Directive No. 38/2003/CT-BNN on Strengthening Management and Use of Military Weapons, Auxiliary Tools, and Enforcement Uniforms in Forest Rangers

DIRECTIVE

On Strengthening Management and Use of Military Weapons, Auxiliary Tools, and Uniforms for Law Enforcement in Forest Rangers

Implementing Decree No. 39/CP dated May 18, 1994 of the Government on the organizational system and tasks and powers of Forest Rangers, Circular Jointly Issued by the Ministry of Forestry and the Ministry of Finance No. 07/TT-LB dated June 7, 1995 on the uniform regulations for forest rangers, the Ministry of Agriculture and Rural Development has issued Decision No. 3602/QD-KL dated September 6, 2000 on the unified uniforms for forest rangers when performing official duties, Decision No. 04/1999/QD/BNN-KL dated January 6, 1999 and Decision No. 112/2002/QD-BNN dated April 2, 2002 on approving the plan to equip military weapons for forest rangers, Decision No. 94/2000/QD/BNN-KL dated August 24, 2000 promulgating the Regulations on Management and Use of Military Weapons and Auxiliary Tools in the Forest Ranger Force.

In recent times, the issuance, management, and use of military weapons, auxiliary tools, uniforms, insignia, and badges for forest rangers at localities and units have generally been regulated. However, some units have shown lax management leading to loss of military weapons and auxiliary tools, improper use, and unauthorized individuals using uniforms, insignia, and badges of forest rangers to commit violations, affecting the reputation of the forest ranger force. Some units produce and supply uniforms and badges for forest rangers that do not meet quality, design, and style standards.

To strengthen the management and use of military weapons, auxiliary tools, uniforms, insignia, and badges for forest rangers in accordance with regulations, the Ministry of Agriculture and Rural Development requests all Forest Ranger District Offices, Technical Protection Forest Centers, and National Parks to immediately implement the following:

1. Management and Use of Military Weapons and Auxiliary Tools:

1.1. Regularly inspect and urge units and individuals responsible for management and use to strictly comply with Decision No. 94/2000/QD/BNN-KL dated August 24, 2000 of the Ministry of Agriculture and Rural Development promulgating the Regulations on Management and Use of Military Weapons and Auxiliary Tools in the Forest Ranger Force.

1.2. After completing official duties, military weapons and auxiliary tools must be properly stored and secured according to technical requirements and safety measures within the agency. When carrying weapons outside the agency, there must be an order from the unit head.

1.3. Cases of lost military weapons and auxiliary tools and unauthorized use must be thoroughly investigated and dealt with strictly in accordance with the law.

2. Management of Uniforms and Insignia and Badges for Forest Rangers

2.1. Review and correct the management, issuance, and use of forest ranger uniforms within the scope of their own units to ensure compliance with Circular Jointly Issued by the Ministry of Forestry and the Ministry of Finance No. 07/TT-LB dated June 7, 1995 on the uniform regulations for forest rangers and Decision No. 3602/QD-KL dated September 6, 2000 of the Minister of Agriculture and Rural Development on the unified uniforms for forest rangers when performing official duties.

Units must establish internal rules, maintain records to ensure proper issuance to eligible recipients based on standards and regulations. For insignia and badges, strict control under special regulations is required, only reissued upon damage, and old ones must be recovered. In cases of loss, a detailed report must be submitted before reissuance, and individuals who lose insignia or badges without justifiable reasons must face appropriate disciplinary actions.

2.2. To ensure quality and uniformity in the design of forest ranger uniforms, the Ministry requires units to procure uniforms from Company 247 (Ministry of Defense), which holds the rights to the design of forest ranger uniforms. If procuring from other units, approval in writing from the Forest Ranger Department regarding the design must be obtained.

2.3. Assign the Forest Ranger Department to supervise implementation, ensuring uniforms, insignia, and badges comply with regulations and standardized designs, proper issuance to eligible recipients, and correct usage purposes.

3. Reporting System

Units must timely report to the Ministry of Agriculture and Rural Development (Forest Ranger Department) on the management and use of military weapons, auxiliary tools, and forest ranger uniforms, and prepare plans for repairing weapons, purchasing additional ammunition, and issuing new insignia and badges for the next year, both regularly and in case of emergencies.

The Director of the Forest Ranger Department, the Heads of Provincial Forest Ranger District Offices, the Directors of National Parks, and related units shall organize the strict implementation of this Directive./.
