DECISION OF THE CHAIRMAN OF THE GOVERNMENT
ON ISSUING CRITERIA AND A LIST FOR CLASSIFYING STATE-OWNED ENTERPRISES WITH 100% STATE CAPITAL
PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on State-Owned Enterprises dated November 26, 2003;
Pursuant to the Enterprise Law dated November 29, 2005;
Upon the proposal of the Minister of Planning and Investment.
DECISION:
Article 1. The criteria and list for classifying state-owned enterprises with 100% state capital are hereby issued together with this Decision.
Article 2. The objects of this Decision include independent state companies, single-member limited liability companies with 100% state capital, and independent accounting subsidiaries of economic groups and state corporations currently in existence.
Article 3. This Decision replaces Decision No. 155/2004/QĐ-TTg dated August 24, 2004 of the Chairman of the Government and shall take effect fifteen days from the date of publication in the Official Gazette.
Ministers, Heads of ministerial-level agencies, Heads of government-attached agencies, Chairmen of provincial and municipal People's Committees under the central government, Boards of Directors of economic groups, and Corporation 91 are responsible for classifying and reorganizing independent state companies, single-member limited liability companies with 100% state capital, and independent accounting subsidiaries of economic groups and state corporations under their management based on this Decision, and submitting reports to the Chairman of the Government before May 31, 2007.
The Ministry of Planning and Investment shall coordinate with the Steering Committee for Enterprise Reform and Development to monitor, guide, and urge ministries, sectors, localities, economic groups, and Corporation 91 to implement this Decision, and periodically compile the situation to report to the Chairman of the Government./.
