RESOLUTION
On the investment policy for constructing the Ho Chi Minh Road
NATIONAL ASSEMBLY OF THE SOCIALIST REPUBLIC OF VIETNAM
Pursuant to the Constitution of the Socialist Republic of Vietnam in 1992, amended and supplemented by Resolution No. 51/2001/QH10 dated December 25, 2001 of the 10th National Assembly, 10th session;
Pursuant to Resolution No. 05/1997/QH10 of the 10th National Assembly, 2nd session on the criteria for major national projects to be submitted to the National Assembly for consideration and decision on investment policies;
Based on the Report No. 1581/CP-CN dated October 22, 2004 of the Government on the overall project of the Ho Chi Minh Road; the Review Report No. 757/UBKHCNMT11 dated November 2, 2004 of the Science, Technology and Environment Committee of the National Assembly, and the opinions of the National Assembly deputies;
RESOLVES
Article 1. Investment in constructing the Ho Chi Minh Road with the following basic parameters:
1. Total length of the entire road: 3167 km (of which the main route is 2667 km long; the western branch is 500 km long).
2. Starting point of the road: Pac Bo - Cao Bang Province; End point of the road: Ca Mau Cape - Ca Mau Province;
3. Route direction: Passing through some key control points as detailed in Appendix No. 1 attached hereto.
4. Scale and technical standards: The cross-section of the road will be planned according to different sections with a scale from 2 to 8 lanes as detailed in Appendix No. 2 attached hereto. The roadbed and two-thirds of the total route will be designed according to expressway standards.
5. Regarding investment capital and phased investment:
- By 2010: Invest to connect the road from Pac Bo to Ca Mau Cape with a scale of 2 lanes. Entrust the Government to review and approve the total budget estimate.
- From 2010 to 2020: Upgrade the Ho Chi Minh Road to expressway standards; for sections that cannot be upgraded to expressway standards, widen the road cross-section appropriately according to the planning of the road network development. The total budget estimate for this phase shall be submitted by the Government to the National Assembly for consideration and decision before implementation.
Article 2. Entrust the Government to implement the construction of the project with the following basic requirements:
1) Specific route selection must ensure relative straightness from north to south, avoid steep slopes and sharp turns; minimize passing through villages and densely populated areas; minimize negative impacts on the environment, landscape, historical and cultural relics, national parks, nature reserves, energy and water conservancy projects, and other important projects; ensure sustainable economic and social development, and guarantee national defense and security in regions where the road passes; at the same time create connectivity between urban areas, residential zones, industrial zones, and key economic regions.
2) Plan for expansion and upgrading of sections of the Ho Chi Minh Road to expressway standards after 2010 based on development needs and traffic volume; clearly define the safe traffic corridor of the road, manage it strictly, plan economic and social development, adjust production structures, relocate residents, ensuring that those who need to be relocated have a better or equal living standard after resettlement; restore revolutionary historical sites in areas where the road passes; prevent and handle promptly and strictly any illegal encroachment on the safe traffic corridor of the road.
3) The phased investment and scale of investment for each section should consider specific development needs, financial balance capacity, and compliance with the national road network development plan; prioritize investment in sections with urgent transportation needs, to leverage economic potential, and to prevent natural disasters; rationally utilize existing sections to enhance efficiency and save investment capital.
4) Ensure strict adherence to deadlines and high quality, effectiveness, and sustainability of the project; closely direct the implementation of the project in accordance with laws on investment and construction and related regulatory documents; clearly define the responsibilities of organizations and individuals involved in the construction project, preventing waste, corruption, and negative practices throughout the investment and construction management process.
5) Coordinate synchronously between constructing the Ho Chi Minh Road and building transverse roads and feeder roads serving civilian needs to ensure traffic safety, forming a seamless road network to maximize the economic and social benefits of the Ho Chi Minh Road for the country's industrialization and modernization.
Article 3. Annually, the Government shall report to the National Assembly on the implementation of the project. Relevant agencies of the National Assembly, Delegations of National Assembly members, National Assembly deputies, and People's Councils of localities through which the Ho Chi Minh Road passes shall supervise the implementation of this Resolution within their respective functions, tasks, and authorities.
This Resolution was adopted by the National Assembly of the Socialist Republic of Vietnam, 11th term, 6th session on December 3, 2004./.
