THE MINISTER OF HEALTH

Pursuant to Decree No. 49/2003/NĐ-CP dated May 15, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

Pursuant to Decree No. 171/2004/NĐ-CP dated September 29, 2004 of the Government stipulating the organization of specialized agencies under provincial People's Committees;

Pursuant to Circular Joint No. 11/2005/TTLT-BYT-BNV dated April 12, 2005 of the Ministry of Health and the Ministry of Home Affairs guiding the functions, tasks, powers, and organizational structure of specialized agencies assisting provincial People's Committees in managing health affairs at the local level;

At the proposal of the Director of the Department of Organization and Cadres and the Director of the Vietnam Preventive Medicine Agency.

DECISION:

Article 1. Issued together with this Decision is the "Regulation on the Functions, Tasks, Powers, and Organizational Structure of the Provincial Social Disease Prevention and Control Center."

Article 2. This Decision takes effect fifteen days from the date of publication in the Official Gazette. The Decision No. 09/2001/QĐ-BYT dated January 3, 2001 of the Minister of Health regarding the issuance of the "Regulation on the Functions, Tasks, and Organizational Structure of the Social Disease Prevention Centers under Provincial Health Departments" is hereby repealed.

Article 3. The Heads of the Office, the Directors of the Department of Organization and Cadres, the Director of the Vietnam Preventive Medicine Agency, the Directors of Provincial Health Departments, and the Heads of related units shall be responsible for implementing this Decision.

Functions, tasks, powers, and organizational structure of

Provincial Social Disease Prevention and Control Center

PART I

GENERAL PROVISIONS

Article 1. Position and role

The Provincial Social Disease Prevention and Control Center (hereinafter referred to as the Provincial Social Disease Prevention Center) is a public service unit under the Provincial Health Department, subject to comprehensive management by the Director of the Provincial Health Department and technical guidance by the Ministry of Health.

Article 2. Legal personality

The Provincial Social Disease Prevention Center has legal personality, its own headquarters, its own seal, and is entitled to open accounts at the State Treasury.

Chapter II

FUNCTIONS, TASKS AND POWERS

Article 3. Function

The Provincial Social Disease Prevention Center advises the Director of the Provincial Health Department on social disease prevention and control matters; organizes and implements specialized and technical activities on social disease prevention and control within the province.

Article 4. Tasks and Authorities

1. Develop plans to implement specialized and technical tasks on social disease prevention and control based on the national health program objectives and the actual situation of the province, submit them to the Director of the Provincial Health Department for approval;

2. Carry out the following activities:

a) Implement specialized and technical activities on social disease prevention and control within the province;

b) Direct, guide, and supervise specialized and technical activities on social disease prevention and control for healthcare facilities within the province;

c) Coordinate with the Provincial Health Education and Communication Center and mass media organizations within the province to organize and implement information, education, and communication activities on social disease prevention and control;

d) Participate in training and retraining in specialized and technical fields of social disease prevention and control according to provincial and central plans for specialists and other staff;

đ) Conduct research and participate in scientific research and application of technological advancements in the field of social disease prevention and control;

e) Manage and organize the implementation of projects under the national health target program and other projects in the field of social disease prevention and control assigned by the Provincial Health Department;

g) Organize and implement services related to social disease prevention and control in accordance with the law; based on local conditions, capacity, and actual needs, the Director of the Provincial Health Department shall, within their authority, stipulate the examination, treatment, follow-up, and implementation of clinical laboratory tests for patients with social diseases at the Center in accordance with the law;

h) Coordinate with relevant agencies to carry out inspection, supervision, and evaluation of activities under their responsibility;

i) Implement personnel management, policy benefits, rewards, and disciplinary measures for civil servants and officials, and manage the financial resources and assets of the unit in accordance with the law;

k) Implement statistical and reporting systems as prescribed by law;

i) Perform other tasks and powers assigned by the Director of the Provincial Health Department.

Chapter III

ORGANIZATIONAL STRUCTURE

Article 5. Organizational Structure

1. The Social Disease Prevention Center shall have a Director and Deputy Directors.

2. Functional Departments include:

a) Planning and Finance Department;

b) Organization and Administration Department;

3. Specialized Departments include:

a) Tuberculosis Department;

b) Mental Health Department;

c) Dermatology Department;

d) Ophthalmology Department;

đ) Laboratory Department.

Article 6. Staffing and Labor Standards

The staffing and labor standards for the Social Disease Prevention Center shall be implemented in accordance with the provisions of the law.

Article 7. Operating expenses

1. Health Service Budget.

2. National Health Program Budget.

3. Fees collected in accordance with the law.

4. Grants and other lawful sources of income.

Article 8. Tasks of the Departments and Divisions

1. Planning and Finance Division:

a) Develop monthly, quarterly, and annual plans for the Center; organize mid-term and final reviews of plan implementation;

b) Compile forecasts for medicines, materials, chemicals, and necessary equipment to support the Center's operations;

c) Manage and distribute funds, medicines, chemicals, and materials according to approved plans, and be responsible for settlement and final accounting in accordance with the law;

d) Participate in organizing training and professional development programs for Center staff and healthcare facilities in the area;

đ) Summarize the Center’s activities, collect information, analyze data, and implement statistical reporting systems as prescribed;

e) Serve as the focal point for compiling domestic and international projects of the Center.

2. Organization and Administration Division:

a) Manage organizational and personnel work; implement legal regulations on policies, rewards, and disciplinary measures;

b) Implement administrative and management tasks to support the Center's operations;

c) Manage the Center's assets;

d) Serve as the focal point for organizing seminars, conferences, training sessions, and health communication and education activities related to social disease prevention.

3. Tuberculosis Department:

a) Develop and implement plans for tuberculosis prevention and control activities in the province;

b) Guide, inspect, and supervise healthcare facilities in the province regarding professional and technical activities related to tuberculosis detection, treatment, management, monitoring, and factors contributing to its spread;

c) Manage information, compile statistics, create maps and charts on the epidemiological situation of tuberculosis in the province;

d) Serve as the focal point for implementing programs and projects related to tuberculosis prevention and control.

4. Mental Health Department:

a) Develop and implement plans for mental health prevention and control activities in the province;

b) Guide, inspect, and supervise healthcare facilities in the province regarding professional and technical activities related to mental health detection, treatment, management, monitoring, and factors contributing to its occurrence;

c) Manage information, compile statistics, create maps and charts on the epidemiological situation of mental health issues in the province;

d) Serve as the focal point for implementing programs and projects related to mental health prevention and control.

5. Dermatology Department:

a) Develop and implement plans for leprosy prevention and control, sexually transmitted infections, and skin diseases in the province;

b) Guide, inspect, and supervise healthcare facilities in the province regarding professional and technical activities related to leprosy investigation, detection, treatment, monitoring, and factors contributing to these conditions;

c) Manage information, compile statistics, create maps and charts on the epidemiological situation of leprosy, sexually transmitted infections, and skin diseases in the province;

d) Serve as the focal point for implementing programs and projects related to leprosy prevention, sexually transmitted infection control, and skin disease management.

6. Ophthalmology Department:

a) Develop and implement plans for preventing blindness-causing eye diseases and providing eye care services to the population in the province;

b) Guide, inspect, and supervise healthcare facilities in the province regarding professional and technical activities related to eye disease investigation, detection, referral, treatment, monitoring, and factors contributing to these conditions, promptly informing lower levels of any professional or technical errors;

c) Manage information, compile statistics, create maps and charts on the epidemiological situation of blindness-causing eye diseases in the province;

d) Serve as the focal point for implementing programs and projects related to blindness prevention and eye care.

7. Laboratory Department:

a) Develop and implement plans for laboratory tests to support social disease prevention efforts;

b) Collect samples for testing and store test samples; send them up the chain according to regulations;

c) Guide, inspect, and evaluate the regular application of laboratory techniques within the specified field for healthcare facilities in the province;

d) Implement laboratory services for social disease prevention in accordance with the law./.
