Circular No. 3771/TM-XNK guiding the implementation of commodity policies and the management of import and export activities in 1995

NOTICE

OF THE MINISTRY OF TRADE NUMBER 3771/TM/XNK DATED MARCH 25, 1995 ON
IMPLEMENTATION OF COMMODITY POLICIES AND MANAGEMENT OF EXPORT AND IMPORT ACTIVITIES IN 1995
On March 15, 1995, the Minister of Trade issued Circular No. 07/TM-XNK guiding all issues related to the implementation of commodity policies and management of export and import activities in 1995 to enforce Decision No. 752/TTg dated December 10, 1994, and other documents numbered 294/KTTH dated January 19, 1995, and 666/KTTH dated February 14, 1995, issued by the Prime Minister.

Now, the Ministry of Trade requests reporting to the competent authorities (Ministries, central agencies, Provincial People's Committees) of enterprises on the following matters:

I - Circular 07 has guided enterprises on the state management of goods circulation according to the following lists:

1 - Prohibited export and import goods.

2 - Export goods managed by quota.

3 - Export and import goods managed by indicative planning.

4 - Export and import goods guided by specialized management agencies.

5 - Import of consumer goods and used goods.

II - In accordance with the directives of the Prime Minister regarding the goods mentioned in the above lists, the Ministry of Trade has coordinated with relevant Ministries to review the entire operation of enterprises in recent years to classify, select, allocate business, and have distributed the total quantity of goods under indicative planning right from the beginning of the year and completed the announcement so that enterprises can proactively conduct business throughout the year without having to run around requesting each shipment when needed.

It is requested that the competent authorities of enterprises coordinate with the Ministry of Trade to handle the following matters:

a - Do not send letters requesting the Ministry of Trade to increase or supplement quantities because they have been fully allocated and announced.

b - Inform subordinate enterprises and remind them not to come to the Ministry of Trade to request additional allocations.

c - Direct enterprises that have received allocations to comply strictly with general regulations on exports and imports. If an enterprise cannot fulfill its allocation, it must report to the Ministry of Trade for transfer to another enterprise to implement. It is not allowed to transfer the allocation to another enterprise under any form (Up to now, there have been opinions and public feedback to the Ministry of Trade: some enterprises have been proposed for allocation by the Ministry, Provincial People's Committee, but lacking capital and customers, have resorted to various forms of selling their allocation rights, which contradicts the proposal of the Ministry, Provincial People's Committee, and violates the general regulations on exports and imports).

III - It is requested that the Ministries managing industries (which have signed guidance documents for implementing each indicative commodity) not confirm or sign documents proposing

the Ministry of Trade to newly allocate or supplement quantities for any specific enterprise. If 60-70% of the quantities have been assigned to the industry-managing Ministries to allocate to key enterprises within those Ministries and these key enterprises cannot fulfill their tasks, then it is proposed that the industry-managing Ministries also handle this situation by informing the Ministry of Trade so that the Ministry of Trade can assign to other enterprises capable of conducting business.

IV - Currently, on the global market, prices of urea fertilizer, sugar, cement are experiencing complex changes due to many reasons of supply not meeting demand. In the country, prices of these commodities are also increasing but not yet corresponding to import prices. Many enterprises, due to lack of information on global prices, seeing domestic prices rising slightly, have resorted to every means to transact and hastily conclude import contracts. Not a few enterprises have been lured by foreign sellers offering low prices, leading to some cases where they were caught off guard, causing disadvantages and failing to fulfill import tasks, wasting time and costs. The Ministry of Trade proposes:

a - Relevant Ministries should coordinate closely with the Ministry of Trade to take proactive measures to respond to price fluctuations affecting both domestic and international markets for each commodity.

b - Ministries, Provincial People's Committees managing enterprises should remind and guide enterprises to monitor market information, prices, and the movement of goods on both domestic and international markets through the daily Market News Briefs issued by the Trade Information Center to conduct business transactions, signing contracts... accurately and effectively, avoiding risks.

The Ministry of Trade requests the competent authorities (Ministries, central agencies, Provincial People's Committees) of enterprises and the Ministries managing industries to provide full support, cooperation, and coordination with the Ministry of Trade to manage export and import activities well in 1995.

The Ministry of Trade requests that the managing authorities (ministries, central agencies, Provincial People's Committees) of enterprises and relevant ministries provide utmost support, cooperation, and coordination with the Ministry of Trade to effectively manage the import and export of goods in 1995.
