DECISION OF THE PRIME MINISTER

Regarding the functions, tasks, powers, and organizational structure
The Technical Safety Inspection and Supervision Bureau

 

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to Decree No. 74/CP dated November 1, 1995 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Industry;

At the request of the Minister of Industry and the Chairman of the Government's Organization and Cadre Affairs Board,

 

DECISION:

Article 1. The Technical Safety Inspection and Supervision Bureau under the Ministry of Industry assists the Minister of Industry in performing state management functions in the technical safety inspection and supervision sector within industrial production sectors, including: Machinery, Metallurgy, Electronics-Information Technology, Chemicals, Geology, Mineral Resources, Mines (including Coal, Oil, Natural Gas, and Precious Stones), Power, and Consumer Industries.

The Technical Safety Inspection and Supervision Bureau has legal personality, its own seal and separate account, operational funds provided by the state budget, headquartered in Hanoi City, and has facilities located in certain areas.

Article 2. The Technical Safety Inspection and Supervision Bureau has the following main tasks and powers:

1. Participate in drafting and guiding the implementation of technical safety regulations, procedures, and standards issued by competent state agencies within the industry.

Draft inspection and supervision systems for technical safety applicable to units under the Ministry of Industry's management to submit to the Minister of Industry for issuance.

2. Organize technical safety inspections and supervision.

Conduct inspections, testing, and prepare files for machines, equipment, materials, and substances with strict requirements for labor safety used in the industry as a basis for the State Labor Safety Inspectorate or Occupational Health Inspectorate to issue usage permits.

3. Monitor compliance with regulations on supply and use of electricity to ensure safety in production and consumption of electricity.

4. Inspect and supervise technical safety in the production, storage, transportation, and use of industrial explosives according to government regulations for entities permitted to produce and consume explosives under the Ministry of Industry.

5. Participate in evaluating technical safety solutions in investment projects and technical design proposals for units under the Ministry of Industry's management.

6. Participate in coordinating with agencies to investigate causes of accidents related to industrial technical safety and propose technical safety solutions.

7. Guide the implementation of regulations and systems regarding professional duties in technical safety inspection and supervision for local industrial departments.

8. Implement international cooperation in the field of technical safety inspection and supervision as assigned by the Minister of Industry.

9. Organize training and professional development in technical safety inspection and supervision within the industry as assigned by the Ministry of Industry.

10. Manage organizational structure and civil servants, officials, and assets of the Bureau in accordance with laws and delegation by the Minister of Industry.

Article 3. The organizational structure of the Technical Safety Inspection and Supervision Bureau includes:

1. Bureau leadership: Consisting of a Director and several Deputy Directors.

The Director is responsible to the Minister of Industry for all activities of the Bureau. Deputy Directors assist the Director as assigned by the Director.

The Director and Deputy Directors are appointed by the Minister of Industry.

2. Supporting machinery for the Director includes:

a) An Office and several specialized and professional Departments as decided by the Minister of Industry.

b) Several Testing Centers and Sub-Bureaus for inspection and supervision as agreed upon by the Minister of Industry and the Minister of Government Personnel Affairs.

Article 4. This Decision takes effect fifteen days from the date of issuance. All previous provisions contrary to this Decision are abolished.

The Minister of Industry, Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of People's Committees of provinces and centrally-administered cities, and the Director of the Technical Safety Inspection and Supervision Bureau are responsible for implementing this Decision./ .
