JOINT CIRCULAR
Guidelines on the content of expenditures and budget management for implementing border management and protection work
managing and protecting the national border, maintaining security,
public order, and social safety in the land border area
Pursuant to Decree No. 34/2000/NĐ-CP dated August 18, 2000 of the Government on the Regulations of the Border Area of the Socialist Republic of Vietnam;
The Ministry of National Defense and the Ministry of Finance provide guidelines on the content of expenditures and budget management to ensure the implementation of border management and protection work, including maintaining security, public order, and social safety in the border area (hereinafter referred to as border management and protection work) as follows:
I. CONTENT OF EXPENDITURES FROM THE BUDGET FOR IMPLEMENTING BORDER MANAGEMENT AND PROTECTION WORK INCLUDES:
MEASURES TO PROTECT THE NATIONAL BORDER INCLUDE:
1. Expenditures for surveying and constructing sign systems indicating "border area," "border zone," and "prohibited area" for border management and protection.
2. Procurement of equipment and means to serve border management and protection.
3. Maintenance, repair, and upkeep of equipment and means provided for border management and protection.
4. Expenditures for operational activities related to border management and protection and enforcement of laws concerning borders.
5. Expenditures for communication, propaganda, and mobilization of the masses in border management and protection activities.
6. Expenditure for border defense diplomacy.
7. Expenditure for border defense training.
8. Expenditures for conferences related to border management and protection work.
9. Administrative expenses serving border management and protection activities of officers and soldiers operating in border areas.
10. Expenditures for rewarding mass movements participating in border management and protection.
II. ESTABLISHMENT OF BUDGET ESTIMATES, ALLOCATION, EXECUTION, AND SETTLEMENT FOR EXPENDITURES ON BORDER MANAGEMENT AND PROTECTION
THE BUDGET FOR BORDER MANAGEMENT AND PROTECTION ACTIVITIES
1. Annually, the Border Guard Command bases its budget estimates to ensure the fulfillment of border management and protection tasks according to the provisions of this Circular and submits them to the Ministry of National Defense for submission to the Ministry of Finance and the Ministry of Planning and Investment for consolidation and presentation to the Government for decision.
The funds for implementing border management and protection work from the state budget are consolidated into a separate item in the annual regular expenditure budget of the Ministry of National Defense.
2. Provincial People's Committees and municipal people's committees under the central government annually allocate funds from their own budgets to implement border management and protection work according to the tasks allocated by Decree No. 34/2000/NĐ-CP dated August 18, 2000 of the Government.
3. The establishment of budget estimates, execution, and settlement of expenditures for border management and protection work shall be carried out in accordance with the State Budget Law, Decree No. 120/1997/NĐ-CP dated December 22, 1997 of the Government, Joint Circular No. 91/1998/BTC-BQP dated June 29, 1998 of the Ministry of Finance and the Ministry of National Defense, and other relevant legal documents.
III. IMPLEMENTATION
1. Units using the budget for border management and protection have the responsibility to complete assigned budget expenditure tasks and strictly comply with current financial management and usage regulations.
2. This Circular takes effect fifteen days from the date of signature.
3. In the course of implementation, if there are difficulties, units are requested to report to the Ministry of National Defense and the Ministry of Finance for consideration and resolution./.
