REGULATIONS

Work Procedures of the Ministry of Agriculture and Rural Development

(Issued pursuant to Decision No. 374/QĐ-BNN-VP, January 28, 2008 of the Minister of Agriculture and Rural Development).

Chapter I.

GENERAL PROVISIONS

Article 1. Scope of Regulation

These Rules prescribe principles, responsibility systems, work procedures, working relationships, and the process for handling tasks of the Ministry's leadership, heads of departments and units under the Ministry, and civil servants and officials of these departments and units (hereinafter referred to as the Ministry).

Article 2. Applicability

These Rules apply to civil servants and officials of departments and units under the Ministry, and organizations and individuals having working relations with the Ministry.

Article 3. Principles of Operation

1. All activities of the Ministry must comply with the provisions of laws and the Rules on Work Procedures of the Ministry.

2. Handle tasks within the scope of authority and responsibilities assigned.

3. Emphasize individual responsibility; each task has only one person in charge and primarily responsible. Heads of departments and units assigned tasks must bear primary responsibility for the tasks assigned.

4. Adhere to the procedures, formalities, and deadlines for handling tasks as prescribed by laws, programs, plans, schedules, and other Rules that have been issued, except in cases of urgent requirements or requirements from higher-level agencies; continuously reform administrative procedures to ensure transparency, timeliness, and effectiveness.

5. Ensure coordination requirements in handling tasks and in all activities according to the functions, tasks, and powers prescribed by law.

Chapter II.

RESPONSIBILITIES, SCOPE, AND METHODS FOR HANDLING TASKS

Article 4. Responsibilities and Scope of Handling Tasks of the Minister

1. Responsibilities for Handling Tasks of the Minister

a) Direct and manage the Ministry to perform its functions, tasks, and state management powers in agriculture and rural development as prescribed by the Constitution, the Law on the Organization of the Government, Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies, Decree No. 01/2008/NĐ-CP of the Government stipulating the functions, tasks, and organizational structure of the Ministry of Agriculture and Rural Development, and related legal documents.

b) Delegate tasks to Deputy Ministers; delegate authority to heads of departments and units under the Ministry, provincial and municipal people's committees directly under the central government, to handle certain matters within their jurisdiction in the field of agriculture and rural development.

c) Direct the guidance, inspection, and supervision of the activities of ministries, sectors, people's councils at various levels, other organizations, agricultural and rural development specialized agencies at localities, and departments and units under the Ministry in the implementation of laws, tasks assigned, delegated, and entrusted within the scope of state management in the field of agriculture and rural development.

Point a) Tasks within the authority prescribed in the Constitution, the Law on the Organization of the Government, the Government's Work Regulation, related legal documents, and the tasks specified in Clause 1 of this Article;

a) Matters within the jurisdiction prescribed in the Constitution, the Law on the Organization of the Government, the Rules on Work Procedures of the Government, and related legal documents, and the tasks stipulated in Clause 1 of this Article.

b) Matters assigned and entrusted by the Government and the Prime Minister; matters assigned by the Party Cadre Committee.

c) Matters involving two or more Deputy Ministers but with differing opinions; directly handle certain matters previously assigned to Deputy Ministers, but due to their importance and urgency, the Minister handles them personally. The Ministry's Office is responsible for reporting to the Deputy Minister in charge about matters handled by the Minister.

d) Handle organizational and personnel work; planning, strategy, and development planning work in the sector.

3. Matters that the Minister organizes collective discussion among the Ministry's leadership before making decisions:

a) Sectoral strategies, planning, and development plans;

b) Sectoral plans to implement important resolutions, directives, policies, and guidelines of the Party and the Government;

c) Annual and long-term work programs and legislative draft plans of the sector;

d) Key programs and projects of the sector; draft decrees, ordinances, and laws drafted by the Ministry before submission to competent authorities;

Point e) Organizational structure and personnel matters of the Ministry as prescribed;

Point g) Annual reports on the implementation of state plans and evaluations of the Ministry's management and direction;

g) Annual reports on the implementation of national plans and reviews of the leadership and management of the Ministry's leadership;

h) Other issues that the Minister deems necessary to discuss.

In special cases where it is not possible to organize collective discussions, upon the Minister's directive, the main agency shall seek opinions from Deputy Ministers, report to the Minister for decision-making.

4. When the Minister is absent on official business, he will delegate authority to a Deputy Minister to handle tasks on his behalf. The Minister may also delegate authority to heads of subordinate departments and units to handle certain tasks within his jurisdiction as prescribed by law.

Article 5. Responsibilities and scope of work of Deputy Ministers

1. Responsibilities for handling work of Deputy Ministers:

a) Deputy Ministers assigned by the Minister to be responsible for certain fields and areas of work, certain agencies and units, and to exercise the powers of the Minister, acting on behalf of the Minister when handling matters within their assigned fields, and shall be accountable under the law and to the Minister for their decisions;

b) Before going on local trips, Deputy Ministers must directly report to the Minister or through assisting officials about the content and program of work to ensure coordination in leading the Ministry (except in cases directly assigned by the Minister).

2. Scope of work handling of Deputy Ministers

a) Direct the implementation of state management tasks, drafting normative legal documents, development strategies, planning, plans, projects, and other management documents in the fields assigned by the Minister.

b) Direct the inspection of the implementation of State policies, laws, the Minister's decisions, identify issues requiring amendment or supplementation.

c) Independently handle assigned tasks; if issues relate to another Deputy Minister’s field, they must coordinate directly with that Deputy Minister to resolve them. In cases where the Minister's opinion is required or there are differing opinions among Deputy Ministers, they must report to the Minister for decision.

d) For issues concerning policy or principles without prescribed regulations, exceeding authority, sensitive issues affecting national economic and social conditions, signing cooperation documents with foreign countries, and other important matters, Deputy Ministers must seek the Minister's opinion before making decisions.

đ) When the Minister adjusts assignments between Deputy Ministers, the Deputy Ministers must hand over the content of work, related files, and documents.

3. Deputy Ministers are authorized to handle work in the absence of the Minister, in addition to implementing the provisions of Clause 2 of this Article, they have the following authorities and responsibilities:

a) Handle general matters of the Ministry and sign documents according to the Minister's authorization;

b) Coordinate activities between Deputy Ministers;

c) Handle urgent matters of other Deputy Ministers in their absence at the request of the Director of the Ministry's Office. The Director of the Ministry's Office is responsible for seeking the opinion of the Deputy Minister in charge; reporting to the Minister when the opinions of the Deputy Minister in charge and the authorized Deputy Minister differ.

Article 6. Methods of Handling Work by Ministry Leaders

1. Directly process work based on letters, files, and materials submitted by relevant agencies, organizations, and individuals, transferred according to the Regulations on Receiving, Processing, and Managing Documents and Information of the Ministry.

2. If necessary, Ministry leaders directly handle work at the request of units without necessarily having a Submission Form or the Office's submission opinion. The Office is responsible for notifying and tracking the results.

3. Regularly meet monthly, quarterly, or urgently with leaders of relevant agencies, organizations, and individuals to hear reports on situations, direct the implementation of unit and Ministry programs and plans, and consult opinions before deciding.

Implement the weekly briefing system of Ministry leaders, and the monthly briefing of the Ministry to implement leadership guidance work with agencies and units under the Ministry.

4. Delegate heads of units to chair meetings with leaders of relevant agencies, organizations, and individuals to resolve issues within the authority of Ministry leaders where units have differing opinions, and submit to Ministry leaders for decision.

5. Establish working groups and steering committees to lead complex and important issues involving multiple units over extended periods.

6. Directly lead issues within their authority. Organize trips to localities, handle work at grassroots levels; receive citizens and guests in their assigned fields.

7. Deputy Ministers cooperate in implementing leadership guidance work according to their fields and areas during trips and while resolving work in localities. The Ministry's Office is responsible for reporting and seeking opinions from Deputy Ministers in charge of fields and areas, to compile integrated contents.

Article 7. Responsibilities, scope, and relationships in handling work of Heads of Units

1. Proactively organize the implementation of tasks within the functions, duties, and authorities of the unit; be responsible to the Minister for the results of assigned tasks; fully implement information and reporting systems as prescribed by law and by the Ministry.

2. Perform tasks assigned by the Minister or Deputy Minister; be authorized by the Minister to resolve or sign certain documents within the Minister's authority and must bear personal responsibility under the law and before the Minister for the content of such authorization.

3. For emergent matters, issues related to multiple units exceeding their authority or lacking sufficient conditions to execute, recommendations for amending and supplementing mechanisms, policies, programs, and plans must promptly report to the Ministry Leadership for consideration and decision; do not transfer tasks within their authority to other units or to the Ministry Leadership, nor resolve tasks within the authority of another unit.

4. Proactively coordinate with Heads of Units to implement projects and programs of the Ministry, handle issues related to the functions and duties of the unit, and perform common tasks of the Ministry.

When assigned to lead the resolution of issues related to the functions, duties, and authorities of another unit, the Head of Unit must reach consensus with the Head of that unit. The Head of Unit asked for opinions in writing must respond in writing according to the requirements of the leading unit. If there is no response within the time specified in the document, it will be considered as agreement and they must bear responsibility for the relevant contents concerning their own unit.

5. Issue and organize the implementation of working regulations within the agency or unit in accordance with legal provisions and those of the Ministry. Assign tasks to deputy-level officials and civil servants under their management.

6. When absent from the office for one day or more, delegate authority to a deputy-level official to manage and operate the unit; if absent for three days or more, report to the Minister in writing through the Director of the Ministry's Office. The person delegated authority bears responsibility to the Head of Unit, the Minister, and under the law for all activities of the unit during the delegation period.

7. Comply with the requirements of the Ministry Leadership when the Ministry Leadership has a work program with the unit.

8. Organize the unit to implement local government policies where the unit is headquartered.

Article 8. Authority to Sign Documents

1. Authority to sign documents of the Minister:

a) Administrative management documents of the Ministry, legislative documents within the authority, organizational structure and personnel documents as prescribed by law.

b) Documents submitted to the Government, National Assembly, and the Central Committee of the Party.

c) Approve projects and proposals authorized by the Prime Minister and group A investment projects.

d) Approve investment policies for projects in accordance with national and Ministry regulations on basic construction investment management.

đ) Delegation documents to the Director of the Ministry's Office, the Director of the Ministry's Inspectorate, and Heads of Departments to resolve certain tasks within the Minister's authority during a specified period.

e) Decisions on rewards, disciplinary actions, salary increases, overseas work and study trips for Deputy Ministers, Heads of Departments, Bureaus, Institutes, and equivalent positions.

2. Authority to sign documents of Deputy Ministers:

Deputy Ministers authorized by the Minister to sign (KT) individual decisions:

a) Individual decisions; approval decisions for group B and C investment projects; technical designs and total budgets for projects led by the Ministry; final settlements and project settlements for group A investment projects according to national and Ministry regulations on investment and construction management; disposal of fixed assets and documents resolving issues within the areas assigned by the Minister.

b) Certain documents stipulated in Clause 1 of this Article, when delegated by the Minister.

3. Authority to sign documents of Heads of Departments, Bureaus, Inspectorate, and the Ministry's Office:

a) Department Heads may sign on behalf of the Minister and stamp the Ministry on administrative documents regarding specialized fields under their responsibility.

b) Directors of the Ministry's Inspectorate and the Ministry's Office may sign under delegation (TUQ) or on behalf of the Minister on administrative documents regarding specialized fields under their unit's responsibility.

c) Bureau Chiefs may issue individual documents and internal regulatory documents within their specialized field and area of responsibility and may not issue legislative documents.

Bureau Chiefs may be authorized by the Minister to sign under delegation (TUQ) certain documents as decided individually by the Minister.

4. The Organization and Cadres Department shall cooperate with the Legal Affairs Department and the Ministry's Office to submit to the Minister for determination of signing authority for units.

Article 9. Responsibilities and scope of work for civil servants

1. Proactively research and advise on the specialized field assigned to monitor, as well as tasks assigned by the Head of the Unit or Ministry Leadership according to the unit's professional functions and responsibilities.

2. Shall be individually responsible before the Head of the Unit, the Ministry's leadership, and the law regarding proposals, progress, quality, and effectiveness of each assigned task; regarding the form, format, procedure, and process for issuing documents and handling tasks within the assigned field of supervision.

3. Shall implement laws and regulations on civil servants and related provisions of the Ministry concerning the performance of duties.

Chapter III.

RELATIONSHIP WITH ORGANIZATIONS AND AUTHORITIES

Article 10. Relationship with Party agencies, National Assembly, Government, Ministries, equivalent agencies to Ministries, localities, central agencies of political-social organizations, social-professional organizations in the sector and field

1. The working relationship between the Minister and the Central Committee of the Party, Party bodies, National Assembly agencies, National Assembly deputies, the Government, Ministries, equivalent agencies to Ministries, local authorities, voters, central agencies of political-social organizations, social-professional organizations in the sector and field under the Ministry’s responsibility shall be carried out in accordance with the Constitution, the Law on the Organization of the Government, Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating functions, tasks, powers, and organizational structure of Ministries and equivalent agencies to Ministries, relevant legal documents, and the Memorandum of Understanding between the Ministry and the organizations that have been agreed upon.

2. The Ministry's leadership shall manage state administrative activities of specialized agricultural management agencies and rural development at provincial and centrally-administered city levels, service-providing organizations, enterprises, cooperatives, and other forms of collective and private economy operating within the sector and field under the Ministry's state administrative management according to the Law on the Organization of the Government 2001, Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating functions, tasks, powers, and organizational structure of Ministries and equivalent agencies to Ministries.

Article 11. Relationship with Party organizations within the Ministry

1. The working relationship between the Ministry's leadership and the Party Cadre and Civil Servants' Committee shall be implemented in accordance with the Central Regulations and the Working Regulations of the Party Cadre and Civil Servants' Committee of the Ministry of Agriculture and Rural Development.

2. The relationship between the Ministry's leadership and the Party Committee of the Ministry, the Party Committee of the grassroots organization in Ho Chi Minh City shall be carried out in accordance with the Central Regulations and the Working Regulations of the Party Committee of the Ministry, the Party Committee of the grassroots organization in Ho Chi Minh City which have been approved by the Party Cadre and Civil Servants' Committee of the Ministry.

Article 12. Relationship with political-social organizations within the Ministry

1. The relationship between the Minister and the Vietnam Agricultural and Rural Development Trade Union shall be carried out in accordance with the Joint Resolution on the working relationship and working style between the Minister and the Standing Committee of the Vietnam Agricultural and Rural Development Trade Union.

2. The relationship between the Minister and political-social organizations within the Ministry:

a) Every six months, the Minister or a Deputy Minister authorized by the Minister shall meet with the Standing Committees of political-social organizations within the Ministry such as the Trade Union, the Communist Youth Union Ho Chi Minh, other political-social organizations, and the Women's Progress Promotion Board of the Ministry to inform them about the Ministry's policies, the resolution of suggestions from members and associates, and their opinions and recommendations.

b) Representatives of political-social organizations within the Ministry may be invited to attend meetings and conferences related to their activities, rights, obligations, and legitimate interests.

c) The Minister shall create favorable conditions for these organizations to operate effectively, contributing to the fulfillment of the political tasks assigned by the State; shall seek the opinions of these organizations before making decisions related to the rights, obligations, and legitimate interests of members and associates.

Article 13. Relations between Heads and Party Committees, Mass Organizations, and Civil Servants within Units

1. The Party organization within the unit operates in accordance with the central regulations on the functions and responsibilities of the party organizations at the grassroots level of administrative agencies or within public service units. The Head of the unit creates favorable conditions for Party organizations and mass organizations to operate in accordance with their objectives, purposes, and charters. They closely cooperate with mass organizations within the unit to ensure democratic regulations in the operation of the agency. The Head collaborates with the Party Committee and mass organizations to care for and create working, learning, and professional development opportunities for civil servants within the unit; build a civilized office culture; and foster mutual assistance to complete assigned tasks effectively.

2. Party members and association members serve as role models in completing assigned tasks in compliance with laws governing civil servants; strictly adhere to regulations concerning the duties and responsibilities of Party members and association members, as well as regulations related to public service; resolve tasks within the stipulated time frame; and bear responsibility before the Head of the unit for the results of the assigned tasks.

Chapter IV.

WORK PROGRAM

Article 14. Types of Work Programs of the Ministry

1. Annual program of work:

a) Content includes two parts: Part one outlines the main directions, major tasks, and solutions of the Ministry across all areas of work; part two lists projects, proposals, and regulatory legal documents (collectively referred to as proposals) submitted to the Government, Prime Minister, and Minister.

b) Proposals included in the annual work program must clearly specify: main content; level of submission; lead unit, cooperating units, and submission deadline (in months).

2. The quarterly work program includes: main work contents and list of proposals submitted to the Government, Prime Minister, and Minister during the quarter.

The first-quarter work program is determined within the annual work program.

3. The monthly work program includes: main work contents and list of proposals submitted to the Government, Prime Minister, and Minister during the month.

The first-month work program of each quarter is determined within the quarterly work program.

4. Weekly work program of the Minister and Deputy Ministers:

a) Based on the monthly work program and the directives of the Minister, the Ministry's Office coordinates with relevant units to develop the weekly work program, which is reviewed by the Ministry's leadership and uploaded to the internal network by Friday of each week.

b) When there are changes to the weekly work program of the Ministry's leadership, the Secretary of the Minister and specialized staff assisting Deputy Ministers must update and immediately upload these changes to the network.

Article 15. Procedures for Developing the Ministry’s Work Program

1. Annual program of work:

a) The Ministry's Office leads and coordinates with Departments, Bureaus, Inspectors, and related units to develop the Ministry’s annual work program.

By November 5 each year, units under the Ministry must send the Ministry's Office a list of proposals (excluding legislative documents sent to the Legal Department for consolidation) that need to be submitted to higher authorities and the Minister in the following year.

By November 5 each year, the Legal Department is responsible for consolidating plans to draft legislative documents for the following year and submitting them to the Ministry's Office for overall consolidation.

Specifically, the program for drafting legislative documents shall be implemented in accordance with Decision No. 90/2007/QĐ-BNN dated November 9, 2007, issued by the Minister of Agriculture and Rural Development on the Regulations for Drafting, Issuing, Reviewing, Handling, and Systematizing Legislative Documents of the Ministry.

- The list of proposals must clearly indicate:

+ Scope and authority to issue (Government, Prime Minister, Minister);

+ Summary of preparation plans for each proposal: Each registered proposal must clearly outline the direction and content of preparation, scope of regulation, coordinating agencies, reviewing agencies, decision-making level, and preliminary implementation plan.

- The Ministry's Office is responsible for consolidating and registering the list of proposals needed to be submitted to the Government and Prime Minister in the Ministry's work program for review by the Ministry's leadership before submission.

- Within five days from the date the Ministry's leadership approves the Ministry's annual work program, the Director of the Ministry's Office submits it for signature by the Ministry's leadership and sends it to the Government's Office before November 15 each year.

b) Implementation of the Ministry’s annual work program: Within ten days from receiving the Government's work program, the Ministry's Office consolidates the parts related to the Ministry in the Government's work program, completes the Ministry’s annual work program, submits it for the Minister's signature and issuance, and distributes it to units for implementation.

2. Quarterly program of work:

a) At the end of each quarter, units must evaluate the implementation of the quarterly work program, review the proposals for the next quarter listed in the annual work program, consider new issues arising, and propose adjustments to the next quarter's work program.

By the 10th day of the last month of each quarter, units must submit proposals to adjust the next quarter's work program, the Legal Department will consolidate adjustments to the plan for drafting legislative documents for the Ministry's Office to incorporate into the quarter's work program (including summaries of adjustments to the implementation plans for each proposal).

b) The Ministry's Office drafts the next quarter's work program, including any related adjustments to the Government's quarterly work program, and submits it for the Ministry's leadership's signature and submission to the Government's Office no later than the 15th day of the last month of each quarter.

Within three days from receiving the next quarter's work program from the Government, the Ministry's Office consolidates the parts related to the Ministry in the Government's work program, completes the Ministry's quarterly work program, submits it for the Minister's signature and issuance, and distributes it to units for implementation.

3. Monthly program of work:

a) Based on the progress of preparing proposals listed in the quarterly work program, outstanding issues, and newly emerging issues, units need to adjust the next month's work program, the Legal Department will consolidate adjustments to the plan for drafting legislative documents and submit adjustment proposals to the Ministry's Office before the 15th of each month.

The Office of the Ministry proposes adjustments from units and submits for signature by the Ministry's leadership to send to the Office of the Government no later than the 20th of each month.

b) Based on the Government's work program, the Prime Minister's work program (relevant to the Ministry), the quarterly work program, directives, and management of the Ministry, as well as unit proposals for adjustment, the Ministry's Office drafts the Ministry's monthly work program, submits it for signature and issuance by the Ministry's leadership, and sends it to units for their knowledge and implementation.

4. Weekly Work Program: The Ministry's Office coordinates with relevant units to develop the weekly work program for the Ministry's leadership and uploads it to the network no later than Friday of the previous week.

5. Procedure for drafting the annual plan for legislative work and ordinance implementation follows the provisions of the Law on Issuing Legal Normative Documents.

6. Adjustments to the work program are made based on the directives of the Ministry's leadership and unit proposals. The Ministry's Office reports to the Ministry's leadership for decision-making on adjustments and promptly informs related units.

7. The Ministry's Office is responsible for advising the Minister on the development, adjustment, and organization of the implementation of the work program (excluding the Ministry's legislative work program) to ensure compliance with the requirements of the Ministry's directives and management.

The Legal Department is responsible for advising the Minister on the development, adjustment, and organization of the implementation of the Ministry's legislative work program. It periodically compiles results and plans for legislative work and sends them to the Ministry's Office for consolidation into the overall work program to be submitted to the Minister according to the prescribed deadlines.

8. The Ministry's annual, quarterly, and monthly work programs are published in full on the website www.mard.gov.vn. Units are responsible for monitoring and implementing them; the Ministry's Office ensures accuracy compared to the original version and does not issue hard copies to units.

Article 16. Work Programs of Units

1. Based on the Ministry's work program, functions, tasks, and authorities assigned, units develop annual, quarterly, monthly, and weekly work programs and plans and organize their implementation.

2. Unit heads are responsible for monitoring, urging, and creating conditions to complete work programs and plans. In cases where subjective or objective difficulties prevent completion according to the schedule, they must promptly report to the Ministry's leadership overseeing the field and inform the Ministry's Office to adjust the overall program and find solutions to address the issues, as stipulated in Article 15.

3. Unit heads are responsible for utilizing information on the website www.mard.gov.vn to promptly grasp situations to serve general directive and management work; they report work results to the Ministry as required.

Chapter V.

PROCEDURE FOR REGULAR WORK MATTERS

Article 17. Completing Preparation Plans for Drafts

1. For draft laws and ordinances, the planning process follows the provisions of the Law on Issuing Legal Normative Documents and Decision No. 90/2007/QĐ-BNN dated November 9, 2007, issued by the Minister of Agriculture and Rural Development on the Regulations for Drafting, Issuing, Checking, Handling, Reviewing, and Systematizing Legal Normative Documents of the Ministry.

2. For projects within the work program (to be submitted to the Government, Prime Minister, Minister):

a) Based on the Ministry's annual work program (project section), the head of the leading unit organizes the completion of preparation plans for each project, clearly defining the scope of the project, necessary tasks, coordinating agencies, reviewing agencies, submission deadlines, and sends these plans to the Ministry's Office for consolidation and submission to the Government's Office.

The deadline for submitting plans is no more than five working days for projects in the first quarter program, and no more than fifteen days for other projects from the date the annual program is issued.

3. Any changes to plans or submission deadlines for projects must be reported and approved by the Minister or Deputy Minister overseeing the field, and reported to the Ministry's Office or the Legal Department (for legislative work plans) according to the deadlines set out in Article 15.

Article 18. Preparation of the project proposal

1. Based on the annual work program, the head of the unit responsible for the main preparation of the project must establish a draft outline, work plan, and financial estimate (if necessary). Upon approval by the Ministry's leadership, the main responsible unit must closely coordinate with related agencies to implement the procedures and timeframes as prescribed and notify the plan to the Ministry's Office for monitoring and urging implementation.

For the preparation of draft laws, ordinances, and regulatory legal documents, in addition to complying with the provisions of this Regulation, they must also be carried out according to the regulations on issuing regulatory legal documents.

2. If the main responsible unit changes the submission deadline or content of the project, it must report and obtain the agreement of the Minister or Deputy Minister in charge of the relevant field.

Article 19. Coordination Relationships in Project Proposal Preparation

1. The head of the unit responsible for drafting the project (hereinafter referred to as the project leader) invites the heads of related units to unify the preparation of the project or requests to send staff to participate in the preparation of the project. The invited unit has the responsibility to dispatch personnel to participate as requested by the project leader. The person dispatched as the representative of the participating unit must regularly report and seek opinions from the head of their unit during the process of participating in the project drafting. The coordination activities in drafting the project mentioned above do not replace the formal consultation procedures prescribed in Clause 2 of this Article.

2. After the project has been prepared, the project leader must formally solicit opinions from related units through one of the following two methods:

a) Organizing a meeting: The project leader sends invitations and materials at least three working days before the meeting. The project leader hosts the meeting, introduces the content, and collects opinions to supplement and complete the project. Discussion points must be recorded in the minutes signed by the chairperson of the meeting.

The invited unit must send a representative with sufficient authority to attend the meeting, express the opinion of the head of the unit, and report the conclusions of the meeting fully to the head of the unit. In case the representative of the invited unit is absent, the project leader sends the relevant parts of the conclusion to that unit. Within five working days from receiving the letter, the head of the unit solicited for opinions must respond in writing. If beyond this period, the head of the unit solicited for opinions does not reply, it is understood as agreeing with the project and must bear responsibility for the related contents.

b) Sending a letter requesting opinions: The project leader sends the final draft of the project and accompanying files to the heads of related units to solicit opinions. The head of the unit solicited for opinions has the responsibility to officially express their opinion in writing, send it to the project leader within the latest five working days from the date of receipt of the request with all necessary files. The opinion letter must clearly state points of agreement, disagreement, recommendations for amendments, and supplements. If the project file is unclear or due to complex issues requiring additional time for study, the unit solicited for opinions has the right to request the project leader to clarify or provide additional necessary documents and agree on the response deadline, but not exceeding ten days. If beyond this period, the head of the unit solicited for opinions does not reply, it is understood as agreeing with the project and must bear responsibility for the related contents.

Article 20. Monitoring and evaluating the implementation of projects

1. Monthly, quarterly, semi-annually, and annually, units shall review and evaluate the implementation of projects within their work programs, report to the Ministry's Office or the Legal Department (for plans to draft regulatory documents) on the implementation status of the projects, difficulties encountered, new developments, subsequent handling measures, and propose adjustments and supplements to the projects in the upcoming work program according to the procedures stipulated in Article 15.

2. The Ministry's Office assists the Minister in summarizing, monitoring, inspecting, and urging units to prepare projects; regularly reporting to the Minister on the results of the Ministry's work program implementation.

3. The Legal Department assists the Minister in monitoring, inspecting, and urging units to prepare regulatory documents; regularly reporting monthly, quarterly, and annually on the results of the regulatory document drafting program for the Office to compile and report comprehensively.

4. Deputy Ministers assigned to oversee projects direct units to implement them according to approved plans; report to the Minister before final acceptance, approval, or submission to higher authorities.

Article 21. Procedures for Handling Documents

1. Official letters and memorandums requesting resolution of tasks shall be sent only one original copy to the competent authority. If it is necessary to send copies to related units for information or coordination, only the names of these units shall be listed in the "To" section of the document.

2. For matters falling within the purview of collective decision-making by the Ministry Leadership as specified in Clause 3, Article 4 of this Regulation, the Minister or Deputy Minister responsible for the relevant field shall consider the content and nature of each project to decide:

a) Permitting the leading unit to complete the procedures and register with the Ministry's Office to schedule presentation to the Ministry Leadership at the next meeting.

b) Requesting the leading unit to prepare additional materials if the content does not meet requirements.

c) Assigning the leading unit to follow the procedure set out in Point b, Clause 2, Article 19 of this Regulation to seek opinions from related units.

3. Based on the directives of the Minister or Deputy Minister regarding the content of projects and tasks, the Ministry's Office and the head of the leading unit shall be responsible for coordinating to finalize the draft document for issuance. For directives concerning the content of projects and tasks that must be institutionalized through documents sent to units or localities, the Ministry's Office and the leading unit shall be responsible for preparing such documents. For documents drafted by departments for professional tasks, depending on specific circumstances, there is no need for the Minister, Deputy Minister to directly approve the document submitted and notify the submitting unit and the Ministry's Office.

4. File and procedures for handling incoming documents and signing documents: carried out according to the Ministry's regulations on receiving, processing, and managing documents and information.

5. Electronic documents shall be processed according to current state regulations. Units or individuals receiving electronic documents shall be responsible for reporting, handling, and responding to the sender according to their authority.

Article 22. Other Regular Tasks Within the Authority of the Ministry Leadership

1. Regular directive and management tasks of the Ministry Leadership shall be implemented according to the methods for resolving tasks outlined in Article 6 of this Regulation.

2. Organizing meetings and conferences:

a) A meeting of the Ministry is convened by the Minister, Deputy Minister, or the heads of units authorized by the Ministry Leadership, including: ministerial coordination meetings with deputy ministers and heads of subordinate units; advisory meetings; working meetings; training and task deployment conferences; mid-year and annual summary conferences; annual summary conferences of the ministry and the sector.

b) A meeting of a unit is convened by the head of the unit, including: coordination meetings with deputy heads and heads of subordinate units; advisory meetings; working meetings; specialized meetings; training and task deployment conferences; mid-year and annual summary conferences; annual summary conferences of the unit's specialized field.

c) Management of meeting systems and procedures to support the Ministry's management and operational activities shall be carried out according to the Ministry's Meeting System Regulations.

Chapter VI.

INSPECTION OF THE IMPLEMENTATION OF MINISTRY DOCUMENTS AND ASSIGNED TASKS

Article 23. Scope and Objects of Inspection

1. Scope of Inspection: inspection of the implementation of legal normative documents on agriculture and rural development; inspection of the drafting and promulgation process of legal normative documents of the Ministry; inspection and handling of legal normative documents and other documents containing legal norms but not issued in the form of legal normative documents, other documents issued by the Ministry; annual, quarterly, monthly work programs and tasks assigned by the Ministry's leadership.

2. Objects of Inspection: agencies and units under the Ministry.

3. Inspections of other Ministries, sectors, People's Committees at all levels regarding the issuance and enforcement of laws, professional standards, international aid programs related to agriculture and rural development shall be conducted in accordance with the provisions of the law, the Law on the Organization of the Government, and Decree No. 178/2007/NĐ-CP stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies.

Article 24. Inspection Authority

1. The Minister shall inspect all activities of agencies, organizations, and units within the scope of the Ministry’s functions, tasks, and powers, and individuals according to the law.

2. Deputy Ministers shall inspect matters within their specialized fields and carry out inspection tasks assigned by the Minister.

3. Heads of units have the right to inspect:

a) Within the scope of their functions, tasks, and powers as prescribed.

b) The implementation of tasks assigned by the Ministry's leadership.

Article 25. Forms of Inspection

1. Heads of units shall regularly self-inspect the implementation of documents and tasks assigned at their units; identify issues and propose timely solutions.

2. Heads of units under the Ministry decide on regular, periodic, or spot inspections of the implementation of Ministry documents and tasks assigned by the leadership according to the authority stipulated in Clause 3 of Article 23.

3. Methods of conducting inspections:

a) Leaders of the Ministry, leaders of functional agencies under the Ministry, and civil servants assigned inspection tasks work directly at the units.

b) Require units to report in writing on the implementation situation.

c) The Minister may delegate a Department Director or Bureau Chief to lead inspections or decide to establish inspection teams for the implementation of documents in various fields or issues requiring focused guidance during specific periods. The leading unit, in coordination with relevant units, develops an inspection outline, submits it to the Ministry's leadership for approval, and implements it.

d) Organize mid-term and final summary meetings. This method applies to large programs and projects.

Article 26. Reporting Inspection Results

1. Upon completion of the inspection, the person in charge must inform the inspected unit's head of the inspection results and report to the inspection task supervisor. The report must clearly state: content, inspected unit; assessment of strengths and weaknesses; violations and recommendations for handling measures (if any).

2. The head of the inspected unit must submit a written report to the Ministry's leadership on the inspection results, simultaneously informing the inspected unit and related units within the Ministry. If violations are found, they shall be handled according to authority or recommended to the competent authority for handling.

The head of the inspected unit is responsible for monitoring post-inspection actions; requesting the inspected unit to rectify violations according to the decision of the competent authority; reporting post-inspection rectification results to the Ministry's leadership.

3. At the end of each month, quarter, heads of units must report to the Ministry on the inspection situation of document implementation and tasks assigned by the Ministry's leadership according to authority.

4. The Ministry's Office compiles and reports to the Ministry on the inspection situation of the Ministry at weekly, monthly, quarterly briefings, mid-year summary conferences, and annual summary conferences of the Ministry, and other task assignment documents.

Chapter VII.

Article 4. Locations for Citizen Reception

Article 27. Responsibilities of the Ministry's Office

1. Arrange the Citizen Reception Room and necessary conditions, equipment to serve citizen reception work at the Ministry's headquarters in Hanoi and Ho Chi Minh City; guide and welcome citizens according to regulations.

2. Timely notify the Inspectorate of the Ministry when citizens come to the Ministry's Citizen Reception Room in Hanoi and Ho Chi Minh City requesting complaints and denunciations to be resolved.

3. Schedule meetings between the Ministry's leadership and citizens monthly in accordance with legal provisions and the Inspector General's recommendations.

Article 28. Responsibilities of the Inspectorate of the Ministry

1. Arrange staff to directly receive citizens at the Ministry's Citizen Reception Room at the Ministry's headquarters in Hanoi and Ho Chi Minh City. Citizen reception and complaint resolution shall be carried out in accordance with the laws on complaints and denunciations and the Citizen Reception Regulations of the Ministry of Agriculture and Rural Development.

2. Request the heads of relevant units to dispatch authorized staff to participate in citizen reception at the Ministry's Citizen Reception Room when necessary.

3. Guide and respond to citizens' complaints, denunciations, and suggestions.

4. Prepare files and documents for the Ministry's leadership to receive citizens when requested.

5. Implement reporting procedures to the Ministry's leadership and the General Inspector regarding the Ministry's citizen reception work.

Article 29. Responsibilities of the Heads of Units

1. The heads of related units are responsible for coordinating with the Chief Inspector of the Ministry in receiving citizens to resolve complaints and denunciations related to the functions and tasks of their units.

2. Dispatch competent staff in accordance with the requirements of the Inspectorate of the Ministry to coordinate in receiving citizens at the Ministry's Citizen Reception Room.

Chapter VIII.

BUSINESS TRIPS, GUESTS

Article 30. Domestic Work Trips

1. Participating in working delegations of Party, State, National Assembly, Government, and inter-ministerial agencies

a) Staff and civil servants dispatched to participate in State and inter-ministerial working delegations at localities and units (collectively referred to as the base) must comply with the required composition. Issues related to the Sector must be prepared in writing according to the requirements of the delegation leader.

b) Upon completion of the work program, within three working days, staff members participating in the delegation must submit a written report to the head who dispatched them about the results of the work program, issues related to the Sector proposed by the base during the meeting, and the conclusions of the delegation leader.

2. Ministry leaders traveling to localities and units under the Sector

a) When there is a directive from the Ministry's leadership, the unit assigned to lead coordination shall contact the base to unify the work program and plan, and submit it to the delegation leader.

b) After the program and plan have been approved, the Ministry's Office shall notify the relevant unit to prepare accordingly.

The heads of units shall dispatch staff to participate in the working delegation as required by the Ministry's leadership, while ensuring the requirements stipulated in point a, Clause 3, Article 3 of this Law.

c) Reports and documents must be completed before the day of work, reported to the Ministry's leadership, and sent to the parties involved for preparation (if necessary).

d) Before the day of work, the leading unit must finalize the work program and plan with the base unit, report to the Ministry's leadership.

đ) Organizing work: The leading unit is responsible for coordinating with the base unit to implement work according to the unified program and plan, handling any arising situations, and seeking approval from the Ministry's leadership if beyond authority. The content of the work must meet the requirements of the Ministry's leadership and the regulations on reports and documents stipulated in point c, Clause 2, Article 3 of this Law.

e) After completing the work trip, the leading unit shall cooperate with the base unit to draft a notification on the results of the work, the directives of the Ministry's leadership, submit it to the Chief of the Ministry's Office for review, and present it for signing and issuance of the notification of the Ministry's leadership conclusions. The Ministry's Office is responsible for checking and urging the implementation of the notification of the Ministry.

3. Other Working Delegations

a) Unit heads, when dispatching staff under their management to work trips, must ensure the correct composition related to the content and program of the work trip. When dispatching staff for work trips, unit heads must arrange substitutes to handle regular work.

b) The delegation dispatched to the base must prepare plans, programs, contents, and report to the responsible leadership and notify the base at least three working days before arrival.

- A working delegation comprising staff from two or more units must have the leading unit arrange a delegation leader and arrange a shared vehicle to save costs.

- Do not combine sightseeing tours in the working schedule during working days of the week.

- The working delegation at the base shall only work and resolve issues within the announced content and program and within the delegation's authority; simultaneously, fully record any recommendations related to the Sector from the base.

- Within three working days after the end of the work trip, the delegation leader must submit a written report to the unit head who dispatched them about the results, recommendations from the base related to the Sector, proposals for organizing the implementation of those recommendations; for inspection and verification delegations, they must follow the regulations on inspection, complaints, denunciations, and anti-corruption.

Article 31. Official overseas trips

1. Participation in delegations led by Party, State, National Assembly, Government, and inter-ministerial leaders:

a) Officials and civil servants assigned to join official delegations must prepare in writing issues related to their field according to the delegation's requirements and bear legal responsibility for the contents of those documents.

b) Within five working days after completing the work program, officials participating in the delegation must report in writing to the head of the agency that dispatched them about the results of the work and the conclusions of the delegation leader.

2. Delegations led by Ministry leadership

a) Delegations led by the Minister or Deputy Minister to officially visit and work with countries, international organizations, attend international conferences, intergovernmental committee meetings with countries, the International Cooperation Department shall coordinate with relevant units to be responsible for preparing procedures for establishing the delegation, the content of the program, preparing reports for the delegation leader's approval, assigning staff from the department to participate in the delegation and organizing the implementation of the work program; preparing reports on the results of the work as prescribed.

b) Delegations led by Ministry leadership attending conferences, seminars, specialized visits, surveys, specialized units assigned the content shall be responsible for coordinating with the International Cooperation Department to prepare and implement the program, and submit written reports to the Ministry Office and the International Cooperation Department for monitoring and summarizing.

c) Other delegations: Only organize delegations to go on official trips according to plans approved in the Ministry's outbound delegation program, within projects, cooperation programs. In other cases, a written report clearly stating the purpose, content, composition, time, location, program, funding source must be sent to the International Cooperation Department for Ministry leadership approval. Only notify foreign partners and complete other procedures after obtaining approval from Ministry leadership.

- The composition of the delegation must ensure the correct target group, suitable for the content of the program. Arranging substitutes to handle work and report to the Ministry when going on official trips shall be carried out according to point a, Clause 3, Article 30 of this Regulation.

- Heads of units, in addition to attending conferences and seminars abroad, are only permitted to conduct visits and surveys when the content aligns with their assigned professional fields, not more than two times per year, and may not use funds from the Ministry's outbound budget unless specifically assigned by the Minister.

- Heads of Departments, Bureaus, the Ministry Office, the Inspectorate going on official trips abroad must report in writing to the Minister. Only proceed with trip procedures after obtaining the Minister's approval.

3. Responsibilities of the International Cooperation Department

a) Handle passport, exit and entry visa procedures, guide state regulations, foreign regulations, and issues related to the delegation's work program.

b) Arrange for Department leaders to see off and welcome the Minister, official delegations led by Ministry leadership, assign staff to handle exit procedures at the Vietnamese border crossing where the Ministry leadership exits and enters.

4. Responsibilities of the Delegation Leader:

a) Organize the implementation of the program content and all activities of the delegation abroad according to the reported program and in accordance with legal provisions.

b) Within five working days after completing the work program, must submit a written report to the Ministry and relevant units.

Article 32. Receiving Guests within the Country

1. Official meetings and work programs for the Leaders of the Ministry:

a) The Minister shall receive and work with guests who are Party and State leaders, Government members, Ministers of Ministries and agencies at the ministerial level, Secretaries and Chairpersons of People's Committees of provinces and centrally governed cities, heads of central political-social organizations, and equivalent positions, delegations, and guests invited by the Minister.

b) Deputy Ministers shall receive guests authorized by the Minister; work with guests who are Deputy Ministers of Ministries and agencies at the ministerial level, Deputy Secretaries of provincial Party Committees, Deputy Chairpersons of People's Committees of provinces and centrally governed cities, and equivalent positions.

c) The Director of the Ministry's Office shall be responsible for arranging the program and preparing for the Ministry's leadership to receive guests at the Ministry's office:

- When there is a planned meeting, the Ministry's Office shall be responsible for coordinating with the guest's agency or the agency requesting the reception (collectively referred to as the guest agency) to report to the Ministry to request the implementation of preparatory work, including specific assignments: content of the working program; participants; preparation of reports; welcoming arrangements for representatives; security protection (if necessary); meeting rooms.

- After the plan has been approved, the Ministry's Office shall notify the units assigned to prepare materials and reports (reports must be submitted to the Ministry's Office for review by the Ministry's leadership at least two days before the meeting); invite participating units; supervise and take responsibility for the preparatory work. In case of urgent requests from the guest agency, participating units shall prepare summary reports, and the head of the unit shall be responsible to the Minister for the content of the report.

- The Ministry's Office shall organize the welcoming and receiving of guests; record the list of representatives; distribute materials; assign speakers; and record the minutes of the meeting.

2. Ministry Leadership Working with Localities and Units within the Sector in the Province

- In cases where Ministry leadership works with the Director of the Department of Agriculture and Rural Development, units within the sector (including seminars), the Ministry's Office and the leading professional unit shall coordinate with the Department of Agriculture and Rural Development to prepare and implement the working program.

- In cases where Ministry leadership works with Provincial Party Committee leaders, Provincial People's Councils, People's Committees of provinces and centrally governed cities, the Ministry's Office and the leading professional unit shall coordinate with the People's Committee Office and the Department of Agriculture and Rural Development of the province and centrally governed city to prepare and implement the working program.

3. For Diplomatic Receptions and Visits by Ministry Leadership

The Ministry's Office shall be responsible for arranging the program, reception rooms, and service work according to the requirements of the Ministry's leadership, but not exceeding legal regulations and those of the Ministry.

4. Heads of Units Organizing Receptions and Meetings

Heads of units shall be responsible for organizing receptions and meetings with Department leaders and equivalent-level leaders on matters within the unit's jurisdiction, or as required by the Ministry's leadership. During the handling of tasks, if the matter involves another unit, they may invite that unit to participate or directly seek its opinion; for matters beyond the unit's jurisdiction, the head of the unit must directly report and seek the opinion of the Ministry's leadership.

Article 33. Receiving Foreign Guests

1. Official receptions and meetings with foreign delegations according to the programs of the Party, State, National Assembly, and Government shall be carried out according to the reception program of the leading agency. The International Cooperation Department has the responsibility to coordinate with the proposing agency to arrange the protocol and reception program, and report to the assigned Ministry leadership at least one day before the reception.

2. Official receptions and meetings with foreign delegations invited by the Minister or proposed by guests and approved by the Minister, as well as social receptions and individual receptions by Ministry leaders for foreign guests, shall be conducted in accordance with the Ministry's Reception Regulations.

3. Heads of units under the Ministry shall proactively organize receptions and meetings with foreign guests on matters within their authority. Each quarter, units shall compile the results of working programs with foreign guests and submit them to the International Cooperation Department for consolidation and reporting to the Ministry.

The International Cooperation Department is responsible for assisting with diplomatic procedures and coordinating with units to handle arising issues.

Article 34. Financial Procedures for Official Travel and Receptions

All financial procedures, expenditure levels, responsibilities, relationships in the allocation and settlement of costs for domestic and foreign official travel and receptions shall be implemented in accordance with current financial regulations and the Ministry's internal expenditure rules.

Chapter IX.

REPORTING AND INFORMATION SYSTEM

Article 35. Deputy Ministers Reporting to the Minister

1. Deputy Ministers shall report to the Minister on matters within their assigned areas of responsibility, matters exceeding their authority to resolve, and matters requiring the Minister's opinion.

2. When Deputy Ministers are authorized to attend or direct conferences, they must report to the Minister on the contents and outcomes of the conference.

3. Report to the Minister on the results of work and recommendations for the Ministry of Agriculture and Rural Development from sectors and localities when appointed to participate in working delegations of Party and State leaders.

Article 36. Unit Heads Reporting to the Ministry Leadership

1. Unit heads under the Ministry must fully implement information and reporting systems to the Ministry Leadership as stipulated and special reports as required by the Ministry. Six-month and annual reports must be reviewed by the Deputy Minister responsible for the area.

a) The regular reporting schedule of units to the Ministry is as follows:

- Weekly reports sent before 15:30 on Fridays;

- Monthly reports sent before the 20th of each month for compilation and reporting to higher-level agencies;

- Mid-year work reports sent before June 10;

- Annual work reports sent before November 10.

When issues arise that exceed the unit's management authority, the unit head must report to the Ministry Leadership for timely resolution.

b) Adjustments to monthly, quarterly, and annual work programs of units shall be carried out in accordance with Article 17 of this Regulation.

c) Other reports (such as administrative reform reports, implementation of anti-corruption laws, thrift and anti-waste laws) shall be specified separately according to the requirements of the Government and the Ministry.

2. In addition to implementing the provisions stipulated in Clause 1 of this Article, the Director of the Ministry's Office must also perform the following tasks:

a) Organize daily information provision to the Minister and Deputy Ministers on resolved issues: processing incoming documents, signed and issued documents by Ministry Leadership;

b) Prepare weekly leadership meeting reports;

c) Compile and prepare periodic (monthly, quarterly, annual) work reports of the Ministry to send to the Government and higher-level state agencies;

d) Guide, monitor, and urge units and specialized management agencies in localities to strictly adhere to information and reporting systems and organize information exploitation to serve the Ministry's direction and control;

đ) Monitor public opinion related to the sector, propose issues for handling, and report daily to the Ministry Leadership.

Article 37. Departmental Weekly Reports

1. Weekly reports of the Department's leadership:

a) The Department's Office shall be responsible for promptly updating the conclusions of the Minister at the weekly meetings into the Department's meeting program software on http://www.mard.gov.vn/giaobanbo/; monitoring, urging units to implement, and completing the report for the weekly meetings of the Department's leadership;

b) Units:

- Update the results of implementation into the Department's meeting program software on http://www.mard.gov.vn/giaobanbo/ no later than 15:30 on Fridays each week.

- Content to be updated includes:

+ Results of implementing tasks assigned by the Department at the weekly meetings of the Department's leadership and other tasks assigned by the leadership during the week;

+ Special situations requiring attention in the implementation of unit tasks (pests, diseases, epidemics, forest fires, droughts, floods, etc., if applicable);

+ Recommendations of the unit (if any).

2. Monthly reports of the Department:

a) Based on the guidance of the Department's leadership, the Department's Office shall issue a document requesting units to report on the results of their monthly tasks; monitor, urge units to implement, and complete the report for the Department's monthly meetings;

b) Units:

- Report on the results of implementing tasks in the month, no later than the 28th of each month or as required by the Department. The content of the report includes:

+ Results of implementing tasks assigned by the Department at the monthly meetings of the Department;

+ Results of implementing programs to build draft projects submitted to higher authorities and to the Minister; the Legal Affairs Department shall compile a report on the situation of building legal documents of the Department;

+ Results of implementing conclusions from higher authorities and the Department's leadership;

+ Results of implementing action programs, resolutions, etc.;

+ Results of processing documents into the Department's document management program;

+ Results of implementing other tasks as required by the Department in the preparation document for the monthly meetings of the Department;

+ Recommendations (if any).

- Prepare specialized reports as required by the Department's leadership (if any).

Article 38. Information on the Activities of the Department

1. Units under the Department shall be responsible for informing staff, civil servants, and employees of the following information:

- Policies and guidelines of the Party and State related to the work of the unit and the sector;

- Work programs of the Department and units; operating funds and annual financial settlements;

- Recruitment, training, awards, disciplinary actions, salary increments, rank promotions, and promotions of cadres and civil servants;

- Documents concluding the handling of complaints and denunciations within the unit;

- Rules and regulations governing work procedures of the unit.

2. Providing Information to the Public

a) Through mass media organizations

The Department maintains regular relations and creates conditions for mass media organizations to provide accurate and timely information about events occurring in the sector.

b) Providing Information on the Internet

- The following documents shall be posted on the Department's wide-area network:

+ Legal documents related to agriculture and rural development that have been issued;

+ Administrative documents, various types of reports, forms, and guiding documents with more than 30 addresses or copies sent and designated by the Director of the Department's Office;

+ Government documents provided to units within the Department to enable them to promptly understand new policies and laws, draft documents prepared by units within the Department or received from other agencies for organization of opinions and improvements;

+ Documents issued by the Department as stipulated in the Regulation on Receipt, Processing, and Management of Documents and Information of the Department;

- The Department's Office shall be responsible for exploiting and disseminating (printing on paper or reposting on the Department's wide-area network) information from the Government's wide-area network, legal documents, reports, and other relevant information to effectively support government and Department leadership operations.

- The Center for Computing and Statistics shall be responsible for providing information to serve state management functions of the Department and individuals or organizations with needs.

- Units within the Department's network must comply with the information exchange system through the Department's wide-area network as prescribed. Regularly monitor information on the network to promptly retrieve directive documents and information sent by the Department for dissemination and implementation.

c) Authority, responsibility, form, content, and relationships in providing information to mass media organizations shall be implemented according to Decision No. 77/2007/QĐ-TTg of the Prime Minister promulgating the Regulation on Spokespersonship and Provision of Information to the Press of Ministries, Sectors, and State Agencies, and the Regulation on Spokespersonship and Provision of Information to the Press of the Ministry of Agriculture and Rural Development.

Posting news and managing information on the Department's electronic bulletin board must comply with laws on posting information on the internet and related regulations of the Department.

Chapter X.

IMPLEMENTATION

Article 39. Responsibility for Implementation

1. The heads of units under the Ministry shall be responsible for disseminating and organizing the implementation of this Regulation.

2. Officials, civil servants, employees, workers under the Ministry's agency, organizations, individuals within the country and abroad who have working relations with the Ministry shall be responsible for implementing this Regulation.

3. The heads of units under the Ministry shall base on this Regulation to amend, supplement, or establish new work regulations within their areas of responsibility to ensure compliance.

4. The Ministry’s Office shall monitor, urge the implementation of the Ministry’s work regulations and those of the units. They shall inspect, summarize experiences, draw lessons, and promptly amend and supplement provisions that are not appropriate to complete the Ministry’s work regulations.

Article 40. Awards and Disciplinary Measures

The implementation of this Regulation shall be one of the bases for evaluating annual or extraordinary competition results, awards according to the Ministry's award regulations. Individuals and units that perform well will be rewarded, while those who violate will be disciplined and dealt with according to current regulations.

Article 41. Amendment and Supplement to the Regulation

During the implementation process, if there are difficulties, units shall promptly identify and propose solutions, reporting to the Ministry to amend, supplement, and perfect the regulation in a timely manner./.
