowing the cardholder to pay for goods or services, withdraw cash within a credit limit approved by the issuing bank according to the contract.
2. The issuing bank may only issue cards to individual cardholders (primary cardholders and secondary cardholders). The issuing bank does not issue cards to organizational cardholders.
3. The card must have the following elements:
a. Name of the cardholder;
b. Name of the issuing bank;
c. Card number;
d. Trademark;
e. Expiration date of the card.
The issuing bank has the right to specify additional elements not contrary to the law.
Article 4.General provisions on lending to credit cardholders
1. When issuing a credit card, the issuing bank examines and grants a specific credit limit to the cardholder. The cardholder may not exceed the credit limit approved by the issuing bank in the contract. If the cardholder wishes to use more than the limit, they must agree with the issuing bank in the contract.
2. The credit limit of a credit card for a customer is included in the total loan amount for that customer and this total loan amount cannot exceed the maximum loan limit for a customer as stipulated by law.
3. The credit debt of the card is included in the total loan debt of the issuing bank.
4. The Issuing Bank shall specify the repayment period and the minimum amount tobe repaid based on the outstanding credit card debt for Credit Card Holders. TheCard Holder must pay the full amount of the minimum due as specified by theIssuing Bank. If the Card Holder fails to repay the debt within the stipulatedperiod, the Issuing Bank will handle the matter according to the current laws andregulations.
5. The Card Holder must pay interest to the Issuing Bank on the outstanding creditcard balance that has not been paid by the due date. The interest rate shall be setby the Issuing Bank and must not contravene the current regulations of the StateBank regarding lending interest rates.
Article 5.Currency for Payment on Cards
1. In card transactions at POS terminals, ATMs, and with the Issuing Bank:
a. Domestic cards: Domestic cards can only be transacted in Vietnamese Dong.
b. International cards:
b.1. International cards issued by Issuing Banks in Vietnam, which can be usedboth domestically and internationally:
- Within the Socialist Republic of Vietnam: International cards can be used inVietnamese Dong. Card Holders may only use the card to conduct foreign currencytransactions with organizations and individuals permitted to collect foreigncurrency under current foreign exchange management laws.
- Outside the Socialist Republic of Vietnam: Resident and non-resident CardHolders may only use the card to conduct foreign currency transactions outsideVietnam upon permission from the Issuing Bank in Vietnam. The amount of foreigncurrency used per transaction when the Card Holder goes abroad must comply withcurrent foreign exchange management laws.
b.2. International cards issued abroad, which can be used within Vietnam:
Card Holders may use the card to conduct transactions at POS terminals inVietnamese Dong and to conduct foreign currency transactions with organizationsand individuals permitted to collect foreign currency under current foreignexchange management laws.
Card Holders may only withdraw Vietnamese Dong in cash at ATMs authorized toconduct foreign exchange operations. Withdrawals of foreign currency cash inaccordance with current foreign exchange management laws may only be conductedat the counters of the Issuing Bank and ATMs.
2. In card payments between ATMs and POS terminals:
Payments between ATMs and POS terminals must be conducted in Vietnamese Dong.
Chapter II
CARD ISSUANCE
Article 6.Conditions for Card Issuance
The State Bank permits the issuance of cards when the bank applying for cardissuance meets the following conditions:
1. For domestic card issuance. The bank applying for card issuance must meet thefollowing conditions:
a. Financial capability without violation of laws;
b. Ensuring necessary equipment systems that meet standards and guarantee thesafety of card issuance and payment activities. There must be a team of staffwith sufficient professional expertise to operate and manage this system inaccordance with international practices;
c. Demonstrating the necessity, business effectiveness, and feasibility ofinvesting in the card issuance and payment system;
d. Reporting and providing complete and accurate information and documentsrelated to the application for card issuance as required by the State Bank.
2. For international card issuance.
In addition to the conditions stipulated in Article 6, Clause 1, banks applying forinternational card issuance must also meet the following condition:
The bank applying for card issuance must be granted a license for foreignexchange operations and permission to provide international payment services bythe State Bank, and must be a formal member of an international cardorganization.
Article 7. Application Documents for Card Issuance
The application documents for card issuance include:
1. For domestic card issuance.
a. An application form for permission to conduct card issuance operations;
b. A copy of the business registration certificate of the bank applying for cardissuance;
c. A copy of the establishment and operation permit of the bank applying forcard issuance;
d. Documentation proving the adequacy of the equipment systems serving cardissuance and payment operations;
đ. Operation plan for the card issuance and payment system. The plan mustdemonstrate the necessity, business effectiveness, and feasibility of conductingcard issuance operations;
e. Other relevant documents as required by the State Bank to clarify theconditions for ensuring the conduct of card issuance operations as stipulated inArticle 6 of this Regulation.
2. For international card issuance:
In addition to the documents stipulated in Article 7, Clause 1, the applicationdocuments for international card issuance also include:
a. License for foreign exchange operations and provision of internationalpayments;
b. Membership agreement signed between the bank applying for card issuanceand the international card organization.
Chapter III
USE OF CARDS
Article 8.Conditions for using the card
1.For the Primary Cardholder, the following conditions must be met:
Having full capacity to act under the provisions of the law;
Being the owner of an individual deposit account opened at the Issuing Bank (ifusing a payment card);
Meeting credit guarantee conditions and other conditions stipulated by the IssuingBank (if using a credit card).
2.For the Secondary Cardholder, the following conditions must be met:
Having full capacity to act under the provisions of the law;
Being committed by the Primary Cardholder to ensure full payment of all amounts,payments, interest, and fees incurred when using the card;
Meeting other conditions set by the Issuing Bank.
Article 9.Card usage contract between the Issuing Bank and the Cardholder
The use of the card must be documented in the form of a card usage contractaccording to a model prescribed by the Issuing Bank, including the followingcontents:
a.Date of signing the contract; name of the legal representative of the IssuingBank; name, address of the Cardholder;
b.Type of card, services received when using the card; scope and validity periodof the card;
c.Limits on using the card;
d.Fees, types of fees, and methods of fee collection for the Cardholder;
đ.Rights and obligations of the parties;
e.Responsibility for breach of contract, termination of contract;
g.Effective term of the contract;
h.Other provisions or agreements.
Supplementary agreements may accompany the contract to detail and specify theterms of the contract.
Article 10.Scope of card usage
1.The card can be used to pay for goods and services at POS terminals or withdrawVietnamese Dong in cash from the Issuing Bank, Commercial Banks, ATMs, andreceive other services provided by the Issuing Bank. If permitted by the IssuingBank or Commercial Bank, the card may also be used to withdraw Vietnamese Dong incash at POS terminals.
2.The use of the card to pay for goods and services in foreign currency can onlybe carried out outside Vietnam or at organizations and individuals within thecountry authorized to collect foreign currency. Issuing Banks and CommercialBanks only allow cardholders to withdraw foreign currency cash at bank countersof the Issuing Bank or Commercial Bank according to current laws on forexmanagement; Issuing Banks and Commercial Banks do not permit cardholders to usethe card to withdraw foreign currency cash at ATMs within the country.
Article 11. Validity period of the card
The validity period of the card is determined by the Issuing Bank. For creditcards, the maximum validity period shall not exceed three (03) years from thedate of issuance.
Article 12. Fees
The Cardholder must pay fees to the Issuing Bank. The amount and type of feesare determined by the Issuing Bank based on the type of card used and theservices provided to the Cardholder in accordance with legal regulations.
Article 13. Reporting lost card or exposed PIN
1.The Cardholder is responsible for safeguarding the card, not allowing others touse it, and keeping the PIN confidential.
If the Cardholder loses the card or exposes or suspects that the PIN has beenexposed to others, which could lead to misuse, the Cardholder must immediatelyreport to the Issuing Bank and formally confirm this report in writing to theIssuing Bank (if previously reported through other means). The Cardholder mustbear the fees as stipulated in the agreement with the Issuing Bank.
2.The Issuing Bank is responsible for promptly confirming to the Cardholder thatthe Issuing Bank has received the written report of the lost card or exposed PIN.
3.In cases where the Cardholder loses the card or exposes the PIN before theIssuing Bank confirms receipt of the report, the Cardholder will bear all lossesand compensate for damages caused by the misuse of the card.
4.In cases where the card is misused after the Issuing Bank confirms receipt of thereport of the lost card or exposed PIN, the Issuing Bank will bear all lossescaused by the misuse of the card according to the agreement in the card usagecontract.
5.The Issuing Bank may purchase insurance for card operations (if applicable) orset aside reserves to offset risks arising from card issuance operations of thebank.
Chapter IV
CARD PAYMENTS
Article 14. Payments between the Cardholder and the Issuing Bank
Periodically, the Issuing Bank prepares and sends statements of card transactionsand calculations of credit amounts, interest (if any), and fees to the Cardholder.The Cardholder must pay the amounts, interest, and fees listed on the statementas prescribed by the Issuing Bank.
The Cardholder may authorize the Issuing Bank to deduct funds from theiraccount to settle debts, interest, and fees incurred when using the card. Suchauthorization must be made in writing.
Article 15. Organizing card payments
1.For domestic cards, the Issuing Bank enters into a card payment contract withCommercial Banks, and Commercial Banks enter into a card payment contract withPOS terminals to organize payments among relevant parties involved in cardtransactions. In cases where the Issuing Bank is also a Commercial Bank, theIssuing Bank directly enters into a card payment contract with the POS terminal.
Where both the Commercial Bank and the Issuing Bank belong to the same bankinggroup, the organization of internal payments is decided by the General Directorof that bank.
2.For international cards, the organization of card payments follows the principlethat:
In cases where an international treaty to which the Socialist Republic of Vietnamhas signed or joined provides different provisions from those of this Regulation,then the provisions of that international treaty shall apply.
Parties involved in organizing card payments may agree to apply internationalcustoms, provided such customs do not conflict with the laws of the SocialistRepublic of Vietnam.
Article 16. Card payment contract
1.The card payment contract must be documented in writing and include thefollowing basic contents:
a.Date, month, year of signing the contract; name, address of the parties; name,legal representative;
b.Object of the Contract; Content of work; Card services performed;
c.Measures to ensure safety in card payment services;
d.Fees and methods of fee collection related to card services;
đ.Methods of payment between the parties;
e.Rights and obligations of the parties;
f.Responsibility for breach of contract, termination of contract;
g.Effective term of the contract;
h.Other agreements.
2.Supplementary agreements may accompany the contract to detail and specify theterms of the contract.
Article 17. Notification of refusal to process card payments
1.The Issuing Bank notifies and requests Commercial Banks or POS terminals torefuse processing in the following cases:
a.Counterfeit cards or cards related to fraudulent transactions;
b.Cards reported lost or exposed PIN by the Cardholder;
c.Card accounts have been closed;
d.The Cardholder fails to fully and timely pay credit amounts, interest, or fees asprescribed;
đ.The Cardholder does not comply with other regulations on card usage announcedby the Issuing Bank.
e. The cardholder violates the card payment regulations of international card organizations and of the State Bank of Vietnam.
2. These notifications shall take effect immediately upon receipt by the relevant parties.
3. After this notification takes effect, if a unit has received the notification but still allows the card to be misused causing damage, that unit shall bear full responsibility for the damage, except where the relevant parties have agreed otherwise.
Chapter V
RIGHTS AND OBLIGATIONS OF THE PARTIES
SECTION I.
RIGHTS AND OBLIGATIONS OF THE CARD ISSUING BANK
Article 18. Rights of the Card Issuing Bank
1. With respect to the Cardholder:
a. To specify the type of card and its usage scope; to set the validity period of the card; to stipulate conditions for using the card in accordance with Article 8 of these Regulations; to extend the card usage period or replace the card;
b. To request the Cardholder to provide all necessary information and documents to clarify the customer's usage conditions when applying for and during the use of the card;
c. To refuse to issue a card if the customer does not meet the usage conditions; to decide to reclaim the card during its use if the Cardholder fails to comply fully with the terms and conditions of the card usage contract, and the Cardholder must bear full responsibility for any losses caused by the reclamation of the card;
d. To increase or decrease the credit limit for the Cardholder; to decide to recover the amount lent to the Cardholder on the card account; to stipulate forms of credit guarantee for card usage; to stipulate types and rates of interest for loans to the Cardholder in accordance with current regulations of the State Bank and fees and their rates;
đ. To collect information about the Cardholder from other organizations;
e. Other rights as stipulated in the card usage contract.
2. With respect to the Acquiring Bank and Merchant:
a. To require the Acquiring Bank and Merchant to implement necessary measures to ensure safety in card payments and not to be responsible for damages caused by non-compliance with these requirements by the Acquiring Bank and Merchant;
b. To request the Acquiring Bank and Merchant to provide necessary information related to the card transactions of the Cardholder at the Acquiring Bank and at the relevant Merchant;
c. To request the Acquiring Bank and Merchant to refund money in cases where card transactions are carried out contrary to the signed payment contract;
d. Other rights as stipulated in the card payment contract.
Article 19. Obligations of the Card Issuing Bank
1. To comply with card issuance regulations of international card organizations and the State Bank of Vietnam.
2. To register card samples and trademarks printed on cards with the State Bank;
3. To resolve or respond to complaints from the Cardholder related to card usage and payment;
4. To make full and timely payments to the Acquiring Bank and Merchant for card transactions conducted in accordance with the contract;
5. To guide the Acquiring Bank to implement technical procedures, business processes, and security measures related to card transactions for the Cardholder and to require the Acquiring Bank to instruct the Merchant on these procedures;
6. Other obligations as stipulated in the card usage contract and the card payment contract.
SECTION II. RIGHTS AND OBLIGATIONS OF THE CARDHOLDER
Article 20. Rights of the Cardholder
1. To use the card to pay for goods and services without being discriminated against in price compared to cash payments and without having to pay additional fees or surcharges to the Merchant;
2. To use the card to withdraw cash from ATMs, at the Acquiring Bank, and at the Merchant if permitted by the Card Issuing Bank or the Acquiring Bank;
3. To lodge a complaint with the Card Issuing Bank in the following cases:
a. Errors or suspected errors in the statement of card transactions issued and sent periodically by the Card Issuing Bank to the Cardholder;
b. The Merchant refuses to accept card payments and requests the Cardholder to pay in cash or another payment method for goods and services provided when the Cardholder has presented and used the card in accordance with regulations;
c. The Merchant increases prices for goods and services or discriminates in pricing when accepting card payments compared to cash payments;
d. The Merchant requests the Cardholder to pay additional surcharges for card transactions;
đ. Other breaches of the card usage contract by the Card Issuing Bank.
Complaints must be made in writing and submitted to the Card Issuing Bank within seven working days from the date the Card Issuing Bank sends the statement to the Cardholder (for case a) or from the date the Cardholder's rights and interests are violated (for cases b, c, d, đ).
4. Other rights as stipulated in the card usage contract.
Article 21. Obligations of the Cardholder
1. To provide complete and accurate information as required by the Card Issuing Bank when applying for a card and during its use;
2. To make full and timely payments to the Card Issuing Bank for loans, interest, and fees arising from card usage according to the Card Issuing Bank's regulations; to repay the entire loan amount lent to the Cardholder on the card account as stipulated in the card usage contract;
3. When the card expires or the Cardholder no longer wishes to continue using it, the Cardholder is responsible for returning the card to the Card Issuing Bank;
4. Both the primary Cardholder and the supplementary Cardholder share joint liability and each bears individual responsibility for fulfilling the terms and conditions of the card usage contract between the Cardholder and the Card Issuing Bank. The primary Cardholder is responsible for paying the Card Issuing Bank for all transactions involving goods and services and cash withdrawals bearing the signature of the cardholder on the invoice as well as those using the PIN number. In the event of the death, disappearance, or loss of capacity of the primary Cardholder, payment to the Card Issuing Bank shall be made in accordance with the provisions of the law.
PART III. RIGHTS AND OBLIGATIONS OF THE CARD PAYMENT BANK
Article 22. RIGHTS OF THE CARD PAYMENT BANK
1.Request the ISSUING BANK to make full and timely payments for card transactionsconducted in accordance with the card usage contract;
2.Request the ACQUIRING ENTITY to refund money for card transactions conducted inviolation of the card usage contract;
3.Request the ACQUIRING ENTITY to provide necessary information related to cardtransactions of the CARDHOLDER at the ACQUIRING ENTITY;
4.Reclaim cards in accordance with Article 28 of this Regulation;
5.Other rights as stipulated in the card payment contract.
Article 23. OBLIGATIONS OF THE CARD PAYMENT BANK
1.Instruct procedures, technical processes, and security measures in card paymentsfor the ACQUIRING ENTITY and the AGENT BANK handling card payments in accordancewith the regulations of the ISSUING BANK. The CARD PAYMENT BANK shall be liablefor any losses caused by non-compliance with these regulations;
2.Notify the ACQUIRING ENTITY of the ISSUING BANK's requests;
3.Implement the ISSUING BANK's requests regarding card transactions of the CARDHOLDERat the ACQUIRING ENTITY;
4.Other obligations as stipulated in the card payment contract.
PART VI. RIGHTS AND OBLIGATIONS OF THE ACQUIRING ENTITY
Article 24. RIGHTS OF THE ACQUIRING ENTITY
1.Request the ISSUING BANK and the CARD PAYMENT BANK to make full and timelypayments for card transactions conducted in accordance with the contract;
2.Check the validity or standards of the card as prescribed by the ISSUING BANK orCARD PAYMENT BANK and refuse to accept the card if it is no longer valid or doesnot meet the prescribed standards;
3.Reclaim cards in accordance with Article 28 of this Regulation;
4.Other rights as stipulated in the card payment contract.
Article 25. OBLIGATIONS OF THE ACQUIRING ENTITY
1.Properly implement all technical and operational procedures related to cardtransactions of the CARDHOLDER as required and instructed by the CARD PAYMENTBANK or the ISSUING BANK; shall be liable for any losses if the ACQUIRING ENTITYfails to comply with the requirements of the ISSUING BANK or CARD PAYMENT BANK;
2.Maintain confidentiality of information related to the card and the CARDHOLDER,except when providing information:
a.At the request of the CARDHOLDER;
b.At the request of the CARD PAYMENT BANK or the ISSUING BANK;
c.As prescribed by law.
3.Other obligations as stipulated in the card payment contract.
Chapter VI
ACCOUNTING AND REPORTING
Article 26. Accounting for
ACCOUNTING AT THE ISSUING BANK AND THE CARD PAYMENT BANK RELATED TO CARDTRANSACTIONS SHALL BE CONDUCTED IN ACCORDANCE WITH THE ACCOUNTING SYSTEMISSUED BY THE STATE BANK.
Article 27. Report
1.EVERY THREE MONTHS, SIX MONTHS, OR ONCE A YEAR, THE ISSUING BANK AND THECARD PAYMENT BANK SHALL REPORT ON THE BUSINESS OPERATIONS OF CARD ISSUANCEAND PAYMENTS ACCORDING TO SPECIFIC INDICATORS AS PRESCRIBED BY THE STATEBANK.
2.BESIDES REGULAR REPORTS, THE ISSUING BANK AND THE CARD PAYMENT BANK SHALLREPORT TO THE STATE BANK IN THE FOLLOWING SITUATIONS:
a.TO SERVE SPECIFIC OBJECTIVES OF THE STATE BANK IN EACH PERIOD WHEN PERFORMINGITS FUNCTIONS;
b.WHEN THERE ARE UNUSUAL DEVELOPMENTS IN CARD ISSUANCE, PAYMENT, AND DEBTCOLLECTION ACTIVITIES THAT MAY AFFECT THE BANK'S OPERATIONS.
Chapter VII
HANDLING VIOLATIONS
Article 28. CARD RECLAMATION
THE ISSUING BANK, THE CARD PAYMENT BANK, THE ACQUIRING ENTITY, AND LEGALORGANIZATIONS HAVE THE RIGHT TO RECLAIM CARDS IN THE FOLLOWING SITUATIONS:
1.FAKE CARDS;
2.USERS WHO CANNOT PROVE THEY ARE THE CARDHOLDER;
3.CARDHOLDER FAILS TO COMPLY WITH THE ISSUING BANK'S (OR THE INTERNATIONAL CARDORGANIZATION'S BRAND) REGULATIONS ON CARD USE;
4.ACCORDING TO THE REQUEST OF THE ISSUING BANK (OR THE INTERNATIONAL CARDORGANIZATION'S BRAND).
Article 29. PROHIBITED ACTIONS
1.PRODUCING, USING, AND CIRCULATING FAKE CARDS;
2.CARDHOLDER TRANSFERS THE CARD TO ANOTHER PERSON;
3.USE A CARD NOT ISSUED BY THE ISSUING BANK FOR THEMSELVES;
4.INTENTIONALLY PROVIDE FALSE PERSONAL INFORMATION OR FALSIFY DOCUMENTS WHENAPPLYING FOR OR USING THE CARD;
5.INTENTIONALLY USE A CARD THAT HAS BEEN ANNOUNCED AS NOT PERMITTED TO CIRCULATE;
6.UNAUTHORIZED ACCESS OR ATTEMPT TO ACCESS ILLEGALLY THE PROGRAM OR DATABASEIN THE CARD ISSUANCE AND PAYMENT SYSTEM NETWORK;
7.PERFORMING FRAUDULENT CARD TRANSACTIONS.
Article 30. Handling Violations
ANY ORGANIZATION OR INDIVIDUAL VIOLATING THE REGULATIONS OF THIS REGULATIONWILL BE HANDLED ACCORDING TO THE GRAVITY AND EXTENT OF THE VIOLATION, INCLUDINGADMINISTRATIVE SANCTIONS, AND IN SEVERE CASES, CRIMINAL LIABILITY; IF DAMAGE ISCAUSED, COMPENSATION MUST BE PROVIDED IN ACCORDANCE WITH THE LAW.
Chapter VIII
IMPLEMENTING PROVISIONS
Article 31.
ANY AMENDMENTS OR SUPPLEMENTS TO THIS REGULATION SHALL BE DECIDED BY THEGOVERNOR OF THE STATE BANK./.
