PRIME MINISTER

Based on the Law on the Organization of the Government dated December 25, 2001;

Pursuant to the Law on Competition and Reward dated November 26, 2003 and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward dated June 14, 2005;

Pursuant to Decision No. 491/QĐ-TTg dated April 16, 2009 of the Prime Minister promulgating National Criteria for New Rural Areas and Decision No. 342/QĐ-TTg dated February 20, 2013 of the Prime Minister supplementing and amending certain national criteria for new rural areas;

Considering the proposal of the Minister of Agriculture and Rural Development,

DECISION:

Article 1. Issuing regulations on recognition and announcement of localities meeting new rural standards with the main contents as follows:

1. Scope of regulation and applicable subjects:

a) Scope of regulation: This Decision stipulates conditions, procedures, formalities, authority for recognizing and announcing communes, districts, provinces meeting new rural standards.

b) Applicability:

- Localities throughout the country;

- Organizations, households, and individuals related during the process of recognizing and announcing localities meeting new rural standards.

Clause 2. Implementation principles:

a) Recognition and announcement of localities meeting new rural standards must ensure principles of transparency, democracy, clarity, and compliance with prescribed procedures and formalities.

b) Recognition and announcement of localities meeting new rural standards must be carried out regularly and continuously annually.

3. Authority for recognizing and announcing localities meeting new rural standards:

a) The Chairman of the People's Committee at provincial level recognizes and announces communes meeting new rural standards.

b) The Prime Minister recognizes and announces districts and provinces meeting new rural standards.

4. Conditions for recognizing localities meeting new rural standards:

a) Communes meeting new rural standards must satisfy the following conditions:

- Having a registration for commune meeting new rural standards confirmed by the People's Committee at district level;

- All 100% of the criteria implemented within the commune must meet the standard as prescribed.

b) Districts meeting new rural standards must satisfy the following conditions:

- Having a registration for meeting new rural standards confirmed by the People's Committee at provincial level;

- At least 75% of the communes within the district must meet the standard as prescribed.

- For the remaining 25% of communes within the district that have not yet met the new rural standards, they must satisfy the following conditions:

+ At least 14 criteria must meet the new rural standards, including two key criteria being poverty reduction and income;

+ The remaining criteria must reach at least 70% of the prescribed standard.

c) Provinces meeting new rural standards must satisfy the following conditions:

- Having a registration for meeting new rural standards confirmed by the Ministry of Agriculture and Rural Development;

- At least 80% of the districts within the province must meet the standard as prescribed;

- For the remaining 20% of districts within the province that have not yet met the new rural standards, they must satisfy the following conditions:

+ At least 50% of the communes within each district must meet the new rural standards;

+ The remaining communes within each district that have not yet met the new rural standards must satisfy at least 14 criteria, including two key criteria being poverty reduction and income. The remaining criteria must reach at least 70% of the prescribed standard.

d) Conditions for re-recognition of communes, districts, and provinces meeting new rural standards

Localities recognized as meeting new rural standards must continuously satisfy the conditions prescribed for each level under Point a, Point b, and Point c, Clause 4, Article 1 of this Decision for five consecutive years from the date of the decision recognizing them as meeting new rural standards by the competent authority.

5. Procedure for recognizing and announcing communes meeting new rural standards:

a) The People's Committee at commune level organizes self-assessment of the results of implementing new rural criteria as follows:

- Prepare a report on the results of implementing new rural criteria;

- Send the report on the results of implementing new rural criteria to the United Front Organization at commune level, its member organizations, and villages for comments;

- Publicly announce the results of implementing new rural criteria through mass media for the people to know and provide opinions;

- Incorporate opinions received, improve the report on implementing new rural criteria, and submit it to the People's Committee at district level before September 25 each year.

b) The People's Committee at district level organizes verification and assessment of the results of implementing new rural criteria for communes as follows:

- Compile the results of implementing new rural criteria for each commune;

- Announce on mass media the list of communes eligible for recognition as meeting new rural standards to solicit public opinion in the district;

- Send the list of communes eligible for recognition as meeting new rural standards to the United Front Organization at district level, its member organizations, and the People's Committees at commune level within the district for comments;

- Organize verification of communes meeting new rural standards and prepare files to submit to the People's Committee at provincial level before October 20 each year.

c) The People's Committee at provincial level organizes review, recognition, and announcement of communes meeting new rural standards:

- Review the results of implementing new rural criteria for communes eligible for recognition as meeting new rural standards as proposed by the People's Committee at district level;

- Decide to recognize communes meeting new rural standards within the province before November 10 each year;

- Organize the announcement of the decision recognizing communes meeting new rural standards and publicly announce it through mass media.

6. Procedure for recognizing and announcing districts meeting new rural standards

a) The People's Committee at district level compiles the number of communes meeting new rural standards within the district recognized by the People's Committee at provincial level and prepares files to submit to the People's Committee at provincial level before November 20 each year.

b) The People's Committee at provincial level organizes verification and assessment of the results of districts meeting new rural standards as follows:

- Compile the results of meeting new rural standards for each district;

- Announce on mass media the list of districts eligible for recognition as meeting new rural standards;

- Send the list of districts eligible for recognition as meeting new rural standards to the United Front Organization at provincial level, its member organizations, and the People's Committees at district level within the province for comments;

c) The Ministry of Agriculture and Rural Development compiles the list of districts meeting the criteria for recognition as new rural areas based on the proposal of the provincial People's Committee and reviews it before submitting for approval.

7. Procedures for recognizing and announcing provinces as new rural areas:

a) The provincial People's Committee compiles the number of districts in the province that have been recognized as new rural areas.

b) The Ministry of Agriculture and Rural Development compiles the list of provinces meeting the criteria for recognition as new rural areas based on the proposal of the provincial People's Committee and reviews it before submitting to the Prime Minister for recognition and announcement of provinces as new rural areas before December 25 each year.

8. Re-recognition for localities that have already achieved the new rural area standard

a) The re-recognition of communes, districts, and provinces that have achieved the new rural area standard shall be conducted every five years from the date of issuance of the decision recognizing the achievement of the new rural area standard by the competent authority.

b) The procedures and formalities for re-recognition of communes, districts, and provinces that have achieved the new rural area standard shall be carried out according to Clause 5, Clause 6, and Clause 7 of Article 1 of this Decision.

Article 2. Awards

1. Annually, the Chairman of the provincial People's Committee considers and decides on awards for communes and districts that have achieved the new rural area standard in accordance with current regulations.

2. Annually, The Prime Minister considers and decides on awards for communes, districts, and provinces that have achieved the new rural area standard in accordance with current regulations and Decision No. 1620/QĐ-TTg dated September 20, 2011 of the Prime Minister on the implementation plan for organizing and implementing the movement "All people join hands to build new rural areas."

Article 3. Implementation

1. For central agencies:

a) The Ministry of Agriculture and Rural Development - the permanent agency of the National Target Program for Building New Rural Areas is responsible for providing specific guidance and organizing inspections of the implementation of the provisions of this Decision.

b) Ministries and sectors are responsible for reviewing, supplementing, and amending specific criteria in the National Criteria for New Rural Areas and guiding localities to implement them in accordance with actual conditions; serving as a basis for evaluating and recognizing communes as new rural areas.

c) Proposing the Vietnam Fatherland Front Central Committee and its member organizations to participate in and supervise the implementation of this Decision.

2. For localities:

The provincial People's Committee directs and organizes the implementation of the provisions of this Decision and the guiding documents of the Ministry of Agriculture and Rural Development, relevant ministries, and sectors.

Article 4. This Decision shall take effect from the date of signing.

Article 5. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of provincial and centrally-administered city People's Committees, and Heads of related agencies are responsible for enforcing this Decision./.
